SUMMARY
Erika Vasko-Mate has requested an appeal of the permanent ineligibility to operate a
Vacation Rental in the City of Palm Springs and administrative fine of $5,000.00 for
operating an unregistered Vacation Rental property located at 2860 N. Los Felices Rd.,
#109., Palm Springs.
RECOMMENDATION:
1) Open the Appeal Hearing and accept public testimony.
2) Adopt Resolution No. ______, A RESOLUTION OF THE ADMINISTRATIVE

Vacation Rental Appeal – 2860 N. Los Felices Rd., #109
STAFF ANALYSIS:
The owner for the property located at 2860 N. Los Felices Rd., #109, Palm Springs did
not hold a Vacation Rental Registration Certificate by the City of Palm Springs as of the
date of violation on June 30, 2024.
Staff has determined that the owner has, without a Registration Certificate, advertised
and operated the property at 2860 N. Los Felices Rd., #109, as a Vacation Rental from
elements as follows in violation of Palm Springs Municipal Code 5.25.040 (a):
1. Advertisement Vrbo.com/3227412 listed as “Palm Springs Condo 3 miles from
downtown and to the breath-taking Aerial Tramway” ATTACHMENT 5
2. Advertisement Vrbo.com/3227412 lists short-term stay reviews

3. A Code Compliance Officer submitted an online booking inquiry to stay during
the dates August 6, 2024, through August 13, 2024 (7-nights); ATTACHMENT

4. A response was received by the Code Compliance Officer confirming
availability for the dates August 6, 2024, through August 13, 2024 (7-nights);

Staff finds that the advertisement found on Vrbo.com/3227412 and inquiry affirmation for
the dates August 6, 2024 through August 13, 2024 (7-nights) for stay at property 2860 N.
Los Felices Rd., #109, is in violation of §5.25.040(a) and proceeded to issue
Administrative Citation AB0728, in the amount of $5,000, to Erika Vasko, the owner on
title, for operating a Vacation Rental without a Vacation Rental Registration Certificate.
The Administrative Citation was mailed by the Department of Special Program
Compliance staff to the mailing address on title.
The following Palm Springs Municipal Codes sections and Regulations are applicable to
this matter.
The Palm Springs Municipal Code §5.25.030 Definitions, reads as follows:
"Vacation Rental" means a single-family dwelling, or any portion thereof,
utilized for occupancy for dwelling, lodging, or sleeping purposes without the
Owner being present for a period of twenty-eight (28) consecutive days or
less,…”
Palm Springs Municipal Code §5.25.040(a) reads as follows:
The operation of a Vacation Rental or a Homeshare Interest without a Vacation
Rental Registration Certificate is prohibited.

Vacation Rental Appeal – 2860 N. Los Felices Rd., #109
Palm Springs Municipal Code §5.25.090(c) reads as follows regarding the administrative
fine:
(c) Any person who operates a Vacation Rental without a Vacation
Registration Certificate, shall be liable to the City for the payment of transient
occupancy tax pursuant to the provisions of the Palm Springs Municipal
Code Chapter 3.24, including without limitation penalties and interest,
payment of an administrative fine in the amount of Five Thousand Dollars
($5,000.00), and permanent ineligibility to operate a Vacation Rental in the
City…”
Administrative Regulation “Operation of a Vacation Rental” dated 07/2017 defining
“Operation” of a Vacation Rental to include the following:
1. “Advertisement” of the property means on any web-based advertising,
hosting platform, print media, bulletin, signage, radio, and television or
on any other medium for the purposes of promoting interest in, testing
the market for, or soliciting the occupancy of a property for a period of
twenty-eight (28) consecutive days or less.
2. An owner, agent or other representative of the owner has an interest in
rental, exchange, trade, gift, or grant of a guest stay at a property of less
than twenty-eight (28) consecutive days or less.
3. An owner, agent or any other representative of the owner interacts with
another party whether directly or indirectly through personal or
digital/electronic contact with the intent to provide availability of the
property for occupancy of 28 days or less, or to complete a rental and/or
reservation of the property for future occupancy of 28 days or less.”
Administrative Regulation “Authority for the Issuance of Administrative Citations”
dated 08/2014 reads as follows:
“Vacation Rental Enforcement Officials are hereby authorized to issue, an
Administrative Citation for the violation of the provision of Chapter 5.25 of the Palm
Springs Municipal Code without first complying with the pre-citation or courtesy notice
requirements contained in PSMC Section 1.06.030.”

