Ewing, reported that the agenda was posted by 5:00p.m. on Friday, December 9, 2005, at 5:00 p.m.; at City Hall exterior bulletin board and the Department of Planning and Zoning counter. 1. PUBLIC COMMENTS: Chairwoman Marantz opened the Public Comments. There being no comments, Public Comments was closed. 2. CONSENT AGENDA: A. Approval of Minutes: November 23, 2005 M/S/C (Hochanadel/Ringlein, 7-0) to approve, minutes of November 23, 2005. B. Adoption of Resolution of Denial for Case 5.0979 CUP — An application by Sprint PCS for a Conditional Use Permit for the installation of one (1) sixty five (65') tall commercial communication antenna located at 1800 South Sunrise Way, Zone RGA (6), Section 25. Commissioner Shoenberger abstained due to a business conflict. M/S/C (Hutcheson/Cohen, 6-0, 1 absent/Shoenberger) to adopt Resolution of Denial. C. Adoption of Resolution of Denial for Case 5.0980 CUP - An application by Verizon Wireless for a Conditional Use Permit for the installation of one (1) sixty five (65') foot tall commercial communication antenna located at 1800 South Sunrise Way, Zone RGA (6), Section 25: Commissioner Shoenberger abstained due to a business conflict. t M/S/C (Hutcheson/Cohen, 6-0, 1 absent/Shoenberger) to adopt Resolution of Denial. Adoption of Resolution of Denial for Case 5.0985 CUP - An application by Singular ireless for a Conditional Use Permit for the installation of one (1) sixty five (65') foot tall commercial communication antenna located at 1800 South Sunrise Way, Zone RGA (6), Section 25. Commissioner Shoenberger abstained due to a business conflict. M/S/C (Hutcheson/Cohen, 6-0 1 absent/Shoenberger) to adopt Resolution of Denial Note: Director of Planning Services, Craig A. Ewing,; reported that there is an appeal process in accordance with City regulations in which these projects may be appealed to the City Council PUBLIC HEARINGS: 3. Case 6.485 VAR - An application by Leslie Wheeler for a Variance to reduce the front yard required setback of 25 feet to 14 feet located at Smoketree Ranch, 1800 South Sunrise, Rock 7, Zone R-1-A, Section 25, APN 510-123-004. Commissioner Shoenberger abstained due to abusiness conflict. Assistant Planner, Michael Blumson, gave a detailed summary of the staff report dated December 14, 2005. Chairwoman Marantz opened the Public Hearing. Chris foster, on behalf of applicant, gave additional information and was available for questions. There being no further comments, the Public Hearing was closed. Discussion was made regarding findings for the project. M/S/C (Ringlein/Roath, 5-1/Marantz, 1 absent/Shoenberger) to deny, without prejudice. Director of Planning Services, Craig A. Ewing, reported this project is subject to the appeal process to City Council 4. Case 5.1079 CUP - An application by Thomas Minder for a Conditional Use Permit to allow a guest house over 1/50 of the lot area located at 233 West Crestview Drive, Zone R-1-C, Section 27, APN 513-372-021. Assistant Planner, Michael Blumson, gave a summary of the staff report dated December 14, 2005. Chairwoman Marantz opened the Public Hearing. 2 City of Palm Springs Planning Commission Minutes of December 14, 2005 Tom Minder, applicant, available for questions. There being no further comments, the Public Hearing was closed. M/S/C (Shoenberger/Cohen, 7-0) to approve, subject to Conditions of Approval; with the following new Condition: Casita not to be rented separately from main house. 5. Case 5.0886-A CUP - An application by Lawrence Miller, owner, for a Conditional Use Permit to convert half of the multi -purpose building into two additional units located at 1800 Smoke Tree Lane, Zone R3/RGA(6), Section 25, APN 510-020-031. Commissioner Shoenberger abstained due to abusiness conflict. Assistant Planner, Michael Blumson, gave a summary of the staff report dated December 14, 2005. He indicated the Smoke Tree Inn operates rental apartment units and these 2 would-be additional rental units. Chair Marantz opened the Public Hearing. -� Robert Gattinella, on behalf of Smoke Tree Inn, gave additional information and available for questions. There being no further comments, the Public Hearing was closed. M/S/C (Hutcheson/Cohen, 6-0, 1 absent/Shoenberger) to approve, subject to Conditions of Approval, 6. Case 5.0866 B / TTM 31525 An application by K. Hovnanian to subdivide approximately 23.9 acre parcel into 70 single-family residential lots, two water quality lots and dedication of a seven -acre park located at the east side of Sunrise Way between San Rafael Drive and South of Whitewater Wash, Zone R-1-C, Section 36. Contract Planner, Bernie Chase, gave a summary of the staff report dated December 14, 2005. He indicated changes to the following Conditions of Approval: #5, #7, #9 and Engineering Conditions #3, #4, #5, #27, #32, #33 and #40. Senior Engineer, Marcus Fuller, gave further information regarding the Engineering conditions. He further stated that the developer is only required to dedicate lands toward park site development and are not required to develop the park. It is the City's responsibility. The Quimby Fees will be collected and it will be a City project to develop that park site. Discussion was made regarding the average size of lots and the front and side yard set -backs. Chair Marantz reminded the Commission that this is a continuance of an approved project. 3 City of Palm Springs Planning Commission Minutes of December 14, 2005 Chairwoman Marantz opened the Public Hearing. Margo Thibeault; MSA Consulting, representing K. Hovnanian, commented that this is the 3`d and final phase of the project and requested further clarification on several conditions of approval. There being no further comments, the Public Hearing was closed. Senior Engineer, Marcus Fuller, gave further information on the Engineering Conditions in question. M/S/C (Hutcheson/Shoenberger, 6-1/Roath) to adopt the Mitigated Negative Declaration and recommend approval of TTM 31525; as amended, to add "if required' to Condition #5; staff to add language to Condition #7 to clarify the Quimby Act and the Park Fee; and to add the revised Engineering Conditions, as submitted. 7. ARCHITECTURAL REVIEW: None: 8. MISCELLANEOUS: None. 9. - COMMISSION/WORK PROGRAM: 'General Plan Update: Craig Ewing gave an update on the Neighborhood Meetings held on the draft Land Use Plan. 'Work Program Priorities and Subcommittee Assignments None reported. I 10. CITY COUNCIL ACTIONS: Update. 11. COMMISSION STAFF REPORTS AND REQUESTS: Craig A. Ewing reported to the Commission to take a good look at land that has not been developed, the land use designation and the density. He further emphasized that what is established in the General Plan is going to direct all the future projects. Further discussion was made between the difference between PD modifications and General Plan amendments. Commissioner Shoenberger commented that higher density is not necessarily a bad thing where you have senior housing or a limited amount of land. He stressed the importance to keep an open mind. 12.
