Approval of Minutes
The Planning Commission minutes of November 23, 1977, draft distributed,
were approved unanimously.

PUBLIC HEARINGS
CASE 5.0023-CUP - Application by MURRAY CONSTRUCTION COMPANY for a Conditional
Use Permit to allow a single story condominium complex on property
situated on the southwest corner of Camino Parocela and Cerritos
Drive, R-G-A (8) and R-1-C Zones, Section 24.
The following was received from the Tribal Council :
"On November 22, 1977 the Tribal Council advised the City
of Palm Springs as follows : 'Although the above concerned
property is non-Indian land, the Tribal Council is advised
that the "Flood Plain" line shown on the plan permits in-
creased use and building space and is not consistent with the
same line across adjacent Indian trust land to the east' .
On this date, December 13, the Tribal Council reiterated the
above statement and further advises that the matter has been
discussed with the Planning Department. "
Planning Director reviewed the plans of the project and presented
the staff report including findings and recommendations. In
response to the Tribal Council comment he indicated on a presentation
• map the area which the County Flood Control District had allowed a
deviation on the 100-year line based on detailed topography of the
site. Although the altered line allowed some additional building
area on one part of the site, it restricted another part of the site
on which building had been allowed. The net result was that the
buildable area of the site did not change.
Chairman asked if there were any questions of Staff by members of
the Commission.
Chairman asked if the fill that would be placed in the area would
raise the project sufficiently out of the flood pTai.n.
Planning Director stated that the pad would be high enough to keep
the project out of the flood area.
Commissioner Ehrens asked if the road at the edge of the project
would be flooded in the event of a storm.
Planning Director stated that it would to a minor degree but
access could be gained from the other areas if the road were
flooded.
There being no further discussion, Chairman declared the hearing
open.
. Richard Musser of Murray Construction Company, the applicant,
stated that his company had worked on the project for a long period
of time and hoped the project would be approved as submitted.
Chairman asked if the Palo Verde trees would be undisturbed.

The applicant stated that the stand of trees would be included into
the landscaping and would be left in their natural state.
No one spoke in opposition.
There being no further appearances, Chairman declared the hearing
closed.
Motion was made by La ham, seconded by Ehrens, and unanimously
carried approving this Conditional Use Permit application subject
to the conditions of the Development Committee and to the following
recommendations of the Architectural Advisory Committee.
1 . That detailed colors and materials be submitted.
2. That a minor remodel plan for the existing 3 unit building be
submitted.
3. That detailed landscape, irrigation and exterior lighting
plans be submitted.
(These recommendations were made at the November 21 , 1977 meeting
• of the Architectura NAdvisory Committee)

CASE 6.299 - Application by W. FOSTER for approval of a Variance to allow
the creation of two substandard residential lots in the R-1-A Zone comprising
18,000 and 15,000 sq. ft. identified as Lots 3 & 4 on Tentative
Parcel Map 11147, R-1-A Zone, Section 15.
The following was received from the Tribal Council :
"Recent review by the Tribal Council has indicated that the
property involved may be located on or near an Indian historical
site. Therefore, further extensive investigation should be
made by the developer respecting archeological status of the
land and the possible existence of artifacts thereon, all
prior to the approval of the proposed parcel map, or any
grading, or otherwise use of said property."
Planning Director stated that staff would contact the University of
California at Riverside regarding the archeological status of the
area and report back to the Commission but that what Commission was
asked to approve was only the variance of lot size and not a permit
to construct.
• Planning Director reviewed the plan of the project and presented
the staff report including findings and recommendations.
Chairman asked if there were any questions of staff by members of
the Planning Commission.

Discussion followed regarding the reasons that these were substandard
in size (subdivided before 1965 when the present ordinance was
adopted) and dedication of the streets bounding the property.
There being no further discussion, Chairman declared the hearing
open.
Carl Rose, a neighbor of the property, then spoke in favor.of the project.
No one spoke in opposition.
Commissioner Lapham stated that he felt that the variance was
reasonable in light of the fact that the lots in proximity to the
area were also substandard in size.
Commissioner Allan stated that she was concerned over the fact that
there might be historical Indian artifacts on the site and asked if
an archeological study had been made in conjunction with the environ-
mental assessment.
Planning Director stated that the City had no evidence that there were
archeological sites on the land, and an archeological study was not
. required.
In reply to Commissioner Allan' s request, Planning Director stated
that staff would investigate this aspect of the site and report back
to the Commission.
Motion was made by Harris, seconded by Chase and unanimously carried
approving this application subject to conditions of the Development
Committee.

