actions.
CASE 3.205. S. APPEL for architectural approval of revised elevations
mechanical equipment screen) for 42-unit condominium complex bounded by
Escoba Drive, Beverly Drive, Avery Drive, R-3 Zone, Section 24.
Approved subject to the following conditions:
1. Plaster parapet to shield equipment.
2. Spark arrester cover to be constructed of street metal . Painted
out to match the stucco and with a low profile.
CASE 3.589-C. Application by TENNIS CLUB HOMEOWNERS ASSOCIATION for revised
elevation of unit #3 for existing condominium on the southwest corner of
Baristo and Patencio Road, R-G-A(8) Zone, Section 15.
Approved as submitted.
CASE 3.677. Application by I. DAMPF for architectural approval of final land-
scape plans for single-family hillside residence at 2301 Araby Drive, R-
1-C Zone, Section 25.
Approved subject to the following conditions:
1. Replace Oleander with Carolina Cherry (north property line only) .
2. Olive to be 24" box size.
3. Mounding not to exceed 18 inches.
4. Mexican Mesquite, 5 gallon size, to be used instead of Mesquite 15
gallon size.
CASE 3.711. Application by R. RICCIARDI for M. Hemstreet for architectural
approval of pool building for 125-unit hotel on North Palm Canyon Drive
between Vista Chino/Via Escuela, C-1 and R-3 Zones, Section 3.
Approved subject to the following conditions:
1. That the wing walls on pool building to be thicker (16 inches).
2. That roof tile on the gazebo match building roof tiles.
3. That landscaping wrap around unit wing walls.
4. That blue trim detail be a deeper richer color and be submitted to
staff for review.
5. That all recommendations of the Development Committee be met.
CASE 3.770 (Minor) . Application by T. DOCZI for M. Alchian for architectural
approval of perimeter fence at 2223 Araby Drive, R-1-B Zone, Section 25.

Approved subject to the following conditions.
1. That the fence detail is approved.
2. That the landscape is to be restudied, noting materials from the
streetscape are to blend into the front ,yard area and that the
road be defined with boulders.
CASE 3.778. Application by DAVITT HOMES, LTD. for architectural approval of
single-family residence on Vista Chino between Whitewater Club
Drive/Volturno Road, R-1 Zone, Section 1.
Approved architecture subject to the following conditions:
1. That a flush plane on the south elevation be created (eliminate
screeds) .
2. That louvered attic vents be replaced by clay pipes (detail
similar to the south elevation).
3. That eave depth be increased to 3 feet.
4. That details be added to the kitchen windows.
5. That all recommendations of the Development Committee be met.
6. Landscaping restudied to replace the Pinus Halepenis with Mondale
Pine and exploration of the courtyard concept in the front areas
(mounding, etc.).
CASE 3.714. Application by PALM SPRINGS ASSOCIATES for Fuddrucker Restaurant
for architectural approval of landscape, irrigations and exterior
lighting plan for restaurant at 262 S. Palm Canyon Drive, C-B-D Zone,
Section 15.
Approved subject to the following conditions:
1. That landscaping details for the entire parking area be submitted
for staff approval .
2. That a planter be included on the north elevation with vines for
staff approval.
SIGN APPLICATION. Application by L. FLAHERTY for Warren Imports for archi-
tectural approval of two main identification signs for business at 166
North Palm Canyon Drive, C-B-D Zone, Section 15.
Approved as submitted.
CASE 5.0326-PD-136-A. Application by CARL'S, JR. for architectural approval
of final development plans for drive through restaurant on North Palm
Canyon Drive between Racquet Club Road/Via Olivera, C-1 Zone, Section 3.

