SUMMARY
Joshua Gilbert has requested an appeal of administrative citation A8264 issued in the
amount of $500 and the two (2) year suspension of the Vacation Rental Registration
Certificate #4968 for the property located at 1344 S. Farrell Dr., Palm Springs, California.
RECOMMENDATION:

Background
The property located at 1344 S. Farrell Dr., Palm Springs, California was registered as a
Vacation Rental with Vacation Rental Registration Certificate #4968. The start date was
March 16, 2022. The Vacation Rental Certificate was revoked August 8, 2024. Vacation
Rental Ordinance 1918 became in effect April 2017 and later amended and reinstated in
November 2022 with Ordinance 2075. The previous and current Vacation Rental
Ordinance details rules that guests renting a Vacation Rental for a period of 28
consecutive days or less must follow; Regulations that owners must follow relating to each
stay that is 28 consecutive days or less and that upon the third violation in any twelve-
month period, the City Manager shall suspend the Vacation Registration Certificate for
two (2) years.

STAFF ANALYSIS
First Citation – A8258
On May 11, 2024, a City of Palm Springs Code Compliance Officer responded to a
complaint for the property located at 1344 S. Farrell Dr., Palm Springs regarding the
Vacation Rental property having too many vehicles. Code Officer Whittaker arrived at the
property at 12:38 pm and observed a violation of Palm Springs Municipal Code “PSMC”
5.25.070(c) vehicles exceeding the permitted limit at the Vacation Rental located at 1344
S. Farrell Dr. The Code Compliance Officer contacted the occupants, discussed the
findings and violation, and issued citation A8258 for a violation of PSMC 5.25.070 (c).
The officer report is included as ATTACHMENT 4. Citation A8258 was not appealed and
paid in full May 25, 2024.
Findings:
Six vehicles at the Vacation Rental. The properties permitted limit is 4.
Second Citation – A8264
On May 13, 2024, a City of Palm Springs Code Compliance Officer discovered a web-
based advertisement for the property located at 1344 S. Farrell Dr. on the rental booking
platform Airbnb.com via the following link:
https://www.airbnb.co.nz/rooms/980501192833016420, and on VRBO via the following
link: https://www.vrbo.com/3610944. Upon review of the advertisement, it was-found that
the properties located at 1322 S Farrell Dr., as well as 1344 S Farrell Dr., were being
offered as a cluster/compound for short-term rental stays. Citation A8264 was issued to
the owner on file for a violation of PSMC 5.25.070(c). The officer report is included as
ATTACHMENT 5. Citation A8264 was paid in full May 30, 2024.

Vacation Rental Appeal – 1344 S. Farrell Dr.
Third Citation – AB0715
On May 14, 2024, a City of Palm Springs Code Compliance Officer issued administrative
citation AB0715 for a violation PSMC 5.25.070(h) – failure to submit a contract summary
for a guest stay identified as a short-term stay for the dates May 9, 2024, through May
12, 2024, from an event that occurred on May 11, 2024. The officer report is included as
ATTACHMENT 6. Citation AB0715 has not been paid as of September 16, 2024.
Findings:
Pursuant to PSMC 5.25.090(b), “Upon the third violation in any twelve-month period, the
City Manager shall suspend the Vacation Registration Certificate for two (2) years”.
Pursuant to Administrative Regulation dated 8/2017, appeals of the third administrative
citation and the suspension of the Vacation Rental Registration Certificate will be
heard by the Administrative Appeals Board according to PSMC Chapter 2.50.
Based on the three (3) administrative citations issued in a twelve-month period, a
suspension of the Vacation Rental Registration Certificate was issued by the Department
of Special Program Compliance with an effective date of June 24, 2024, for two (2) years
through June 24, 2026. ATTACHMENT 7.

