of detailed landscape plans for four, 4-unit apartments on Avenida
Caballeros between Vista Chino/Cottonwood, R-2 Zone, Section 11.
Approved subject to the following condition: That all recommendations
of the Development Committee be implemented.
Abstention: Ealy.
CASE 3.758. Application by RATTNER INVESTMENTS #III for architectural
approval of detailed landscape plans for a 129 unit apartment complex on
Farrell Drive between Hwy Ill/Sonora Road. , R-3 Zone, Section 24. (Ref.
TPM 20358. )
Restudy noting the following:
1. That additional canopy trees shall be added to the street
frontages (e.g. Rhus Lancea and Schinus Molle) in lieu of Crepe
Myrtle.
2. That additional tree species with varying height shall be added
(e.g. Eucalyptus/evergreen trees in lieu of some of the Honey
Locusts and Crepe Myrtle) .
3. That canopy trees shall be substituted for Melaleuca.
4. That large boulders and mounding be used in native planting areas.
5. That specimen species eg Ocotillo and Opuntia shall be introduced
into the native planting areas . Natal Plum should also be used as
a contrast.
6. That the following species be substituted with alternate more heat
tolerant types; Lily of the Nile (suggest curve leaf yucca);
Abelia, New Zealand Flax.
7. That bougainvillea be used on southern elevations and a substitute
vine be found for bougainvillea on the northern elevation. Vines
shall be espaliered to buildings throughout. Bougainvillea should
be used as accents against walls on the street elevations at gate
entries.
8. Restudy the use of more shade tolerant ground cover species in
court areas (i .e. substitute shade tolerant species for Verbena,
Gazania, Copper King, and Potentilla Verna.
9. Substitute Rosemary with species less likely to invade shrub

ITEM REMOVED FROM THE CONSENT AGENDA
CASE 3.944 (MINOR) . Application by VALENTINE HOTEL for architectural approval
�..� of detailed landscape plans and revised elevations for hotel at 2095 N.
Indian Avenue, R-3 Zone, Section 3.
Planner (Green) presented the project and showed the revisions made to
the plans during construction. He stated that the AAC recommended
revision of the file roof area, the bridge, and the battered walls;,, and
that the applicant disagreed with the recommendations and wished to
present his case.
C. Jensen, applicant, Garden Grove, stated that he wished to address AAC
concerns as follows:
The fascia was revised to a flat surface with contrasting colors to
avoid the cost of placing lines on the fascia; the landscaping was
proposed to screen the corner of the building; the tile roof into the
parapet was to direct water during the rainy season. He stated that
there is an existing condition of a staircase to the roof on the back of
the second level which was never indicated by the previous architect and
that there is a domed building and windwall for privacy for living
quarters on the second level . He requested that the new roof (on which
permits have been obtained) be considered "as built" although the owner
will remove any items that the Commission requires. He stated that he
had not addressed the AAC regarding these concerns because the owner was
not available for direction, and that he would like to proceed as soon
as possible with the project.
Commissioner Kaptur stated that there is too much involved to take quick
action, and that perhaps the Building Division could issue permits for
other phases while a restudy of the project is undertaken.
M/S/C (Kaptur/Curtis;) for a restudy of the architecture and landscaping
per AAC recommendations as follows:
Architecture
1. That the tile roofed area be revised.
2. That the bridge be revised.
3. That the battered walls on the mechanical enclosures be revised.
Landscaping
1. That landscape masses be added to screen the A.C. units (ea Natal
Plum, Nerium Oleander, Xylosma) .
2. That Chamerops palm may be used in lieu of Sago palms.
3. That the spacing and species of Hibiscus be restudied.
Chairman explained to the applicant that the AAC should hear the
applicant's appeal , and that the Commission rarely overrides the
Committee.
Planning Director stated that he would work with the applicant to
expedite progress of the project.

