Approved subject to the following condition: That masonite be used for a four foot high screen on a steel frame with the screen to be painted white to match the building (details to be reviewed by staff). Commissioner Olsen arrived. • ITEMS REMOVED FORM CONSENT ACTION AGENDA CASE 3.0064 (MINOR) . Application by CITY OF PALM SPRINGS for architectural approval of revised plans (addition to pro shop) at the Municipal Golf Course, 1885 Golf Club Drive, 0 Zone, Section 29. Planner (Williams) stated that the bids for the addition were higher than anticipated; that four alternates to the originally approved design were submitted; and that either the trellis, the rock veneer, the land- scaping, or the tile would be deleted depending on the new bid costs. Planning Director stated that private developers are also given the opportunity for alternatives but not necessarily approval ; that if all the alternates on the subject project were removed, the application should be denied; that the trellis and the rock veneer should remain, although the rock veneer could be replaced with stucco if the Commission so desires; and that the planter should stay and if necessary the landscape phased. Chairman suggested that the building be left the way it is until money is available. Planning Director stated that the Council may want to complete the building although AAC and Planning Commission recommendations will be noted to the Council . M/S/C (Hough/Whitney; Neel/Lapham dissented) approving modifications to . the originally approved plan but retaining the trellis, rock veneer, and landscape area. M/S/C (Whitney/Neel ) tabling the two items for the applicants to be in attendance. MISCELLANEOUS ITEMS TIME EXTENSION - CASE 5.0231-PD-139. Request by CHRIS MILLS for Stanley Broxmeyer for a twelve-month time extension for a Planned Development District to allow construction of an affordable housing project between North Palm Canyon Drive/Gateway Drive/extension of Tramview Road, R-1-C Zone, Section 34. M/S/C (Curtis/Neel ) approving a twelve-month time extension (new expiration date - February 2, 1988) , subject to the original conditions • of approval . NB: Commissioner Olsen who originally dissented on the motion, feeling that projects that were approved several years ago should be reviewed per current standards, stated that since the subject Planned Development District is preliminary, he would change his vote to "AYE" since the final development plans would be coming to the Commission for review. Planning Director added that in the future staff reports would include more background information so that new Commissioners can evaluate projects they have not seen before. TIME EXTENSION - CASE 5.0360-PD-170. Request by ROBERT P. WARMINGTON COMPANY for a twelve-month time extension for a Planned Development District to allow construction of a 195 unit hotel on E. Palm Canyon Drive between Camino Real/Arginlla, R-2/R-3 Zones, Section 26. Planner (Williams) stated that the applicants are requesting a second time extension to finish some internal procedure. M/S/C (Olsen/Edgmon) approving a twelve-month time extension for PD-170 (new expiration date - May 6, 1988) subject to all original conditions of approval . April 22, 1987 PC MINUTES Page 6 PUBLIC HEARINGS CASE 5.0401-MISC. (CONTINUED) . Initiation by the CITY OF PALM SPRINGS for • revisions for local guidelines relating to objectives, criteria and pro- cedures for the implementation of the California Environmental Quality Act (CEQA) pertaining to the Environmental Evaluation of Public and private activities and the preparation of environmental documents. (This item is categorically exempt from Environmental Assessment per CEQA guidelines. ) Planning Director recommended continuance for finalization of the delineation between ministerial and discretionary projects since the delineation determines the level of environmental review. Chairman declared the hearing open; there being no appearances, the hearing was closed. M/S/C (Curtis/Neel ) continuing the application to May 13. CASE 5.0430-CUP & TPM 21981 (CONTINUED) . Application by RALPH HITCHCOCK for Southern California Edison for a conditional use permit and tentative parcel map to allow construction of electrical substation on Sunny Dunes Road and Calle Amigos/Thornhill Road, R-1-C Zone, Section 23. (Commission response to written comments on Draft Negative Declaration; • final approval . No comments received. ) Recommendation: That the Commission order the filing of a Negative Declaration and give final approval subject to conditions to CUP 5.0430 and Tentative Parcel Map 21981. Planner (Williams) stated that the applicant has submitted a new rendering and site plan showing modifications to the wall , the material of which was a concern to the Commission at the April 8 meeting; that the new proposal shows the Calle Amigos frontage and is of metal painted tan and broken by pilasters matching the adjoining concrete wall ; that the AAC has not seen either the changes to the wall or landscaping, which now has Carobs, Bottletrees and