approval of final landscape, irrigation, exterior lighting plans, identifi-
cation sign, and walls for retail/commercial/industrial complex on Gene

1. That shrub material be evaluated as to solar exposure.

CASE 5.0516 - CUP. Application by RANDY ROESCH for architectural approval of
revised elevations for a light maintenance/vehicle cleaning/administrative
office building for Roesch Bus Lines on Research Drive between Computer
Way/Farrell Drive, M-1-P Zone, Section 12.
Withdrawn by the applicant.
CASE 5.0360 TIME EXTENSION. Request by GEORGE NEWLAND for a twelve-month retro-
active time extension for the Warmington Hotel , a 192-unit hotel complex on
the southeast corner of E. Palm Canyon Drive/Camino Real , R-2/R-3 Zones,
Section 26.
Approved subject to all original conditions.

CASE 3.0259. Application by L. SANDOR for Harold Matzner for architectural
approval of revised retaining wall material and reconsideration of condi-
tions of approval for guest house addition and parking area at 555 Patencio
Road, R-1-A Zone, Section 10.
Planner (Evans) described the application and the changes that have
occurred to the plans from the original approval .
Commissioner Mills asked about the material of the other walls and was
informed that the other walls were a combination of stucco and rock facing.
Commissioner Dotson asked about the access from the parking.
Planner stated that a path to the main level of the house provides access
,.,, from the parking area.

Laszlo Sandor, project architect, spoke about the conditions originally
imposed on the Buccino plan. He indicated that those conditions were
designed to mitigate the high retaining wall which no longer exists in the
plans , therefore the mitigation may be eliminated. He felt that the
plaster wall would be more in keeping with the architecture of the project.

PUBLIC HEARINGS
CASE 5.0511-PD-201. Application by INTERCAL PSCC for a planned development
istrict for an 800 room resort hotel and a 700-unit time share project on
N. Sunrise Way between Whitewater Wash/San Rafael Drive (extension) , 0-
5/W-0-5 Zones, Section 26.
(A notice of completion and a draft Environmental Impact Report will be
considered by the Commission.)
Planner (Evans) explained the draft Environmental Impact Report and that
the Planning Commission would be taking comments on the draft. He
explained that the action before the Planning Commission is to hold a
public hearing today; and that there would an additional public hearing on
December 13 before the report and project were final .
Planner (Evans) , project developer, explained the projects location,
design, height, density, the General Plan amendment necessary for the
project, setbacks and buffers , the alignment of Sunrise Way, the traffic
and transportation issues, and the TUMF fees that the project would be
paying. He explained the Environmental Impact areas as noise, animal
habitat including the Fringe-Toed Lizard and Desert Tortoise, air quality,
scenic resources , socio-economic impacts, housing impacts and social
service impacts.
Chairman declared the hearing open.

Dale Stein /explained that the golf course proposal for the project was to
purchase the existing golf course at the Palm Springs Country Club, which
is immediately adjacent to the project, and that is in escrow at this time.
There being no further appearances; Chairman declared the hearing closed.
Commissioner Dotson asked about the need for a General Plan Amendment and
how it fit in with the General Plan cycle for the City.
Planner (Evans) indicated that the General Plan cycle was compatible with
the proposal ; and that there was a General Plan Amendment scheduled
currently with the item on the December 13 agenda .

Commissioner Dotson asked about the impact of the project on Golden Sands
and whether or not the residents had been contacted.
Planner (Evans) indicated that the notification was to the property owners
and, in the case of a project like Golden Sands, that the individual resi-
dents would not be directly noticed.
Chairman (Lapham) asked about the details of the noticing.
Planner (Evans) explained that the noticing was to all property owners
within 400 ft. and a newspaper ad. In addition the City notified those on
the list for Environmental Impact reports for the City.
No action was necessary and the case will be renoticed for a hearing on
December 13.
TRIBAL COUNCIL COMMENTS
The Notice of Completion and the Draft EIR were received at the Tribal
Office on October 23, 1989. After consideration of the recommendations of
the Indian Planning Commission, the Tribal Council took the following
actions.
1. Observed that the Draft EIR was very thorough in its analysis of the
existing and projected environmental issues , and in its discussion of
the mitigation measures.
2. Noted that the Archaeological Research Unit (UCR) found there were no
expectations of the occurrence of archaeological resources inthe sub-
ject property, therefore a cultural resources survey was not recom-
mended.
3. Found that the Draft EIR appeared to be adequate with respect to its
compliance with CEQA and City guidelines.