CASE 3.0092 (MINOR)-Continued. Application by FAIRMONT SIGNS for K-Mart for
architectural approval of main identification sign for business in
existing shopping center on the southwest corner of Farrell
Drive/Tahquitz-McCallum Way, C-S-C Zone, Section 13.
Zoning Enforcement Officer stated that the application is for two main
identification signs (on the south and east elevations) and that the
applicant after a restudy has submitted plans conforming in appearance
to the existing Vons and Thrifty signs.
M/S/C (Curtis/Kaptur;) approving the application as submitted.
CASE 3.856. Application by LUCINDA ROMANO for architectural approval of
revised plans for four-plex on Cottonwood Road between Vista
Chino/Chuckwalla Road, R-2 Zone, Section 11.
Planner (Green) stated that the applicant has revised the plans
addressing issue of the site plan, orientation, and architecture
expressed by the AAC at the August 25 meeting, but that the Committee
has not seen plans revised after the September 8 meeting. He stated in
reply to Commission question that the oddly shaped details on the fascia
are stucco popouts.
M/S/C (Kaptur/Ealy) approving the application subject to the following:
Approved subject to:
1. That accents shall be added to the two central windows in the
north elevation.
2. That gable roofs be added throughout.
3. That working drawings be submitted-.
4. That the AAC review the revised elevations submitted after the
September 8 meeting.
Landscaping restudied noting:
1. That an olive be added in lieu of ficus.
2. That continuity of species be introduced into the plan.
3. That the position of plants be revised to improve maintenance.
4. That shade species shall be used in shaded areas.

PUBLIC HEARINGS
CASE 5.0400-ZTA (Continued) . Initiation by the CITY OF PALM SPRINGS of
revisions to the Zoning Ordinance (all sections) .
(Commission response to written comments on Draft Negative Declaration.
No comments received. )
Recommendation: That the item be continued to September 24, 1986 at the
request of the Tribal Council .
Planning Director stated that staff is preparing language to include key
sections of the Indian agreement (#779) in the ordinance, including
the appeals section with the agreement added as an appendix to expedite
amendments. He stated that revisions are being made to allow develop-
ment of smaller lots and industrial zones under specific development
plans, that Indian densities, setbacks, and heights will be included in
the R-4 Zone section; minor deviations between the two ordinances
resolved; and standard language developed. He stated that the Tribal
Council might not be in favor of more stringent standards for the C-IAA
Zone. regarding open space and setbacks because the Indians have no set-
backs in commercial zones, and that no additional written comment from
the Tribal Council has been received as of September 10.
Chairman declared the hearing open. There being no appearances,
Chairman closed the hearing.

NOTE: In reply to Commission question, Planning Director stated that
�.� the language developed in the ordinance has been in response to input
from the architectural and development communities and that copies of
the revised ordinance have been given to two AAC members (architects) ,
but no comments have been received. He stated that the ordinance has
been reviewed continuously for the past five years.

CASE 3.0094 (MINOR) . Application by WESSMAN DEVELOPMENT for architectural
.. approval of additional parking lot lights at Las Palmas Medical Plaza on
the southwest corner of Tachevah Way/Via Miraleste, PD-72, Section 11.
M/S/C (Olsen/Neel ; Ealy/Kaptur abstained) approving the application
subject to the following conditions:
1. That the standards shall be located at the intersection of parking
stripes.
2. That the base detailing shall be compatible with the detailing of
the existing buildings .
CASE 3.0097 (MINOR) . Application by DAVID CHRISTIAN for American Diversified
Capital Corp. for architectural approval of revisions to the Tahquitz
elevation, entry designations, and new signs at for retail center 1777
E. Tahquitz Way, C-1-AA Zone, Section 14. (Ref. Case 3.309)
Planning Director stated that the Bank of Palm Springs has been trying
to solve its identity crisis by signing along the Tahquitz frontage with
the last major attempt being burgundy awnings at the two entries, which
were approved by the Commission with the condition that plans for
remodeling of the frontage to coordinate colors and materials be
returned to the Commission for review. He described the revisions as a
series of freestanding glass block and plaster columns with showcases
and landscaping located behind the sidewalk and Epoxy paint in dark
green over the orange tile band on the building. He stated that the
dark green color could be lighter, that the appearance is art deco and
the columns are internally lit for sparkle at night to create a retail
rather than an office appearance. He stated that the AAC recommended
that two of the entry columns touch the building, that the showcases are
two feet behind the column line, and that any color changes would be
brought back for Commission review. He stated that staff will review
the working drawings.
Discussion ensued on the appearance of the backs of the showcases.
Planning Director stated that the material is opaque but not selected at
the present time, and that the rear of the case and a portion of the
retaining wall will be visible. He explained that the lighting is
proposed to be white. Chairman directed staff to contact the architect
for a plan showing the sides and rears of the cases.
M/S/C (Curtis/Olsen; Ealy/Kaptur abstained) approving the application
subject to the following conditions:
1. That glass block be used instead of tile.
2. That end columns be connected to the fascia and resubmitted for
staff approval .
3. That the four center columns be freestanding.
4. That the working drawings be submitted for Planning Commission
review.
5. That detailed landscape, irrigation, and exterior lighting plans
be submitted.
6. That plans be submitted showing sides and rears of the show cases.

