There were no Tribal Council comments. November 12, 1986 PLANNING COMMISSION MINUTES Page 2 CONSENT AGENDA Approval of architectural cases is valid for two years. The approval granted must be exercised within that time period unless extended. M/S/C (Curtis/Neel ; Olsen absent) taking the following actions: CASE 3.729. Application by DENNIS MARTIN for architectural approval of revised elevations for 84 single family residents on Paseo De Anza between Francis Drive/Racquet Club, PD-110 Zone, Section 2. Approved subject to the following conditions: 1. That the entry of the C-2 unit shall be revised. 2. That vertical wing wall elements shall be added at the point of transition in the eaves. 3. That stepped elements in the fascias shall extend around from front to side elevation and die into the wing wall (noted in 2 above) . 4. That all exposed wood shall be resawn and stained. 5. That the revised elevations shall be submitted for AAC review. 6. That a color and material board shall be submitted. CASE 3.758. Application by RATTNER INVESTMENTS, III for architectural approval of revised landscape plans for 129 unit apartment complex on Farrell Drive between Hwy 111/Sonora Road, R-3 Zone, Section 24. Approved subject to the following conditions: 1. That street trees be Date Palms or Washingtonia Filifera, minimum height 15 ft. , maximum height 25 ft. 2. That Queen Palms be relocated from interior streets to pool areas. 3. That Melaleucas and Bottle trees be used for interior street trees in lieu of Queen Palms. 4. That some canopy trees be included in the interior courtyards. 5. That all species and sizes be labeled on the plan. 6. That larger species be substituted for smaller interior tree species. (50% of interior trees shall be 24" box size or larger. ) 7. That an alternate species shall be substituted for Varigated Pittosporum. 8. Application by DAVE HAMILTON or Shook Building Systems for architectural approval of final landscape plans for a multi-use building in Champion Business Park on Gene Autry Trail between Sunny Dunes Road/Mesquite Avenue, PD-126, Section 20. Approved subject to the following conditions: 1. That additional ficus trees be added to the north, west and south sides of the building. 2. That 6 additional shade trees be added in the rear parking area. 3. That above changes to be reviewed and approved by staff. CASE 3.991. Application by DAVE HAMILTON for Shook Building Systems for architectural approval of final landscape plans for a multi-use building in Champion Business Park on Gene Autry Trail between Sunny Dunes Road/Mesquite Avenue, PD-126, Section 20. Approved subject to the following conditions: 1. That additional ficus trees be added to the perimeter of the two buildings. 2. That the tree plantings at both entries to the source yard be beefed up by adding additional eucalyptus trees or changing the tree to a larger, high canopy type tree. 3. That above changes be reviewed and approved by staff. CASE 3.0105 (MINOR) . Application by RICHARD FISCHER for the Palm Springs Spa Hotel or arc itectural approval of working drawings for a porte-cochere on hotel at 100 N. Indian Avenue, C-2/C-1AA Zones (IL) , Section 14. Approved subject to the following condition: That the scuppers be eliminated in the fascia and the water allowed to drain directly through the roof. Application by MICHAEL BUCCINO for Prescott-Antares Corporation or architectural approval of parking lot details for existing hotel at 772 Prescott Drive, R-2 Zone, Section 10. Approved as submitted. TIME EXTENSION - TTM 19447 (REF. CASE 3.605) . Request by SANBORN/WEBB ENGINEERING or Ed Potter for a twelve-month time extension for tentative tract map to construct a 40-unit condominium project east of Zanjero, west of Racquet Club, R-2 Zone, Section 3. Approved subject to all original conditions of approval . (New expiration date will be December 21, 1987. ) ARCHITECTURAL APPROVAL ITEMS Approval of architectural cases is valid for two years. The approval granted must be exercised within that time period unless extended. CASE 3.0085. Request by MARK BLAICH CONSTRUCTION for reconsideration of Commission restudy of a four-unit apartment building at Junipero Avenue/San Marco Road, R-2 Zone, Section 3. Planning Director explained that the applicant requested continuance to discuss the application with the AAC and that the AAC had reiterated its ., concerns on design and recommended a restudy. M. Blaich, San Clemente, Palm Springs, the applicant, stated that the AAC did not like the architectural aspects of the project and the split- level . Commissioner Hough stated that the committee was concerned about the vertical elements rather than the split level . Chairman stated that the repetitious design of the architecture is a concern and directed applicant to discuss the design with staff. M/S/C (Curtis/Neel ; Olsen absent) for a restudy of the application noting the following: 1. That balconies should have a solid rail . 2. That the vertical repetitious building elements as shown disrupt the elevations. 3. That horizontal elements should be used to visually tie the building together. 