REPORT OF POSTING OF AGENDA:
The agenda was available for public access at the City Hall exterior bulletin board (west
side of Council Chamber) and the Planning Services counter by 5:00 p.m. on Friday,
July 18, 2008.
ACCEPTANCE OF THE AGENDA:
Commissioner Scott noted his abstention on Item 4A due to his absence on July 9th.
The Director of Planning Services requested Items 213 and 3A continued to an
undetermined date.
PUBLIC COMMENTS:
Chairman Hochanadel opened Public Comments; there being no appearances Public

Commissioner Caffery noted that he prefers terracotta for the color of the parapet rather

4. PUBLIC HEARINGS:
4A. Case 5.1184 CUP / 6.510 VAR (Palm Springs Recycling) - An application by
Rick Bracamonte for a Conditional Use Permit to allow a recycling center
located at 280 Oasis Road, Zone M-1, Section 34, APN: 669-444-013. (Project
Planner: David A. Newell, Associate Planner) (Continued from the July 9th
meeting.)
Commissioner Scott left the Council Chamber at 1:45 p.m.
David A. Newell, Associate Planner, provided background information as outlined in the
staff report dated July 23, 2008. Mr. Newell reported that code enforcement has

received five complaints from separate property owners within the last year mainly due
to maintenance issues.
Chairman Hochanadel opened the Public Hearing:
- the complaints received toward the applicant. Mr. Bochnewich requested consideration
be given for the property improvements and stringent conditions and requested a 10
year time limit on the conditional use permit.
-Gary Jacobs, Palm Springs, property owner across the street, stated that he is not
opposed to the recycling center but would like a stipulation that the applicant is
responsible for the upkeep and maintenance of his property.
-Jerry Johnson, Palm Springs, pastor of church next door, concerned with the upkeep
and maintenance of the property. Mr. Johnson requested the new height of the
wall conceals the stacked materials to prevent debris from blowing onto neighboring
properties.
-Frank Burgess, Palm Springs, adjacent neighbor, stated that he is not in opposition
recycling center, however, questioned the zoning for this site. Mr.
Burgess requested condition #5 changed to, "shall' rather than "may"; fire condition #4
pertaining to storage height not to exceed height 10 feet and submittal of plans in less
than one year.
-Peter Bochnewich, applicant response, addressed the neighbor's
property maintenance concerns.
There being no further appearances the Public Hearing was closed.
Commissioner Donenfeld noted that he is in favor of a five year time limit because of the
inconsistency of current zoning and the general plan goals for this area.
Discussion occurred on the wall height and a provision to control debris from blowing
onto neighboring property.
M/S/C (Caffery/Vice Chairman Cohen, 4-0, 2 absent Ringlein/Conrad, 1 abstained/
Scott) To approve, subject to Conditions of Approval, as amended:
Direct staff to return with a final resolution with the following changes:
-Condition #1 C - The height of the wall block wall to be ten feet in height.
-Condition #4 - The Conditional Use Permit shall be valid for a period of five (5) years
from the date of approval. The Variance to run concurrently for a period of five (5)
years.
-Condition #5 and #8 - To include a performance provision to control debris from
blowing off -site.

-Fire Condition #4 and #13 - Staff to work with the fire department to_ clarify storage
height.
-Street Condition #2 change to #1 D. To submit street improvement plans within 6
months and construction completed within 12 months of approval date.
Commissioner Scott re-entered the Council Chamber at 2 32-p.m.
413. Case 5.1128 CUP / 6.501 VAR (Easy Lube) - An application by Endure
Investments, LLC, for a Conditional Use Permit to allow the construction
and operation of an automobile service station and a Variance to reduce
setbacks located at the southeast corner of Gene Autry Trail and Mission
Road, Zone M-1-P, Section 17, APN: 677-280-041. (Project Planner: David A.
Newell, Associate Planner)
David A. Newell, Associate Planner, provided background information as outlined in the
staff report dated July 23, 2008.
Chairman Hochanadel opened the Public Hearing:
-Jack Kurchian, Endure Investments, developer, addressed the design and orientation
of the site. Mr. Kurchian provided further details pertaining to landscape berming and
hours of operation.
There being no further appearances the public hearing was closed.
Discussion occurred on potential noise to the adjacent residential homes (air tools
and the car wash drying cycle) during the evening hours. Staff noted this area is the
main delivery access for The Springs including deliveries for Home Depot.
M/S/C (Scott/Vice Chairman Cohen, 5-0, 2 absent Ringlein/Conrad) To approve,
subject to Conditions of Approval, as amended:
-The hours of operation for the automobile use and car wash facility shall be from7 a.m.
to 7 p.m. daily.
-Revise Condition #8 (Final Design): Final landscaping, irrigation, exterior lighting, and
fencing plans shall be submitted for approval by the Planning Commission prior to
issuance of a building permit. Landscape plans shall be approved by the Riverside
County Agricultural Commissioner's Office prior to submittal.

PLANNING COMMISSION COMMENTS:
Commissioner Donenfeld noted that the Architectural Advisory Committee has
requested a joint meeting with the Planning Commission. Staff responded that the next
Hochanadel-suggested confirmation of this date with the members of the AAC so that
the majority will be in attendance.
PLANNING DIRECTOR'S REPORT:
Mr. Ewing reported that the State has adopted a bill extending one (1) additional year
to tentative tract maps and provided further details.
ADJOURNMENT:
There being no further comments the meeting adjourned at 3:01 p.m.
