Chairman called the meeting to order at 1:30 p.m.
Minutes of the June 9, 1982 meeting were unanimously approved as submitted.
NOTE: All minute pages dated May 26, 1982 shall be changed to June 9, 1982.
Motion was made by D. Harris, seconded by Madsen, and unanimously carried (Allan
& Service absent) amending the May 26, 1982 meeting as follows:
Page 18, Second Time Extension-Case 5.0108-CUP - new expiration date to be

PUBLIC HEARING ITEMS
NOTE: There were no Tribal Council comments for this meeting.
CASE 5.0226-CUP. Application by KAPTUR & CIOFFI for S. Solomon for a
conditional use permit to allow construction of additional facilities
(clubhouse, exercise rooms, locker rooms, & swimming pool ) for
conversion of existing public tennis facility to a private tennis club
on Baristo Road between Sunrise Way/Hermosa Way, R-G-A (8) Zone, Section
14.
(This action is categorically exempt from environmental assessment per
CEQA guidelines. )
Chairman stated that the application must be renoticed because of an
error in the wording and will be withdrawn from the agenda.
Chairman asked if any members of the public could not return on July 14,
1982; there being no appearances, the hearing was rescheduled for July
14, 1982 being renoticed to correct the error in wording.
CASE 5.0227-CUP & 6.325-VARIANCE. Application by M. BUCCINO for G. Weiner for
a CUP to construct a tennis court with substandard setbacks and a
variance to add night lighting to the court and to construct an attached
garage within setbacks on Valmonte Sur between Via Chica/Via Corte, R-1-
B Zone, Section 11.
(This action is categorically exempt from environmental assessment per
CEQA guidelines. )
Planning Director presented the staff report including findings,
recommendations and direction for Commission action. He stated that
some letters in opposition had been received and that if the CUP were
approved, Condition No. 2 in the staff report would be modified since
the AAC has recommended denial of the court; and that staff would
suggest reducing the size of the court.
Planner II presented the plans on the display board.
Planning Director read letters in opposition and in favor of the project
(on file in the office of the Department of Community Development) and
stated that staff would disagree with the theory that there would be an
increase in traffic if the court were approved; that the AAC felt that
it was difficult to extract aesthetics from land use and had recommended
denial .
Planner II distributed an aerial photograph to the Commission which
showed adjacent property owners.
Planning Director stated that the area is older and has dense
vegetation; that the house to the west is five to seven feet from the
property line; and that the owner is in opposition to the court.

In reply to a question from Commissioner Madsen, Planner II stated that
by reducing the size of the court there would be an increase of four to
thirteen feet in the front setback and five feet would remain on the
west side. Planning Director stated that the Zoning Ordinance would
require a ten foot setback on the west side of the property and twenty
feet in the front.
Commissioner Koetting stated that the interior court fence could be
moved slightly with very little loss of tennis court size. Planning
Director stated that if the court were reduced, it could be shifted
slightly to the street and an eight foot setback could be achieved.
Commissioner Koetting stated that in the staff findings under
"Variance", three of the four responses were negative.
In reply to a question by Commissioner Koetting, Planning Director
stated that the CUP is for the tennis court only and the variance was a
request for night lighting of the court and construction of a garage
within setbacks.
Chairman declared the hearing open.
M. Buccino, 274 A North Palm Canyon Drive, landscape architect for the
project, explained that his client wishes to have a full size court;
that the plan chosen is the most viable since it encroaches on one
corner only of the property; that large, mature oleanders surround the
area; that the impact on the adjacent property would be minimal ; and
that the owner could not attend and had made a request for continuance.
Chairman stated that he would not allow a continuance.
Mr. Buccino stated that the project should be evaluated on City
standards and conditions of the area; that the garage can be designed in
no other way because of access dificulties; and that the garage cannot
be seen from the street.
In reply to a question by Commissioner Koetting, Mr. Buccino stated that
there is a possibility that the west side yard could be widened by
narrowing the size of the court.
Mrs. A. Solomon, 450 Via Colusa, objected to the application stating
that it would be only four feet from her property line; that there were
no other tennis courts in the area; and that the noise and traffic
generated would be a detriment to the neighborhood. She distributed
three other letters in opposition to the project and requested that the
court be denied.

