Application by ED KANAN for architectural approval of working drawing for an apartment complex on Ramon Road/Grenfall Road, R-2 Zone, Section 23. Restudy noting the following: 1. That maximum building height is 24' . 2. That the design needs to be more in kind with the previously approved elevations. 3. That the chimney elements be restored. 4. That the garden walls be integrated with the building mass, and shown on the elevations. 5. That shade control be provided through the use of awnings and window treatments. (Not changes to the roof line. ) CASE 3.0085. Application by WADE RITCHIE for Mark Blaich for architectural approval of revised site plans and elevations for a 4-unit apartment • building on Junipero Street/San Marco, R-2 Zone, Section 3. Restudy noting the following: 1. That paint samples be submitted. 2. That a roof plan be submitted. 3. That the building be tied together with architectural elements. 4. That additional window protection be provided (12" minimum) . 5. That the use of garden walls and patio space is encouraged. 6. That the hardscape be reduced and total elimination of on-site hardscape be encouraged (use public sidewalk) . CASE 3.0171 (MINOR) . Application by WELLS FARGO BANK for architectural approval of automatic teller machine on the northside of bank at 1711 East Palm Canyon Drive, C-D-N Zone, Section 25. Continued to March 25 pending receipt of revised plans. CASE 5.0389-PD-177 (Ref. TPM 21324). Application by EXPO ENTERPRISES for architectural approval of final development plans (revised elevations) • for a planned development district to allow development of mobilehome lots on the west end of Mesquite Avenue, R-TP/0-20 Zones, Section 22. HOWLETT for architectural approval of • revised main identification sign for Royal Sun Hotel , 1700 South Palm Canyon Drive, R-3 Zone, Section 26. Restudy noting the following: 1. That no logo be added to the rock wall unless the sign is recessed into the wall and is much smaller in size. 2. That the applicant is encouraged to explore a low profile monument sign. ITEMS REMOVED FROM THE CONSENT ACTION AGENDA Approval of architectural cases is valid for two years. The approval granted must be exercised within that time period unless extended. CASE 3.0175 (MINOR) . Application by CHRIS GEORGE for architectural approval of colors and wall to separate pool from street for Fairmont Hotel at 641 North Palm Canyon Drive, C-B-D/R-2 Zones, Section 10. Planner (Green) : Described the repaint using three colors. One of which is a lilac, base color. He stated that there was a 3-2 vote by the AAC for approval and that the two dissenters felt that the lilac color was too dark. • Commissioner Hough stated that he was present at the AAC meeting, that the base color was too dark, and that the committee tried to review the color in sunlight but it was an overcast day. He stated that he did not mind the deep base color because it is only predominant in two areas. Commissioner Curtis stated that the base color is too bold for the building; Chairman agreed. M/S/C (Curtis/Neel ; Edgmon/Whitney absent; Hough/Olsen dissented) for a restudy of the colors. CASE 3.0116. Application by CHRISTIAN ASSOCIATES for Robert Poon for architectural approval of grading plans for a two-story, 95 room hotel (Hampton Inn) on North Palm Canyon Drive between Via Escuela/Vista Chino, C-1/R-3 Zones, Section 3. Planner (Williams): The T-111 siding on the soffit was a condition of approval , but the applicants requested a change because they could not get fire treated wood; that there is a treatment available on the market now which allows the T-111 to be used and satisfies fire department requirements; that the applicant will keep the soffit as originally approved with the T-111, and that staff recommends continuing the grading plans to the next meeting. M/S/C (Neel/Olsen; Curtis abstained; Edgmon/Whitney absent) continuing • the grading plan to March 25 and denying the proposed soffit change (with the applicants to return to the originally approved T-111 siding) . Application by ROBERT MCCOY for Larry Pierce for . architectural approval of final development plans for a hotel on Indian Avenue, south of Arenas Road, C-2/C-1-AA Zones (I .L. ), Section 14. Planner (Green): The project has undergone several restudies and had been substantially improved, and the landscape, grading plans and working drawings are on the agenda for review in final development plans; the plans conform to the preliminary plans, including detailing; the AAC restudied the landscaping plans (because the committee felt the landscaping should be of the same quality as the architecture) and the tower element design should be integrated with the hotel . M/S/C (Hough/Neel ; Edgmon/Whitney absent; Curtis dissented) taking the following actions: A. Architecture. Approved subject to the following conditions: 1. That exposed sheet metal on the balconies shall be deleted. 