REPORT OF POSTING OF AGENDA
The July 12, 2006 agenda was available for public access at the City Hall exterior
bulletin board and the Department of Planning Services counter by 5:00 p.m. on July 7,
2006.
1. PUBLIC COMMENTS: (Three minute time limit.)
Chair Marantz opened the Public Comments portion of the meeting.
There being no comments, Public Comments was closed.
2. CONSENT AGENDA: None.
PUBLIC HEARINGS:
3. Case 5.1085 CUP /. TTM 34019 - An application by Pali -Palm Springs to
sub -divide one lot for the development of 34 residential condominium units
and two commercial condominium units comprised of a nine -room hotel and
bar, and architectural review for adaptive re -use, construction and
renovations to existing buildings, located 261 South Belardo Road, Zone R3,
Section 15. (Continued from June 28, 2006 Planning Commission meeting.)

Associate Planner, Diane Bullock, gave background information as outlined in the staff
report dated July 12, 2006. She indicated that during their July 11th meeting, the
Historic Preservation Board Meeting imposed a 120-day stay of demolition for the 1915
craftsman bungalow.
Chair Marantz requested clarification on the setbacks and parking.
Chair Marantz opened the Public Hearing.
Matt Fisher, applicant, gave additional information and requested consideration to
eliminate the following three Engineering conditions: #71 and #74, page 30, relating
to sidewalks on Cahuilla; and #96, page 31, relating to undergrounding of utility lines.
Allison Massett, architect, addressed condition #35, requiring loading space; requested
the loading space be provided within the parking bays on Belardo.
Tom Lockett, landscape architect, gave further details relating to the landscaping.
Bob Helbling, Palm Springs, spoke in favor of the project and stated he has enjoyed
working with this developer as a neighborhood member and stated his opposition to
(� sidewalks.
Frank Tyson, Palm Springs, stated that the developer has made major changes and
appreciates it; he indicated the neighborhood is opposed to sidewalks and in favor of
undergrounding the utilities.
There being no further comments, the Public Hearing was closed.
Chair Marantz requested clarification on the engineering conditions raised by the
applicant.
Director of Public Works, David Barakian, stated that the overhead utility lines on
Cahuilla, are required by ordinance to be placed underground to the nearest pole. He
gave additional information relating to the pedestrian sidewalk and parking bays.
Chair Marantz requested clarification for Condition #35.
Commissioner Hutcheson commented that he is in favor of deleting Engineering
Conditions #71 and #74, retaining Condition #96 and modifying Condition #35.

Commissioner Hochanadel requested clarification on the sidewalks and gutter
drainage.
M/S/C (HutchesonNice Chair Hochanadel, 4-0, 3 absent/Cohen, Roath, and
Shoenberger) To recommend approval to City Council, subject to Conditions of
Approval; with the elimination of Conditions of Approval #71 and 74; and Condition #35
amended as follows: 'The existing on site bay spaces and drive aisle may serve as the
project loading zone subject no adverse impact to adjacent public ROW."

4. Case 3.2871 MAJ / 5.1004 GPA / 5.1124 ZTA - An application by BMW Motors
of Palm Springs for approval of a Major Architectural Approval for a
proposed new automobile dealership facility on a undeveloped lot located at
3737 East Palm Canyon Drive; and associated with the project is a General
Plan Amendment to delete the requirement for a public frontage road along
East Palm Canyon Drive, and a Zoning Text Amendment to allow parking
within the East Palm Canyon Drive setback, Zone C2, Section 30, APN 681-
070-016.
Lyn Calerdine, Contract Planner, LSA Associates, gave background based on the staff
report. He gave further details relating to the East Palm Canyon frontage road and
indicated the only concern the Architectural Advisory Committee had was the lighting -
which has been conditioned for further AAC review.
Chair Marantz requested clarification on the frontage road and stated her main concern
is the access to East Palm Canyon.
Director of Public Works, David Barakian, gave details relating to the flow of traffic and
the frontage road.
Commissioner Hutcheson requested a condition be imposed requiring prior
authorization for any changes made to the frontage road.
Chair Marantz opened the Public Hearing.
Jerry Johnson, applicant, gave additional information and indicated they have spent a
lot of time analyzing the project. He requested clarification on Building Condition #8 and
#9 as to whether storage of inventory is considered as parking; requested consideration
for shading requirements; Engineering Condition #11, relating to the 8 foot sidewalk;
requested consideration for a 6 foot sidewalk.

John Ellis, Palm Springs, voiced concerns relating to the access road, drainage and a
traffic signal or access road at Horizon Village.
Susan Cogliane, Palm Springs, spoke in opposition to the vacation of the frontage road
and the safety of the seniors in the neighboring mobile home parks.
There being no further comments, Chair Marantz, closed the public hearing.
The Commission discussed the actual right of access to the road.
Commissioner Hutcheson requested clarification on reducing the sidewalk by 2 feet.
Commissioner Hochanadel requested clarification on paging systems.
M/S/C (Hutcheson/Ringlein, 4-0, 3 absent/Cohen, Roath, and Shoenberger) To approve
the Major Architectural and recommend the approval of the Zone Text Amendment and
General Plan Amendment to City Council; as amended:
*Prior authorization is required for any changes to the Frontage Road.
*Condition #17 to include: No paging systems allowed.
5. Case 5.1086 ZTA / CUP - An application for a Zone Text Amendment to
amend the text for the M-1-P and M-2 Zones to allow ambulance services,
and a Conditional Use Permit for American Medical Response to operate an
ambulance dispatch and service deployment center located at 1111
Montalvo Way, Zone M-1-P, Section 7.
Associate Planner, Ken Lyon, gave background information as outlined in the staff
report dated July 12, 2006.
Chair Marantz opened the Public Hearing.
Wayne Ennis, Operations Manager, gave additional information and commented that
they have outgrown the building and accessibility to the major thoroughfare is difficult.
There being no further comments, Chair Marantz, closed the Public Hearing.
Vice Chair Hochanadel commented that this site is perfect and requested clarification
on the types of mechanic work performed on site.

Conditional Use Permit.
ARCHITECTURAL REVIEW:
6. Case 3.2898 SFR - An application by Zebra Development Inc., to construct a
single family residence of approximately 6,363 square feet located at 3193
Avenida Sevilla, Zone R-1-13, Section 35.
Associate Planner, Diane Bullock, gave background information as outlined in the staff
report dated July 12, 2006.
M/S/C (Hutcheson/Ringlein, 4-0, 3 absent/Cohen, Roath, and Shoenberger) To
approve, subject to Conditions of Approval.

8. COMMISSION WORK PROGRAM:
**General Plan Update
**Work Program Priorities and Subcommittee Assignments
Associate Planner, Ken Lyon, gave an update on the status of the General Plan Update.
Craig A. Ewing reported that overlay zones would be the topic of the next Study Session
in August.
9. CITY COUNCIL ACTIONS: Update.
Craig A. Ewing reported that the City Council would be holding a meeting tonight to
discuss the Chino Cone Ordinance, Palm Hotel and the Mesquite project.
10. COMMISSION/STAFF REPORTS AND REQUESTS -
Chair Marantz commented that she would not be in attendance for the meeting of
August 23rd.

Ken Lyon reported that next week there would be an Environmental Impact Report
Scoping meeting for the General Plan Update.
Commission Hochanadel inquired on the status of security gates on a building at Sunny
Dunes & Palm Canyon; as well as a follow-up on a property located across from
Kentucky Fried Chicken Restaurant which looks like the roof is falling off.
Craig A. Ewing noted that the Code Enforcement department would be presenting
to City Council a comprehensive downtown sign enforcement program.
