ROLL CALL: Present: Baker, Murphy, Miller, Rotman, Chair Weremiuk Staff Present: Planning Director Hadwin, Associate Planner Glenn Mlaker, Associate Planner Kikuchi, Administrative Specialist Fields REPORT OF POSTING OF AGENDA: The agenda was available for public access at the City Hall exterior bulletin board (west side of Council Chamber) by 9:00 pm on Thursday, December 7, 2023, and posted on the City’s website as required by established policies and procedures. APPROVAL OF MINUTES: NOVEMBER 8, 2023 Planning Director Hadwin noted a correction to the Roll Call: Commissioner Murphy was an Excused Absence. Rotman, seconded by Baker to approve, with corrections, the Minutes of the November 8, 2023 meeting. AYES: BAKER, MILLER, ROTMAN, MURPHY, WEREMIUK 2. PUBLIC HEARINGS: None. 3. A REQUEST BY WAYNE GOTTLIEB, OWNER, IN CONJUNCTION WITH OFF THE CHARTS CANNABIS DISPENSARY FOR A MAJOR DEVELOPMENT PERMIT APPLICATION TO CONSTRUCT A 628-SQUARE FOOT ADDITION TO AN EXISTING COMMERCIAL BUILDING FOR A NEW CANNABIS DISPENSARY AND LOUNGE LOCATED AT 1534 NORTH PALM CANYON DRIVE, C-1 (CASE #DP 2023- 0016) (GM) Glenn Mlaker, Associate Planner, presented the staff report to the Commission. Wayne Gottlieb, Resident and Applicant, and Juan Carlos Ochoa, Architect for the Applicant, spoke and answered questions of the Commission. Chair Weremiuk, seconded by Rotman, to approve with modifications: 1) Remove the storage container in the back parking lot. 2) Move back some of the gravel to widen the driveway. 3) Revise site plan with the gravel walkway no wider than 1 foot. 4) Review by the Architectural Review Committee of the front of the building, and to provide renderings. 5) Apply black top to the whole of the driveway. 6) Trees should be 36” boxes and provide shade. 7) Provide a readable landscape plan with details for the area between the buildings. 8) Move the ADA parking closer to the building with the subject addition. A REQUEST BY THE PLANNING COMMISSION FOR A SIX- MONTH REVIEW OF LAND USE PERMIT 19-102 AMENDMENT FOR THE VILLAGE (FORMER VILLAGE PUB) LOCATED AT 266 SOUTH PALM CANYON DRIVE, ZONE CBD, SECTION 15 (CASE NO. LUP 19-102 AMENDMENT). (NK) Noriko Kikuchi, Associate Planner, presented the staff report to the Commission. Tareef Talala, Applicant, spoke and answered questions of the Commission. Chair Weremiuk, seconded by Miller, to approve with modifications: Planning Commission Minutes December 13, 2023 Page 3 of 3 3 1) Obtain approval for the after-the-fact art mural on the south side of the building. 2) Remove the requirement of a six-month review to a one-year review to assess noise issues, should there be any verified noise complaints, with the elimination of future reviews if there are no noise complaints before December 24, 2024. AYES: BAKER, MILLER, ROTMAN, MURPHY, WEREMIUK PLANNING COMMISSION REPORTS, REQUESTS AND COMMENTS: (None) PLANNING DIRECTOR’S REPORT: x Vice Chair J.R. Roberts has resigned, and the recruitment of a new Commissioner has been initiated. x Commissioner Lauri Aylaian will return beginning to the Commission in January. x The Starbucks drive-through application has been called for a de novo hearing at City Council on December 14, 2023. x New Architectural Review Committee Members were appointed for a three-year term – x Lance O’Donnell, licensed architect x Gary Fredricks, architectural designer, and x Jackie Thomas, other professional ADJOURNMENT: The Planning Commission adjourned at 6:35 pm to 5:30 pm, Wednesday, January 10, 2024, 3200 East Tahquitz Canyon Way.