Vacation Rental Appeal – 1344 S. Farrell Dr.
The following Palm Springs Municipal Code sections and Regulations are applicable to
this matter.
The Palm Springs Municipal Code, Vacation Rentals §5.25.030 – Definitions
"Cluster or compound" means any two or more vacation rentals that
operate on a unified or shared basis where residents of such
vacation rentals have exclusive access to more than one vacation
rental and/or the facilities of such vacation rentals, including by way
of example, a swimming pool, tennis court, or cooking facilities.
The Palm Springs Municipal Code, Vacation Rentals §5.25.070 - Operational
Requirements and Standard Conditions:
(c) “The owner shall limit overnight occupancy of the vacation rental unit
to a specific number of occupants, with the maximum number of
occupants as no more than two persons per bedroom within each
vacation rental unit and a maximum of no more than eight persons
total within the vacation rental unit, except that owner may allow up
to two minor children, age 12 or under, to occupy the vacation rental
in addition to the maximum number of occupants otherwise provided
in this subsection. The number of bedrooms in a vacation rental shall
be verified by the enforcement official using county assessor and/or
city building records and/or a physical inspection of the premises,
prior to the issuance of a registration certificate. The owner may also
allow up to four daytime occupants in addition to the total number of
guests allowed for overnight occupancy pursuant to this subsection.
No more than one automobile per bedroom shall be allowed for
each vacation rental. Advertising and/or renting one or more
vacation rentals as part of a cluster or compound is prohibited.”
(h) “Prior to occupancy pursuant to each separate occasion of rental of
a vacation rental, the owner or the owner's agent or representative
shall enter into a written contract with a responsible person where:
(1) the responsible person will provide the responsible person's
name, age, address, and a copy of a government issued
identification; (2) establishes and sets out the terms and conditions
of the contract, including without limitation, occupancy limits, noise
prohibitions, and vehicle parking requirements; (3) requires the
responsible person to acknowledge and agree that he or she is
legally responsible for compliance of all occupants of the vacation
rental or their guests with all provisions of this chapter and/or the
municipal code; (4) the owner or the owner's agent provides a copy
of the "Good Neighbor Brochure" to the responsible person; (5) the
responsible person provides a list of all guests by name; and (6) the
responsible person provides a list of all guests' vehicles, including
license plate numbers. Each contract shall be maintained by the

owner or the owner's agent for a minimum of four years and shall be
readily available for inspection upon request of the enforcement
official. A summary or abstract of the written contract, in a form
approved by the enforcement official, shall be filed with the
enforcement official prior to each applicable occupancy, in a
manner approved by the enforcement official, and shall be posted
in a conspicuous location on the vacation rental property and shall
be made available on site at the request of an enforcement official.
Palm Springs Municipal Code §5.25.090 (b) – Violations
(b) “Upon the third violation in any twelve-month period, the City Manager shall
suspend the Vacation Registration Certificate for two (2) years”.
ADMINISTRATIVE REGULATION “Violation Count for Purposes of Suspending a
Vacation Rental Certificate”- Effective 8/2017
Procedure:
A. Section 5.25.090(b) specifies, “Upon the third violation in any twelve (12)
month period, the City Manager shall suspend the Vacation Rental Certificate for
two (2) years.” Following is a clarification how violations are counted.
1. Administrative citations for violations of Chapter 5.25 issued to the Vacation
Rental guest, Owner, or Owner’s agent prior to April 16, 2017, will count
towards the calculation of the three (3) violations in any twelve (12) month
period for suspending the Vacation Rental Certificate for such property in
accordance with Section 5.25.090(b).
2. There will be no suspension unless at least one (1) violation occurs under
new Ordinance No. 1918.
3. Appeals of the third administrative citation and the suspension of the
Vacation Rental Registration Certificate will be heard by the
Administrative Appeals Board according to PSMC Chapter 2.50.
Administrative Regulation “Authority for the Issuance of Administrative Citations”
dated 08/2017 reads as follows:
“Vacation Rental Enforcement Officials are hereby authorized to issue, an
Administrative Citation for the violation of the provision of Chapter 5.25 of the Palm
Springs Municipal Code without first complying with the pre-citation or courtesy notice
requirements contained in PSMC Section 1.06.030.”

Jurisdiction: This administrative hearing is conducted in accordance with Palm Springs
Municipal Code 2.50 which confers jurisdiction upon the Administrative Appeals Board.
WHEREAS, the City investigated in detail and found the property 1344 S. Farrell
Dr., Palm Springs, California to be in violation pursuant to Section 5.25.070(c) on May 11,
2024, and issued administrative citation A8258; and
WHEREAS, the City investigated in detail and found the property 1344 S. Farrell
Dr., Palm Springs, California to be in violation pursuant to Section 5.25.070(c) on May 13,
2024, and issued administrative citation A8264; and
WHEREAS, the City investigated in detail and found the property 1344 S. Farrell
Dr., Palm Springs, California to be in violation pursuant to Section 5.25.070(h) on May
13, 2024, and issued administrative citation AB0715; and
WHEREAS, upon the third violation in any twelve-month period, the City Manager
shall suspend the Vacation Registration Certificate for two (2) years; and
WHEREAS Green Palm Management LLC, C/O Lauren Barrish, owner for the
property, was issued a suspension of the Vacation Rental Registration Certificate for a
period of two-years for the property located at 1344 S. Farrell Dr., Palm Springs, California
on May 30, 2024, with an effective suspension date of June 24, 2024, and
WHEREAS, Joshua Gilbert for the property located at 1344 S. Farrell Dr., Palm
Springs, California filed an administrative appeal of the suspension of the Vacation Rental
Registration Certificate with the City Clerk and paid the appeal fee; and
WHEREAS, pursuant to Administrative Regulation dated 8/2017, appeals of the
third administrative citation and the suspension of the Vacation Rental Registration
Certificate will be heard by the Administrative Appeals Board according to PSMC Chapter
2.50
WHEREAS, the Administrative Appeals Board opened and conducted a duly
noticed Administrative Appeal Hearing on September 25, 2024; and