4. Application by CHRISTIAN ASSOCIATES for Robert Poon for arc itectural approval of a two-story, 94 room hotel on N. Palm Canyon Drive between Via Escuela/Vista Chino, C-1/R-3 Zones, Section 3. M/S/C (Curtis/Neel ; Olsen absent) tabling the application until the applicant was present. CASE 7.648 - AMM. Application by SANG PAO WANG for administrative minor modification to allow construction of a two-story house at 266 Crestview, R-1-C Zone, Section 27. M/S/C (Curtis/Neel ; Olsen absent) tabling the application until the applicant was present. MISCELLANEOUS ITEMS CASE 5.0411-MISC. (Continued) . Planning Commission review of Draft EIR for the Riverside County Redevelopment Agency of projects in the City's Sphere of Influence. Planning Director stated that the item had been continued several times and that he and the Redevelopment Director had met with the Riverside County Planning Director and a letter from City staff has been sent delineating City concerns. He stated that there are two redevelopment projects in the City' s northern sphere area - Garnet and West Garnet; that there are deficiencies in the EIR; that specific plans are being t" requested since infrastructure requires review, particularly in the light of the fact that in the Garnet area the County is encouraging high industrial and high commercial uses which require sewering instead of sceptic tanks. He stated that the West Garnet plan should include a windbreak plan, removal or relocation of illegal or non-conforming uses, public services improvements; and rehabilitation programming; and that the Garnet plan should have a windbreak/landscape plan including an Indian Avenue streetscape, standards for industrial and tourist/commercial facilities; a design review process that includes City approval of project design; and a public facilities development plan. He stated that another aspect that should be studied is an all weather crossing on Indian Avenue, and that although he Commission is not directly involved in tax matters, the City is concerned about future taxation implications in the event of annexation. He recommended that the Commission endorse the letter and add any of its concerns. M/S/C (Hough/Curtis; Olsen absent) approving the content (regarding City concerns) of the letter sent to the County by Planning staff. CASE 5.0420-MISC (Continued) . Planning Commission review of Commission Annual Report for . Planning Director briefly described the contents of the Commission's annual report including the statistical charts and stated that the overall activity level in building is slightly higher in new cases, that several major projects have been started, and that the number of November 12, 1986 PLANNING COMMISSION MINUTES Page 6 CASE 5.0420-MISC (Continued) residential uses average 1,000, which meets the sewer plan expansion projections. He gave a brief summary of land use legislation and stated that the first City historic district is now in effect, that street furniture has been purchased, and that historic plaques are approved and being placed. He stated that the acreage developed is less than previously and that some of the other charts have been developed electronically. He recommended continuance of the report for further Commission review. M/S/C (Whitney/Curtis; Olsen absent) continuing the item to November 26. PUBLIC HEARINGS CASE 5.0416-CUP (Continued). Application by CHRIS MILLS for U.S. Sprint for conditional use permit to allow a prefabricated building to house a unmanned switching station on North Indian Avenue between Radio/Las Vegas Road, C-M Zone, Section 34. (Commission response to written comments on the Draft Negative Declaration; final approval . No comments received. ) Recommendation: That the Commission order the filing of a Draft Negative Declaration and give approval to the conditional use permit subject to conditions. .,� Chairman declared the hearing open; there being no appearances the hearing was closed. Discussion ensued on the Commission requirement for decomposed granite (DG) . Planner (Williams) stated that the applicant preferred that the interior of the site be left in a natural state, but that the AAC recommended DG. Chairman stated that the Commission waived the DG requirement. M/S/C (Curtis/Kaptur; Olsen absent) approving CUP 5.0416 based on the following findings and subject to the following conditions: Findings: 1. That the site is adequate in size and shape to accommodate the proposed use. 2. That the proposed use is necessary and desirable at this time and is not likely to cause significant impacts to surrounding properties. 3. That the proposed use is consistent with the zoning designation and General Plan and will not be detrimental to the public health, safety or welfare. 4. That a Conditional Use Permit is the proper application for the proposed use (a public utility) . November 12, 1986 PLANNING COMMISSION MINUTES Page 7 CASE 5.0416-CUP (Continued) Conditions: 1. A landscape area of a minimum of ten (10) feet in depth shall be provided along the west property line (Section 9219.03.D.3). 