January 27, 1988 PC MINUTES Page 2 CONSENT ACTION AGENDA Approval of architectural cases is valid for two years. The approval granted must be exercised within that time period unless extended. M/S/C (Curtis/Hough) taking the following actions: CASE 3.0041 (MINOR) . Application by MAGNUM ENTERPRISES, INC. for architectural approval of awning at Tony Roma' s Restaurant, 450 S. Palm Canyon Drive, CBD Zone, Section 15. Approved subject to the following conditions: 1. That the steel posts be 32" x 32" minimum in size. 2. That the slumpstone walls have a step. 3. That the slumpstone be painted the color of the building. CASE 3.0237. Application by VITO DISTEFANO for architectural approval of final detailed landscape, irrigation and exterior lighting plans for a two unit apartment complex at 1340 Camino Amapola between Thornhill Drive/Calle Amigo, R-2 Zone, Section 23. Approved subject to the approved conditions: 1. That Melalucas be added to the west property line. 2. That Queen Palms and a Jacaranda be added to the south (front) elevation. 3. That a Jacaranda be added on the east side. 4. Sizes and location of landscaping to be as noted on the plan. CASE 3.0339 (MINOR). Application by D&A SHADE COMPANY for architectural approval of awning for restaurant (Speak Easy) at 233 E. Saturnino Road, C-1 Zone (I.L. ) , Section 14. Restudy of paint color noting the following: 1. That the color is too blue and a warmer grey tone is to be selected. 2. Awning color (burgundy) is approved. Initiation by the CITY OF PALM SPRINGS of preliminary landscape plans for the airport loop road and parking lot, Section 18. Approved subject to the following conditions: 1. That the entries be lighted. 2. That details of light fixtures be submitted. 3. That the parallel parking use 6' red zone (18-18-6, 18-18-6 etc.) 4. That tall trees such as Eucalyptus be used on the west side of the employee parking area (for shade) . 5. That a full landscape plan for the future employee lot be provided. 6. That the pedestrian crossings be highlighted with decorative or colored pavement. 7. That the southerly entrance be better defined to create smoother traffic flow. 8. That additional signs be explored for the south entrance. ITEMS REMOVED FROM THE CONSENT ACTION AGENDA Approval of architectural cases is valid for two years. Construction for architectural approval of revised architectural plans for an industrial building on Tachevah Drive/ Montalvo Way, M-1-P Zone, Section 7. Planner (Williams) presented the case on the board and stated that the AAC recommended a restudy, but that the revisions suggested were minor and the AAC after the applicant left agreed to staff' s monitoring of the condi- tions. She stated that there were AAC concerns on the north elevation, that the committee recommended an offset using the new parking standards for space and increasing the landscaping. Commissioner Hough commented that the rear of the building is visible from ,,,� - the corner and a offset would enhance the design. (Continued) Commissioner Ed mon suggested g gg painting a swatch of the base color on the building before proceeding with the painting. M/S/C (Olsen/Curtis) approving the application subject to the following conditions: 1. That the rear elevation (north) be revised to have an offset or recess along the main section of building. 2. That the new parking standards be utilized and the extra square footage be used to create the offset on the north elevation. 3. That a revised landscape plan be submitted. 4. That more landscape be added to the building corners at the north elevation. 5. That a swatch of the base color be painted on the building for staff approval before the entire building is painted. 6. That all recommendations of the Development Committee be met. CASE 3.0328. Application by CENTER BELARDO COMPANY for architectural approval of revised plans for a two story commercial building on North Palm Canyon Drive, between Alejo/Amado Roads, CBD Zone, Section 15. Planner (Williams) stated that the project has had several restudies and that the AAC on January 25 felt that the elements were still not integrated and needed refinement, that the towers did not integrate well with the building, and that the parking lot circulation is poor. She stated that the south stairwell is weak in design and that the mechanical well should be raised. She noted that the architect had made revisions after the Monday AAC meeting, which the AAC had not seen. Eric Stein, project architect, 2395 Ventura Blvd. , Calabasas, stated that he had responded to AAC concerns including parking, circulation, architectural elevations, the mechanical well , and deletion of the tile roof and replacing it with plaster. He stated that 1200 sq. ft. of retail space was sacrificed by the owner; that the entrance is now visible and