ROLL CALL: Present: Commissioner Donenfeld, Commissioner Hirschbein, Commissioner Hudson, Commissioner Moruzzi, Vice Chair Calerdine, Chair Weremiuk Staff Planning Director Fagg, Deputy City Attorney Daudt, Director of Engineering Present: Garcia, Administrative Assistant Bruggemans, Associate Planner Newell, Associate Planner Lyon REPORT OF POSTING OF AGENDA: The Agenda was available for public access at the City Hall exterior bulletin board (west side of Council Chamber) and the Planning Services counter by 2:00 pm on Thursday, January 4, 2018. ACCEPTANCE OF THE AGENDA: Chair Weremiuk requested that Item 213 be moved to the end of the agenda. The agenda was accepted, as amended. PUBLIC COMMENTS: Chair Weremiuk opened public comments: ROLAND LEWIS, (spoke in reference to Item 3A) in opposition of the landscape design; noting that it's in violation of the Solar Shade Act. He urged the Commission that his solar panels not be blocked. CHRIS SAHLIN, applicant, Item 3A, spoke about the proposed landscape design. ALLEN WORTHY, spoke about harassment by the police department and lack of response from the city. There being no further speakers public comments was closed. 1. CONSENT CALENDAR: Planning Commission Minutes January 10, 2018 City of Palm Springs 1A. APPROVAL OF MINUTES: NOVEMBER 8, 2017 STUDY SESSION MINUTES, DECEMBER 13, 2017 STUDY SESSION MINUTES MOTION: Calerdine, seconded by Donenfeld to approve Item 1A as part of the Consent Calendar. AYES: Donenfeld, Hirschbein, Hudson, Moruzzi, Calerdine, Weremiuk EXCLUDED CONSENT CALENDAR: None. 2. PUBLIC HEARINGS: 2A. JR HAVENDALE, LLC FOR TENTATIVE PARCEL MAP 37376 TO SUBDIVIDE 2.67-ACRES OF LAND INTO FOUR PARCELS FOR THE EXISTING COMMERCIAL DEVELOPMENT LOCATED AT 450, 462, 490 SOUTH PALM CANYON DRIVE AND 471 SOUTH INDIAN CANYON DRIVE, ZONE CBD (CASE TPM 37376). (DN) Associate Planner Newell provided an overview on the proposed request to subdivide 2.67-acres into four parcels as outlined in the staff report. Chair Weremiuk opened the public hearing: BENJAMIN EGAN, civil engineer & surveyor, clarified there is no development proposed and they are looking to fix the underlying mass and are requesting deferment of off -site improvements. JOSEPH RAMANI, property owner, stated purchased this property several months ago and wants to clean up the existing parcel map into four separate parcels. He clarified that his intention is not to redevelop the site and will put a deed restriction to prohibit any redevelopment. Director of Engineering Garcia verified Public Works is comfortable with deferment of the off -site improvements. Chair Weremiuk concurred with staffs recommendation and would be making a motion in a favor of approval. Commissioner Donenfeld noted a concern that the applicant originally went in for a lot line adjustment which does not require infrastructure improvements. Staff then directed the applicant to apply for a revision to the tract map which requires infrastructure improvements. He disagrees with the motion. Chair Weremiuk withdrew her motion for further discussion. 2 Planning Commission Minutes January 10, 2018 City of Palm Springs The Commission discussed off -site improvements that would be required as part of the entitlement versus the requirement that would be applied to mapping requirements. Weremiuk, seconded by Calerdine to recommend approval to the City Council with conditions subject to: 1. Deferral of Engineering Conditions #4, #6, #7, #9, #11, #12 and #14 AYES: Donenfeld, Hirschbein, Hudson, Moruzzi, Calerdine, Weremiuk A recess was taken at 2:41 pm. The meeting resume at 2:51 pm. (These Items were moved out of order) 3. UNFINISHED BUSINESS: 3A. A MAJOR ARCHITECTURAL APPLICATION BY MARK WALTERS AND RICK CASSAR, OWNERS, FOR A 7,211 SQUARE FOOT SINGLE FAMILY RESIDENCE ON A HILLSIDE LOT LOCATED AT 1610 HILLVIEW COVE (ZONE R-1-C, CASE 3.4035 MAJ 17.1527 AMM; APN #686-450-010) (KL) Associate Planner Lyon provided an update on modifications to the landscape design as outlined in the staff report. SEAN LOCKYER, project architect, addressed questions from the Commission. Donenfeld, seconded by Calerdine to approve with conditions subject to: Mexican Blue Palm shall be planted on northwest corner of the site. AYES: Donenfeld, Hirschbein, Hudson, Moruzzi, Calerdine, Weremiuk 3B. REQUEST BY PALM SPRINGS SAFE ACCESS INC. TO APPEAL THE PLANNING DIRECTOR'S DENIAL OF A SIGN PERMIT APPLICATION FOR THE BUSINESS AT 1247 SOUTH GENE AUTRY TRAIL (CASE 17-056 APP). (FF) Planning Director Fagg provided background information on the sign permit appeal as outlined the staff memorandum. Vice Chair Calerdine said a finding should be made stating that the original sign program does not appear to be valid. Planning Director Fagg clarified that direction to property owner to come back with a sign program. 