Chairman called the meeting to order at 1 :30 p.m. and welcomed a new member,
Robert Ostertag, to his first meeting.
Approval of Minutes
The Planning Commission minutes of October 12, 1977, draft distributed, were
approved as corrected.
Corrections:
Page 3, Paragraphs .l & 3 - The word "other" in both paragraphs is changed to "same"
Page 3, Paragraph 6 is changed to read as follows: "Commissioners Harris and
Ehrens expressed concern over this 'drainage problem, and Commissioner Ehrens
stated that the City has the responsibility for solving the problem since t'iey
created it before they sold the property."
Page 6: Full Paragraph 8 is changed to read, "James Schlecht, 383 S. Palm Canyon,

CASE 5 0013-CUP - Application by JAMES HOUSTON for a Conditional Use Permit
to allow night lighting for a tennis court located on the south side
of Via Lola, between North Palm Canyon Drive and Cahuilla Road, R-1-C
Zone, Section 10.
Action was taken on draft Negative Declaration on July 13, 1977.
Planning Director stated that this item had been continued to allow the
applicant to prepare line of sight studies of the lighting plan as it
affects the condominium owners to the west, to explore alternate types
of lighting, and to allow staff time to notify the individual residents
of the condominiums.
Planning Director then gave the background of the project stating that
this was an existing tennis court for which the owner had sought a condi-
tional use permit for night lighting in 1976 and had withdrawn the appli-
cation when heavy protests had arisen from the two-story condominium
unit owners who had .complained that the lights were visible from the
second story decks.
Planning Director explained that the proposed light fixtures would be
lowered to 19 feet and cantilevered out onto the court, effectively
shielding the light from the neighboring condominiums. Planning Director
also stated that existing plantings as well as other plantings including
trees would further screen the lights.
Planning Director then read four letters in opposition to the projcct from
the condominium owners, and stated that there were 16 copies of a declara-
tion expressing disapproval of the lighting installation.
Planning Staff had recommended approval of the Conditional Use Permit based
on findings and subject to conditions as indicated in the staff report.
Commissioner Ehrens asked how many lights would be installed on the court.
Planning Director stated that eight lights would be installed because
with the lights being lowered to 19 feet and wattage being restricted to
400 watts,that number of fixtures was needed for adequate court coverage.

Commissioner Lapham and staff then discussed the history of the ordinance
as it pertains to tennis courts and in reference to the date that the
condominiums were built (approximately 20 years ago).
Commissioner Chase then asked staff if many complaints were received re-
garding lighted tennis courts, and Planning Director replied that very
few were received until these requests reach the Planning Commission in
public hearings.
Chairman then declared the hearing open.
Hugh Kaptur, architect for the applicant, spoke in favor stating that his
client did not intend to impose any uncomfortable conditions upon his
neighbors, but that the tennis court is extremely well landscaped and an
asset to the area. He also stated that it was a private court and was not
going to be used by his client to give tennis lessons. The reason the
client wanted the court to be lighted was to allow him to play tennis in
the evenings during the few times he was in Palm Springs during the year.
Mr. Kaptur then stated that with theplantings screening the court, there
were only four apartments that might be affected by the lighting.
J. W. Lowell , 197 Via Lola, No. 12, then spoke in opposition stating that
there were eleven apartments, rather than four, that faced the court. He
stated that he had received correspondence from two additional condominium
owners, both in opposition. He also stated that since the court has been
finished, there. has been very little play on;it, and that there must be a
reason lighting had been requested which rumor had indicated might be that
the court was to be used to. give tennis lessons.
Since there were no more appearances, the hearing was closed.
Commissioner Chase stated that Mr. Lowell had stated a fact that had supported
the applicant's claim in that the court was not used very often. He also
asked if Mr. Lowell knew for fact that the court was to be used for pro-
fessional lessons, and Mr. Lowell answered that he had heard a rumor to the
effect, but nothing concrete.
Commissioner Harris stated that he felt that the lighting would not be visible,
nor would it intrude upon the next door neighbors.
Mr. Lowell then stated that from the architect's description, possibly the
lighting would not affect the neighboring owners.
Discussion then continued regarding the number and type of lights and the
landscaping around the court.

Commissioner Lapham stated that the application for a Conditional Use Permit
meets the letter of the new tennis court ordinance, and that if the Commis-
sion is going to allow lighting of courts, this court meets the requirements.
He stated further that he felt that the "good neighbor" policy would be in
effect as far as the applicant was concerned.
After a brief further discussion, Commission on motion by Chase, seconded
by Ehrens (Allan absent, Ortner voting "No"*) and carried approved this ap-
plication subject to conditions as outlined by staff.
*Mrs. Ortner stated in clarification of her "No" vote that she felt that if
a person has a tennis court, he should be allowed to play on it; however,
with 22 neighbors protesting the lighting of the court, she felt that she
had to vote on the side of those people in the surrounding area who were
objecting.
CASE 5 0025-CUP - Application by the PALM SPRINGS YOUTH CENTER for a Conditional
Use Permit to allow youth center facilities use on the south side of Mesquite
between Mountain View Drive and Orange Avenue, W-R-1-C Zone, Section 19.
Action was taken on the draft Negative Declaration in the October 12, 1977,
meeting.
Planning Director stated that staff has been attempting to resolve the prob-
lems regarding the Youth Center site, and had resolved most of them. The
major problems were (1 ) the drainage structure on the property which distri-
butes water from the end of Desert Way onto the property; and (2) the types
of alternatives available to alleviate the drainage problem The two
alternatives are to construct a pipe to take water to another outlet away
from the property, or to abandon the drainage pipe construction and complete
Desert Way out to Mesquite Avenue - thus the water could be diverted to flow
down Mesquite into a sewer outlet.
Planning Director stated that the City Manager had informed him that the City
would participate in the funding of the alteration of the drainage system in
the amount of $13,000. to $14,000 based on preliminary engineering estimates.
Planning Director stated further that the staff recommendation was to approve
the Youth Center project subject to the recommendations of the Architectural
Advisory Committee and the Development Committee with the exceptions that
the Youth Center shall participate in the construction of a sidewalk and/or
bikepath across the property at such time as a Master Plan for same is imple-
mented; and that the facility shall be required to hook up to the existing
sewer on Mesquite.

