HomeMy WebLinkAbout2098' ORDINANCE NO. 2098 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTIONS 2.24.010 AND 2.24,020 OF THE PALM SPRINGS MUNICIPAL CODE TO EXPAND THE PUBLIC ARTS COMMISSION FROM SEVEN TO NINE MEMBERS. City Attorney's Summary This ordinance expands the City's Public Arts Commission from seven to nine members. WHEREAS, the Public Arts Commission of the City of Palm Springs plays a crucial role in facilitating cultural and artistic projects, enhancing the community's quality of life; and WHEREAS, there is an increasing complexity and volume of public art projects requiring enhanced coordination with other city departments and necessitating specialized skills in solicitations, procurement, and contract management; and WHEREAS, expanding the membership of the Public Arts Commission from seven to nine members will provide the necessary support and resources to effectively manage and implement the growing number of sophisticated art projects and ventures within the City. ' THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by the and through this Ordinance. SECTION 2. Code Amendment. Section 2.24.010 of the Palm Springs Municipal Code is hereby amended to read as follows: "2.24.010 Creation. There is created within the city of Palm Springs a public arts commission consisting of nine members, appointed by the city council, to serve at the pleasure of the city council." SECTION 3. Code Amendment. Section 2.24.020 of the Palm Springs Municipal Code is hereby amended to read as follows: Ordinance No. 2098 Page 2 ' 2.24.020 Term —Vacancies —Vote. ' Members of the commission shall serve for the term provided by Chapter 2.06 of the Palm Springs Municipal Code. A vacancy in the commission shall not impair the right of the remaining members to exercise the powers of the commission pursuant to this chapter. Five members shall constitute a quorum of the commission, and any ruling, decision or other action of the commission may be taken by a majority of those members present, provided a quorum is present." SECTION 4. Compliance with California Environmental Quality Act. The City Council finds that this Ordinance is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the State CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Further, if the activity is deemed a project this City Council finds that this Ordinance is exempt pursuant to Section 15061(b)(3) of the State CEQA Guidelines, as it can be seen with certainty that there is no possibility that this Ordinance may have a significant effect on the environment. SECTION 5. Severability. If any section, sentence, clause or phrase of this Ordinance or the application thereof to any entity, person or circumstance is held for any reason to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect other , provisions or applications of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are severable. The City Council of the City of Palm Springs hereby declares that it would have adopted this Ordinance and each section, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 6. Effective Date. This Ordinance shall become effective thirty (30) days following its adoption. PASSED, APPROVED, AND ADOPTED BY THE PALM SPRINGS CITY COUNCIL THIS 9T" DAY OF JULY, 2024.