WHEREAS, the Administrative Appeals Board was presented evidence that
Green Palm Management LLC, C/O Lauren Barrish, owner for the property located at
1344 S. Farrell Dr., Palm Springs, is in violation pursuant to Section 5.25.090 (b) of the
Palm Springs Municipal Code; and
WHEREAS, the Administrative Appeals Board has carefully reviewed and
considered all the evidence presented in connection with said appeal on September 25,
2024;
THE ADMINISTRATIVE APPEALS BOARD HEREBY FINDS, after due
consideration given to the relevancy, weight and credibility of testimony and evidence,
and based upon a preponderance of the evidence in accordance with the Board’s
procedures, as follows:
SECTION 1.
The Appellant is in violation of Palm Springs Municipal Code 5.25.090(b).
The Administrative Appeals Board upholds administrative citation A8264 and the
administrative decision of a two-year suspension of the Vacation Rental

I received a call from the Short-Term Vacation Rental
Hotline regarding a possible vehicle· occupancy violation.
I arrived at the location at 12:38 pm, where I observed 4
vehic les parked in the driveway and an additiona l 2
parked in the street close to the property. I made contact
at the front door with the occupants, who confirmed that
they were renting the property for the weekend. I then
advi sed them of the complaint that was received
concerning the vehicles, and it was confirmed via the
guest s that the two Ford Mustangs parked in the street
belonged to 'cabana boys ', who were also at the property.

During my going over the vehicle occupancy guidelines
with the guests, they became argumentative and stated
that they had rented both this property, and the one next
door, later identified as 1322 S Farrell Dr, so they felt it
was Justifiable that they could have the extra vehicles
informed them that each short-term rental property is
treated as a separate property, regardless if they had
rented both. After issuing the citation, the extra 2
vehicles were moved. I went over the citation payment
and appeals process with the responsib le renter. I ca lled
and spoke to Kevin Francis, the local contact for the
property, advising him of the witnessed violation and
citation. I also ca lled and spoke to the repor t ing party as
requested. As there was no contract summary
submission on file for th is short-term guest stay, a
citation will be issued to the homeowner for fai lure to
submit a contract summary.

The City of Palm Springs Code Compliance Division discovered a web-based advertisement for the above property on Monday, May 13,
2024, on the rental booking platfonn Airbnb.com via the following link: https://www.airbnb.eo.nz/rooms/980501192833016420, and on
VRBO via the following link: https://www.vrbo.com/3610944. Upon review of the advertisement, it was-found that the properties located at
1322 S Farrell Dr., as well as 1344 S Farrell Dr. were being offered as a cluster/compound for short-term rental stays.
III. The codes that pertain to the violations listed in this letter are:
5.2S.070(c) Operational Requirements and Standard Conditions
"The owner shall limit overnight occupancy of the vacation rental unit to a specific number of occupants, with the maximum number of
occupants as no more than two persons per bedroom within each vacation rental unit and a maximum ofno more than eight persons total
within the vacation rental unit, except that owner may allow up to two minor children, age 12 or under, to occupy the vacation rental in
addition to the maximum number of occupants otherwise provided in this subsection. The number of bedrooms in a vacation rental shall be
verified by the enforcement official using c;:ounty assessor and/or city building records and/or a physical inspection of the premises, prior to
the issuance of a registration certificate. The owner may also allow up to four daytime occupants in addition to the total number of guests
allowed for overnight occupancy pursuant to this subsection. No more than one automobile per bedroom shall be allowed for each vacation
rental. Advertising and/or renting one or more vacation rentals as part of a cluster or compound is prohibited."