2. That heavier wood than 2x material shall be used for the handrail . 3. That the tile on the building fascia shall be the same as on the perimeter wall . 4. That 60% mortar shall be specified with the barrel tile. B. Landscaping. Restudy noting the following: 1. That the landscaping plan be prepared with the same thoroughness as the building. 2. That a berm (18" - 24" high) , lawn, vines, and trees be used for the street frontage (incorporate sign concept) . 3. That evergreen shade trees shall be used throughout the parking lot. 4. That Silk Oaks and London Plane trees shall be substituted with other species. 5. That palms and planting masses shall be located around vertical buildings masses (e.g. elevator towers) . 6. That a colored landscaping plan shall be submitted. C. Tower. Restudied recommending that some of the detailed design elements of the hotel be used on the tower. CASE 5.0421-PO-185. Application by M. FONTANA for Desert Hospital for architectural approval of a proposal to renovate the El Mirador Hotel • and Tower including a building addition, R-4 Zone, Section 11. M/S/C (Olsen/Curtis; Edgmon/Whitney absent) tabling the application until the hospital planner arrived. Application by BARRY RUSHTON for Raffles Hotel for • architectural approval of revised entry and landscape plans for hotel at 280 Mel Avenue, R-3 Zone, Section 11. Planner (Vankeeken) : Building remodeling includes a revised entry and landscaping and a new office building; there is a gazebo in the back which is screened from the street by landscaping. M/S/C (Hough/Olsen; Edgmon/Whitney absent) approving the application subject to the following conditions: 1. That concrete block be used over entryway with the color to match garden wall . 2. That the concrete block wall be returned at building to give symmetry to street elevation. 3. That Celotex be installed to roof of office to give slope to flat roof. 4. That the fascia on the office be straight. PUBLIC HEARINGS . CASE 5.0424-CUP (Continued) . Application by the MARRIOTT CORPORATION for a conditional use permit for construction of a 148 unit 3-story hotel with a maximum height of 46 feet on the east side of Hermosa Drive between Tahquitz Way/Andreas Road, R-4-VP/C-1-AA Zone (I .L. ) , Section 14. (Commission response to written comments on Draft Negative Declaration. No comments received. ) Recommendation: That the Commission approve the application subject to conditions: Planner (Green) : The project is being reviewed under a Conditional Use Permit because of its height and has been previously restudied; it con- forms to the Indian Zoning Ordinance for yard requirements on Hermosa; restudy requested that the 3-story elements have the same roof structure as the single story; the building mass; shading effect on the courtyards (AAC noted this was an operational concern of the hotel ) ; and con- sistency with the other structures on Tahquitz-McCallum Way. Changes have been made to the elevations including balcony treatments, radiusing of corners awnings and window treatments. The yellow awning color is shown on the elevations; and the AAC recommended that the proposed 2- foot balconies be extended to 4-feet. The mechanical equipment has been screened; review of working drawings will be an additional condition; and the Tribal Council recommended approval . Balcony changes shown on the board were submitted just prior to the meeting. . Chairman opened the public hearing. (Continued) • Ruel Young, 1428 Rodeo Drive, Palm Springs, project architect: The pro- ject has been approved after meetings with staff and the AAC to review concerns; the mass has been stepped and variety and order brought to the plan; the roof plan has been simplified; the balcony depth increased. The elevations have been changed only to show roof and floor plan revisions; and the elevations will look the same as they did. The six 2-foot balconies should be kept if possible, but could be deleted if necessary for Commission approval . Colors and material samples for the awnings will be reviewed by the Commission. The client will either eliminate the metal trellises or find material that can be painted. Only the architectural elements and organization of the