ENVIRONMENTAL ASSESSMENT ITEMS - CONSENT AGENDA
Environmental evaluation reports were received by the Commissioners
for their review and study prior to the Planning Commission meeting.
Further review may be dispensed with and all items approved by motion.
Motion was made by Chase, seconded by Allan (Harris abstaining on
Tentative Parcel Map 11678) and carried, that a Negative Declaration
be declared on the basis of no significant impact or subject to
mitigation measures being added to the project to avoid or reduce
the impact to an insignificant level in conjunction with the following
cases:
CASE 5.0035 - Environmental assessment on request by SEVENTH DAY ADVENTIST
CHURCH for approval of a two (2) room school plus a room for church
related use at 620 South Sunrise Way, R-1-C Zone, Section 24.

CASE 5.0036-CZ - (inadvertently omitted from the agenda) - Environmental
assessment on request by CATHEDRAL CANYON WEST for approval of a
Change of Zone from Urban Reserve to R-1-A, on the west side of
Channel Drive, Urban Reserve Zone, Section 5.
Planning Director reviewed the baseline study prepared for this
case by staff and stated that staff' s recommendation was that a
draft Negative Declaration be prepared for this project. A brief
Commission discussion followed regarding emergency response times,
and mountainside building (no building on slopes greater than
30°).

CASE 5.0040-CUP - Environmental Assessment on request by J. GREENBAUM,
R. VAN HOOK, K. DOUGLAS, for approval of tennis court lighting
including a variance from required setback on properties at 515 Via
Lola, 432 Hermosa Place, and 474 Hermosa Place, R-1-A Zone, Section
10.
Planning Director stated that this case is an application for a
Conditional Use Permit, including a variance, and that it was
being handled this way because the Zoning Ordinance was written so
that if a tennis court did not meet the required setback, the owner
could not apply for lights. In this case there are three (3)
tennis courts in the backyards of these three properties and they
are in violation of setbacks in conjunction with one another,
therefore, staff is combining these applications and is making
findings that will explain both the variance and conditional use
. permit.

CASE 5.0041-CZ - Environmental assessment on request by CAIN DEVELOPMENT
CORPORATION for Shirley Kitchen for approval of zone change from
R-1 -B to P, R-2 and R-G-A (8) on property located on the south side
of Vista Chino between Sunrise and Cerritos , R-1-B Zone, Section 12.
The following was received from the Tribal Council :
"The Tribal Council , in accordance with recommendations of
the Indian Planning Commission, approved filing of a negative
impact report in the above case. "
Planning Director stated that staff was recommending that the
environmental assessment be waived until a General Plan hearing is
held on this case.
Motion was made by Chase, seconded by Allan, and carried unanimously
approving staff' s recommendations.
TENTATIVE PARCEL MAP 11601 (Case 3.008) - Environmental assessment on request
by WEBB ENGINEERING, INC. for Calmark properties, for approval of
• Tentative Parcel Map 11601 , R-4 Zone, Section 15, (northeast corner
of Calle E1 Segundo and Saturnino Road) .
The following was received by the Tribal Council :
"The Tribal Council , in accordance with recommendations of the
Indian Planning Commission, approved the filing of a negative
impact report in the above case. However, an apparent error
appears in the City Planning Commission agenda description of
the matter since the described location of the property at
the Northeast corner of Calle E1 Segundo and Saturnino Road
is in Section 14 T4S, R4E instead of Section 15. "
TENTATIVE PARCEL MAP 11657 - Environmental assessment on request by WEBB
ENGINEERING, INC. for Santa Barbara Savings and Loan, for approval of
Tentative Parcel Map 11657, R-3 Zone, Section 22 (area bounded by
Ramon Road, Highway 111 , and Belardo Road) .
The following was received from the Tribal Council :
"The Tribal Council , in accordance with recommendations of the
Indian Planning Commission, approved the filing of a negative
impact report in this case. "
TENTATIVE PARCEL MAP 11678 - Environment assessment on request by HALLMARK
ENGINEERING for J. Wessmen for approval of Tentative Parcel Map
11678 (located at the corner of La Cresta and Desert Way) R-1 -C
Zone, Section 19.

TENTATIVE TRACT AND PARCEL MAPS
Planning Director reviewed and explained the maps and the Planning
Commission discussed and took action on the following Tentative
Tract and Parcel Maps based on the finding that the proposed subdivision
together with the provisions for design and improvement are consistent
with the General Plan of the City of Palm Springs and will not have
a significant adverse effect on the environment and subject to the
conditions as outlined.
TENTATIVE TRACT MAP 10325 - Request by K. W. L. ASSOCIATES for Van Kleeck
Enterprises, Inc. for approval of Tentative Tract Map 10325 on
property located between Golf Club Drive and Bolero Road, R-G-A (8)
Zone, Section 29.
Motion was made by Ehrens, seconded by Chase, and unanimously
carried approving Tentative Tract Map 10325 subject to conditions
of the Development Committee.
TENTATIVE PARCEL MAP 11408 - Request by HALLMARK ENGINEERING, INC. for
. CDM LTD. for approval of Tentative Parcel Map 11408 located on
South Palm Canyon Drive and Cantina Way, R-1-A and R-2 Zone, Section
27.
Motion was made by Lapham, seconded by Allan, and carried (Chase
abstaining) approving Tentative Parcel Map 11408 subject to all
conditions of the Development Committee.