2. That additional landscaping shall be provided along the north boundary, subject to staff review. 3. That final exterior, lighting and irrigation plans shall be submitted prior to issuance of building permits. 4. That the light source of exterior building lighting shall not be visible off-site. (Details of the fixture shall be submitted. ) 5. The mechanical (A/C) equipment shall be screened. 6. That the chain link fence is acceptable. 7. That all recommendations of the Development Committee (with the exceptions noted below) be implemented. NOTE: The Planning Commission deleted the Development Committee requirements for decomposed granite; turf block (per Fire Department approval ) ; and for improved parking on-site. �-� CASE 5.0417-CUP. Application by MICHAEL BUCCINO for Cherokee Village Resort or con itional use permit to allow the use of an existing residential condominium as a resort hotel with ancillary restaurant and convention facilities on Cherokee Way/Highway 111, R-G-A(8) Zone (IL), Section 30. (Environmental assessment; tentative approval . ) Recommendation: That the Commission order the preparation of a Draft Negative Declaration; give tentative approval to the application and continue it to November 26 for Commission response to written comments on the Draft Negative Declaration. Planner (Green) presented the staff report. He stated that a parking management plan will be required if the convention facility is used by other than hotel guests, and that the parking spaces will be provided by the closure of a deadend street (Seven Lakes Drive) and controlled by Cherokee Village. He stated that closure of the deadend street will benefit both Seven Lakes and Cherokee Village by adding parking for Cherokee Village and relieving some of the Seven Lakes Condominium burden of improvement costs. He explained that the overall density of the project would not be changed and that the facility will be used mainly by hotel guests with additional parking spaces to be shown and valet parking required if there is occasional outside use of the facilities. He stated that the additional spaces are for hotel employees. M. Buccino, Sunny Dunes Road, representing the applicant, stated that there are 75 service employees of the hotel at the present time, that the restaurant will serve the existing facilities and will be increased November 12, 1986 PLANNING COMMISSION MINUTES Page 8 CASE 5.0417-CUP (Continued) 200 + square feet to make the operation possible. He described the amenities of the project and stated that Cherokee Village has reached an agreement with Seven Lakes on the deadend street and that a lot line adjustment is being completed. He requested that the outside shell of the restaurant be allowed to proceed because of convention scheduling. In reply to Chairman' s question, he stated that the final outcome of the project will be a permanent physical separation from Seven Lakes by two 6-foot high masonary walls. He requested that recently submitted revised sign materials be approved for the Cherokee Village sign. Discussion followed on the styrofoam material proposed for the letters and feather logo. Mr. Buccino stated that the material had been used in other projects in the area and weathers well , although the AAC recommended denial of the material believing that it would be easily damaged and cause maintenance problems. He stated that the developers would maintain the sign regularly since it is their main sign. J. Crocker, 330 W. Arenas, requested clarification of hotel development in residential areas (city-wide) requiring 40 acres for development, not 20 acres. Planning Director stated that the General Plan language established a 40-acre minimum, but that the Zoning Ordinance states 20 acres and is the operative document; and that the 20-acre minimum figure was developed prior to the General Plan amendment. He stated that the Cherokee Village application was an architectural case and did not require public hearings. There being no further appearances, the public hearing was closed. Discussion ensued on sign materials. Commissioner Kaptur and Chairman stated that the Commission should review the material . Planning Director stated that the AAC was not supportive of the material , and that the original proposal was enameled metal . In reply to Commission question, he stated that there was no problem with allowing the kitchen expansion to proceed. M/S/C (Hough/Neel ; Olsen absent) ordering the preparation of a Draft Negative Declaration, tentatively approving the application, and continuing it to November 26 for written response to the Draft Negative Declaration. Discussion continued on the sign material . Planning Director stated that the material has been approved by the AAC and used occasionally, but that in this particular case the committee felt that the material was not appropriate. Commissioner Hough stated that the sign was ground mounted and subject to vandalism and vehicle damage, and that the material has been used on signs which were of higher elevation. He stated that the material has enough mass since it is