building were addressed in the revisions; the footprint remains as it was, and the courtyard is shaded by the building. Jack Bloodworth, Santa Ana, Marriott representative: Revised design is very good. Marriott representatives met with the homeowners association of Palm Regency and the homeowners support the project on condition that the rear wall (north elevation) be 5 feet high to screen parked cars. Marriott feels this is an appropriate idea and the wall will be land- scaped and have wrought iron breaks. Palm Regency Homeowner (speaking from the audience) : The association approved the revisions. • Chairman closed the public hearing. Commissioner Curtis inquired if sufficiently large landscaping wereshown on the preliminary plan to complement the 3 story mass of the building. Commissioner Neel : The landscaping plan is adequate only if trees are of sufficient size (60 inch box) . M/S/C (Olsen/Hough; Edgmon/Whitney absent; Curtis dissented) ordering the filing of a Negative Declaration and approving the application based on the following findings and subject to the following conditions. FINDINGS 1. That a Conditional Use Permit application is appropriate for consideration of this highrise hotel application proposal . 2. That the hotel use is necessary and desirable for development of this resort community, is in harmony with the elements and objectives of the General Plan, and is not detrimental to existing or future uses in the zone. 3. That the site is adequate in size and shape to accommodate the use, including yards, setbacks, walls or fences, landscaping and other features required to adjust the use to existing or future • permitted uses. 4. That the site is accessed by Tahquitz Way and Hermosa Drive, (a major thoroughfare and collector street) which, after compliance March 11, 1987 PLANNING COMMISSION MINUTES Page 7 PUBLIC HEARINGS (Continued) CASE 5.0424. (Continued) • with conditions, will be designed and improved to carry the type and quantity of traffic to be generated by the proposed use. 5. That the application complies with Ordinance 779 (The Joint Planning Procedure Ordinance). CONDITIONS 1. That detailed landscape, lighting and irrigation plans shall be submitted for AAC and Planning Commission approval prior to issuance of building permits. 2. That signs shall be subject to a separate application. 3. That all mechanical equipment shall be screened. 4. That all recommendations of the Development Committee be complied with. 5. That working drawings shall be submitted for AAC and Planning Commission approval . 6. That a 5 foot wall/fence along the northern perimeter to screen parking is permissable. • 7. That a revised trellis detail (in lieu of the proposed flat metal detail ) shall be submitted. 8. That a sample of awning colors and materials shall be submited. 9. That the two feet deep balconies shall be deepened to four feet, except tha single bay on th east elevation (as noted on the plan) . 10. That a blend of roof tile shall be used. TRIBAL COUNCIL COMMENTS This Case was previously considered by the Tribal Council , most recently on February 24, 1987. After consideration of the recommendations of the Indian Planning Commission, the Tribal Council reiterated its previous actions to: 1. Approve the filing of a Negative Declaration with the mitigation measures noted in the Environmental Assessment. 2. Concur with the findings contained in Planning Staff report dated January 28, 1987, and approve the granting of the Conditional Use Permit subject to the conditions recommended by Planning Staff. • March 11, 1987 PLANNING COMMISSION MINUTES Page 8 PUBLIC HEARINGS (Continued) CASE 5.0436-ZTA/CZ (Continued) . Initiation by the CITY OF PALM SPRINGS of a Zoning Text Amendment to establish a "R" resort combining zone for the purpose of protecting those properties citywide which have a potential for providing resort/commercial uses from certain incompatible uses, and to consider a change of zone to place combining zone on certain properties citywide. (Commission response to written comments on Draft Negative Declaration; final approval . No comments received. ) Recommendation: That the Commission order the filing of a Negative Declaration; final approval of the case. Chairman: All the Commissioners' offices except for Commissioner Edgmon are in the proposed zone change area, so Commissioners drew straws to determine who would vote on the case. Two of the voting Commissioners are absent, and there is no quorum. Assistant City Attorney: Commissioners can vote to continue the case to March 25 