Chairman called the meeting to order at 1:30 p.m.

Approval of architectural cases is valid for two years. The approval granted

CASE 3.702. Application by KAPTUR & CIOFFI for Peri-Mel 1 for architectural
approval of screening of florescent light fixtures for 118 unit
condominium project on Avenida Caballeros between Arenas Road and
Saturmino Road, R-4 Zone (I.L.), Section 14.
Continued to December 9 for field trip by the AAC.
CASE 3.785. Application by RICHARD EHRLICH for architectural approval of
revised plans for entry gates for 134 unit apartment project located
between East Palm Canyon Drive/Avery/Compadre, R-3 Zone, Section 24.
Restudy noting the following: :
1. That a stepped masonry wall be used in place of the fixed panels.
2. That a square bar stock with radius corners is an acceptable gate
frame with round pickets.
3. That a detailed street elevation be presented, including adjacent
building.
CASE 3.0204 (MINOR)/3.343. Application by ROBERT CHEROSKE for architectural
approval of existing building color for single family hillside residence
at 575 N. Patencio Road, R-1-A Zone, Section 10.
Removed from the agenda (color of paint on the building is as approved by
the Planning Commission).
CASE 3.0205 (MINOR). Application by ROBERT WEITHORN for architectural approval
of stucco of slumpstone wall and color for Orchid Tree Hotel , 261 S.
Belardo, R-3 Zone, Section 15.
Approved subject to the following conditions:
1. That cap of pool enclosure wall be removed and that wall be stucco to
match finish (texture) and color of cottages.
2. That garden walls be painted or stained or mortar wash applied and
painted to match the color of cottages.

CASE 3.0318 (MINOR). Application by EXPRESS GAS for architectural approval of
revised building color and revised sign for service station at 2901 N.
Palm Canyon Drive, U-R Zone, Section 3.

CASE 3.0324 (MINOR) . Application by CHRISTOPHER MILLS for architectural
approval of revision to existing stone wall to allow mounting of brass
letters for Liebling Building on the northeast corner of Tahquitz Way/N.
Palm Canyon, C-B-D Zone, Section 15.
Approved as submitted.
CASE 5.0424-CUP. Application by the MARRIOTT CORP. for architectural
approval of revised detailed landscape and irrigation and exterior
lighting plans and a main identification sign for a 149 unit hotel on
the east side of Hermosa Drive/Tahquitz Way/Andreas Drive, R-4-VP/C-1-AA
Zones (I.L. ), Section 14.

CASE 7.675-AMM. Application by TOM DOCZI for architectural approval of final
detailed landscape, irrigation, and exterior lighting plans for a single
family residence at 690 Stevens Road, R-1-A Zone, Section 11.
Restudy noting the following: That a cutout in the driveway be provided
for landscaping per original conditions.

CASE 3.0277 (Continued). Application by SCOTT DORIUS for architectural
approval of revised plans for mini-storage building on Gene Autry Trail
between East Palm Canyon Drive/Palm Canyon Drive, M-1 Zone (I.L. ),
Section 20.
Planner (VanKeeken) described the revised plans with the Commission at
the board. She stated that the AAC recommended landscape and site plan