In reply to questions by Commissioner Koetting, Mrs. Solomon stated that
moving the court would not alleviate the problem since it is the tennis
court itself with its noise intrusion in a quiet neighborhood that is
the problem; that she felt reducing the court would not be viable since
the full size is needed for playing tennis (except for paddle tennis) ;
and that a good neighborhood is one in which there are existing courts
and large lot sizes such as Las Palmas.
Mr. Buccino declined rebuttal .
In reply to a question by Chairman, Planning Director stated that the
court would be allowed under an architectural approval except for the
encroachment into the setbacks.
Commissioner D. Harris stated that he did not feel that traffic would be
generated by the court but that he could not support the application
because of its encroachment into the setbacks and subsequent
infringement on the rights of the adjoining property owners.
Commissioner Christian stated that the front setback encroachment would
not be a problem because of the dense vegetation but the encroachment
into the side yard setback is a problem and alternatives should be used
in an effort to achieve a ten foot side yard setback; and that the noise
• level would be no different even if the setback were 20 feet.
Chairman defined the issues as a CUP for the setbacks with a variance
for night lighting and garage encroachment into the setback.
Planning Director explained that the proposal (without alternatives) was
for a five foot setback to the west property line. Commissioner Madsen
stated that he could not support a five foot setback when the
neighboring house was set so close to the property line.
Chairman stated that the two variances indicate special privilege; that
he would not object to an encroachment into the front setback but could
not support encroachment into the west side yard; and that he would
support sinking the court.
Motion was made by D. Harris and seconded by Madsen for a restudy of
the application (both the CUP and Variance) instead of a denial .
After discussion, Commissioner D. Harris withdrew his motion for an
overall restudy of both the CUP and the variance.
Motion was made by D. Harris, seconded by Madsen, and carried (Christian
dissented; Allan & Service absent) for a restudy of Conditional Use
Permit 5.0227 to study alternatives to the reduced setbacks.
Motion was made by Christian, seconded by Madsen, and unanimously
carried (Allan & Service absent) denying the variance (Case 6.325) .

PUBLIC COMMENTS
J. Bagala, representing American Network of Milwaukee, Wisconsin (Case 3.508)
stated that his company is proposing installation of a satellite receiver and
antenna at the Seven Springs Hotel for entertainment, teleconferences and
future digital information to the hotel ; that his company, in response to AAC
recommendations, has proposed reducing the size of the antenna dish, its
relocation, the screening of the security fence, and painting the antenna the
color of the building; and that his company feels that the existing berms and
landscape adequately screen the view from the street (on which there are
garages) .
In reply to question by Chairman, Mr. Bagala stated that the diameter of the
dish antenna has been reduced and new plans have been resubmitted.
Zoning Enforcement Officer stated that the dish antenna had been reduced after
the first meeting with the AAC and at the AAC's request, has been relocated
which requires that the color match the building; that the AAC had reviewed
the antenna three times and made suggestions, but that the Committee wishes
the Planning Commission to review it since it is a different type of antenna
than previously seen in the City; and that the AAC wishes direction from the
Commission as to whether or not this type of antenna will be allowed.
J. Jamison, Newport Beach, representing Cadillac Fairview (Case 5.0155-PD-129)
requested that since staff is recommending a restudy with regard to the flume
• on the property which the City desires to keep intact, that the item be
removed from the agenda for further study with the engineers and be returned
to the Commission at a future date.
T. Payne, Cathedral City, Hallmark TV Service Manager, stated that he could
not get a good definition of a satellite terminal from the AAC who seemed to
feel that the dish antenna was stealing signals but that the FCC's position is
that the wave lengths are in the air for anyone to capture, therefore, it is
not stealing; that the Committee had concerns about the 14 foot height of the
antenna but the antenna would not be that high since it angles; and requested
guidelines so that a dish antenna could be installed at Hallmark TV on South
Indian Avenue.
Chairman commented that the guidelines might not be able to be determined at
the meeting and would not be based necessarily on the FCC's determinations.
M. Price, ASL Engineering, (Case 3.498 & TPM 18648) requested that the glue
laminated wood beams and columns recommended by the AAC be deleted and another
material substituted which is acceptable to both the City and his client.