Jurisdiction: This administrative hearing is conducted in accordance with Palm
Springs Municipal Code 2.50 which confers jurisdiction upon the Administrative Appeals
Board.
WHEREAS Erika Vasko did not obtain a Short-Term Vacation Rental
Registration Certificate for the property located at 2860 N. Los Felices Rd., #109, Palm
Springs, pursuant to Palm Springs Municipal Code Chapter 5.25; and
WHEREAS, any person who operates a Vacation Rental without a Vacation
Registration Certificate, shall be liable to the City an administrative fine in the amount of
Five Thousand Dollars ($5,000.00), and permanent ineligibility to operate a Vacation
Rental in the City, Palm Springs Municipal Code 5.25.090 (c); and
WHEREAS, “Operation” of a Vacation Rental as used in Palm Springs Municipal
Code Section 5.25 includes “Advertisement” of the property on any web-based
advertising, hosting platform, print media, bulletin, signage, radio, and television or any
other medium for the purposes of promoting interest in, testing the market for, or

WHEREAS, Administrative Citation No. AB0728, operating a Vacation Rental
without a Vacation Rental Registration Certificate, was issued on July 11, 2024, to Erika
Vasko for the property located at 2860 N. Los Felices Rd., #109, Palm Springs; and
WHEREAS, Erika Vasko-Mate filed an administrative appeal of the
Administrative Citation No. AB0728 operating a Vacation Rental without a Vacation
Rental Registration Certificate issued in the amount of $5,000 for the property located at
2860 N. Los Felices Rd., #109, Palm Springs with the City Clerk; and
WHEREAS, the Administrative Appeals Board opened and conducted a duly
noticed Administrative Appeal Hearing on September 25, 2024; and
WHEREAS, the Administrative Appeals Board was presented evidence that Erika
Vasko violated Section 5.25.040(a) of the Palm Springs Municipal Code by an

advertisement listed on Advertisement Vrbo.com/3227412 for the property located at
2860 N. Los Felices Rd., #109, Palm Springs; and
WHEREAS, the Administrative Appeals Board was presented evidence that Erika
Vasko is in violation of Section 5.25.040(a) of the Palm Springs Municipal Code by a
response to an inquiry to book the property located at 2860 N. Los Felices Rd., #109,
Palm Springs and confirmation of a period less than twenty-eight (28) days; August 6,
2024 through August 13, 2024 (7-nights); and
WHEREAS, the Administrative Appeals Board has carefully reviewed and
considered all the evidence presented in connection with said appeal on September 25,
2024; and
THE ADMINISTRATIVE APPEALS BOARD HEREBY FINDS, after due
consideration given to the relevancy, weight and credibility of testimony and evidence,
and based upon a preponderance of the evidence in accordance with the Board’s
procedures, as follows:
SECTION 1.
The Appellant is in violation of Palm Springs Municipal Code 5.25.040(a).
The Administrative Appeals Board upholds the administrative decision that
Erika Vasko is permanently ineligible to operate a Vacation Rental in the
City of Palm Springs, including the property located at 2860 N. Los Felices
Rd., #109, Palm Springs and the fine of $5,000.
The Appellant is not in violation of Palm Springs Municipal Code
5.25.040(a). The Administrative Appeals Board overturns the
administrative decision that Erika Vasko is permanently ineligible to
operate a Vacation Rental in the City of Palm Springs, including the
property located at 2860 N. Los Felices Rd., #109, Palm Springs and the
fine of $5,000.

