ROLL CALL: Present This Meeting: Commissioner Calerdine, Commissioner Donenfeld, Commissioner Lowe, Commissioner Middleton, Commissioner Weremiuk, Chair Klatchko Absent This Meeting: None Staff Present: Flinn Fagg, Michael Daudt, Terri Hintz, Savat Khamphou, David Newell, Edward Robertson REPORT OF POSTING OF AGENDA: The agenda was available for public access at the City Hall exterior bulletin board (west side of Council Chamber) and the Planning Services counter by 4:00 pm on Thursday, January 21, 2016. ACCEPTANCE OF THE AGENDA: The agenda was accepted as presented. PUBLIC COMMENTS: Chair Klatchko opened public comments: The following persons spoke in reference to prior Study Study item - Serena Park: DENISE JANSSEN EAGER, requested that the Planning Commission study the intersection of N. Farrell Drive and Racquet Club Road, as the project would further impact safety at the intersection. TRUDY SMEBY, requested that the plan for the development be revised so that the proposed street adjacent to the existing Alexander Estates development is moved adjacent to the Whitewater Wash. Planning Commission Minutes City of Palm Springs January 27, 2016 RENEE SAUNDERS, commented that the proposed development will add significant traffic to the adjacent residential streets. ALLEN BOWLEY, secretary, Gene Autry Neighborhood Association, voiced concerns about increased traffic on residential streets, noting that there no sidewalks on Whitewater Club Drive, and that traffic calming efforts are already being installed due to impacts of the existing traffic. The following persons commented on: ALLEN WORTHY, spoke about corruption in the city. CLAIRE RICE, resides in Demuth Park neighborhood, requested a sound and traffic study be conducted to establish this would not impact them in a negative way. JIM OSTERBERGER AND MICHAEL MC CARTNEY, representing Spurline Bar, commented that they have reached an amicable conclusion with the owner of Chill Bar. There being no further appearances the public comments was closed. 1. PUBLIC HEARING: 1A. JENNIFER GUGLIEMO'S APPLICATION FOR A CONDITIONAL USE PERMIT TO OPERATE A KENNEL (DOG DAY CARE, BOARDING AND TRAINING) AND INCIDENTAL RETAIL SALES OF DOG NOVELTY ITEMS WITHIN A 2,345-SQUARE FOOT SPACE OF AN EXISTING BUILDING LOCATED AT 752 VELLA ROAD, ZONE M- 1, SECTION 19 (CASE 5.1386-CUP). (ER) Principal PIanner Robertson presented the proposed project as outlined in the staff report. The Commission questioned and/or commented on: • Are there any required State or Local regulations? • What relationship is the outdoor area to the neighborhood? • Type of proposed wall? • Is the City's Noise Ordinance applicable to this project? • It's important that dogs have an outdoor area to enjoy the sunshine and air. • Noise attenuation - is there a condition to minimize the barking dogs inside the building? Chair Klatchko opened the public hearing: JENNIFER GUGLIEMO, applicant, indicated that the building has drop ceilings that will mitigate the noise and provided details pertaining to the space per dog and outdoor area. 21 Planning Commission Minutes City of Palm Springs January 27, 2016 ALLEN WORTHY, spoke in support of the dog day care. There being no further appearances the public hearing was closed. ACTION: Approve subject to Conditions; and • Planning Commission review in six (6) months. Motion: Commissioner Lowe, seconded by Commissioner Donenfeld and unanimously carried on a roll call vote. AYES: Commissioner Calerdine, Commissioner Donenfeld, Commissioner Lowe, Commissioner Middleton, Commissioner Weremiuk, Chair Klatchko 2. NEW BUSINESS: 2A. A REPORT ON AN APPROVED CONDITIONAL USE PERMIT ISSUED TO JAYDUBYA ENTERTAINMENT, LLC FOR A COCKTAIL LOUNGE WITH INDOOR AMPLIFIED MUSIC AT 212 AND 216 S. INDIAN CANYON DRIVE, ZONE LSC, SECTION 14 SPECIFIC PLAN (CASE 5.1320 CUP). (DN) Associate Planner Newell provided an overview of the proposed project as outlined in the staff report. RON BOWDEN, applicant, Chill Bar, stated that they have installed a high -density sound board to mitigate the noise. ACTION: To accept and file. Motion: Commissioner Lowe, seconded by Commissioner Weremiuk and unanimously carried on a roll call vote. AYES: Commissioner Calerdine, Commissioner Donenfeld, Commissioner Lowe, Commissioner Middleton, Commissioner Weremiuk, Chair Klatchko 2B. A REPORT ON AN APPROVED LAND USE PERMIT ISSUED TO MIGGY'S CANTINA, LLC FOR OUTDOOR ENTERTAINMENT 1 MUSICIANS AS AN ACCESSORY USE TO A RESTAURANT LOCATED AT 1555 SOUTH PALM CANYON DRIVE, ZONE PD-131 1 I.L. (CASE LUP 13-067). (DN) Associate Planner Newell provided an update on the project as outlined in the staff memorandum. Commissioner Weremiuk recalled noise issues related to bass vibrations that impacted some of the neighbors and requested staff report back to determine if the facility is in operation. 3 1 P a g e Planning Commission Minutes City of Palm Springs January 27, 2016 Commissioner Middleton requested clarification if the original Noise Ordinance will remain in effect for special events held in the future. ACTION: Receive and file with further review in 3 months. Motion: Commissioner Weremiuk, seconded by Commissioner Lowe and unanimously carried on a roll call vote. AYES: Commissioner Calerdine, Commissioner Donenfeld, Commissioner Lowe, Commissioner Middleton, Commissioner Weremiuk, Chair Klatchko PLANNING COMMISSION REPORTS, REQUESTS, AND COMMENTS: The Commission commented on: • Appreciated full-size plans for the Serena Park project and requested large plans for developments of this magnitude. • Commissioner Weremiuk will be absent the February 24th meeting. • Disappointed with the quality of the presentation from MSA Consulting. • Independent peer review performed for the environmental documentation. PLANNING DIRECTOR'S REPORT: Planning Director Fagg noted that another study session will be held on February 10th to further discuss the proposed Serena Park development. ADJOURNMENT: The Planning Commission adjourned at 2:30 pm to a Study Session at 11:30 am on Wednesday, February 10, 2016, City Hall, Large Conference Room, 3200 East Tahquitz Canyon Way.