mounted on a concrete base. Discussion continued on the material . Mr. Buccino stated that sign will be surrounded by a finished surface with the styrofoam being on the interior only. November 12, 1986 PLANNING COMMISSION MINUTES Page 9 CASE 5.0417-CUP (Continued) Commissioner Kaptur noted that the material seems hard and thick and would be as strong as a metal sign. M/S/C (Neel/Kaptur; Olsen absent) approving the styrofoam material for the letters and feather of the sign (replacing the originally approved enameled metal ) . PUBLIC COMMENTS - NONE. ARCHITECTURAL APPROVAL ITEMS (Continued) Approval of architectural cases is valid for two years. The approval granted must be exercised within that time period unless extended. CASE 7.648 - AMM. Application by SANG PAO WANG for administrative minor modification to allow construction of a two-story house at 266 Crestview, R-1-C Zone, Section 27. M/S/C (Kaptur/Curtis; Olsen absent) removing the item from the table. Planner (Green) described the site on the edge of the ravine. He stated that the lot was partially filled to create a flat pad, but the fill material made part of the pad unsuitable for development which cut the size of the pad in half, and that the applicant is requesting a two- story building through an administrative minor modification (AMM) . He stated that the adjoining properties are those of Sonny Bono and an existing single family residence and that the AAC recommended approval of the two-story concept. He stated that there are other two-story and split level homes in the area. Planning Director stated that the house has a fill problem and that a two-story concept is acceptable in staff's opinion. He stated that the house has a setback problem since the Zoning Ordinance requires a 1:1 setback for houses in excess of 15 feet in height. He stated that staff would work with the architect and an AMM could be granted for a 20% reduction in setback because of the substandard lot. Chairman stated that the zoning ordinance does not address the Mesa area. In reply to Commission question, Planning Director stated that no notification was sent to neighbors and would not be necessary as long as the house is out of the setback. Commissioner Kaptur stated that if the neighbors objected to the height it would influence his judgment on the matter. Commissioner Whitney stated that she found no problems with a two-story house on the site. M/S/C (Curtis/Hough; Kaptur dissented; Olsen absent) approving a two- story concept for Case 7.648 AMM subject to the following conditions: 1. That the building comply with the Zoning Ordinance regarding °`- setbacks (to be resolved with staff) . 2. That all recommendations of the Development Committee be met. November 12, 1986 PLANNING COMMISSION MINUTES Page 10 MISCELLANEOUS ITEMS (Continued) CASE 5.0413-CUP. Request by ROBERT NACKOWSKI for Hawthorne Savings for Plann-ing Commission reconsideration of lowering of tennis courts in conjunction with two single family residences on San Joaquin Drive between San Mateo Drive/Alondra Way, R-1-C Zone, Section 19. Planning Director explained that the proposed tennis courts, which would back up to the Desert Flower Condominiums, were approved by the Planning Commission subject to conditions, one of which was that the tennis courts be lowered 4 ft. to eliminate any chainlink fencing above 6 ft. in height, that the applicant feels that the condition is a hardship and is appealing to the Council , but prior to Council review he has requested that the Commission reconsider the condition to lower the courts. He stated that there are some renderings showing the fairly limited impact on the Ehrlich home and that the AAC reviewed the case on November 10 and reiterated its recommendation that although the impact to the property on the east is not significant; the site is overdeveloped with an unpleasing elevation to the street. He stated that the applicant can sink the tennis courts 2 to 3 feet resulting in a 6 ft. high fence on the front and an 8 to 9 ft. perimeter height, and that someone voting for the original motion would be required to make a motion for reconsideration. Commissioner Curtis questioned whether or not the AAC felt that the view south from the street into the two single family residences could be improved by sinking the courts 2 to 3 feet instead of 4 feet. Planning Director stated that the issue of sinking the court only 2 to 3 feet was just presented, but that the AAC was reviewing only the ability of the applicant to develop typical landscaping for a residential appearance, and that they were not reviewing the 2 to 3 foot sunken courts with landscaping. He stated that not all problems would be eliminated by sinking the courts only 2 to 3 feet. Commissioner Whitney stated that sinking the courts will not allow for an adjustment in the landscape plan, and that the setback requirements will not be met, which caused the AAC concern. Commissioner Hough stated that the proposal would only allow 24 inches of landscaping. Motion was made by Neel for reconsideration of the condition to lower the