CASE 3.0671. Application by BEN URMSTON for Ronald Gilbreath for architectural
approval of a single-family hillside residence on Cantina Way between S.
Palm Canyon Drive/dead end, R-1-A Zone, Section 27.
Planner (Abbas) explained the restudy recommendation by the Architectural
Advisory Committee and the unusual nature of the single-family house pro-
posal .
Commissioner Hough reiterated the concerns of the AAC.
Ben Urmston, project architect, indicated that his client was concerned
about the 5 ft. additional street dedication requirement set forth by the
Engineering Department. He indicated that property on the other side of
Cantina Way could not be widened due to the toe of the mountain being at
the existing curb line. He indicated that his client had already spent
$100,000 on the development of the property including bringing up the sewer
line from S. Palm Canyon Drive.
The Planning Commission discussed the nature of the house and the nature of
the AAC recommendations.
M/S/C (Dotson/Mills; Olsen absent) recommending restudy of the house and
site plan.
CASE 3.0692. Application by CHANDULAL PATEL for architectural approval a 56-unit
hotel at N. Palm Canyon Drive/Via Escuela, C-1/R-3 Zones, Section 3.
(Commission response to written comments on draft Negative Declaration;
action.) .
Planner (Evans) reviewed the application for the 56-unit hotel .
In response to question by Commissioner Dotson, Planner reviewed the facts
as possibilities and the concern, on the part of the Planning staff, that a
driveway to Palm Canyon Drive may be a traffic problem, although the
Traffic Engineer felt that the distance was adequate to insure safe access.
Commissioner Mills agreed with restudy recommendation, as did the Chairman.
Chairman Lapham indicated various elements in the proposed building needed
to be less flattened.

CASE 3.0704( MINOR) . Application by MIKE LYNN for architectural approval of
exterior Changes to building exterior (formerly Proprietors) at 844 N.
Palm Canyon Drive, C-1 Zone, Section 10.
Planner (Evans) reviewed the proposed remodel of the commercial building
j and indicated that the AAC felt the direction was appropriate but that the
details needed to be worked out.
Commissioner Mills stated that he felt that the building was a better
statement as it was and that the proposed remodel is a poor direction.
Commissioner Dotson inquired whether or not the building has any historic
significance.
Planning Director indicated that it was not on the list at this time.
M/S/C (Dotson/Whitney; Olsen/Hough absent) recommending a restudy of the
application.
CASE 5.0459-PD-193 / CASE 3.0293. Request by BERNIE CRAWFORD to allow provisions
of a planned development district to go into effect prior to beginning of
construction of remainder of development on E1 Cielo Road between Tahquitz-
McCallum Way/Ramon Road, P Zone, Section 18.
M/S/C (Edgmon/Whitney; Mills abstained; Olsen/Hough absent) tabling item
per a 4-0 vote.
CASE 5.0507-CUP. Planning Commission discussion regarding request to extend
hours of operation of a dance studio and nightclub on Gene Autry Trail
between Vista Chino/Ramon Road, M-1 Zone, Section 12.
Planner (Goodwin) presented the request for extension of the hours of
operation at the recently approved nightclub, and that the CUP approval did
not have specific hours of operation as a condition.
Adrian Guevara, nightclub operator, indicated that he felt that there was a
need for an after hours club operation for the 18 and over age group.
M/S/C (Whitney/Hough; Olsen absent) approving by 6-0 vote for the extension
of hours of operation as requested.
CASE 5.0459-PD-193 / CASE 3.0293. Request by BERNIE CRAWFORD to allow provisions
of a planned development district to go into effect prior to beginning of

McCallum Way/Ramon Road, P Zone, Section 18.

to bring the item off the table.
Planning Director explained the request, by Bernie Crawford, to allow
planned development district #193 to go into effect at the completion of
Phase 1; that his project was previously approved as a professional
building prior to the planned development district application. He
explained that the PD anticipated the development of the larger portion of
the parcel to be under construction prior to the planned development
district taking effect, which has the affect of the C-1-AA Zoning, as
opposed to the "P" Zoning which previously existed on the property; that
was possibly confusing to the participants of the planned development
III! district. He stated that staff recommends that the Planned Development be
in effect, at this time, because of the construction that has already
taken place.
M/S/C (Hough/Mills; Lapham abstained; Olsen absent) approved by 5-0-1 vote.
COMMISSION/STAFF REPORTS OR REQUESTS.
Planning Director discussed the upcoming Joint Study Session with the City
Council and the Economic Development Commission. Joint Study Session will
be held the afternoon of November 14 to review the Downtown Plan set forth
.by Jani Productions, John Jerde Partnership. On the evening of November 21
there would be a general presentation to the overall public at the Con-
vention Center. Planning Director also indicated the upcoming General Plan
Community meetings will be held at 7:00 p.m. on Thursday, November 9 at
the Cielo Vista School and Thursday, November 16 at the Ramada Resort.
CITY COUNCIL ACTIONS. Update of City Council actions.
No report given.