CASE 3.01.02 (MINOR) . Application by ARTHUR FRIEDMAN for architectural
approval of elevations for ice cream store at 170 N. Palm Canyon Drive,
C-B-D Zone, Section 15.
Planner (Williams) explained that the proposal is for a new retail
business (ice cream store) in the passage from Palm Canyon to the
Tackett Center and that the AAC recommends approval . She stated, in
reply to Chairman's question, that the plans coordinate with the overall
remodel of the center.
M/S/C (Curtis/Olsen) approving the application subject to the following
conditions:
1. That the revised master plan of the southerly walk and court shall
be resubmitted for approval .
2. That the southerly closure of passageway is approved.
3. That the storefronts match in height and details.
4. That details of condition #3 shall be reviewed by staff.
CASE 3.0104 (MINOR) . Request by CLASSIC SPORTSWEAR for consideration of a
deviation from sign program for store at 611. S. Palm Canyon Drive (Sun
Center) , PD-77, Section 22.
Zoning Enforcement Officer stated that the Planning Commission pre-
viously approved a sign program, which is being implemented, of a dark
brown background and ivory letters for the center but that the applicant
after changing his business from an appliance store to a sportswear stop
has installed a new sign without permits with the reverse of the colors
of the sign program. He stated that the City has ordered removal of the
sign, but that the City Attorney advised that the sign be reconsidered
at the Planning Commission level for acceptability to the Commission .
M. Hill , 611 S. Palm Canyon Drive, the applicant, stated that the
problem is his fault because he thought that the sign company had
obtained the necessary permits , that he attempted to obtain a permit
after being noticed by the City, but the application was denied. He
requested consideration to allow the sign to remain because of the
approach of the season and the costs involved in replacing it. He
stated that sixteen businesses in the center have indicated that they
are not offended by the sign, and that he now understands the sign
program, although it was designed before he was part of the center.
Commissioner Kaptur stated that the sign would be costly to remove and
would not make a difference because the entire center is not
aesthetically pleasing. He stated that in the future if the applicant
wishes to change the sign he has to conform to the sign program.
Commissioner Whitney noted that although she was in sympathy with the
applicant, she felt that the sign should conform to the approved sign
program. Commissioner Ealy questioned whether or not approving the sign
would grant a variance. Chairman stated that if the Commission approves
the application a sign would be approved that does not conform to the
sign program previously approved by the Commission.

Commissioner Ealy stated that if the applicant's request is denied, he
should seek recourse against the sign company. Mr. Hill stated that the
sign company has refused to take any responsibility.

M/S/C (Whitney/Olsen) approving the application subject to the following
condition: That the sign is approved only temporarily and is to be
removed and replaced with a sign conforming to the Sun Center sign
program on or before August 1. , 1987.
ADMINISTRATIVE NOTE:
Discussion followed on whether or not the City should fine contractors in
instances where no permits are obtained. Planning Director stated that the
fee can be doubled, and that the City could inform the contractor's licensing
board for revocation of the licenses.
Discussion continued on the problem. Commissioner Olsen suggested that the
Business Licenses Division inform the applicants at the time a license is
�.... issued. Planning Director stated that there are handouts and sign brochures
given the applicants by this division, but in this instance the applicant was
an established business person and it was probably assumed by the Business
License staff that he knew the regulations since the previous sign was
approved in conformance with the sign program. He stated that in this
particular instance the sign company was from out of town and the sign cost
less because of not paying for a permit, and that local sign companies know
requirements and are cooperative.