California Fan Palms and with the Date Palms originally proposed deleted. Chairman declared the hearing open. Ralph Hitchcock, Southern California Edison, 1700 E. Tahquitz-McCallum, explained that the pilasters break up the long wall and that the plans would be reviewed by staff for consistency. Planning Director stated that the landscaping is preliminary and details can be reviewed further; and that the pilasters should break below the wall to reduce its massiveness. • There being no further appearances the hearing was closed. April 22, 1987 PC MINUTES Page 7 PUBLIC HEARINGS CASE 5.0430-CUP/TPM 21981 (Continued) • M/S/C (Curtis/Neel ) ordering the filing of a Negative Declaration and approving CUP 5.0430 and TPM 21981 based on the following findings and subject to the following conditions: Findings 1. That a conditional use permit and tentative parcel map are appro- priate applications for the proposed use. 2. That the site is sufficient in size and shape to accommodate the proposed use. 3. That the proposed use does not conflict with the General Plan. 4. That the proposed use is not detrimental to the surrounding land uses or neighborhood. Conditions 1 . That the Development Committee Conditions of March 31, 1987 shall apply. 2. That the revised landscape plans submitted to the Commission on April 22 be reviewed further by the Commission, noting that the • AAC recommends that date palms be substituted with another species and that canopy trees of varied heights encouraged. 3. That the wall plan submitted to the Commission of April 22 be reviewed by the AAC and Commission. ITEMS REMOVED FORM CONSENT ACTION AGENDA (Continued) SIGN APPLICATION (Continued) . Application by FORTUNE SIGNS for Chen Ling Restaurant for architectural approval for revised main identification signs for restaurant at 787 N. Palm Canyon Drive, C-1 Zone, Section 10. M/S/C (Whitney/Neel ) removing the Chen Ling sign application and Case 3.0205 from the table. Planning Director stated that staff is uncomfortable with the application; that the AAC recommended a restudy and suggested a monument sign for the restaurant (which is part of a complex divided by a drive- way at the signalized intersection of North Palm Canyon and Tamarisk) ; that the applicants have already constructed the signs as they were previously submitted and restudied; that they are requesting two signs although one frontage is on an alley and signing is not allowed by Ordinance; that the alley sign could be allowed if there were no sign on the street side; that there are significant problems in signing the . building because of recessed design. He stated that the applicants thought they could erect the sign because only a few details were left -April 22, 1987 PC MINUTES Page 8 ITEMS REMOVED FORM CONSENT ACTION AGENDA (Continued) SIGN APPLICATION. (Continued) • to be resolved; that staff requested that the sign be raised by a crane and held for a photograph so the placement could be reviewed before installation; that staff recommends no signing on the north side (con- sistent with the ordinance) ; that the sign on the fascia should be reviewed in an architectural sense; that if the Commission allows the sign on the fascia, the raceway should be located behind the fascia; and that staff would encourage a monument sign in the existing planter in front of the restaurant although it encroaches into the right-of-way. He stated that perhaps the corner sign could be adapted to a pedestrian convenience sign with one major sign centered on the Palm Canyon side; that staff could find out if there are traffic sensors in the driveway at the signal lighted intersection; and that the current black and white sign would be removed if a new sign is allowed. Chairman stated that he had driven by the restaurant and had seen the signs installed and wondered why the restaurant frontage facing the signal lights intersection is not considered street frontage. Planning Director stated that there are problems if signage is allowed when signalization is used as the criteria and that in a similar situation in the Sun Center the Wherehouse was granted a second sign; that an appli- cant often requests signs on a driveway, but if a sign variance were granted for the subject sign, the sign should not be as close to Palm Canyon but moved back. . Mickey Wu, Fortune Sign Company, E1 Monte, stated that staff suggested a monument sign, but locating it in the planter would be difficult. Planning Director stated that an encroachment permit could be issued if a monument sign in the planter were allowed (perpendicular to Palm Canyon, double-faced, and facing Palm Canyon) , but the sign should be redesigned so that it does not crowd the edge of Palm Canyon and is integrated with the building and landscaping; that the size could be 4 x 5 x 4 feet (in height) , that Zoning Enforcement staff reviewed the sign and did not encourage a monument sign because of its location in the right-of-way; and that no sign has been approved by staff. Commissioner Curtis asked why the sign was built if it was never