HomeMy WebLinkAbout2005-07-27 PC MinutesCITY OF PALM SPRINGS >' PLANNING COMMISSION MINUTES July 27, 2005 Council Chamber, City Hall 3200 East Tahquitz Canyon Way Palm Springs, CA 92262 ROLL CALL: Present: Roath, Cohen, Hochanadel and Chairwoman Marantz Absent: Shoenberger, Ringlein, Hutcheson CALL TO ORDER: Chairwoman Marantz called the meeting to order at 1:30 p.m. REPORT OF POSTING OF AGENDA: Interim Director of Planning Services, Norm Canchola, reported that the agenda was posted by 5:00 p.m. on Friday, July 22, 2005, at the City Hall exterior bulletin board and the Department of Planning and Zoning counter. APPROVAL OF MINUTES: Minutes of June 23, 2004 were postponed. M/S/C (Roath/Hochanadel, 3-0, 1 absent/ Cohen) to approve minutes of July 13, 2005. 1. PUBLIC COMMENTS: Chairwoman Marantz opened Public Comments portion of the meeting. There being no comments, Public Comments was closed. CONSENT AGENDA: 2A. Case 5.0957 — An application by Rothbart Development for architectural review of the Bank of America building as part of the destination Ramon-Walmart project located at 5601 Ramon Road East, Zone W. M-11.L., Section 20. Principal Planner, Alex Meyerhoff, gave details of the project. M/S/C (Hochanadel/Cohen, 4-0) to approve, subject to Conditions of Approval. 2B. Case 3.1711 - An application by Harry Kea[, on behalf of Yang S. Kil, owner, to construct a 432 square foot addition located at 855 West Panorama, Zone R1A, Section 03, APN 504- 213-001. Assistant Planner, Diane Bullock, gave details of the project. M/S/C (Roath/Hochanadel, 4-0) to approve, subject to Conditions of Approval. City of Palm Springs Planning Commission Minutes of July 27, 2005 PUBLIC HEARINGS: 3. Case 5.1051 - CUP - An application by Freedom Recovery Centers, LLC, on behalf of the owners of the Harlow Hotel and Village Inn, for a Conditional Use Permit for the change of use from existing hotel units to an intermediate care facility located at 855 North Indian Canyon Way and 175 East Alameda, Zone R3, Section 10, APN 505-285-011 and 012. Assistant Planner, Diane Bullock, gave details of the project at the exhibits. She reported that a neighborhood meeting was held on June 30`h and the attendees were in support of the project. She gave further details using the power -point presentation showing elevations, architecture and the types of treatments to be offered. Commissioner Roath inquired about the TOT fees and how it would affect the City. Norm Canchola replied staff would look into it and get back to the Planning Commission. Chairwoman Marantz stated her concern about the limited amount of parking spaces; only 11 parking spaces. Chairwoman Marantz opened the Public Hearing Bob Evans, representing the Movie Colony, expressed his concern that the project might be a drug rehabilitation program otherwise was in support of the project. \ } Joy Belli, Palm Springs, voiced concern about the limited amount of parking stalls. Victoria Smart, Acting Executive Director for Freedom Recovery Centers, gave an overview of treatment services to be offered. Jim Reinuth, one of the designers on the project, responded to the parking concerns and stating that the number of parking spaces have been maximized. Henry Dietz, Bloomfield Hills, MI, co-owner of property, further addressed the parking concerns. (7j There being no further comments, the Public Hearing was closed Commissioner Cohen commended the applicants on the project. M/S/C (Cohen/Roath, 4-0) to approve, subject to Conditions of Approval. 4. Case 5.1048 — CUP - An application by Southwestern Investments LLC, for a Conditional Use Permit for the operation of a Goodwill Thrift Store located at 150 South Sunrise Way, Zone C-D-N, Section 13, APN 502-161-004. Assistant Planner, Diane Bullock, gave an update of the project. She reported that on July 6, 2005, the City Council heard the staff report, did not open the public hearing and voted to send this project back to the Planning Commission for review of the use of a thrift store in the CDN zone and proper noticing to the tenants of the shopping center. She gave further details using the power -point presentation. 2 City of Palm Springs Planning Commission Minutes of July 27, 2005 Chairwoman Marantz opened the Public Hearing. James Dodson, Palm Springs, tenant at shopping center, spoke in opposition of project. Bob Evans, Palm Springs, requested more handicap parking. Lawrence ?, Palm Springs, owner of Palm Liquor, concerned about heavy traffic in the parking area. David Yerks, Palm Springs, spoke in opposition of project. Adam Zack, Palm Springs, Vice President of Jensen's Finest Foods, expressed concern about parking and felt there could be better uses for the store front. Carole Lillis, tenant in shopping center, spoke in opposition of project and concerned about the homeless problem in the area. Teresa Sivigliano, Palm Springs, spoke about the homeless problem in the area. George Shauiban, Calibasas, addressed issues regarding parking, security and the homeless problem. Craig Smith, San Fernando, Vice President of Operations for Retail at Goodwill, addressed issues regarding parking, donations, large appliances and resource center. There being no further comments, the Public Hearing was closed. Commissioners Hochanadel and Roath inquired about the drop-off areas for large appliances and furniture donations. Mr. Smith gave the Planning Commission additional information. Commissioner Hochanadel expressed his concern about the homeless problem in the area and felt this is a high -end shopping center. Chairwoman Marantz concurred with the homeless problem in the area and felt this type of business would exacerbate the situation. M/S/C (Hochanadel/Marantz, 3-1/Roath) to deny, and direct staff to prepare a resolution of denial for the August 10, 2005 Planning Commission meeting. 5. Case 5,1011 PD-299 / TTM32353 — An application by Landau Development Company, Inc., for a Tentative Tract Map and Planned Development District. The proposed project is in the Resort Overlay. The Tentative Tract Map is to subdivide approximately 0.91 acres into 4 lots of approximately 6,100 square feet, a 24 foot wide private road and approximately 900 square feet of dedicated open space. The Planned Development District is to construct 4 new single family residences of approximately 2,500 square feet each located at 260 West Vista Chino, Zone R-3, Section 3, APN 504-310-011. Interim Director of Planning Services, Norm Canchola, requested to continue project to a date uncertain and a new Public Hearing Notice will be sent out. 6. ARCHITECTURAL REVIEW: None. n City of Palm Springs Planning Commission Minutes of July 27, 2005 MISCELLANEOUS: 7. Case R-05-012: Determination by the Planning Commission that the vacation of a 119 foot long, 30-foot wide Camino Parocela right of way, located south of Ramon Road and East of Fern Canyon,Drive, adjacent to APN 513-270-007, is consistent with the City's General Plan. Principal Planner, Alex Meyerhoff, gave details of the project. M/S/C (Hochanadel/Cohen, 4-0) to approve. 8. Election of Officers - Postponed until meeting of August 10, 2005. 9. COMMISSION WORK PROGRAM: • General Plan Update — No updates. • Work Program Priorities and Subcommittee Assignments - The Architectural Advisory Committee meeting was very well attended. 10. CITY COUNCIL ACTIONS: No meeting will be held this week. 11. COMMISSION/STAFF REPORTS AND REQUESTS - Commissioner Roath commented at the previous Architectural Advisory Committee meeting there were several interesting projects coming up especially in the Section 14 area. He was pleased to see very good architecture produced at low scale. Commissioner Cohen concurred that the mixed -use project on Tahquitz Canyon was beautifully put together and well presented.