more practical; that sun control has been designed; and that the building color has been lightened. Chairman stated that the revisions have improved the project except removing the tile on the upper parapet did not help the design and the tile roof should remain. The architect agreed and stated that the mechanical equipment is screened from above and would have a better proportion if raised over the current six foot height. (Continued) Planning Director stated that there is no particular height limit for the mechanical equipment, but the design should be compatible with the building, and that the height could be 6 to 7 feet. Commissioner Whitney questioned the height of the roof. Mr. Stein stated that it is 30 ft. and with equipment above would be 36 ft. Chairman stated that the height is allowable under the ordinance. Commissioner Hough stated that he dissented on the restudy motion of the AAC because he felt that the architect would revise the plan as directed by the AAC without a restudy. Chairman stated that the AAC should review the changes, especially the roof. M/S/C (Whitney/Olsen; Hough dissented) for a restudy noting the following: 1. That the towers are out of scale with the building mass and do not appear to be integral or engaged with the rest of the building. 2. Parking lot to be redesigned to eliminate the one way drive. 3. That the corridor as designed does not enhance or complement the buildings. 4. Sense of entry on Belardo is lacking. 5. South stairwell design is weak. 6. Suggest raising the mechanical well to given height (tile to remain). PUBLIC HEARINGS CASE 5.0461-GPA (Continued). Initiation by the CITY OF PALM SPRINGS of amend- ments to the General Plan Circulation Element, City-wide. (Commission ' response to written comments on Draft Negative Declaration; comments received, action. ) Planning Director stated that there had been extensive review at the January 13th Planning Commission Meeting and at the January 20th Planning Commission Study Session; that the case planner would review the public comments; that most of the recommendations were not controversial but that concentration would be on the areas of controversy; and that the Tribal Council is in concurrence except for a few locations. He recommended that the Commission take action on as much as possible, and that the items of ., controversy be continued for further review. (Continued) Planner (Evans) stated that five letters and several phone calls had been received in the Planning office regarding street plan changes. He stated that the Tribal Council opposed the deletion of Barona Road from Murray Canyon to Bogert Trail and Acanto Way as General Plan streets, feeling that the action would be premature until a circulation study is completed for the area. He stated that the Indians also opposed the extension of Mesquite and feel that the traffic does not warrant it and feel that this extension to El Cielo would impact Fairc,hilds Golf Course, and might hinder development of the property to its best use. He noted that the Indians support the extension of Alejo to the Mid-Valley Parkway and stated that a letter had been received from the City of Cathedral City which indicates general concurrence with the changes, with Cathedral City feeling that most the relationships between the two city boundaries are positive, but that Cathedral City wishes to review points of connection. He stated that Cathedral City wants trheMi d-Val ley Parkway alignment to be along Gene Autry Trail instead of along the west side of the Whitewater River as recommended by the City of Palm Springs, and suggests "concept only" be placed on any exhibits regarding the alignment until the SCAG EIR is completed. He stated that Cathedral City also requested reworking of the Airport traffic route down Ramon Road with some other road being used such as Vista Chino for Airport traffic dispersement. He stated also that the city staffs are discussing Alejo as not a major thoroughfare into Cathedral City, at Cathedral City' s request. Planner noted that a letter had been received from Mary Lawler of the Palm -- Springs Townhomes who is concerned about the proposed one-way couplet north of Vista Chino impacting a residential area. He stated that staff is reviewing options for the one-way couplet and meeting with the Redevelopment Director also to discuss the Indian Avenue/Palm Canyon corridor. Planner commented that a letter had been received from Helen Darrow, a Via Colusa Road owner opposed to a roadway section for Alejo which would reduce her buildable lot size. He noted that letter had been received from Mr. & Mrs. Darst opposing widening of Ramon Road which would require dedication and reduce the size of their residential lot on which they plan to build. He stated that calls have been received from Smoketree