approved. Planning Director stated that there was miscommunication and misunderstanding on what was to be submitted; that staff did not know the sign was being built; that the applicant wanted to erect the sign quickly; that the applicant made the assumption in error that only details needed to be resolved; and that the raceway and colors were never approved. He stated that staff was uncomfortable with the inte- gration with the architecture. Mr. Wu stated that staff opinion and direction was followed; that although he had been told that 14 inch letters were allowable, staff later informed him that the height must be changed to 12 inches; that • the rust color was changed to red-orange by the applicant; that he was urged by the applicant to finish the sign before the season ended; and that the sign will not be erected without permits, but only placed in its location for picture taking and is now in Los Angeles. (Continued) • that it can be integrated with the monument sign with some adjustment; and that he had a signed approved rendering showing a March 14 stamp by the City. Zoning Enforcement Officer (Timbrook) stated that as far as the revised drawing shown by the applicant, the sign maker was asked to submit a colored rendering to scale; and that a monument sign would be invisible from Palm Canyon. Chairman stated that the monument sign is ideal aesthetically but is not visible unless a person were directly in front of it. Planning Director stated that it would be visible because it would be perpendicular to the street; a monument sign could be allowed under an encroachment permit; and that signs in the right-of-way are a problem as are signs clustered on fascias without frontage. Zoning Enforcement Officer stated that a monument sign would not be visible for traffic traveling north and south, and that the sign view would be obstructed by posts, palm trees, and street lights. Commissioner Whitney commented that she liked the sign on the fascia since the monument sign would not be visible. • Chairman suggested a continuance to resolve the problems of visibility and ordinance requirements. Commissioner Whitney asked if the applicant would be satisfied with one sign on the fascia on Palm Canyon. Iris Hsu, the applicant, stated that the restaurant is difficult to find and one sign would not suffice; that a sign on the driveway would not be dangerous; that she choose red-orange because she did not like rust; and that she wanted signing before the season ends. M/S/C (Neel/Curtis) taking the following actions: 1. Approved two signs, one recessed on Palm Canyon and one facing north to the alley, subject to staff review of location. ) 2. Approved red color proposed by the applicant. 3. Directed that the raceway be hidden. NB: The Commission approved two signs based on the finding that the building design creates an unusual set of circumstances. (Staff noted that the sign on Palm Canyon should be moved to the rear allowing the letters to break around the beam. ) • Planning Director stated in regard to the legality of the Commission action that the sign ordinance leaves some leeway to the Commission in cases of unusual architectural characteristics. Application by ORCHID TREE HOTEL for architectural approval of wall and gates to enclose the Baristo Road entrance and patios, and revised exterior colors for walls at 261 S. Belardo Road, R-3 Zone, Section 15. Planner (Vankeeken) explained that the gray color proposed for the wall and the hotel building is because the adjacent church is a concrete block (gray) building. Robert Whitehorn, representing the Orchid Tree Hotel , stated that the San Marino Hotel across the street is also gray; that the owner of the Orchid Tree had reviewed many colors before deciding that the walls should be gray; that four members of the AAC liked gray for the buildings, but wanted the dark slump stone walls changed to another color, and that there will be much more wall visible. Commissioner Whitney stated that the AAC preferred not to see the wall color changed, but recommended that if the applicant wants gray on the hotel the wall color should also be changed to gray. Planner stated that the applicants feel that gray does not blend well with the slump stone garden wall . Mr. Whitehorn stated that the pinkish color of the stone in the walls clashes with the orange tile of the roof of the building and several different colors and washes were tried with- out success; that the wall has three different colors of brick because of repairs; that the patio facing Baristo and Belardo would be land- scaped; that bougainvillea will cascade over the wall ; that the wall is necessary to prevent burglaries; and that he preferred painting the walls of the building with the rock wall left in its present colors, and that the walls had staff approval for construction. Planner stated that the AAC recommended that the walls be repainted to match the building. Mr. Whitehorn stated that some of the AAC members felt that the gray color would be acceptable, and that two or more shades of gray could be used in the