Continued to January 9, 1985 for more detailed information as follows:
1. That site cross sections and streetscapes be submitted.
2. That the parapet match the design in the center; metal cap to be
stucco (rolled, stucco fin to be metal flashing painted to match
the roof tile).
3. That the design intent of the original condition of approval be
attempted to include landscaping, more berms, retaining wall and
trellis coordination.
4. That the sign program be detailed to include ivory letters with
yellow star logo and for monument sign to be redwood or cedar
background, sandblasted and stained dark with a red and yellow
trim detail and elimination of a clearance arm sign.
5. That the landscape plan be reworked to include berm detail and
replacement of Washingtonia Robusta with Washingtonia Filifera.
Commission Curtis came to the meeting.
ARCHITECTURAL APPROVAL ITEMS
The Planning Commission reviewed plans, discussed, and took action on
the following items involving architectural approval subject to the con-
ditions as outlined.
CASE 3.772. Application by B. LEUNG for D. Langman for architectural approval
of commercial building on South Indian Avenue between Baristo
Road/Arenas Road, C-B-D Zone, Section 15.
Planning Director stated that parking calculations for Fuddruckers did
not include the use of this property (formerly used as a parking lot by
Old World Restaurant employees).
Combination of the driveway with the Liquor Barn driveway was discussed.
Planning Director stated that although there are some physical problems
with the driveway combination, staff could study the situation and
report to the Commission.
Commissioner Kaptur came to the meeting and abstained on the discussion
and voting.
Planner II (Williams) stated that the plan had been reviewed by the
Redevelopment Agency with no comment.
M/S/C (Madsen/Curtis; Kaptur abstained) approving the application sub-
ject to the following conditions:

1. That the southerly driveway be reduced to 22 feet and increase the
planter along the building to 4 feet.
2. That the fascia be extended on the south elevation 3 feet east
beyond the vertical element.
3. That the fascia be extended on the west elevation to approximately
four feet for overhang.
4. That the planting wells be placed every other parking space along
the west elevation. (AAC recommendation using some compact spaces
to increase the planter areas.
5. That final landscape exterior lighting and irrigation be submitted
for AAC reviews.
6. That a sign program be submitted and approved prior to issuance of
building permits.
CASE 3.773. Application by B. LEUNG for D. Langman for architectural approval
of addition to existing home and new tennis court on E1 Portal between
Mason Drive/Mountain, R-1 Zone, Section 27.
.., B. Leung of Palm Desert, the architect, explained that there is a game
room between bedrooms one and two on the plan.
Planning Director stated that the architect's solution to the addition
to the guest house is exciting but there is a problem in detached guest
house requirements because of the addition exceeding the lot coverage
that is required.
Chairman commented that there seems to be much construction of additions
connected to the main structure with a minimal structure.
ITEM REMOVED FROM THE THE CONSENT ACTION AGENDA.
CASE 3.742. Application by H. LAPHAM for Hilton Riviera Hotel for architec-
tural approval of landscape plan for swimming pool addition for hotel on
the northeast corner of North Indian Avenue/Vista Chino, R-3 Zone,
Section 2.
Commission Koetting stated that he requested review because of the
Commission's condition to upgrade the chain link fencing on Indian
Avenue which has never been completed, even though the hotel is
requesting a massive revision to parking.
Planning Director stated that upgrading of the fencing could be a con-
dition of the PD for a high-rise which the hotel has submitted.
M/S/C (Koetting/Madsen; Kaptur abstained) approving the application sub-
ject to the following conditions:

1. That bamboo be added to the landscape plan.
2. That a slight grading mounding be added in the river rock areas.
3. That a landscape plan and eventual solution for the chain link
fence along Indian Avenue be submitted.
PUBLIC HEARINGS
CASE 5.0348-CUP. Application by DESERT SON-SHINE PRE-SCHOOL/KINDERGARTEN for
a Conditional Use Permit to allow a pre-school facility on Sunrise Way
between Vista Chino/Via Negocio, C-1 Zone, Section 1.
(This action is categorically exempt from environmental assessment per
CEQA guidelines. Final approval .)
Recommendation: That the Commission order the filing of a Negative
Declaration and approve C.U.P application 5.0348.
Planner II (Williams) presented the staff report.
Planning Director stated that the City Attorney feels that with a minor
use change, relocation of the curbs and undergrounding of utilities are
excessive requirements and that staff recommends deletion of these con-
ditions. He stated that the actual play area will be constructed by
berming a portion of the parking lot and adding sand which can be
removed at a later date if another use is purposed for the building.
Planner II stated that the parking meets requirements even with removal
of ten spaces for the play area.
Planning Director stated that fire codes will be required to be met.
Chairman stated that originally he felt the use was not desirable
because of the commercial nature of the area. That because of its
proximity to buildings where people work and the necessity of providing
day-care for children of these workers, he now believes that the site is
an ideal location. He commended staff on timely completion of the
project.
Chairman declared the hearing open.
Mrs. V. Gord, director of the pre-school, stated that fire and State
inspections have been made and the agencies feel that the building is
every adequate for the use. She stated that the rear alley area of the
building will be used for pick-up and dropping off of children and that
there is a waiting list for children. She stated that the State will
not allow more than 12 children per teacher.
There being no further appearances the hearing was closed.

