HomeMy WebLinkAbout3B - Presentation0Cannabis Temporary EventsAgenda Item #3B OFFICE OF SPECIAL PROGRAMS September 26, 2024 Item 3B - Page 1 Cannabis Temporary Events December 2, 2019, City Council adopted Ordinance 2005, establishing Palm Springs Municipal Code 5.55.100. •When adopted, the intended location for temporary cannabis events was the Palm Springs Convention Center. •Temporary cannabis events are multi -day events where people can sell and consume cannabis. •Events range from one to four days. Item 3B - Page 2 Cannabis Temporary Events Workgroup •Staff engaged a nine -person workgroup to assist in identification of potential locations for events. •The workgroup consisted of cannabis professionals from the Coachella Valley. Item 3B - Page 3 Workgroup Recommended Locations •All City Parks •Palm Canyon South of Baristo, stretching down to Ramon •E. Arenas Road between Indian Canyon Drive and S. Calle Encilia* •Any outdoor streets •Industrial zones, utilizing vacant warehouses •Estate homes and hotels •Palm Springs Surf Club* Item 3B - Page 4 Cannabis Temporary Events OFFICE OF SPECIAL PROGRAMS May 22, 2024, Special Program Compliance presented Cannabis Temporary Events to the Planning Commission: •Proposed Locations for Temporary Cannabis Events •Issues and concerns related to Proposed Locations Item 3B - Page 5 OFFICE OF SPECIAL PROGRAMS Planning Commission Direction •Explore alternate locations, including City owned lots and property. •Clarify the Department of Cannabis Control venue restrictions regarding locations that are licensed for alcohol sales. Item 3B - Page 6 Venue Restrictions OFFICE OF SPECIAL PROGRAMS •Agua Caliente Band of Cahuilla Indian Commercial Cannabis Prohibition does not permit cannabis activity on tribal land. •A temporary cannabis event shall not be issued for a premises that is licensed for the sale of alcohol or cannabis. • §1561. Temporary Cannabis Event Requirements. (f) A temporary cannabis event license shall not be issued for a premises that is licensed for the sale of alcohol or tobacco. •Palm Springs Municipal Code Section 6.10, Smoking Prohibited in Public Places. “… the declared purpose of this chapter is to prohibit the smoking of tobacco, or any other weed of plant in certain areas which are open to the public.” Item 3B - Page 7 OFFICE OF SPECIAL PROGRAMS On June 26, 2024, Special Program Compliance returned to Planning Commission and presented three locations: •Amtrak Tr ain Station 1 Train Station Road •Vacant City Owned Lots 1503 and 1504 Gene Autry •Visitor’s Center 2901 N. Palm Canyon Drive Recommended Venues for Consideration Item 3B - Page 8 Planning Commission Recommendation Planning Commission recommend two locations for consideration by Council. Vacant City Owned Lots 1503 and 1504 Gene Autry Amtrak Train Station 1 Train Station Road Additionally, should the locations be approved, a one-year review to determine if any changes need to be made.