residents opposing the Barona Road deletion, that Jim Cornett of the Desert Museum expressed concern about the Murray Canyon Road extension, and that two informational calls had also been received. He explained that the area of most concern to the Smoketree residents is development of roadways servicing Palm Canyon through the to Smoketree property and the Indians are concerned about extension of Barona to Acanto Way (as noted previously) . He stated that Acanto Way has been deleted from the County's General Plan making the right-of-way on the City side only with a private road and easement on the County side. ..; He commented that perhaps it is the opportune time for the Indians to assist in working with the County to develop a circulation plan within Palm Canyon since the County indicates it will require improvements when January 27, 1988 PC MINUTES Page 7 PUBLIC HEARINGS (Continued) CASE 5.0461-GPA. (Continued) development occurs, but does not follow through. He stated that extending the road into Palm Hills will be difficult and expensive, and that the Murray Canyon extension is needed if development occurs in the area because it will relieve the major intersections on East Palm Canyon Drive. He noted that without this relief the intersections of Sunrise and Highway 111 will be impacted. He further -explained that the Tribal Council is also concerned about the extension of Mesquite Avenue from Compadre to El Cielo from its current terminus at Mesquite Country Club. He stated that when Fairchilds Golf Course was approved, a condition of approval was to dedicate the right-of-way for the City and that the Indians want the link deleted citing low projected traffic volumes. He stated that Mesquite would be a valuable link but that the property owner also wants it deleted. He explained that the extension of Anza to Santa Catalina would eliminate awkward intersections but is not practical because of the need to acquire four lots; and that staff would recommend leaving Santa Catalina as it is. Commissioner Curtis asked about the alignment of Mesquite relating to Fair- child's Golf Course. Planner stated that several different alignments have been proposed for Mesquite, and that the area is difficult and restrictive and requires difficult engineering solutions. He stated that if a reverse curve on Mesquite were begun at Farrell it would have been a better solution. He discussed several other alternatives at the board. Commissioner Hough asked about the conditions of the CUP for Mesquite Avenue. Planning Director explained that the CUP did not discuss the street except dedication of the roadway and improvement at City request. He stated that the City Right-of-Way Agent accepted the Indian's proposal with three years to improve the road but did not make that particular clause known to the Community Development staff, and that the Fairchild's CUP is only valid with that requirement and could be revoked, but that the property is Indian land and the Indians could remove it from the General Plan and approve the Fairchild's CUP without the street going through. He stated that the applicant has been discussing building a hotel on the prop- erty for ten years and that the final authority lies with the Indians. Commissioner Curtis asked if Compadre and Sonora will be built out. Planning Director stated that half of Compadre would be in the Fairchilds project, but that it does not replace Mesquite. He stated that the CUP condition for Fairchild's is clear. Commissioner Whitney asked if there were any letters on Ramon Road west. Planner replied that there was one letter in support of a reduced section. Chairman declared the hearing open. Paul Selzer, attorney representing Smoketree Ranch property owners, spoke in opposition to deletion of the Barona/Bogert Trail extension and the retention of the Barona/Murray Canyon extension. He gave alternatives that should be considered as follows: 1. Deletion of Murray Canyon extension entirely and retaining the Barona Road extension on the other side of the wash, because if there is January 27, 1988 PC MINUTES Page 8 PUBLIC HEARINGS (Continued) CASE 5.0461-GPA. (Continued) development in the canyon, Murray Canyon development will bring traffic back to the Palm Canyon/Murray Canyon intersection. He stated also that Murray Canyon interfers with the natural wildlife- populated open space in the City. 2. Barona Road and Murray Canyon both deleted from circulation plan. They can be put back on later and builders and the County will have to solve the problem. 3. Leave both on the plan and reduce Murray Canyon to two lanes. 