3 Planning Commission Minutes January 10, 2018 City of Palm Springs Weremiuk, seconded by Hirschbein to approve Sign A and direct the property owner to come back with a Sign Program for the business complex. AYES: Donenfeld, Hirschbein, Hudson, Moruzzi, Calerdine, Weremiuk 3C. A MAJOR ARCHITECTURAL APPLICATION BY LEGACY PALM SPRINGS, LLC, OWNER, PROPOSING DEVELOPMENT OF A 114-BED ASSISTED LIVING FACILITY WITH ACCESSORY COMMERCIAL USES ON A 1.43-ACRE LOT LOCATED AT 1000 NORTH PALM CANYON DRIVE, ZONE PDD 357, (CASE 5.1237 MAJ). (KL) Associate Planner Lyon provided an update on the subcommittee recommendations and summarized the modifications made to architectural and landscape design of the project. CHRIS SAHLIN, project architect, provided details and was available for questions. Hudson, seconded by Weremiuk to approve subject to: 1. Landscape comments made by the subcommittee members to be reviewed by staff. 2. Railing details and flashing reviewed at final PD process. 3. Review screening at south property line. ROSIAN V, LLC, FOR A PLANNED DEVELOPMENT DISTRICT (PDD), A MINOR ARCHITECTURAL APPLICATION (MAA), A CONDITIONAL USE PERMIT (CUP) AND A VARIANCE APPLICATION (VAR), PROPOSING RENOVATION AND ADDITIONS TO AN EXISTING 62-ROOM HOTEL TO ADD AN OUTDOOR MUSIC VENUE, AN OUTDOOR RESTAURANT USE, AND OUTDOOR COCKTAIL LOUNGE USE AND SUPPORT SPACES AT THE MONROE HOTEL (AKA INFUSION BEACH HOTEL) LOCATED AT 1900 NORTH PALM CANYON DRIVE (CASE 6.1409 CUP 1 PDD 387 1 3.864 MAA 1 6.650 VAR, (APN 504-320-026, ZONE C-11 R-31 RESORT COMBINING ZONE). (KL) Associate Planner Lyon provided an overview on the proposed renovation and additions to an existing hotel as outlined in the staff report. NICOLE CRISTE, Terra Nova Planning, City's CEQA Consultant for this project, provided clarification on the environmental study and was available for questions from the Commission. 4 Planning Commission Minutes January 10. 2018 City of Palm Springs Chair Weremiuk opened the public hearing and with no speakers coming forward the public hearing was closed. Commissioner Hudson said the 60 ft. distance is minor and thinks the circulation diagram for this valet situation is ideal. He is supportive. Commissioner Hirschbein thinks the valet parking should free of charge and a certain amount of stacking should be in the parking lot. Vice Chair Calerdine said when it returns for the Final PD he'd like to see the parking plan updated to show parking for Infusion Beach and Dinks. Chair Weremiuk would like to see the following items incorporated into the project: • Parking queuing on hotel site. • Six month and one year review on the parking adequacy. VARIANCE (CASE 6.550): Commissioner Hirschbein, seconded by Calerdine to adopt findings in the staff report and approve the Variance subject to: • Free valet parking. • Adequate parking distribution between Dink's and the hotel. • Provide diagram of parking stacking on the hotel property. • Provide parking signage. • Staffing until 3 am. • Six month and one year review on parking adequacy. • Occupancy and special events are based on 113 and occupancy; and greater quantity will require a LUP. AYES: Hirschbein, Hudson, Moruzzi, Calerdine, Weremiuk NOES: Donenfeld CONDITIONAL USE PERMIT (5.1409 CUP): Chair Weremiuk would like to include additional noise reduction measures and no subwoofers in the conditions. Planning Director Fagg said staff will work on a condition that addresses noise after 10 pm. (Noise emanating from the property in such that normal conversation can be carried on within the property itself.) Calerdine, seconded by Hirschbein, to approve subject to amended conditions. • Six month and one year CUP review. • Hours of operation shall be reviewed in six months. 5 Planning Commission Minutes January 10, 2018 City of Palm Springs AYES: Donenfeld, Hirschbein, Hudson, Moruzzi, Calerdine, Weremiuk CEQA CERTIFICATION: Calerdine, seconded by Hirschbein to adopt the Mitigation Negative Declaration. AYES: DonenfeId, Hirschbein, Hudson, Moruzzi, Calerdine, Weremiuk MINOR ARCHITECTURAL APPLICATION (3.864 MAA): Calerdine, seconded by Hirschbein, to continue to a date uncertain. AYES: DonenfeId, Hirschbein, Hudson, Moruzzi, Calerdine, Weremiuk PLANNED DEVELOPMENT DISTRICT (5.14091PDD 387): The Commission discussed items that might be a good public benefit consisting of: • Pedestrian safety or traffic calming improvements (crosswalks, sidewalks, lighting) Calerdine, seconded by DonenfeId, to continue to a date certain of January 24, 2018.