In reply to Chairman's question regarding the adjacent Bank of America
building, Planning Director stated that the building is used as a docu-
ment review center by the Bank of America, which is a non-commercial
office use.
M/S/C (Lawrence/Curtis) giving final approval to the application with
the following findings and subject to the following conditions:
FINDINGS:
1. That the C.U.P. application is appropriate for consideration of
this proposal.
2. That the use is in harmony with the General Plan.
3. That the use is in harmony with the Zoning Ordinance.
4. That the site is adequate in size and shape to accommodate the
purposed use.
5. That the site is served by Sunrise Way and Via Negocio, both of
which are at a capacity to service the proposed use.
CONDITION:
1. That all recommendations of the Development Committee be met,
dated November 30, 1984 with the exception of off-site improvement
requirements such as curb and gutter relocation, undergrounding of
utilities, etc. which are deleted as requirements. .
CASE 5.0349-GPA. Initiation by THE CITY OF PALM SPRINGS PLANNING COMMISSION
for an amendment to the General Plan from "Medium Density Residential"
to "Professional" for 4 acres at the northeast corner of Ramon Road/El
Cielo Road, R-2 Zone, Section 18.
(Environmental Assessment and tentative approval. )
Recommendation that the Planning Commission order the preparation of a
Draft Negative Declaration and tentatively approve the application and
continue it to the January 9, 1985 meeting.
Planner II (Williams) presented the staff report.
Planning Director stated that the General Plan Amendment is only for the
four acres to cover the proposal which prompted the General Plan change.
Planning Director explained a former proposal on the site.

Chairman declared the hearing open.
C. Mills, 278 C. North Palm Canyon, one of the owners of the 4 acre
parcel requested the change to "Professional" since it is a better use
of the property.
There being no further appearance the hearing was closed.
Planning Director stated that the proposal would be spot zoning without
a General Plan Amendment.
M/S/C (Apf elbaum/Kaptur) ordering the preparation of a Draft Negative
Declaration, tentatively approving the General Plan Amendment and
continuing the case to January 9, 1985 for Commission response to
written comments on the Draft Negative Declaration.
ARCHITECTURAL ITEMS (Continued)
CASE 3.759. Application by CHRISTIAN ASSOCIATES for W. Dunagan for archi-
tectural approval of hotel bungalows on Cortez Road between Zanjero
Road/DeAnza, R-G-A(6) Zone, Section 3.
D. Christian, 1000 South Palm Canyon, the architect, stated that the
name "Sundance" stated for the project was because the project is
affiliated with the original Sundance project.
Planner II (Williams) stated that Traffic Engineering has requested a 90
degree angle onto the street for turn around. She stated that a hotel
use is not allowed but that by zoning on the site and staff will be
considering an appropriate use with the applicant.
D. Christian stated that he had concerns with the 90 degree intersection
and turn around requirements since the project is only eight units with
adjacent bay parking and should not cause a traffic problem. He stated
that there is more hard scape than usual because there is a swimming
pool for each unit and also the hard scape allows individual garages.
He stated that the applicant will put in stamped concrete if the budget
allows.
Commissioner Kaptur stated that the interior driveway area should be
stamped concrete.
Mr. Christian stated that the client would accede to the stamped con-
crete if it is a condition of approval .
Planning Director stated that the project is not considered to be a
hotel but a residential development with a managers office and rental
uses and meets Ordinance requirements.
Mr. Christian stated that it is not a hotel and will be of high quality.