4. Mr. Selzer stated that Smoketree Ranch owns parts of two sections on the other side and would be involved in the construction of the road which could be dedicated to the City, and if more development occurs the people causing the problem should pay for it, and the County and the City should have an assessment fee for this. Mr. Selzer stated that the first three alternatives serve the interests of the City best and help to alleviate street problems, and that the current proposal does not solve the problem. Commissioner Hough asked why both plans should remain with the reduction of Murray Canyon to two lanes. Mr. Selzer answered that the County and developers would have to deal with the City of Palm Springs which would then make the County understand the problems and also would give the City some ammunition. Commissioner Curtis stated that Acanto Way to Barona is mountain property, is not visible, and it does not matter who deeds it. Planning Director stated that it would be Barona not Acanto which was on the plan and the residents of Smoketree and the Tribal Council oppose it. He stated that staff recommended taking it off the plan and this was reversed pre- viously by the Commission, and the Council leaving the road on the south side of . the wash. He stated that a developer wanted to build houses on fourteen lots on the east side of the saddle and the Council denied the application. He stated that staff is recommending that it be taken off the General Plan and stated that the City cannot obtain current grant funds but the responsibilities should be on the people creating the problem of having to put in a roadway. He stated that the County does not want to solve the problem; but that the Andreas Cove Country Club would be required by the .County to solve it, which would be optimistic at best. He stated that the staff has discussed transportation development fees such as $1200 per unit to improve the roadway system but this has not been implemented. Mr. Selzer commented that by removing the Barona Road extension, no one will have to do anything, including the County; but if the roadway remains on the plan, there is a tool to force the County to make developers pay for streets. He stated that otherwise the people living in the area have the burden. January 27, 1988 PC MINUTES Page 9 PUBLIC HEARINGS (Continued) CASE 5.0461-GPA. (Continued) Commissioner Neel stated that it is premature to take action on either street and that they should remain on the General Plan Street Plan. Chair- man commented that nothing will happen until the Commission has positive answers to problems. Joan Taylor, 1800 S. Sunrise Way, stated that she attended the hearing when Barona was recommended to be taken off the plan, but that the Commission decided that there should be another link to Murray Canyon and the mountain, and the road was not deleted and the Council agreed. Jim Cornett, Curator of Natural Sciences at the Desert Museum, requested that Murray Canyon not be extended through Smoketree, because the museum is studying the wildlife in Smoketree Ranch and the extension would destroy the existing environment and the work would have to be abandoned. He sug- gested an alternate route and stated that the area has desert animals that are unaffected by development around them, and there is no other such place in Palm Springs. He stated that studying the physiology of the desert animals and how they adapt to the environment is important, and the fact that they live in the Smoketree Ranch area saves time and money in studying them. Planning Director stated that leaving the streets on the plan would not affect the research; he asked the length of time of the study. Mr. Cornett explained that it would be seven years and the value of the area as a habitat would be even more valuable after the study is completed. He stated that in response to Commissioner Whitney's question that it is a local project. Gager Vaughn, president of Smoketree, stated that it would be a shame to have the road go through the property since the property will be kept as a sanctuary for 25 more years, and a road would ruin the area for the home- owners and the animals. He stated that the area is desert habitat pre- served as it was years ago in the desert, and invited the Commissioners to visit the ranch. There being no further appearances, Chairman closed the hearing. Chairman asked direction for Commission action. Planner stated that the South Palm Canyon area, the Mesquite Avenue crossing through Fairchild's Golf Course and alternatives to the one-way couplet could be extracted from the amendment and discussed further (with the remainder of the changes to continue processing) . Commissioner Whitney suggested delaying the entire action until all ele- ments are reviewed since one street change may effect another. Chairman asked about impacts. Planner stated that Mesquite may service the east to west corridor because the City is depending on Mesquite for four lanes of traffic which could affect other areas, but