approval but a restudy of the managers unit. Commissioner Olsen
commented that the managers unit is a step backward in its design and
questioned whether or not the project should be approved since the
project was the catalyst for the scenic corridor revisions.
Planning Director stated that the application could be approved because
the City Council had not finally endorsed the corridor zoning concept
and the project use is currently by right of zone. He stated that the
City Attorney recommends that the project not be denied because of its
use and stated that it can be re-evaluated at the building permit stage
if the Council endorses the scenic corridor zoning revisions.
Assistant City Attorney stated that whatever approval was given would be
for the architectural issues and would not address whether or not the
project should go forward. He stated that if the architecture were
approved the application would be finished and that it does not matter
if it is continued or action on the architecture taken.
Commissioner Olsen reiterated that the architecture is not appropriate
on a scenic corridor.
Commissioner Hough suggested a restudy of the manager's unit.
Commissioner Neel stated that the landscaping is adequate and that staff
and the applicant can resolve the architectural issues.
Vice-Chairman stated that he did not like the large number of windows,
but that the landscaping has been increased and hides the project. He
asked about staff concerns over the number of trees inside the project.
Planning Director stated that he had discussed the landscaping with the
applicants and thought that trees should be added to the middle row of
buildings but the Fire Department has requirements that prevent the
addition of trees but that the applicants will meet with staff to review
this possibility.
Vice-Chairman commented that the wall is sterile in appearance and
questioned whether or not there is any offset in the wall .
Planning Director stated that the wall has offsets and is split faced
block with a fluted block outline.

plan subject to the following conditions:
1. Site plan and landscape plan: That the entry gate be on inside of
wall .
2. Restudy of managers unit noting:

PUBLIC HEARINGS
CASE 5.0400-ZTA (Continued). PLANNING COMMISSION review of M-1 provisions on
scenic corridors for inclusion in the Zoning Ordinance.
(An Environmental Assessment/Initial Study has been previously
considered and a Negative Declaration filed on the original zoning text
amendments. )
Planning Director stated that the Commission passed a series of
revisions to the Zoning Ordinance and gave verbal direction that mini-
warehouses in M-1 Zones be by CUP application and that staff recommends
eliminating the uses in conflict with the general direction on the M-1
Zoning given by the Commission. He stated that Part I of the revisions
addresses all lots in the M-1 Zone and Part II addresses lots not
located within two hundred feet of a scenic corridor. He recommended
continuance to December 9 so that a Commission subcommittee can review
the revisions, because the revisions will involve Indian lands and the
Tribal Council consultant was told that the case would be continued and also
because the revisions are no different from those staff recommended in
1981, which were viewed by the Tribal Council as too restrictive. He
stated that the revisions may have to be refined.
Vice-Chairman declared the hearing open; there being no appearances the
hearing was closed.
Vice-Chairman selected Commissioners Edgmon and Hough as representatives
to review the M-1 revisions with staff.
M/S/C (Olsen/Neel ; Lapham absent) continuing the amendments to the
Zoning Ordinance to December 9.
Vice-Chairman commented that the Commission supports staff's direction
on the revisions.
CASE 5.0453-PD-192 (Continued) . Application by BOGIE ROAD DEVELOPMENT for a
Planned Development District to allow construction of a commercial
development, multi-family residential apartments, and office complex at
the southeast corner of Gene Autry Trail/Vista Chino, M-I-P/W-M-IP Zone,
Section 7.
Planning Director stated that the Commission has the option to remove
the application from the agenda for a General Plan amendment study or to
deny the project as inconsistent with the General Plan; and that the
Commission has indicated that the project is acceptable and would bring
vitality to

