MINUTES
CALL TO ORDER: The Chair called the meeting to order at 5:34 p.m.
ROLL CALL: Chair Hough, Vice-Chair Nelson, Rosenow, Kiser, Hansen, Miller.
ABSENT: Member Rose.

PUBLIC COMMENT:
PETER MORUZZI, representing the Palm Springs Modern Committee (“PSModcom”) agreed
with the staff recommendation but suggested clarification of the term “Reuse / Rehabilitation”.

4.A. THE PALM SPRINGS POLICE OFFICERS’ ASSOCIATION SEEKING A
CERTIFICATE OF APPROPRIATENESS FOR INSTALLATION OF A MURAL
ON THE SOUTH FAÇADE OF THE TOWN & COUNTRY CENTER, A CLASS 1
HISTORIC SITE, LOCATED AT 169 NORTH INDIAN CANYON DRIVE (APN
513-092-009), HSPB #51.
Staff member Lyon summarized the staff report.
Member Nelson asked what the amount of the penalties are that would be imposed
on the applicant for starting work without permits (Lyon responded he did not have
that information.)
Member Rosenow asked if the current colors on the Town & Country Center are
the historic colors (Lyon responded yes.) He asked if the building alterations
previously approved by the HSPB for prospective tenants was proceeding (Lyon
responded he did not know the status of confirmed tenants for the Center.)
Member Hansen asked if staff has a particular definition of “reuse / rehabilitation”.
(Lyon responded no, and described typical actions that would constitute reuse /
rehabilitation.)
Michael Torres, speaking on behalf of the Police Officer’s Association, (“the
Association”) apologized for starting the work without permits and explained the
purpose of the mural.
Member Nelson asked whether use of the entire wall for the mural had been
considered (Mr. Torres noted cost was a consideration that dictated the mural
size.)
Member Miller asked for clarification on timeframe for removal of the mural and
whether it should be tied to tenant occupancy of the building or if there should be
the ability to extend the time that the mural may remain. (Lyon responded that the
term in which the mural should remain was a suggestion by staff, recognizing that
the mural may conflict with future renovation that may impose doors or windows
being cut into the wall on which the mural is proposed.)

Mr. Torres explained that the building owner contemplated the mural could exist
for around three to five years. He noted that the Association acknowledged that
at some point the mural may need to be painted over.
Director Fagg suggested the removal of the mural could be considered by the
HSPB when a Certificate of Appropriateness is submitted for alterations to the
exterior of the building to accommodate new uses / tenants in the building.
Member Nelson expressed concern that it was taking a long time for the building
to be redeveloped.
Mr. Torres noted the Association hopes the mural could remain for three to five
years.
Member Kiser moved that the board accept the recommendation in the staff report.
Chair Hough seconded the motion. Member Nelson noted that the mural is
temporary and suggested an amendment to incorporate the time for removal of the
mural based on Director Fagg’s recommendation. Member Miller suggested an
amendment of at least five years if no alterations of the building are submitted in
that timeframe with the allowance that the Board could consider extending the date
on which the mural should be removed. Member Nelson suggested an
amendment that the police officer’s association identify a site for the mural to be
relocated. (Amendment was not accepted.)
Staff Lyon restated the motion: To grant the Certificate of Appropriateness that
the mural be allowed to be placed on the building on a temporary basis, and either
upon submittal of a Certificate of Appropriateness, or five (5) years, whichever
comes first, the HSPB will, at a noticed meeting, consider whether the mural should
be removed or allowed to continue for an additonal defined period of time.
AYES: Nelson, Kiser, Hough, Hansen, Miller, Rosenow.
NOES: None.
ABSENT: Rose.
BOARD MEMBER COMMENTS:
Member Nelson expressed concern that future initiatives of this sort, regardless of the
historic site on which it is considered, should be properly processed prior to installation.
STAFF COMMENTS: (None.)
ADJOURNMENT: The Historic Site Preservation Board adjourned to its regularly scheduled
meeting on Tuesday October 5, 2021, at 5:30 P.M.