ENVIRONMENTAL ASSESSMENT ITEMS
Environmental evaluation reports were received by the Commission for
their review and study prior to the Planning Commission meeting.
Further review may be dispensed with and all items approved by motion.
TTM 18087. Application by KWL ASSOCIATES for Andreas Hills Inc., for approval
of TTM 18087, a subdivision of property for lot sales on Bogert Trail ,
W-R-1-B Zone, Sections 35 & 36.
Planning Director reviewed the history of the project and presented the
environmental assessment/initial study. He stated that when the final
map is approved the "W" prefix will be removed; that the homes would
require architectural approval ; and that fire sprinklers would be
required since the area is out of the five minute response time area.
Planning Director presented the project on the display board and stated
that staff would recommend preparation of a draft Negative Declaration
and tentative approval .
In reply to questions from Commissioner Koetting, Planning Director
stated that a condition for circular driveways would be added to
eliminate backing onto Bogert Trail ; that there is no room in the tract
for inclusion of an internal circulation system; that Lot 32 will remain
vacant; and that there will not be a homeowners association since there
• is no common area.
Motion was made by Koetting, seconded by Christian, and unanimously
carried (Allan & Service absent) ordering the preparation of a draft
Negative Declaration, tentatively approving TTM 18087 subject to
Development Committee and staff recommendations (with the added
conditions that all driveways accessing Bogert Trail be circular) , and
continuing the map application to the July 14 Consent Agenda.
CASE 3.304 and TTM 15945-Revised. Application by KWL ASSOCIATES for J. Cotton
for architectural approval and tentative tract map approval for four, 4-
unit condominiums on Avenida Caballeros and Vista Chino, R-2 Zone,
Section 11.
(Commission response to written comments on draft Negative Declaration
and action for filing. )
Planning Director stated that the project processing has been of long
duration; that an environmental assessment/initial study had been
provided for the meeting at the advice of the Assistant City Attorney;
explained the environmental assessment and the Development Committee
recommendations including those amended recommendations, and stated that
additions could be made to the building if done properly.
. Commissioner Madsen (Commission AAC representative) stated that the
colors change from top to bottom of the building, and that two
architects dissented because they did not like the design.

Commissioner Christian remarked that the color range requires thought on
its application to the building and suggested that colored elevations be
submitted for the project.
Commissioner Koetting suggested that the C.C. & R. 's be reviewed by the
Commission.
Commissioner Madsen clarified that the AAC recommended that the upstairs
balcony patios not be enclosed.
Motion was made by Christian, seconded by D. Harris, and unanimously
carried (Allan & Service absent) continuing the application to the July
14 meeting for submission of colored elevations.
TENTATIVE TRACT & PARCEL MAPS
Planning Director reviewed and explained the map and the Planning
Commission discussed and took action on the following parcel map based
on the finding that the proposed subdivision, together with the
provisions for design and improvement, are consistent with the General
Plan of the City of Palm Springs. A Negative Declaration has been
• ordered filed based on the finding that the project will not have a
significant adverse effect on the environment and subject to conditions
as outlined.
TPM 17656. Application by CITY OF PALM SPRINGS/M. DRAGICEVICH for TPM 17656,
a subdivision of Lot 11 of Parcel Map 16175 on property located south of
Mathew Drive east of Cherokee, C-M, C-2, R-1-AH, & 0-20 Zones, Section
30.
(Previously assessed in conjunction with Case 5.0090-CUP. )
Planning Director stated that the map was a subdivision of a large lot
left from the shopping center at Rim Rocks Plaza, and the applicant
wants to dedicate a hillside portion to the City; that the City has
designed the parcel map to divide the area into two lots; that no
additional environmental assessment is necessary; and no additional
conditions are required.
Motion was made by Christian, seconded by Koetting, and unanimously
carried (Allan & Service absent; Madsen abstained) approving TPM 17656
subject to Development Committee recommendations of June 17, 1982.