Chairman commented that the area has been reviewed for use of the R-G-A-
6/C-1 parcels at several Commission meetings for general direction for
viable uses and the subject project is an attractive one.
Planning Director commented that the parcel is larger than most in the
area.
M/S/C (Apf elbaum/Curtis; Koetting abstained) approving the application
subject to the following conditions:
1. That stamped concrete be used in the hardscape areas.
2. That final landscape, irrigation, and exterior lighting plans be
submitted.
3. That all recommendations of the Development Committee be met.
4. That staff resolve driveway turn around problems with the Traffic
Engineer.
Note: Planning Director stated that staff has not supported a turn
around except on major and secondary thoroughfares and that the subject
street is a low flow street.
MISCELLANEOUS ITEM
DETERMINATION 10.438. Not on Agenda. Towed vehicle storage yard.
Planning Director stated that staff is recommending that a storage yard
not be approved unless there is an office structure on the site as a
protection against unsightliness. He stated that with an office on-site
there would be employees to monitor the gate and take phone calls and
also there is more control with a business office license use. He
stated there is a possibility that without an office on-site there will
be a tow truck office use in a home and that the other two tow truck
businesses in the City or on lots with offices. He stated that tow
trucks are not allowed to be parked in residential neighborhoods and
that the applicant has been located in a C-1 Zone.
R. B. Steel, 1479 North Palm Canyon, stated that he has obtained a City
business license and has been looking for a yard. He stated that a
permanent structure will be built on one of the two lots that are in
escrow within a year and he stated that the facility is a short term
storage yard to keep vehicles for insurance company review. He stated
also that he was not in the junk business.
M/S/C (Kaptur/Madsen) that the parking and storage of towed vehicles and
parking of tow trucks is a allowable use (without an office structure
on-sight) in M-1 Zone City-wide. Planning Director stated that other
uses such as mini-storage and warehousing would not be affected by the
determination since the proposal is a unique service function.

DISCUSSION. Planning Commission discussion of Resolution No. 3701 (El Cielo
street name change).
Chairman stated that the motion needed to be rescinded because of
Resolution No. 3701 because of Council request not to consider a street
name change for E1 Cielo Road.
M/S/C (Madsen/Curtis) rescinding Planning Commission Resolution NO. 3701
regarding a street name change for El Cielo Road.
ADDED STARTERS
TTM 18126 (REFERENCE CASE. 3.439). Request by ERVIN ENGINEERING for J. Cain
for a twelve month time extention for a subdivision of land for condo-
minium purposes on Vista Chino and Cerritos Road/Sunrise Way, R-G-A-6
Zone, Section 12.
M/S/C (Lawrence/Kaptur; Madsen abstained) approving a twelve month time
extention for TTM 18126 subject to all original conditions of approval .
(New expiration date: January 20, 1986. )
CHAIRMAN REQUESTS
Chairman requested that staff review a blinking red light on the Danny's
slack business on Arenas Road.
DISCUSSION. Redevelopment Agency request for Planning Commission reconsider-
ation on landscape screening for O'Donnell Golf Course.
Redevelopment Director requested that Planning Commission reconsider its
denial of Eucalyptus trees on Belardo Road and Museum Drive. Since the
tree will serve as a barrier for golf balls on those streets. He stated
that the Redevelopment Agency may be liable for damage caused by the
golf balls.
Discussion followed on the viability of a fence in relation to golf
course holes Nos. 1 and 3. Redevelopment Director stated that the tree
barrier became a concern when the street was extended.
Commissioner Apfelbaum stated that the AAC review the 26 foot high fence
originally purposed and rejected it at its November 26 meeting because
of its precedent setting nature.
Discussion followed on the AAC recommendation regarding deletion of the
Eucalyptus trees along Belardo Road and Museum Drive. Commissioner
Curtis stated that the landscape member of the AAC recommended multi-
trunked Eucalyptus trees kept at a 25 foot height.
M/S/C (Curtis/Lawrence) approving multi-trunked Eucalyptus trees along
Belardo Road and Museum Drive subject to keeping the height at 25 feet.

ADDED STARTERS (Continued)
CASE 3.231. Application by S.W.R. architectural approval of window details
for a condominium complex on East Palm Canyon Drive between Gene Autry
Trail/Broadmoore Drive, R-3 Zone, Section 30.
Planner III (Evans) described current revisions to the window detail and
stated that two AAC members had reviewed the revisions in the field and
felt that they were acceptable and gave the appearance of the original
detail.
M/S/C (Lawrence/Service) approving the revised window details as sub-
mitted.