Contract Summary
You are hereby notified that a violation of Palm Springs Municipal Code Section 5.25.070(h) has been
determined to exist with respect to your ownership and use of the property referenced above. Accordingly,
you are receiving this Administrative Citation# AB0715. Pursuant to Section 5.25.090(d), you are ordered
to pay an administrative fine in the amount of two thousand five hundred dollars ($2,500.00). Further,
the Vacation Registration Certificate shall be suspended for a period of six {6) months for a first
offense.
Also, according to Section 5.25.090(d), a second violation arising from a failure to submit a contract
summary will result in an administrative fine in the amount of not less than five thousand dollars
($5,000.00) and a revocation of the owner's Vacation Registration Certificate.
Additional information concerning this violation is reflected below:
On Saturday, May 11, 2024, while serving as the on-call Code Compliance Officer for vacation rentals, I
received and responded to an active nuisance complaint for the property located at 1344 S Farrell Dr.
Upon my arrival and after conducting my investigation into the complaint, I issued an administrative
citation to the responsible renter for the witnessed violation. · Jt was discovered while speaking to the
responsible renter that they had rented the property next door as well, which was identified as 1322 S
Farrell Dr., in addition to the property located at 1344 S Farrell Dr. Before myresponse to the location, I
performed a search in the city's record-keeping database to determine if a contract summary was on file
for this particular guest stay, and was unable to locate one. Upon my return back to my office, I
performed a second, more thorough search and still was unable to locate one. I then contacted the
assigned property management company on file for this property, APEK Rentals, and asked for a copy
of the booking itinerary for this particular guest's stay. On Monday, May 13, 2024, I received the
booking itinerary that indicated a check-in date of May 9, 2024, and a check-out date of May 12, 2024.,
along with the responsible renter's name which matched the guest that was issued the citation for the
active nuisance on May 11, 2024. It should be noted that both properties were advertised, and utilized
as a compound/cluster, which is a separate violation of the City of Palm Springs Short-Term Vacation
Rental ordinance. I was unable to locate a contract summary submission for either property for this
particular guest stay. As a result of my findings, I issued an administrative citation to the owner on file
for failure to submit a contract summary for both properties as they were booked together.

YOU HAVE THE RIGHT TO APPEAL THIS CITATION
Payment of this administrative fine must be made within fifteen {15) days from the mailing date of this
letter. Should you file an appeal, the appeal and hearing provisions of Palm Springs Municipal Code,
Chapter 2.50 will apply. If you choose to appeal this citation, payment of the administrative fine is
suspended pending a final decision by the Administrative Appeals Board. However, you must pay the
current non-refundable appeal fee of $911.00 and submit the request for appeal form no later than
fifteen (15) days from the mailing date of this letter. Please see the City website at

HOW TO APPEAL THIS CITATION
A responsible party receiving an administrative citation may appeal such
citation within fifteen (15} calendar days from the date the citation is mailed.
The provisions of Palm Springs Municipal Code Chapter 2.50 will apply to
appeals. An ·appeal must be filed in writing by using the applicable
request for appeal form available from the City's website at
www.palmspringsca.gov OR www.psvacationrentalcompliance.com._lf you
choose to appeal this citation, payment of the administrative fine is
suspended pending a final decision by the Administrative Appeals Board.
However, you must pay thE:3 current appeal fee and submit the request for
appeal form to the Palm Springs Office of the City Clerk no later than fifteen
(15) calendar days from the date the citation is mailed. PAYMENT OF THE
ADMINISTRATIVE FINE MUST BE SENT TO THE CITY'S CITATION
PROCESSING CENTER IN NEWPORT BEACH SPECIFIED ABOVE. THE

ca ll Code Comp liance Officer for vacation rental s, I
received and responded to an active nui sa nce
complaint for the property located at 1344 S Farrell
Dr. Upon my arrival and after conductin g my
in vestigation into the complai nt, I issued an
admi nistrative citation to th e re s pons ible ren t er for
the witnessed vio lation. It was d iscovered w hil e
speakin g to the res ponsi bl e rent er that they had
rented the property nex t door as w e ll, which was
id entified as 1322 S Farrell Dr., in addition t o the
property located at 1344 S Farre ll Dr. Before my
respon se to the location, I performed a sea rch in the
city's record-keep ing database to determine if a
contract summary was on fil e for th is particu lar
guest stay, and was unable to locate one. Upon my
return back to my office, I perfo rmed a second,
more thorough search and still was unab le to locate
one. I then contacted the assig ned property
management company on fil e for this prop erty,
APEK Rent a ls, and asked for a copy of the booking
it inerary for thi s part ic ul ar guest's stay. On Monday,
May 13, 2024, I received the booking it ine rary t hat
in dicated a c h eck-in date of May 9, 2024, and a
check-ou t date of May 12, 2024., a long with the
respo nsible renter's name which matched the guest
that w as i ssued the citation for t he active nuisance
on M ay 71 , 2024. It s hould be noted th at both
pro pertie s were advertised, and util ized as a
compo und/cl uster, which is a sepa rate viol ation of
th e City of Pa lm Spr in gs Short-Term Va ca tion Rental