MISCELLANEOUS ITEMS
• SECOND TIME EXTENSION - TTM 14416. Request byy TUMANJAN & TUMANJAN INC. for a
12-month time extension for TTM 14416, a subdivision of lots for
condominium purposes on property on Highway 111 between Bogie
Road/Broadmoor Drive, R-3 Zone, Sections 29 & 30.
Motion was made by Madsen, seconded by Koetting, and unanimously carried
(Allan & Service absent) approving a second 12-month time extension for
TTM 14416 subject to all original conditions of approval with no new
conditions. Expiration date will be 8/6/83.
TIME EXTENSION - TPM 17878. Request by MAINIERO & SMITH ASSOC. for SRS
Investment Co. for a 12-month time extension for TPM 17878, a
combination of parcels on Montalvo Way between Valdivia Way/Chia Road,
M-1-P Zone, Section 7.
Motion was made by D. Harris, seconded by Madsen, and unanimously
carried (Allan & Service absent) approving a 12-month time extension for
TPM 17878 subject to all original conditions of approval with no new
conditions. Expiration date will be 9/2/83.
• ARCHITECTURAL APPROVAL ITEMS
The Planning Commission reviewed plans, discussed, and took action on
the following items involving architectural approval subject to the
conditions as outlined.
CASE 3.508 (Minor). Application by AMERICAN NETWORK for architectural
approval of a revised plot plan for a dish antenna for the Hotel 7
Springs on East Palm Canyon Drive, R-3 Zone, Section 26.
Planning Director stated that the AAC recommended a restudy; described
the location of the antenna as the south side of the hotel facing Twin
Palms Drive; stated that the AAC has concerns about the size and
screening; that a review of the project could be part of the July 21
study session; that there is a dish antenna at the present time on the
top of the General Telephone building which is screened by a circular
parapet and well integrated into the building; that there are two types
of antennas (broadcast and communication); reviewed the Antenna
Ordinance with the Commission; stated that antennas may not be more
than six feet above the roof or 15 feet above ground level ; that there
would be concerns with installation in a commercial or industrial zone
since there is no place for them on the ground and the height would then
become a problem because screening devices such as parapets are
• expensive to build; that the Commission directed that antennas be
reviewed individually; that the KPSI antenna approved by the Commission
was screened by oleanders; that an antenna had been approved by the
Planning Director at the Warner Cable site prior to Commission interest
in these antennae; and that it will be coming back for review of revised

plans. He noted that the AAC recommended a restudy based on the
screening and suggested a study session on the general topic of dish
antennas since the Committee wants Commission input before any action is
taken.
Commissioner Koetting stated that the AAC concerns seem to be color,
height, circumference, and screening.
Discussion of the aesthetics and placement of the antenna ensued. In
reply to a question by Commissioner Koetting, Planning Director stated
that it could be installed in a mechanical well if it were aimed at the
satellite.
Commissioner D. Harris requested that the AAC meet with the Commission
at the study session and that the subject application be restudied.
Planning Director stated that no new plans have been submitted since the
Monday, June 21 meeting of the AAC.
Motion was made by Christian, seconded by D. Harris, and unanimously
carried (Allan & Service absent) for a restudy of the application with a
general discussion of dish antennas to be held at the study session of
July 21, from 3 - 5 p.m in the Large Conference Room at City Hall .
CASE 3.498 & TPM 18648. Application by ASL CONSULTING ENGINEERS for R. Squire
for architectural and map approval for an industrial office building at
Valdivia Way between Campana Way/Tachevah Drive, M-1-P Zone, Section 7.
(Previously given an environmental assessment in conjunction with TTM
9780. Final approval . )
Planning Director stated that the laminated beams and columns could be
reviewed and an alternative presented to the Commission.
Screening of the evaporative coolers was discussed. Planning Director
stated that industrial zones required screening within 200 feet.
M. Price, ASL Consulting Engineers, stated that the parapet is required
within 200 feet but for added visual protection the parapet screens the
coolers for a distance of 500 feet.
Planning Director stated that staff would review the parapet situation
in the working drawings.
Discussion followed on the type of materials to be used on the parapet.
Commissioner Koetting stated that the coolers would have to be located
in the narrow runway and caused him concern.
• Discussion followed on the glue lam beams. Commission consensus was
that if staff could not reach a solution, the matter would be brought
back to the Commission.