the area. He stated that staff's recommendation would be to study the
General Plan regarding the residential use and defer the study on the
industrial portion. He stated that a question would be whether or not
to leave the industrial on the General Plan and work around it or to
develop a new designation or a method to insure compatibility of the
project.
Vice-Chairman declared the hearing open.
James Prock, 5942 La Place Court, Carlsbad, the applicant stated that he
had no further suggestions and that any option which would address the
industrial portion and give flexibility to the use if industrial is
eliminated would be acceptable. He stated that a redesignation to
expand the residential portion or development of a commercial element
consistent with the development that is occurring around it would also
be acceptable, but that leaving industrial zoning on the property would
allow no flexibility and leave the project in limbo. He stated that a
designed mixed use project is desirable and requested that the twenty-
nine acres of industrial be included in the General Plan. He stated
that a resort hotel or residential zone would be satisfactory for those
acres.
Planning Director stated that the present zoning is 0-5 on the adjoining
property which allows residential development at 3.5 units per acre and
that the study may have to be expanded beyond the project site to make
uses on the property compatible with the area. He stated that the
prop-
erty further south is M-I-P and all the properties next to the subject
.proposal are 0-5. He stated that there would be retention of flood
waters on the 29 acres whether or not it was zoned industrial, the other
acres would develop around the 29 acre site, and that an assessment
district is being formed, probably within two months. He stated that
the commercial uses would require a CUP and the residential section
would require a General Plan Amendment, and that the commercial uses
could be placed on the 29 industrial acres under a Planned Development
District, that a palette of resort uses cwould be developed and perhaps
a new General Plan designation for the southern tip of the property
could be developed, (perhaps "resort") but probably not residential or
hotel or apartment zoning because there should not be a corridor of high
density nor resort commercial development along the corridor.
Mr. Prock suggested commercial under a CUP on the north portion of the
property and stated that the most desirable land uses could be addressed
later.
Planning Director stated that staff' s recommendation would be "resort
commercial" "or neighborhood shopping center" to eliminate industrial
park uses on both sides of a residential area.

agenda pending a General Plan study per staff recommendations.

CASE 5.0454-CUP (Ref. Case 3.0260) Continued. Application by LASZLO SANDOR for
Harold Matzner for a conditional use permit to allow construction of a
tennis court with substandard setbacks on Crescent Drive/Patencio Road/R-1-
A Zone, Section 10.
(This action is categorically exempt from Environmental Assessment per CEQA
guidelines. )
Planning Director stated that the applicant has submitted a plan that
improves the aesthetics of the parking although the Commission recommended
no parking within the setbacks.
Vice-Chairman declared the hearing open.
Laszlo Sandor, project architect, Indian Wells, stated that the plan has
addressed the concerns of the neighbors; that the tennis court is sunken
four feet; that a compatible masonry wall of the same height as the
neighboring wall has been designed, and one parking space has been
eliminated. He stated that the driveway entrance has been shifted and
mounding and decorative paving added; that the driveway was not eliminated
since the client needs it because of no other parking, and that the project
meets setback requirements by averaging setbacks.
There being no further appearances, Vice-Chairman declared the hearing
closed.
Mr. Sandor stated that the landscaping has been removed from the north side
of the court because the area faces a neighbor's service yard and a wall
and is not visible from any angle and is compatible with the desert in its
present state.
M/S/C (Olsen/Edgmon; Lapham absent) approving CUP 5.0454 based on the
following findings and subject to the following conditions:
Findings
1. That the southerly portion of the site contains a steep hillside
which restricts the available area for construction of a tennis
court.
2. That the lot is narrower than specified in the R-1-A section of the
Zoning Ordinance.
3. That a tennis court which intrudes into the setbacks can be con-
sidered under a CUP.
4. That the tennis court is accessory to a residential lot and as such
is necessary and desirable for the development of the community and
is in harmony with the General Plan, and as conditioned is not
detrimental to existing or future uses in the zone.
5. That the site is adequate in size and shape to accommodate the use,
including yards and setbacks and walls or fences, landscaping and