ordinance. I was unable to locate a contract
summary submission for either property for this
particular guest stay. As a result of my findings, I
issued an administrative citation to the owner on file
for failure to submit a contract summary for both
properties as they were booked together.

This Short Term Rental Agreement (hereinafter: the "Agreement") is entered into and made effective as of the signing date by and between the Property
Owner/Operator ("Owner") and the Guest (together -the "Parties"). Terms not specified in this Agreement shall be in accordance with the House rules or
the Reservation policies which are provided separately by the Owner.
The parties agree as follows:
Accommodation Terms
1. The Guest agrees to abide by all rules and regulations set forth by local laws.
1. The Guest shall behave in a respectful manner and shall be good neighbors respecting the rights of the surrounding property owners. Creating a
disturbance of the above nature shall be grounds for immediate termination of this agreement.
1. The Guest commits not to use the property for any illegal or commercial purpose, including but not limited to sub-lease the property or otherwise
allowing anyone or more people to stay above the maximum permitted or if not previously agreed with the Owner.
1. The Guest is responsible for any breakage or damage costs (or related costs) in or to the property -along with any extra costs that may result -
which are caused by the Guest or any members of the Guest's party.
1. The Owner can refuse to allow the Guest into the property or ask the Guest to leave if they reasonably believe the Guest or any member of the
Guest's party (or any other person invited by the Guest to the property) are behaving illegally or that any damage is likely to be caused, has been
caused or is being caused as a result of the Guest behavior or any members the Guest has invited to the property and without providing a refund
of any payment the Guest has paid for the booking and the Owner will not be legally responsible to find any alternative accommodation.
1. Parking is limited to designated parking areas only.
1. The Guest must not hold events (such as parties, celebrations or meetings) at the property without the advance written consent of the Owner.
Any of these cases will allow the Owner to terminate the Agreement without providing a refund of any payment the Guest has paid for th_e booking
and the Owner will not be legally responsible to find any alternative acrommodation.
1. The Guest must allow the Owner or their representative (including workmen), with reasonable notice, access to the property at any reasonable
time during your stay (e_xcept in an emergency or if a problem needs sorting out quickly and you cannot be contacted in time. In these situations,
the owner can enter the property at any time with~ut giving you prior notice).
1. The Guest is obliged not to make any changes in the rented property without prior receipt of agreement from the Owner in writing.
1. By agreeing to these Terms & Conditions, as acknowledged by signature below, the Guest waives, discharges and agrees to hold harmless Owner
from all damages or injuries a_rising from or related to the Guest stay at Property, including without limitation, any accidents or injury to the Guest,
Guest's visitors and associates, and loss of money, jewelry or valuables of any kind. The Guest is responsible for keeping his valuables safe at all
times.
Additional Policies such as Rates and Fees, Check-In/Out Time, Cancellations, Minimum Stay, Smoking, Pets, Maximum Guests allowed, Children and
age, Security Deposit etc. will be according to the House rules or the Reservation policies which are provided separately by the Owner.

Upon review of the recent activity at your Vacation Rental property at 1344 S. Farrell Dr., Palm Springs, the City
of Palm Springs is suspending your Vacation Rental Registration Certificate for a period of two (2) years. In order
to minimize the negative impact to the near-term guests visiting our city who may be currently booked at your
property, the suspension period will begin on June 24, 2024, and will end on June 24, 2026. All advertising of
your property for short-term renting must cease immediately.
During the suspension period, your property may not be rented for short-term stays (28 days or less) but you
may rent your property as a long term rental.
This suspension is being made in accordance with the City of Palm Springs Municipal Code Section 5.25.090(b) as
follows:
"Upon the third violation in any twelve month period, the City Manager shall suspend the Vacation
Registration Certificate for two (2) years."

the third and fourth Administrative Citations AB0715 must be addressed at this Administrative Appeals Board

322-8382 with questions.
Should you choose to appeal this suspension, your suspension does go into effect on June 24, 2024, in accordance

violation of PSMC Section 5.25.090(c).