alcoves to minimize the effect. He repeated that the dis- crepancy is between the colors of the walls and the roof colors. Chairman stated that the Commission needs a specific overall color recommendation from the AAC. Mr. Whitehorn reiterated that he does not want to paint the wall and requested approval of the color on the building. He stated that the wall will be extended because of insurance company requirements. Commissioner Hough stated that he though there was too much gray because of the adjacent gray-painted church. Commissioner Curtis requested a color board because large scale projects require exact color review. • M/S/C (Whitney/Edgmon) continuing the application to May 13 for a firm recommendation from the AAC regarding colors of the wall and of the repaint of the hotel . April 22, 1987 PC MINUTES Page 11 MISCELLANEOUS ITEMS CASE 20.103 (CONTINUED) . Request by RIVERSIDE COUNTY for review of change of zone Case 4875 for property located at the southwest corner of Inter- state 10/Gene Autry Trail (Palm Drive) . Planning Director stated that staff feels that the project is pro- fessionally done; that the orientation to the freeway is good; that the zone change is to support freeway types of businesses such as restaurants, gas stations, industrial parks, hotels and truck stops; and that the project is consistent with the Sphere Plan. He stated that staff is concerned about emergency service response time, which leaves potential businesses isolated from emergency services; that the type of sewage service is not known; that hotels on restricted sites are problems for private septic systems; that signalization coordinated with Cal Trans is necessary for the intersection of Salvia and Gene Autry; and that a traffic study should be done. He stated that the landscape buffer should be increased on the west, north and northwest sides along the freeway off-ramps, and a sign program and individual architectural reviews done of the site. He stated that the proposal is consistent with the Ci ty's General Plan and the staff would support the project if urban services were available and traffic mitigation developed. M/S/C (Hough/Olsen) approving the concept and the zone change with the following recommendations: 1. That prior to approval of this large scale industrial and commercial development services must be in place to urban service • levels. 2. That provisions for sewer service be provided either with the Desert Water Agency, Coachella Valley Water District or Desert Hot Springs. 3. That potential traffic conflicts due to size of the project and relationship to a freeway interchange mandates a traffic study to determine extent, location and funding of traffic improvements. 4. That this development pays its share of traffic improvement costs. 5. That west and north landscape buffers be increased. 6. That a sign program for the entire complex be submitted and approved as part of the development package. 7. That individual projects on the site be reviewed architecturally. 8. That plans for each development be submitted to the City for review and comment. DISCUSSION. Request by REUEL YOUNG for change in submittal requirements concerning rendered exhibits. • Planning Director stated that a letter has been received from a local architect requesting that when multiple exhibits of colored elevations and exhibits are submitted that they be returned to the applicant; that "April 22, 1987 PC MINUTES Page 12 MISCELLANEOUS ITEMS (Continued) DISCUSSION. (Continued) • the AAC felt that all of the exhibits should be kept for reference for future changes as invaluable resource materials; and that the policy not be changed. Chairman agreed that it is important to keep the exhibits as a record. Planning Director explained that large exhibits are often returned to the applicant and photographs substituted for the City's records, and that the City does not require more exhibits than other valley cities, which view Palm Springs as a leader in project control . Commission consensus was to maintain the current policy of keeping all required submitted exhibits. CASE 85.122. Request by DON WILLIAMS for William Wehe for a certificate of compliance for property on Alejo Road, off Bisnaga Avenue, R-1-B Zone, Section 25. Planning Director explained that a Certificate of Compliance is necessary to determine conformance with the Subdivision Map Act since the subject lots were not formed by a subdivision map. M/S/C (Olsen/Hough) approving the Certificate of Compliance for property as described on Araby. . CITY COUNCIL ACTIONS. Update of City Council Actions. Planning Commission/City Council Joint Study Session. Planning Director stated that he is still trying to find an acceptable date. Commission consensus was that either May 5, 6, or 12 would be acceptable. "R" Zone (Case 5.0436-ZTA/CZ) . City Council approved the "R" Zone. ADDED STARTER ADDED STARTERS. (Determination of eligibility for consideration. ) M/S/C (Edgmon/Hough) determining that Case 5.0052-PD-82 is eligible for consideration since the project has been red tagged (stopped) in the middle of installing new siding. April 22, 1987 PC MINUTES Page 13 ADDED STARTER (Continued) CASE 5.0052-PD-82. Request by CARVER CO. for architectural approval of revised exterior materials and design for a commercial complex on the southwest corner of S. Palm Canyon Drive/portion of Ramon Road, C-1/R-3 Zones (I .L. ) , Section 22. Zoning Enforcement Officer (Forcucci) stated that staff sent notices to owners of buildings with wood siding which was in a state of disrepair; that the response of the Carver Company on the financial plaza on Palm Canyon was that the company would comply in the near future; that changes made were different from the original appearance and staff has brought the changes to the Commission; that the applicants are putting up V-groove spruce wood for stability; and that the color is different but can be changed to match the original . Planning Director stated that the applicants have put in a vapor barrier, treated the wood, nailed the wood to the studs and will stain the wood with an acrylic stain. He stated that the AAC felt that the architectural character of the building changed because of the change in wood; that the spruce wood does not withstand the elements; and that application of the material should be stopped. Commissioner Hough stated that he looked at the building and did not think the appearance had changed. Chairman stated that nothing other than redwood or laminated beams withstands the elements. Planning Director stated that redwood was the previous material , and • that staff recommended that it be restored to the original design. Ms. Sandy Yavitz, 555 S. Palm Canyon, Carver Co. representative, stated that there have been problems with the redwood which came off the buildings; that an alternative such as stucco was very expensive; and that metal gave an unaesthetic appearance and was too heavy, so the spruce wood was chosen which is V-groove, will be sealed, and can be stained to match the existing building; and that a maintenance program will be established. She stated that three-fourths of the building is finished. Planning Director stated that the AAC generally recommends against wood unless it is glue-lam and feels that spruce has problems because there are no overhangs, exposing the spruce to the sun; that spruce will not be stable; and that a piece of the siding brought in to the staff as a sample is already "bowed". He stated that the treatment is "V" groove and less desirable than tongue and groove which locks, and that the spruce will probably last for 2 or 3 years. Chairman suggested that the applicants be allowed to finish and if the siding becomes too warped, Carver Company can be cited. M/S/C (Neel/Hough) approving the revised exterior material (spruce wood) of the Financial Plaza subject to the following conditions: • 1. That a maintenance schedule be established and the applicant cited if the material begins to show weather damage. 2. That the exterior color be reviewed and approved at staff level . Chairman asked staff to review the colors of the Fairmont Hotel which has been painted pinkish lavender. Zoning Enforcement Officer stated that the color was approved by the Commission. Chairman stated that he had a call from a person living behind the hotel objecting to the color; that the color is a bright lavender; and that the Commission members are not color experts and when a controversial color is submitted, a swatch should be applied on the building for review in the field by staff, Commission and AAC. He stated that young local architects are relatively inexperienced in the use of color and are experimenting with faddish colors. - CASE 3.976-SURGICAL CENTER ON PALM CANYON/INDIAN AVENUE. Commissioner Olsen stated that he thought the building was supposed to be white, but it is bright yellow. Planning Director stated that the yellow is the original color. DIRECTIONAL SIGNS. Offensive yellow and black directional signs on the corner of Indian and Palm Canyon. Staff will review. - PALM SPRINGS DESERT INN SIGN. Planning Director stated that staff • approved the sign but it was not finished the way staff directed; that the owner complained; that staff direction was overridden and the sign was a change of face only. - SIGNS INSIDE BALLPARK. Insensitive signs with many colors are at the ballpark. Planning Director stated that either the signs should be a green background with light green letters or have a uniform frame, and that probably the type of sign should be a part of the lease agreement since it is part of the advertising revenue of the City. Staff will review with Director of Parks, Recreation and Library. Commissioner Whitney suggested that the sign limitations and direction could be incorporated in renegotiated agreements on the ballpark. ADVICE SUMMARY. Advice Summaries were distributed by the City Clerk's Office to inform Commissioners of actions on cases in other areas involving conflicts of interest. NEW DISPLAY BOARDS. Council Chamber display boards will be removed and new ones installed during the last week of April .