CASE 3.0105 (MINOR) . Application by FISCHER ARCHITECTS for architectural
approval of exterior color change and new porte cochere for the Spa
Hotel , N. Indian Avenue, C-2 and C-1-AA Zone (IL) , Section 1.4.
Planner (Williams) presented the case and stated that the AAC recom-
mended restudy of the porte cochere. Discussion ensued on the
revisions. Chairman stated that the porte cochere has many problems
besides proportions, and that the applicant may feel that changing pro-
portions is sufficient but that the design of the porte cochere does not

integrate well with the building. Commissioner Whitney stated that she
was concerned about the landscaping around the porte cochere. Planner
stated that the AAC recommends a softer transition between the land-
scaped areas for continuity.
M/S/C (Whitney/Curtis) taking the following actions :
1. That the colors and balconies are approved.
2. That the landscaping is to be restudied.
3. That the porte cochere is to be redesigned in overall design and
proportions.
Abstention: Kaptur
CASE 5.0342-MISC.-A. Initiation by the CITY OF PALM SPRINGS of architectural
approval of design for expansion of DeMuth Park for 2 softball fields
for park located south of Mesquite between Mountain View/Vella Road, W-
R-1C Zone, Section 19.
Planning Director described the project, stated that the Community
Services Division is emphasizing softball and that the soccer fields are
to be relocated and softball fields added. He stated that the AAC
recommended berming around the fields, and that staff would recommend a
strong tree form such as Eucalyptus around the entire lighted portion of
the park to mitigate the lights. He stated that the City could probably
work with the center to change the configuration of one of the fields
slightly since there is access through the Youth Center Drive, and that
no bleachers are proposed because of long-term maintenance and
liability. Commissioner Olsen suggested stepped berming similar to that
of the Oasis Water Park. Planning Director stated that the Commission
could make the size of the soccer fields a condition of approval .
M/S/C (Whitney/Olsen) approving the application subject to the following
conditions.
1. That more berming be provided for spectator seating for fields one
and two.
2. That the new soccer fields be at least the same size as the
existing.
3. That berming be stepped around the baseball fields.
4. That a tree program around the perimeter of the lighted fields be
submitted.

COMMISSION REPORTS, REQUESTS AND DISCUSSION.
- Commissioner Kaptur asked that action be taken on the removal of
dumpsters from the street at the side of the Sheraton Hotel . Zoning
Enforcement Officer explained the City has only recently become aware of
the problem and is taking steps to have the dumpsters removed.
Commissioner Curtis requested that the broken, taped windows of car
agencies on N. Indian Avenue be investigated.
Planning Commission study session. September 17 from 3 to 5 p.m. in the
Large Conference Room, City Hall . Agenda Items: Vineyard overall
design and concept; development proposal at E. Palm Canyon/Araby Drive,
east of Hershels Deli including frontage road options; and the
architectural review process.
- AAC appointment:
M/S/C (Kaptur/Whitney) appointing Michael Buccino, local landscape
architect, to the AAC effective September 22, 1986 for a three year
period.
MISCELLANEOUS ITEMS
CASE 3.0106. Application by CITY OF PALM SPRINGS for architectural approval
of building addition to Village Green to house Country Store, S. Palm
Canyon Drive, C-B-D Zone, Section 15 .
(Environmental Assessment. )
Planning Director stated that the AAC recommended restudy of the archi-
tecture.
M/S/C (Kaptur/Olsen) ordering the preparation of a Draft Negative
Declaration, and continuation of the case to September 24.
M/S/C (Curtis/Neel ) for restudy of the architecture noting the
following:
1. That the structure have continuity of design.
2. That the structures be tied visually with other structures on the