that the South Palm Canyon changes would not affect the entire plan, although it could be dis- cussed further. He stated that complete data could be brought before January 27, 1988 PC MINUTES Page 10 PUBLIC HEARINGS (Continued) CASE 5.0461-GPA. (Continued) the Commission; and that the other areas could stand on their own except for Mesquite, as noted previously. Commissioner Hough asked if delay would delay projects. Planner stated that there are major projects on Gene Autry Trail for which an additional five feet of right-of-way is needed. He noted that it would be best to have the right-of-way consistent with the proposed General Plan. He stated that the information could be gathered for the next meeting. Commissioner Olsen asked about discussing the bottleneck on Alejo between Via Miraleste and Indian. Planning Director stated that the location is an appropriate matter of concern. M/S/C (Neel/Whitney) continuing the amendments to February 10. Note: Special Study Session on the Items of Concern. Commission consensus was that a study session and possibly a field trip should be scheduled by staff with Commissioners apprised of the date, time and place. TRIBAL COUNCIL COFMENTS In keeping with its policy of reviewing those land use cases which are city-wide in nature, this case was considered by the Tribal Council from the standpoint of its potential impact on developed and undeveloped Indian ti... trust lands as well as on fee lands. After consideration of the recommendations of those members of the Indian Planning Commission who were present at the Commission's meeting of January 25, 1988, the Tribal Council took the following actions: 1. Concurred with the filing of a Negative Declaration. 2. Concurred with the proposals contained in City Planning Department Staff Report dated December 9, 1987, to upgrade the right-of-way and/or capacity of those General Plan Streets listed in Table 1. 3. Concurred with the proposals contained in staff report of December 9 to downgrade the right-of-way and/or capacity of those General Plan Streets listed in Table 2. 4. Concurred with establishment of Mid-Valley Parkway and favored the alignment that follows the west bank of the Whitewater River, with the alignment being subject to further review upon completion of the detailed study and environmental impact report referenced in staff report. The Tribal Council had objected to the deletion of that por- tion of the "Highway 111 Bypass" southerly of Gene Autry Trail when that action was taken some years ago. It is timely that action be taken to re-establish a Highway 111 Bypass. Concurred with the extension of Alejo Road to Mid-Valley Parkway which would provide for 4 continuous East-West Corridors on a con- ventional one-mile grid, i .e. , Vista Chino, Alejo Road, Ramon Road and East Palm Canyon Drive. Strongly objected to the proposal to delete Barona Road (Murray Canyon Drive to Bogert Trail ) and Acanto Road (South Palm Canyon to East End) as General Plan Streets. This action would be premature and inappropriate until such time as a comprehensive access/circula- tion study for the Palm Canyon/Palm Hills Areas has been completed. Strongly recommended that Mesquite Avenue (Farrell Drive to El Cielo Road) be deleted as a General Plan Street. The extension of Mesquite Avenue from its present terminus a sort distance easterly of Farrell Drive to E1 Cielo Road would severely impact an existing quality development located on Indian trust land, and would further be a major constraint on the potential development/redevelopment of this property to its ultimate highest and best use. The JHK Study Projects an ADT of 6,000 on this Section of Mesquite Avenue at full build-out scenario, With the proposed upgrading of Ramon Road and East Palm Canyon Drive, which are approximately one-half mile North and South, respectively, of Mesquite Avenue, the projected traffic volume for this section of Mesquite Avenue could be readily absorbed by these major East-West Corridors. PUBLIC COMMENTS Don Frank, 550 N. Cahuilla Road, stated that the General Plan was prepared 20 years ago and should be revised for a Master Plan that everyone under- stands; and that the General Plan Circulation Plan should be held until the master plan is finished. He stated that perhaps a moratorium should be put in place and that people do not feel that they are involved with regula- tions of the City. Chairman stated that the City publishes development and revisions to city documents in the Desert Sun regularly, and few come to the meetings. He stated that the Commission wants input, but that everybody complains after the development occurs which is frustrating. Planning Director stated that he would contact Mr. Frank to discuss a General Plan update (which has been a priority) but that there have been no