SECTION 2. The Administrative Appeals Board directs the City Clerk to deliver a
copy of this Resolution to each party and to file a disposition report with the Palm

1. Advertising a vacation Rental through VRBO platform without registration certificate.
2.Before I placed' an AD to the VRBO website as an advertisement about the condominium, .I asked the
VRBO company for information about the process. I was informed that I can start to advertise and I
have to send an application to the city to obtain a permit. My intention was to follow through and get
the permit. Unfortunately, I received a phone call from my family overseas that one of my sister lung
cancer metastases. I had to leave the country because I wanted to able to say good bye to my sister Edit
who is 67 years old. While I was traveling back to Europe, I found it out that my other sister Irma .age 62
was placed on hospice due to pancreatic cancer. She worked in New York as a travel nurse. I barely got
home from a long-travel and the very· next morningl triecf to make it toNew York to see my sister Irma
while she was still alive. As I was heading to the airport the Mercy Home hospice phoned me and told
me that Irma passed away early morning. I was heartbroken and I still had to go because she had no one
in New York and I had to make arrangement to bring her ashes to my home. The least I could do in this
heart-breaking situation to show respect and dignity especially knowing that how many lives she
touched throughout her nursing profession. I came home from New York and I was run down due to the
emotional pain and I tested positive for COVID. I had to ask extra days off from my work trying to recover.
It added on to my wariness the hospital where is my work place was already operating with short staff.
Please understand that I am not writing this letter to ask sympathy, I am writing this so whoever read
this note perhaps can have a little bit better understanding of the back ground. I don't take this citation
lightly. I learned from my mistakes that I should of call the city of Palm Spring first not VRBO to get
information what needed to be done before I started to advertise this condominium. After I received this
letter regarding this mistake, I had a chance to talk to Mr. Mitch Nabhan. I appreciated that he took the
time to listen and professionally explained the procedure about obtaining permit.
In my 25 years nursing experience I saved and touched hundreds of people lives but when it comes to
our own family members end life it's never easy to bear with the pain and multiple grief process.
After I had a chance to talk to Mr. Nabhan I have a better understanding what needed to be done. I
-learned from my•mistakes and I immediately took responsibility to correct it. I cancelled the-VRBO ·
advertisement on July 15, 2024 the day I received the letter from the city of Palm Springs. I want to
assure the committee that this situation will never be repeated.
3. I am the bread winner in my family, my husband could not work over 13 years due to his health
condition. I work extra days most of the week 6 days 12 hours shift and with the driving I am gone 14
hours each day. I have many family members in the state and overseas and they relying on me
financially. These sad and unexpected situations created additional expenses like airplane tickets, hotel
charges cremation of my dear sister Irma. I was asked to pay for my other sister Edit funeral when she
passes. This citation puts me even more financial hardship and grieve. I would like to ask kindly this
committee to cancel this fine due to my difficult situations that I am facing.

Operating a Vacation Rental without a Vacation Rental Registration Certificate
You are hereby notified that a violation of Palm Springs Municipal Code Section 5.25.040(a) ha s been
determined to exist with respect to your ownership and use of the property referenced above.
Accordingly , you are recei v ing this Administrative Citation # AB0728. Pursuant to Section
5.25.090(c), you are ordered to pay an administrative fine in the amount of five thousand dollars
($5,000.00). Further, you must cease operating and advertising as a Vacation Rental immediately,
and you are permanently ineligible to operate a Vacation Rental in the City.
A lso, pursuant to Section 5.25.090(c), each future violation arising from your continued operation as
an unpermitted Vacation Rental wi ll result in an administrative fine in the amount of not less than ten
thousand dollars ($10,000.00) and may result in the City of Palm Springs pursuit for compliance
through further administrative proceedings , including but not limited to , added inspections and
directions to remediate the v io lation , administrative citations, judicial process or by entry upon the
property by City employees or contractors for purposes of effecting those actions necessary to correct
the violation. If such further action by the City is necessary, you w ill be charged a fee equal to the
actual costs incurred by the City in obtaining compliance wi th the notice, including , but not limited to,
subsequent inspection costs, staff time, overhead, and legal expenses including attorney's fees.
Current fees for the City costs are as follows:
General staff and inspection time@$101.00/hr. City attorney time @$200.00/hr.
As the owner of the property at issue or as the individual or entity responsible for the
violation, you are individually responsible for correcting the violation.
YOU HAVE THE RIGHT TO APPEAL THIS CITATION
Payment of this administrative fine must be made within fifteen (15) days from the mailing date of this
letter. Should you file an appeal , the appeal and hearing provisions of Palm Springs Municipal Code,
Chapter 2.50 will apply. If you choose to appeal this ci tation , payment of the administrative fine is
suspended pending a final decision by the Administrative Appeals Board. However, you must pay the
current non-refundable appeal fee of $911.00 and submit the request for appeal form no later than
fifteen (15) days from the mailing date of this letter. Please see th e City website at

