ROLL CALL: Present This Meeting: Commissioner Donenfeld, Commissioner Hirschbein, Commissioner Lowe, Commissioner Middleton, Commissioner Weremiuk, Chair Klatchko Absent This Meeting: Vice -Chair Calerdine Staff Present: Flinn Fagg, Michael Daudt, Terri Hintz, Ken Lyon, Edward Robertson REPORT OF POSTING OF AGENDA: The agenda was available for public access at the City Hall exterior bulletin board (west side of Council Chamber) and the Planning Services counter by 6:00 pm on Thursday, May 5, 2016. ACCEPTANCE OF THE AGENDA: Chair Klatchko reported that Item 2B and 2C would be continued; however, the public comments would allowed for Item 213. The agenda was accepted. PUBLIC COMMENTS: Chair Klatchko opened public comments: Planning Commission Minutes Z City of Palm Springs May 11, 2016 JUDY ELMORE, spoke in reference to item 2B, expressed concern with the streets, construction vehicles and noise from rock crushing. She suggested designating no parking areas for certain areas of the street. JOHN MC INTOSH, resides near Item 2B, he urged that any development of site should be limited to single -story and elevation be held to a minimum to reduce impact to the neighbors. ALICE SLEIGHT, spoke in reference to Item 2B, she is opposed to the 20% lot width reduction; noting that this is an upscale neighborhood and having two small homes on one lot is a big concern. There being no further speakers public comments was closed. 1. CONSENT CALENDAR: 1A. APPROVAL OF MINUTES: APRIL 27, 2016 Commissioner Weremiuk requested two corrections. ACTION: Approve minutes of April 27, 2016, as amended. Motion: Commissioner Donenfeld, seconded by Commissioner Weremiuk and carried 5-1-1 on a roll call vote. AYES: Commissioner Donenfeld, Commissioner Hirschbein, Commissioner Middleton, Commissioner Weremiuk, Chair Klatchko ABSENT: Vice -Chair Calerdine ABSTAIN: Commissioner Lowe 2. PUBLIC HEARINGS: 2A. ATEF D. JABER, OWNER OF FIESTA MARKET, FOR A CONDITIONAL USE PERMIT FOR A CONVENIENCE STORE USE AT THE SOSSA'S CENTER, LOCATED AT 3700 EAST VISTA CHINO, SUITE "G", APN 6770-040-027, ZONE M-1- P (CASE 5.0691 CUP). (KL) Associate Planner Lyon presented the proposed project as outlined in the staff report, Planning Commission Minutes 3 City of Palm Springs May 11, 2016 Commissioner Weremiuk questioned if a single serving of alcohol (beer or wine mix) is regulated on this type of use. Deputy City Attorney noted that typically these conditions are imposed by the Alcohol Beverage Commission (ABC). Director Fagg pointed -out that ABC regulates certain types of alcohol licenses within a census tracts. Chair Klatchko opened the public hearing portion of the meeting: ATEF JABER, applicant, said he's lived in the valley for 20 years and has owned grocery stores that had liquor licenses and has had no violations. There being no further appearances the public hearing was closed. Commissioner Weremiuk commented that she lives adjacent to this site and this vacant site is not a good thing. She said people in the neighborhood would like to see this project succeed. She prefers imposing a condition to restrict selling individual sizes given the heavy and fast traffic on Vista Chino Road. Commissioner Middleton asked the applicant if he will sell small bottles of hard liquor (1 to 2 oz.) similar to what are served on flights. The applicant responded no that he will only sell one -pint and larger and does not have a problem restricting the small bottles of alcohol. ACTION: Approve subject to Conditions, as amended: • Restrict single sales of beer and wine coolers. • Restrict individual sizes of less than one pint of hard liquor. Motion: Commissioner Lowe, seconded by Commissioner Weremiuk and unanimously carried 6-0-1 on a roll call vote. AYES: Commissioner Donenfeld, Commissioner Hirschbein, Commissioner Lowe, Commissioner Middleton, Commissioner Weremiuk, Chair Klatchko ABSENT: Vice -Chair Calerdine 2B. REQUEST BY FOUNTAIN VILLAGE DEVELOPMENT FOR A TENTATIVE PARCEL MAP TO SUBDIVIDE A 1.7-ACRE PARCEL INTO TWO SINGLE-FAMILY RESIDENTIAL LOTS AND AN ADMINISTRATIVE MINOR MODIFICATION (AMM) APPLICATION FOR A 20 PERCENT REDUCTION OF THE REQUIRED LOT WIDTH Planning Commission Minutes 4 City of Palm Springs May 11, 2016 IN THE R-1-A ZONING DESIGNATION FOR THE PARCEL LOCATED AT THE WESTERN TERMINUS OF WEST SANTA ROSA DRIVE, ZONE R-1-A; SECTION 15 (CASE TPM 3692217.1482 AMM). (ER) Principal Planner Robertson provided a brief overview of the proposed project and noted that additional research is necessary for this application. He requested this item be continued to a date certain. Chair Klatchko opened the public hearing and with no speakers coming forward the public hearing was closed. ACTION: Continue to a date certain of May 25, 2016. Motion: Commissioner Weremiuk, seconded by Commissioner Middleton and unanimously carried 6-0-1 on a roll call vote. AYES: Commissioner Donenfeld, Commissioner Hirschbein, Commissioner Lowe, Commissioner Middleton, Commissioner Weremiuk, Chair Klatchko ABSENT: Vice -Chair Calerdine 2C. WOODBRIDGE PACIFIC GROUP ON BEHALF OF PALM CANYON 65, LLC, FOR PLANNED DEVELOPMENT IN LIEU OF ZONE CHANGE, TENTATIVE TRACT MAP AND MAJOR ARCHITECTURAL APPLICATION TO CONSTRUCT A MIXED - USE PROJECT ON 12.4-ACRES CONSISTING OF (57) SINGLE-FAMILY RESIDENCES ON LOTS AVERAGING 5,362-SQUARE FEET IN SIZE, (22) MULTI- FAMILY RESIDENTIAL CONDOMINIUMS AND APPROXIMATELY 15,893-SQUARE FEET OF COMMERCIAL SPACE LOCATED AT 777 SOUTH PALM CANYON DRIVE (CASE NOS. 5.1378 PD-379, ZC 3.3876 MAJ AND TTM 36914). (DN) Director Fagg reported that staff is requesting to table this item. The project will be re - noticed for May 25, 2016. ACTION: Table. (The project has been revised and will be re -noticed for the next regular meeting of May 25, 2016.) Motion: Commissioner Donenfeld, seconded by Commissioner Lowe and unanimously carried 6-0-1 on a roll call vote. AYES: Commissioner Donenfeld, Commissioner Hirschbein, Commissioner Lowe, Commissioner Middleton, Commissioner Weremiuk, Chair Klatchko ABSENT: Vice -Chair Calerdine Planning Commission Minutes 5 City of Palm Springs May 11, 2016 PLANNING COMMISSION COMMENTS: Commissioner Middleton provided details on the Green Building Program that was developed in 2010 by CVAG noting that the area of concentration is on what point should there be requirements that solar panels be installed in new and remodeling construction. Commissioner Weremiuk spoke regarding the Parks & Recreation Commission and suggested having a joint meeting. PLANNING DIRECTOR'S REPORT: Planning Director Fagg spoke about the following items: • A tour of the proposed Eagle Canyon development. • A study session will be scheduled for May 25th at 11:30 am to discuss the Rimrock project. Commissioner Middleton noted she would be out of town on May 25th. ADJOURNMENT: There being no further comments the Planning Commission adjourned at 2:23 pm to Wednesday, May 25, 2016, at 1:30 pm preceded by the site tour of the proposed Eagle Canyon development on Monday, May 23, 2016, at 8:00 am.