other features to adjust the use to existing or future uses in the
neighborhood.
Conditions
1. That detailed landscaping plans be submitted prior to issuance of a
grading permit.
2. That this approval does not include illumination of the court, which
is prohibited by the Zoning Ordinance.
3. That all recommendations of the Development Committee be met.
4. That final detailed landscape, exterior lighting, and irrigation
plans be submitted.
TPM 22406 (Continued) . Application by HACKER ENGINEERING COMPANY INC, for John
Rocca for tentative parcel map to subdivide property into thirteen lots for
residential purposes at Morongo Trail/Araby Drive, R-1-B Zone, Section 25.
(Commission response to written comments on Draft Negative Declaration;
action. )
Planning Director stated that the subdivision is unusual, that the rear
property lines on some of the lots are the streets for the rest of the
properties, and that the AAC recommended approval to be subject to land-
scaping and maintenance (with a landscape plan to be submitted and a means
to maintain it), and that the applicants have submitted a revised plan for
overall landscaping for which the AAC recommended approval . He stated that
the applicant agrees to the landscaping revisions but is voicing concern
over the private maintenance requirement, feeling that a homeowners
association for such a small project would be a detriment and is requesting
a maintenance district. He stated that a maintenance district would be
possible for the landscaping but not for the private streets and the appli-
cation needs to be continued for development of a mechanism to accomplish
the desired maintenance6redesign of the project.
Vice-Chairman declared the hearing open.
Rhonda Cress, 15342 Hawthorn Blvd. , Lawndale, representing the applicant,
stated that the applicant does not want a homeowners association and
requested that street maintenance be addressed some other way.
Planning Director stated that no private streets have been maintained with
maintenance agreements in the City, that staff feels that a homeowners
association is necessary but would be willing to explore other
possibilities; and that research is needed to determine whether or not a
public street would take too much right-of-way from the lots and affect
them negatively.

Ms. Cress stated that the property lines are as tight as they can be pre-
sently, and that the streets cannot be widened to make public streets.
Planning Director stated that more research is needed and the problem
should be resolved at the December 9 meeting. He stated that the sidewalk
requirement is a standard one for any subdivision but that the Commission
could review the area and determine whether or not the sidewalk requirement
should be waived.
Ms. Cress suggested landscaping to the curb and Planning Director stated
that it could be discussed.
Assistant City Attorney stated that without a homeowners association there
is a problem in ownership of the private streets since someone has to own
them.
Planning Director stated that the private streets could be owned by the
people individually by easements.
There being no further appearances, Vice-Chairman closed the hearing.

application to December 9 for further review.
PUBLIC COMMENTS - None.
MISCELLANEOUS ITEMS
TIME EXTENSION - TTM 19447. Request by SANBORN/WEBB ENGINEERING for Tim Binder
for a twelve-month time extension for a 1 lot subdivision to create a 40
unit residential condominium complex on N. Indian Avenue east of Zanjero
Road, north of Racquet Club Road, R-2 Zone, Section 3.
M/S/C (Olsen/Neel; Lapham absent) approving a twelve-month time extension
for TTM 19447 subject to all original conditions of approval . (New
expiration date will be December 21, 1988. )
CITY COUNCIL ACTIONS. Update of City Council actions.
CASE 3.0272 (Voss Investments) . Appeal was heard by the Council and case
was approved; applicants are discussing withdrawing and redesigning the
project since it is controversial and over budget. Project will be
reviewed later by the Commission.
- CASE 5.0344-PD-164 (Convention Center) . Tours will be conducted through
the convention center around December 15 and Commission will be invited.
There will be a nationally televised New Year' s Eve Party, on December 31.

CITY COUNCIL ACTIONS. (Continued)
Commissioner Curtis stated that the high school rented the Convention
Center for its 50th year reunion and later was told that they could not
have the facility because of an series of IBM conferences. Planning
Director stated that negotiations are underway regarding this, and that
Council may decide to form a Convention Center Commission, although it is
not required to by law.
CASE 5.0453-PD-192. Commissioner Whitney asked if a retention pond next to
commercial or residential development were unusual . Planning Director
stated that it should not be a problem.
CASE 3.758-Dead Palm Trees ' . Planning Director stated that the applicants
are waiting until electrical lines are undergrounded before replacing the
eight dead palm trees.
- AWNING MAINTENANCE PROGRAM. Commissioner Edgmon stated that a maintenance
and placement program should be developed for awnings through the ordinance
if necessary. Commissioner Whitney stated the best solution would be not
to approve any more. Planning Director stated that was the approach for
many years but awnings are popular with pedestrians, are liked by people,
and are an architectural bandage.