Description of the violations in this matter:
Palm Springs Municipal Code Section 5.25.040(a) prohibits the operation of a Vacation Rental or a
Homeshare in the City of Palm Springs without a Vacation Rental Registration Certificate.
Section 5.25.090 (c) provides the fines and penalties for the operation of a Vacation Rental in the
City of Palm Springs without a Vacation Rental Registration Certificate.
We are aware that the address above was advertised and/or operating as a short-term rental via

A responsible party receiving an administrative citation may appeal such

The provisions of Palm Springs Municipal Code Chapter 2.50 will apply to
appeals. An appeal must be filed in writing by using the applicable
request for appeal form available from the City's website at
www.palmspringsca.gov OR www.psvacationrentalcompliance.com._lf you
choose to appeal this citation, payment of the administrative fine is
suspended pending a final decision by the Administrative Appeals Board.

Quiet, quaint, little condo!
It was a great place to stay for a couple nights for 2 people . It is small , but perfect for our needs! The
house had all the essentials. The community is quiet and peacefu l. Erika responded quickly to all my
questions. Parking is easy and plentiful. Would stay again.

Decent little one bedroom for a couple or two friends . I believe our stay may have been a first in the unit.
So, there were just a few minor kinks that needed attention . Place is dated, nothing spectacular as to the
amenities. Just your basics. The grounds are well manicured , pool is nice and tennis courts too . Property
owners are nice people.

living room , bedroom bathroom , patio. Our home is in a resort style area. with few community heated pools, jacuzzis,
tennis court with a Mountain View. Steve drove there to make sure the home all clean, sanitized it took many hours for
him to get there because of the rain and heavy traffic . You were able to check in earlier so you did not have to pay on
more day for higher price in the hotel. Yo u were asking If you can stay longer and not to check out at 10 am but
sometimes afternoon. We more than happy to accommodate you even we did not have to. These are maybe little things
but these are the small th ings goes a long way w ith people who shows appreciation for others .. Our home is not a
modern style but it decorated with a European taste. Most importantly our home was sanitized when we rented to you.
Unfortunately we were very disappointed w hat kids of condition we got it back. Ha ir balls were all over on tbd floors ,
hairs in the white kitchen counter, shower, in the bed fecal material on the toilet seat cover, dirt spots on the fl oors. I
don't e xpect any guest to do deep cleaning bu t at minimum at least sweep the hair and dirt from the floor and wipe th e
toi let seat, I left plenty wipes to use. It would not take more than 5-10 minutes to do al l that. It made us very sad how bad
we found our home. We traveled a lot in United State and over seas and rented many homes as a homeowner. We
always had appreciation for the land lords th at they were willing to open and share their homes with us an others
especially it's pretty personal. We never complained that " dated" we always looked for cleanness , sincerity and
kindness. Perh aps what would be "dated" for someone's eyes it's a treasure and meaningfu l for others. Therefore the
above mention moral values overrides someone opinion being "dated." By the way you were not the first person used
our home we been renting it out for close to two decades with different companies for many guests .. The guests before
you were from the same company you rented our home and they were very appreciative and left our home very nice and
clean unfortunately it did not happened in your case.