courts, but died for lack of a second. Discussion followed. Chairman stated that the Commission feels that the courts should remain at the originally approved height. Commissioner Curtis stated that the issue was discussed at length in the meeting in which the application was addressed, thanked the applicant for his letter of explanation of the reasoning (hydrological concerns) for reconsideration, and stated that the view situation is not so much a concern as the site plan, which was approved with conditions, to lessen the visual impacts. Planning Director stated that if there is no motion to reconsider, no action is required, that an appeal from Mr. Nackowski to the Council has been received, and will be scheduled for Council review. Application by ARTHUR FRIEDMAN for House of Sensu for arcitectural approval of awning and sign for restaurant in the Tackett Center, 120 N. Palm Canyon Drive, CBD Zone, Section 15. Planner (Williams) presented the street elevations of the Tackett Center and stated that the applicant is proposing a new awning design which was recommended for approval by the AAC. She stated that the support columns will be increased to 4 X 4 posts. In reply to Commission question, she stated that the colors shown on the display board are not the approved colors, and the elevations only are being shown. She stated that the oblong structure shown on the board is wood, is existing, and is the entry way to the court. Commissioner Kaptur questioned the "Christmas tree" shaped awning because the shape is totally foreign to the design of the complex and the approved awning plan. Planner stated that the awnings on the Palm Canyon frontage are the box type, and that the awning proposed is the only awning on the Indian Avenue elevation. Commissioner Whitney stated that the awning is attractive, but inappropriate. Commissioner Kaptur commented that the design has no relation to the other revisions and should be square as are the other awnings. M/S/C (Whitney/Neel ; Olsen absent) for a restudy noting that the design of the awning should be in character with t e�u'ilding design. Discussion with the applicant ensured. Mr. Beatty asked whether or not his input had any relevance to Commission action. Chairman explained that the shape of the awning is not acceptable. Mr. Beatty stated that the awning is a block away from the front of the building, has no relevance to the front of the center, and is the only awning on the elevation. Discussion continued. Commissioner Kaptur explained that there should be integration with the other elements of the project, and that the application is not a separate project. Mr. Beatty stated that the lack of identification is creating business problems for the restauranteur. Chairman reiterated that the awning shape should not be foreign to the structure. Planning Director stated that staff would work with the applicant to design an awning that is sensitive and compatible. November 12, 1986 PLANNING COMMISSION MINUTES Page 12 CASE 5.0275-PD-147. Application by TOM MILNER for Desert Fashion Plaza for architectural approval of revised plans for kiosk in retail complex, 100 block of N. Palm Canyon Drive, PD-147, Section 15. M/S/C (Curtis/Neel ; Olsen absent) for a restudy noting the following: 1. That 1P2 or 2 X 6 metal framing be used. 2. That the framework be an equal distance from the kiosk south elevations) . 3. That stucco or sheet metal panels be used to screen the equipment. CASE 3.0116. Application by CHRISTIAN ASSOCIATES for Robert Poon for architectural approval of a two-story, 94 room hotel on N. Palm Canyon Drive between Via Escuela/Vista Chino, C-1/R-3 Zones, Section 3. M/S/C (Curtis/Hough; Olsen absent) removing the item from the table. Planner (Williams) presented the project on the board. M/S/C (Neel/Whitney; Olsen absent) for a restudy noting the following: 1. That the continuous roof line is monotonous. 2. That there should be more variety in the elevations. MISCELLANEOUS ITEMS (Continued) CITY COUNCIL ACTIONS. Planning Commission update of City Council actions. CASE 3.995-APPEAL (ALLEN FENCE) . Council concurred that chain link ences are not aesthetic and if-adjacent to custom built hillside homes, the fences should be more aesthetic or located away from property lines. Staff has been directed to work with the applicant and the Commission to find an agreeable solution. Council did not want to eliminate, endorse, or set specific guidelines for chainlink fencing. This type of fencing could be used if not adjacent to property, but against another property a more sensitive fencing type should be used. Commissioner Kaptur stated that he was not present when the fencing was approved by the Commission, that chain link fencing painted the color of the hillside is acceptable but where used on three sides surrounded by other residential property, it is not appropriate. ADMINISTRATIVE NOTE: The minutes of November 12 indicated no Tribal Council comments; however, the Tribal Council commented on Case 5.0417-CUP (memo dated November 11, 1986) . These comments were reiterated on November 25, 1986.