changes in the direction of the City - only refinement of development standards. He stated that Mr. Frank has been involved in city issues lately. ITEMS REMOVED FROM THE CONSENT ACTION AGENDA (Continued) CASE 5.0437-PD-187. Application by KAPTUR AND CIOFFI for Motel 6 Inc. for archi- tectural approval of final development plans for a 150 unit hotel on South Palm Canyon Drive between Camino Parocela/Sunny Dunes Road, PD 187, Section 23. Planning Director stated that there have been changes to the site plan on which the Traffic Engineer has not commented, and that there are signifi- cant changes to the site plan as it relates to traffic circulation and open space. (Continued) Planner, (Williams) described the thirteen foot fall on the site, stated that landscaping will be increased on the Chia frontage; and that the building has shifted to the east, modifying the entrance driveway and creating a retaining wall condition at the back of Building "C". She stated that the Traffic Engineer has concerns about the driveway shifting toward the corner and that a right turn in and out on the driveway was designed with a median island, but that Caltrans wants it removed and the design will allow, left turns. She stated also that the parking lot has become steeper, there is less stacking room, the trash enclosure has been shifted, and cooling will be by a chiller on the south property line. She stated that the preliminary plans did not show a chiller at all; and that the structure is 9 ft. high and has no screening. She stated that the AAC reviewed the site plans and architecture and felt comfortable with both and left the signing for staff to review. She stated that the landscape plans were not reviewed and continuance is recommended because of one abstention and one absence of the landscape architects on the AAC. She noted that the intersection is being redesigned and final development plans will not be sent to Council until the intersection problem is resolved. Commissioner Curtis asked reasons for the driveway deletion on Parocela. Hugh Kaptur, Tahquitz Way, project architect, stated that at the approval of the Planned Development District the Commission and AAC recommended that additional landscaping be placed at the back of the project for an increased buffer between the project and the residential area to the rear; and that the project was moved forward 10 feet, bringing the driveway 10 feet closer to the intersection and also reducing stacking space 10 feet. He stated that retaining walls on the back between the buildings and the parking areas were necessary because it was necessary for the buildings to be on one pad instead of stepping them. He stated also that the handi- capped ramps on the original plan were too long and cars would bottom out on the transition between the street and the ramps, so the entrance was eliminated. He stated that staff and the applicant agreed to this, and that was the reason the rear entrance to the property was lost, which was more of a convenience rather than a necessity. He stated the Motel 6 has two mechanical air conditioning systems - window units and chilled water, and since window units are not acceptable in Palm Springs the client decided to use a chilled water system which placed the structure on the ground behind the gas station, but that it is screened and not visible. He stated that the chiller is caged on the top and sides to eliminate vandalism; that he would work with staff on the location; that he would like the applicant, Mr. Fogerty, to speak to traffic problems on the high- way; that the intersection will be signalized. He explained that the curb island was originally approved by Caltrans, and he did not know why the agency changed its decision. He noted that the building has been lowered with a view to a well-landscaped pool area, and that as many negatives have been removed as possible. Pete Fogerty, 84206 Coral Ridge, Tucson, Arizona, stated that the traffic access to Palm Canyon has been designed with the aid of the Traffic Engineer and Caltrans approved it and that the redesign of the transition was also approved by Caltrans. He stated that Caltrans has recognized the fact and moving the building forward was a relief to traffic since the driveway will be aligned with Indian Avenue making left turns difficult. Planning Director stated that the building has only shifted slightly, but the driveway location has changed and that the Traffic Engineers concern can be resolved at staff level . He stated that the turning area can be less restrictive by taking extra parking space and changing the configuration of the circulation plan. Commissioner Olsen commented that he was disappointed that the building had been moved forward 10 feet toward the street because the larger setback allowed increased landscaping.