and persons in the audience can speak to the case in the public comments section of the agenda. M/S/C (Neel/Hough; Edgmon/Whitney absent) continuing the application to March 25. TRIBAL COUNCIL COMMENTS As noted previously, the Tribal Council recognizes the importance of tourism to the economic well -being of Palm Springs, and will continue to be supportive of the City's efforts to enhance its competitive position in this market, including those efforts to encourage development of quality facilities related to tourism. After consideration of the recommendations of the Indian Planning Commission, the Tribal Council took the following action: 1. Noted that the proposed "R" Resort Combining Zone will be placed on properties city wide, including numerous Indian trust parcels. 2. While a Conditional Use Permit is restrictive in nature and adds another dimension to the development approval process with respect to requiring additional filing fees, possibly increasing the pro- cessing time, imposing additional conditions on development, etc. , the Tribal Council supported in principle, the proposed Zoning Text Amendment which would create an "R" Resort Combining Zone. 3. The Tribal Council concurred with the proposal to place the "R" Resort Combining Zone on those properties generally shown on the map attached to Planning Staff Report dated February 25, 1987. 4. This action by the Tribal Council is based in part, on the • following understandings and conditions: March 11, 1987 PLANNING COMMISSION MINUTES Page 9 PUBLIC HEARINGS (Continued) CASE 5.0436. (Continued) • a. On the understanding that the underlying zones will not be changed, and all uses of the underlying zones will be per- mitted with the one exception of requiring a Conditional Use Permit for the development of multi-family dwellings. b. On the condition that existing developments in the proposed overlay zone will not be classified as "Non-Conforming", and that the implementation of the "R" Resort Combining Zone will be responsive to the current and projected absorption rate for new tourist related developments, including hotels, and will be amended, and possibly repealed, to respond to significant changes in this market. CASE 5.0401-MISC. Initiation by the CITY OF PALM SPRINGS of revisions to local guidelines relating to objectives, criteria, and procedures for the implementation of the California Environmental Quality Act (CEQA) pertaining to the environmental evaluation of public and private activities and the preparation of environmental documents. (Categorically exempt from Environmental Assessment per CEQA. ) Planner (Green): The Environmental Planner is attending an out of town • meeting on Andreas Cove County Club and the case should be continued to March 25. Chairman opened the public hearing; no one spoke; the hearing was closed. M/S/C (Neel/Curtis; Edgmon/Whitney absent) continuing the case to March 25. TRIBAL COUNCIL COMMENTS The Planning Staff report and draft of the Revised CEQA Procedures were received by the Tribal Planning Consultant and Indian Planning Commission on March 10, 1987. The Tribal Council respectfully requested that this Case be continued for at least two weeks to provide adequate time for the Indian Planning Commission, Tribal Planning Consultant and the Tribal Council to fully review the considerable amount of material which has been received on this matter. PUBLIC COMMENTS • - Robert Fey, 423 Tahquitz, representing the Board of Realtors: Board of Realtors is interested in knowing how many acres of vacant land are in the combining zone, the number of potential hotel units, and potential demand. The General Plan for Section 14 has a mix of residential and March 11, 1987 PLANNING COMMISSION MINUTES Page 10 PUBLIC COMMENTS (Continued) hotel uses which determines the traffic circulation which would be • changed drastically and requires and in-depth study. Negative zoning is being proposed if a CUP is required for multi-dwelling complexes, because the site would have to be found to be not appropriate for hotel uses. (Ref. Case 5.0436-ZTA/CZ. ) - Assistant City Attorney in response to Chairman's question: Regarding replying to Mr. Fey, the public comments section is not for argument or interaction between the Commission and public. The section is just to receive comment. Chairman can comment only in general terms (Chairman declined to comment) . Roy Fey, 2470 Caliente: Our group is interesting in building a retirement hotel west of the Indian Cemetery on Tahquitz and the public hearing will be on March 25. Roy Fey questioned