CASE 3.498 & TPM 18648 (Cont'd. )
Motion was made by Christian, seconded by D. Harris, and unanimously
carried (Allan & Service absent) approving Case 3.498 and TPM 18648
subject to the following conditions:
1. That all recommendations of the Development Committee be met.
2. That an equitable solution be reached with staff and applicant
relative to the glue laminated beams and columns and if no
solution is reached, the matter is to be brought back to the
Commission for review.
3. That working drawings be submitted.
4. That the planter be situated adjoining the southwesterly trash
enclosure.
5. That the olive trees be increased to 42 inch box size.
6. That a revised landscape, irrigation and exterior lighting plan be
submitted.
CASE 3.333. Application by TAHQUITZ PROPERTIES for architectural approval of
canopy and circulation for commercial/professional office building on
Tahquitz-McCallum Way, C-1-AA Zone ( I.L. ) , Section 14.
Chairman and Commissioner Madsen abstained; Commissioner Christian
presided.
Planning Director stated that the item was continued for restudy of the
relationship between the teller facility and the overall property and
that the circulation problem has been resolved and meets code. He
stated that easy access to the facility would be from Andreas Road.
Commissioner Koetting requested that the applicant answer questions, and
stated that the traffic stacking conflict problem was not discussed in
detail in the minutes.
W. Foster, the applicant, stated that there is an adequate area for
approaching the teller window since most business is by commercial
customers, not individuals, and business is done inside the bank; that
the applicant has no problem with elimination of the canopy and its
replacement with trees for shade; noted that the island would be
expanded except for the pedestal ; and stated that handicap parking is
directly south of Building "C" .
Commissioner Christian commented that if any problems arise, they would
mainly affect the bank customer.
• Motion was made by Koetting, seconded by D. Harris, and unanimously
carried (Allan & Service absent; Madsen & M. Harris abstained) approving
the revised site plan subject to the following conditions:

1. That the northerly four spaces in the parking lot immediately to
the west of Building "C" be reserved by signing for bank employee
parking.
2. That landscaping on the island be increased.
3. That the canopy be eliminated.
SIGN APPLICATION. Application by IMPERIAL SIGN CO. for Union Oil Co. for
architectural approval of gasoline rate sign for station at northwest
corner of Amado Road/N. Palm Canyon Drive, C-B-D Zone, Section 15.
Zoning Officer stated that the sign meets the Sign Ordinance.
Planning Director stated that the AAC recommended approval subject to
six conditions and that when the sign came in originally 12 years ago,
the applicant received a variance to increase its height over the 20
foot height limit because of the service station canopy which blocks the
sign.
Zoning Enforcement Officer stated that the blank space in the center of
• the sign was left for future diesel designation.
Planning Director stated that it was necessary to have the word
"gasoline" because of a requirement of State Law.
Commissioner Koetting commented that although the sign was well
designed, it looked top heavy on the slender pedestal . He stated that
the letters are easier to read closer to the ground.
Zoning Officer stated that the can is painted, not bronzed; and that six
inch letters are difficult to read and are easier to read closer to the
ground.
Motion was made by Madsen and seconded by D. Harris to approve the sign
subject to conditions of the AAC. The vote was as follows:
AYES: D. Harris, Madsen
NOES: Christian, Koetting, M. Harris
ABSENT: Allan, Service
The motion was defeated.
Motion was made by Christian, seconded by Koetting, and carried (Allan &
Service absent; Madsen dissented) for a restudy.
NOTE: Commission consensus was that it had seen signs in the past that
• were superior and that the company is capable of a better design.
Commission concerns were the height of the sign and the structure on
which it stands and the concerns of the AAC.