APPEALS
SIGN APPLICATION APPEAL - Appeal for reconsideration of staff denial of sign
colors at 1068 North Palm Canyon Drive (Wine Time).
The Architectural Advisory Committee recommended the following:
1 . That the proposed sign graphics and colors be denied.
2. That the sign be totally restudied both as to graphics and
colors.
After presentation of the request by the Senior Planner and discussion
by the Commissioners, motion was made by Allan, seconded by Chase, and
unanimously carried denying this appeal based on the following findings:
• 1 . That the graphics were poorly done.
2. That the combinations of colors as proposed were in poor taste
and did not relate to the existing colors of the building.

CASE 8.209 - SIGN VARIANCE - Request for sign variance from K. M. PATEL
for sign at 1450 North Indian Avenue (Kingsway Inn).
The Architectural Advisory Committee recommended the following:
The AAC reiterated their previous feeling that the sign was cluttered
graphically and needs restudy.
Planning Director presented the variance request, and after discussion
by the Commissioners, motion was made by Chase, seconded by Ehrens,
and carried unanimously for denial of this variance application based
on the following finding:
1 . That to allow this variance of an illegal sign change which has
been determined to be graphically unacceptable would set an
undesirable precedent and promote further unacceptable signs.

ARCHITECTURAL APPROVAL ITEMS
The Planning Commission reviewed plans, discussed and took action
on the following items involving architectural approval subject to
the conditions as outlined.
CASE 2.903 - Application by JOHN MAZICH for architectural approval of
revised elevations, landscape, irrigation, exterior lighting and
sign plans for remodel of existing facilities located at 2225 North
Indian Avenue, C-M Zone, Section 34.
Motion was made by Allan, seconded by Harris, and unanimously
carried approving this application subject to the following conditions:
1 . That the mansard roof be continued around the rear of the
building.
2. That new light fixtures be submitted to replace the existing
area light.
3. That a plan be submitted to staff to review diffusion of the
exposed lighting under the island canopy.
4. That specific sign plans be submitted for approval .
CASE 2.915 - Application by J. WALLING (Wadsworth storage building) for
architectural approval of landscape plans M-1 Zone, Section 19.
The Architectural Advisory Committee reviewed these landscape plans
and minor site revisions from the original site plan and recommended
approval subject to minor revisions which were presented at the
Planning Commission meeting.
Motion was made by Ehrens, seconded by Chase, and unanimously
carried approving this application subject to conditions of the
Architectural Advisory Committee.

CASE 2.969 - Application by T. JAKWAY for architectural approval of revised
plans for construction of J. Walker hillside residence to be located
at 775 Chino Canyon Road, R-1-A Zone, Section 3.
Motion was made by Chase, seconded by Ehrens, and unanimously
carried approving this application subject to the following condition:
1 . The submission of detailed landscape and irrigation plans.

CASE 2.975 - Application by FRIEDMAN-DUNPHY ASSOCIATES for architectural
approval of revised elevations including a two story portion within
a previously approved all one story project on the south side of
Alejo Road between Hermosa Drive and Calle Rolph, R-G-A (8) Zone,
Section 14.
Moton was made by Chase, seconded by Ehrens, and unanimously carried
approving this application as submitted.
CASE 3.015 - Application by THORNTON AND FAGAN INC. for Salvatore A.
Vassallo for architectural approval of revised elevation for six
unit, one story condominium project on property located between E1
Alameda and Tamarisk on the east side of Indian Avenue, R-3 Zone,
Section 11 .
Motion was made by Ehrens , seconded by Allan, and unanimously
carried approving this application subject to the following conditions:
1 . Resubmittal of carport plans and clearer details of the land-
scape, irrigation and exterior lighting plans.
2. Submission of detailed colors and materials.
NOTE: The Committee noted that the carports were shown at 18 ft.
rather than 20 ft. in depth which would cause slight modi-
fication of the plan and the Committee also recommended
that the stone wall be allowed to remain as long as the
applicant would sign a covenant that he would participate
in an assessment district to put in the street improvements,
sidewalks, etc.

CASE 3.020 - Application by L. LAPHAM for Eli Birer for architectural
approval of revised elevations for custom single family dwelling at
2421 Cahuilla Hills Drive, R-1-C Zone, Section 27.
Motion was made by Chase, seconded by Ehrens, (Harris and Lapham
abstaining) and carried approving this application subject to sub-
mission of detailed landscape and irrigation plans.