staff on whether the Indians had comment on the "R" Zone. Planner (Green) : The Indians have commented. (Read Tribal Council com- ments which are on file in the Planning Division. ) The Indians are supporting the "R" Zone. Karen Tabbah, 648 Calle Petunia: Palm Springs should encourage the "R" Zone since the City is a resort, but seniors with limited incomes should be able to have congregate care. Applications already submitted to the • City should be protected and allowed to continue processing and land should not be restricted to hotel use only. Zelda Seegal : The City should have the flexibility of allowing senior facilities along Tahquitz because of its close-in location to the downtown. Seniors pay taxes and support the downtown. ARCHITECTURAL APPROVAL ITEMS Approval of architectural cases is valid for two years. The approval granted must be exercised within that time period unless extended. CASE 5.0421-PD-185. Application by M. FONTANA for Desert Hospital for architectural approval of a proposal to renovate the E1 Mirador Hotel and Tower including a building addition, R-4 Zone, Section 11. M/S/C (Curtis/Hough; Edgmon/Whitney absent)) removing 5.0421-PD-185 from the table. Planner (Patenaude) : Discussed the architectural concept at the board while referring to a display model . The project is a Class 7 Historic Site and the exterior cannot be changed without Commission and Council approval . City staff has been working with the hospital staff to save . and renovate the El Mirador and also include a practical use for the hospital . The hospital is working with an out-of-state firm specializing in historical renovation as well as medical facilities. (Continued) • The exterior will be taken back to its thirties facade which will neces- sitate removal of some of the elements including the porte-cochere. The architects feel that the tower is an important part of the complex, and any additions should complement and focus on the tower structure. The AAC liked the design and the architects will submit final details. Staff has had concerns about the E1 Mirador building and this approach will be a way to improve it. Chairman: The whole hospital should have looked like the proposal . Mike Fontana, Desert Hospital Planner: The building will be taken as far as it can to the original , including restoration of the archways after removal of the porte-cochere and the entrance structure. The tower will be retained, the colonnade removed, and the 1920 design restored, which had subtle Mediterranean aspects. There is no infrastructure left in the building because of demolition in the 80' s. The building could not be used for non-ambulatory patients because of the two stories so the building will be made more cost efficient by adding a medical facility on the sloping area in the rear of the tower. This addition will not be visible from Indian Avenue and will preserve the integrity of the tower from that street and ancillary services such as a pharmacy and lab will be on the first level and physician offices on the second. The access for the building will be off Indian Avenue to the north. The Commission should state its concerns regarding the • architectural concept. Planner: Parking will be determined with the total Planned Development District and architectural concept approval is requested. M/S/C (Hough/Olsen; Edgmon/Whitney absent) approving the design concept of the architecture (building mass, architectural style, site plan) sub- ject to review of the final details. CASE 5.0434-MISC.-DISCUSSION. Planning Commission discussion of city- initiated landscape guidelines for the City of Palm Springs. Planner (Green) : Landscape guidelines for City facilities have been prepared by Planning and Parks staff, and the guidelines are for Commission review and comment. They will be reviewed by the AAC and other landscape architects. M/S/C (Neel/Olsen; Edgmon/Whitney absent) continuing the guidelines to March 25 for further Commission review and comment. ADDED STARTERS CASE 3.0183 (MINOR) . Application by BARRY RUSHTON for Raffles Hotel for architectural approval of revised entry and landscape plans for hotel at 280 Mel Avenue, R-3 Zone, Section 11. • M/S/C (Olsen/Neel ; Edgmon/Whitney absent) determining that added starter Case 5.0391-CUP is eligible for consideration. March 11, 1987 PLANNING COMMISSION MINUTES Page 12 ADDED STARTERS (Continued) CASE 5.0391-CUP. Application by CHRISTOPHER MILLS for Moe Salem for revisions to grading/site plan for gas station remodel on Indian Avenue between Saturnino and Ramon Road in C-2 