CASE 3.105. Application by D. ALLEN for architectural approval of a revised
parking plan for a retail store/office complex (Amado Center) on North
Palm Canyon Drive/Amado Road, C-B-D Zone, Section 15.
Planning Director stated that staff has been working with the Amado
Center to resolve parking problems created by the use of the building
and that staff would recommend the area along Belardo Road be reviewed
by staff for completeness of landscape screening.
In reply to a question by Commissioner D. Harris, Planning Director
stated that the lighting plan should be submitted as part of the parking
lot plan.
Motion was made by Madsen, seconded by D. Harris, and unanimously
carried (Allan, Service & Koetting absent) approving the application
subject to the following conditions:
1. That Belardo Road landscaping be reviewed by staff.
2. That an exterior lighting plan be submitted.
CASE 3.507 (Minor) . Application by ARCHULETA-RICCIARDI for Great Western
Savings for architectural approval of automatic teller machine at 420 S.
Palm Canyon Drive, C-1 Zone, Section 15.
Discussion ensued on the etched mural . Commissioner Madsen stated that
the AAC felt that the mural was an extension of the Great Western theme
and would look cleaner without it.
Motion was made by Christian, seconded by D. Harris, and unanimously
carried (Allan, Service, & Koetting absent) approving the application
subject to the following conditions:
1. That the sign area be reduced to two square feet.
2. That the etched mural be retained.
CASE 3.463. Application by R. HARRISON for G. Maloof for architectural
approval of revised elevations to store front at 198 S. Palm Canyon
Drive, C-B-D Zone, Section 15.
Chairman abstained; Commissioner Christian presided.
• Motion was made by Madsen, seconded by D. Harris, and unanimously
carried (Allan, Service & Koetting absent; M. Harris abstained)
approving the application as submitted.
Commissioner Koetting returned to*the*meeting at this point.

CASE 3.509 (Minor) . Application by CHRISTIAN ASSOCIATES for Las Casuelas
Terraza restaurant for architectural approval of installation of loading
dock and trash facility at 222 S. Palm Canyon Drive, C-B-D Zone, Section
15.
Chairman, Commissioner Christian, and Commissioner Madsen abstained,
therefore there was no quorum.
At the request of Chairman, Assistant City Attorney stated that the
Commission could not draw straws because there was no absolute necessity
to vote since the Commission can vote when the entire body is present
even though no quorum is present at the June 23 meeting.
Chairman commented that there would be new Commissioners at the July 14
meeting and action could be taken at that time and continued the
application to the July 14 meeting.
CONTINUED ITEMS
DISCUSSION. Planning Commission discussion of Zoning Ordinance change request
to allow carport encroachments into the required setback citywide.
Chairman continued the item to the July 21 study session.
Commissioner Christian stated that the concept is viable if controlled.
ITEMS FOR RESTUDY
The following items were removed from the Planning Commission agenda
pending restudy. Application will be rescheduled for hearing only after

CASE 5.0166-PD-129. Application by CADILLAC FAIRVIEW HOMES WEST for archi-
tectural approval of final development plans for condominium project at
the westerly terminus of Tahquitz-McCallum Way (south side) , R-2, R-3
and 0-20 Zones, Section 15.
Removed at the applicant's request to resolve the problem of retention
of the historical on-site flume.
COMMISSION REPORTS, REQUESTS AND DISCUSSION
- Chairman, whose term expires June 30, 1982, stated that he was pleased
to have worked with the Commissioners and felt that much had been
accomplished during the last several years.
- Commissioner D. Harris thanked Chairman and Commissioners Christian and
Allan for the years of service and stated that he felt that they would
be missed.
- Planning Director requested that the Commissioners fill in vacation
schedules.
- In reply to a question by Commissioner Christian, Planning Director
stated that his proposed revisions to the submittal procedures packet
was delivered to the task force staff and that the task force will
probably be reconvened to review it; that he would ask the Director of
Community Development if other persons other than the task force can
attend.
In reply to a question by Commissioner D. Harris, Planning Director
stated that a time share includes less than 12 buyers buying more than
12 time periods and that that is a clear interpretation of the Ordinance
according to the Assistant City Attorney; that a CUP would be required
but that no enforcement of the two in existence has begun; and that any
number of time periods over 12 is considered a time share.
ADJOURNMENT
There being no further business to discuss, Chairman adjourned the
meeting at 4:15 p.m.