CASE 3.040 - Application by SALVATORE CAVALLARO for architectural approval
of duplex at 860 to 862 Camino Parocela, R-2 Zone, Section 23.
Motion was made by Ehrens, seconded by Allan, and unanimously
carried approving this application subject to site changes as
recommended by the Development Committee.

CASE 3.042 - Application by BBHR PROJECT MANAGEMENT LTD. for architectural
approval of 106 townhouse apartments at the corner of Avenida Caballeros
and Baristo Road, R-4 Zone, Section 14.
Motion was made by Ehrens, seconded by Allan, and unanimously carried ap-
proving this application subject to the following conditions:
1 . That the Spanish texture proposed for the plaster be modified to
a lighter pattern.
2. That detailed landscape, irrigation, and exterior lighting plans
be submitted.
3. That building be continuous on the project.
CASE 3.043 -Application by ROBERT T. PETERS for Howard T. Lane for architectural
approval of one and one-half story (5,000 sq. ft. ) single family hillside
residence, Andreas Hills, Section 1 (5S, 4E).
Motion was made by Chase, seconded by Allan, and unanimously carried ap-
proving this application subject to detailed landscape plan submittal , es-
pecially since the lot has a proposed tennis court, and subject to the
submission of colors and materials for staff approval .
CASE 3.044 - Application by ROBERT T. PETERS for Howard T. Lane for architectural
�- approval of one and one-half story (4,200 sq. ft. ) single family hillside
residence, Andreas Hills, Section 1 (5S, 4E).
Motion was made by Chase, seconded by Allan and unanimously carried ap-
proving this application subject to detailed landscape plan submittal , es-
pecially since the lot has a proposed tennis court, and subject to the
submission of colors and materials for staff approval .
CASE 3.029 - Application by CHARLES`HAVER & ASSOCIATES for Mildred L. Patencio
for architectural approval of revised plans for six lots on the north side
of Vista Chino, east of Hermosa (Tentative Tract Map 10594) R-1-C Zone, Sec-
tion 2.
Motion was made by Chase, seconded by Harris, and unanimously carried ap-
proving this application subject to the following conditions:
1 . That there is a minor restudy of unit A-1 to integrate a large sloping
tile roof on the front elevation similar to that already on the rear
elevation with the changes being subject to staff review.
2. That detailed colors and materials be submitted for all of the elevations.
3. That four "B" plans and only two "A" plans be constructed.

CASE 3.048 - Application by the CITY OF PALM SPRINGS DEPARTMENT OF COMMUNITY SERVICES
for architectural approval of multi-purpose gymnasium structure for Desert
Highland Park, W-0 Zone, Section 34.
Motion was made by Ehrens, seconded by Allan, and unanimously carried approving
this application subject to the submission of detailed colors and materials and
the submission of landscape and irrigation plans.

CASE 5.990- CUP - Application by IRV STEIMAN for architectural approval of
landscape, irrigation, and exterior lighting plans for an office
building on the southeast corner of Mesquite Avenue and South Palm
Canyon Drive, C-1 and R-2 Zones , Section 23.
Motion was made by Lapham, seconded by Chase, and unanimously
carried approving this application as submitted.

The following item was continued:
CASE 5.702-PD-42 - Application by BERGHEER COMPANY (Sunrise Racquet Club)
for architectural approval of revised as-built perimeter landscape
plans for the 196 unit condominium project R-1-C Zone, Section 12.
This item was continued to the meeting of January 11 , 1978.
ITEMS FOR RESTUDY
The following items were removed from the Planning Commission
agenda pending restudy. Applications will be rescheduled for
hearing only after revised submittals have been processed.
CASE 3.034 - Application by VEE BEE INC. (V. Johnson) for D. Jarvis
for architectural approval of single family residence, R-1-B Zone,
Section 25.
CASE 3.037 - Application by HALLMARK ENGINEERING INC. for R. Morreale,
Inc. for architectural approval of revised site plans and elevations
for 20-unit condominium project, R-3 Zone, Section 26.
CASE 3.047 - Application by PAUL H. PETERSEN for architectural approval
of single family hillside residence at 2365 Milo Drive, R-1-C Zone,
Section 3.

condominiums for architectural approval of solar collector system
on roof, R-2 Zone, Section 26.
No new plans were submitted.
CASE 5.997- PD-76 Application by MITCHELL LAUFORD & ASSOCIATES for
H. Licker for architectural approval of revised final landscape
plans as a portion of the final development plans for completion of
an existing shopping center located at the southeast corner of
Tahquitz McCallum Way and Sunrise Way, C-D-N & P Zone, Section 13.
No new plans were submitted.

Chairman stated that there would be no Planning Commission meeting
in December 28, 1977, because of lack of a quorum. The next meeting
will be held on January 11 , 1978.
There being no further business to discuss, Chairman adjourned the
meeting at 4:05 p.m.