Zone, Section 14. (Indian Land) Planner (Williams) : The project is being reviewed because the approved grading plan which was based on original conditions of approval has not been installed (per the approved plan) . The applicants have put the entire parking area into concrete and the planter area in concrete. Staff has tried to resolve the problems with the landlord, the applicant, and adjacent tenant without success. The original condition specified 12 parking spaces across the front of the paint store and was changed due to drainage. Staff recommends that the parking lot be installed per approved plans (add barrier curb and planter) . The present condition is a violation of the zoning ordinance and the inade- quate movement caused by 450 parking will force traffic through the ser- vice station area. Moe Salem, 1485 Camino Alturas: An upgraded parking lot was approved by the Commission without landscaping at the paint store; the paint store tenant cannot be forced to make improvements, and does not want the diagonal curb removed. Planning staff stated that the project would have to be reviewed as a site plan change by the Commission. In dis- cussions with the staff was told that if the plan could be resolved with the Engineering Division, it would be satisfactory; that Engineering has approved the change subject to certain drainage conditions; that the asphalt was changed to concrete for better maintenance in the field, and • was approved by the Engineering Division if "as-built" plans were sub- mitted showing the material change; that the paint store owner objects to the curb across the front and the planter required by Planning because of the difficulty of wheelbarrowing paint into the store; that he will not be put into the position of a police officer for the Planning Division; that he was threatened with an injunction to cease work by the paint store owner if he continued; that the concrete is an improvement over the green gravel at the paint store; and that he would like the matter settled so that he can open his service station. Chris Mills, Project Architect: The plan as originally drawn was approved by Engineering and the curb was at a slight angle to the paint store, but it conflicted with an under sidewalk drainage structure. The paint store owner objected and the plan was re-engineered without a curb to the satisfaction of the paint store owner and the Engineering Division, but the Planning Division was not consulted. The parking in the new plan was set at 900 which was objected to by the paint store owner who wants 450 parking, which is the way it was on the original parking lot. The angled curb looks like 450 parking but cars park at 900. Chairman: The 450 parking is a concern; it puts traffic onto Palm Canyon. The concrete at the paint store looks better than the green gravel . • Commissioner Hough questioned the necessity of placating the paint store owner. March 11 , 1987 PLANNING COMMISSION MINUTES Page 13 ADDED STARTERS (Continued) CASE 5.0391-CUP. Mr. Mills: The paint store owner will file an injunction and Mr. Salem will not be able to open his service station which is scheduled to open immediately. Assistant City Attorney: There is a zoning enforcement problem because the project has not been built according to plan; the project is before the Commission to forestall zoning enforcement action; the case should be continued to March 25 for a meeting with those involved to develop a staff-approved plan. The applicant could be allowed a temporary opening with no zoning enforcement for two weeks. If the site does not conform to an amended plan approved by the Commission or the original plan, the landlord and the occupants of the project are subject to zoning enforce- ment action which could ultimately close the business. Mr. Mills: The applicant could bond to the cost of the changes. Planner: The project is close to final inspection and bonding would not be a problem for the Planning Division. Mr. Salem: Bonding is not a problem, but the paint store owner's lease rights cannot be violated since the paint store owner is not involved in the upgrading of the property. Chairman: The landlord has the problem. M/S/C (Olsen/Neel ; Edgmon/Whitney absent) continuing the application to March 25 with the posting of a bond (with a 90 day time limit for com- pliance) , for completion of the parking lot acceptable to the Commission subject to approval of the certificate of occupancy by responsible City departments and problems of the paving resolved with staff, the appli- cant, and the landlord.