Commissioner Harris complimented staff on finding an equitable solution to
most of the problems.
Commissioner Ostertag asked where the water flow was generated and stated
that in the event of area flooding a potential hazard as an attractive
nuisance will exist in close proximity to the Center.
Planning Director stated that there is a natural sheet flow due to the
configuration of the property, and that the Riverside County Flood Control
District recommendation would be to build a pad for the Youth Center up to
a specific level to lift the building out of the flood plain and then to
divert the sheet flow around the building.
Commissioner Ehrens asked if there was going to be a parking problem at
the center. Planning Director stated that in the development of that portion
of the park, staff was looking into a driveway access.
Commissioner Ehrens then stated that if the Parks Department wished to have
a street into the park, that department should build it.
Chairman declared the hearing open.
John Hollinger, 1089 Olive, President of the Youth Center Board, spoke in
favor an stated that staff was very cooperative in solving the problems that
had arisen. He also stated that there was very little traffic generated
by the center in terms of parking. He stated that the center would cooperate
with the City in paving a 70-foot parking strip, and that the City Engineering
Division would cooperate in this venture.
Since there were no further appearances, the hearing was closed.
Motion was made by La ham, seconded by Harris and carried (Allan absent,
Ostertag abstaining approving this application subject to conditions of the
Development Committee and also subject to the recommendations of the Archi-
tectural Advisory Committee as follows:
1 . That the standing seam material roof be wrapped over the facia and under
the soffit with all edges to be mitered.
2. That the overhang on the standing seam material roof be extended 2 feet.
3. That specific samples of the Tek-Crete and metal roof material be submitted.
4. Thtat the orange accent color be resubmitted.
5. That detailed landscape, irrigation, and exterior lighting plans be submitted.
6. That the revised Development Committee recommendations be met.

CASE 5.0029-CZ - Application by ROSE AND SAM MINASH for a change of zone from
W-0-5 to R-4, C-2, M-1 . Property located on the east side of Bogie Road
south of Vista Chino, W-0-5 Zone, Section 7.
Planning Director stated that there was a change in the request on the ap-
plication. He stated that originally the request was a zone change to R-4,
C-2, and M-1 , but that a letter from the applicants had been overlooked in
which they had requested that the whole 77 acres be zoned M-1 . He stated
further that since the property north of Vista Chino has been developed into
an industrial type of usage, and that the property across from the southerly
portion of the applicants' property was zoned M-1-P, a zone change to M71
might be feasible. However, this type of zone change would take a General
Plan amendment.
Planning Director stated that staff's recommendation would be to continue this
item until the Planning Commission meeting of January 11 , 1978, to give
staff time to prepare for consideration an amendment to the General Plan.
Chairman declared the hearing open.
Ben Ramsey, 2125 Via Robles, Oceanside, representing the applicants, presented
a rendering of an industrial park proposed for the site.
Since there were no further appearances, the hearing was closed.
Commissioner Harris stated that since staff had not considered the zone change
in the light of the request to M-1 , what would the Commission be asked to do.
Planning Director stated that a change in the General Plan would have to be
initiated by the Planning Commission, and that if the Commission would take
action to continue this item until January 11 , 1978, it would be appropriate
to direct staff to renotice the public hearing prior to January 11 , and also
to direct staff to prepare for consideration an amendment to the General Plan.
Commissioner Lapham stated that the "0-5" designation is really a holding zone
for consideration of future development Planning Director stated that that
is true, and that 0-5 also indicated some type of hazard on the property. In
this case there is a water course, a blowsand problem, and it is in the noise
zone of the airport.
Motion was made by Ehrens, seconded by Chase, and carried (Allan absent) con-
tinuing this item until January 11 , 1978, and directing staff to prepare for
consideration an amendment to the General Plan.
CASE 5.0030-CZ - Application by TOWNHOUSE BUILDERS for a change of zone from
R-G-A 8 to C-1 property located on north side of East Palm Canyon Drive
and Cherokee Way) Section 30.
The following was received from the Tribal Council :

"The Tribal Council , in accordance with recommendations of the
Indian Planning Commission, has consistently supported the
change of zone as now requested.
For example, the Tribal Council last advised the City of Palm
Springs on September 13 and 27, 1977, as follows:
' Item No. 2 - Case 5.0005 - Conditional Use Permit, N/W
corner East Palm Canyon Drive and Cherokee Way.
Under dates of August 9, and August 23, 1977, the Tribal
Council has advised the City of Palm Springs in the instant
Case No. 5.0005, as follows:
'The Tribal. Council has consistently approved a commercial
zone on the subject property, in agreement with the former
commercial zone applying prior to 1973. Most recently, the
Tribal Council has approved (July 12, 1977) the filing of a
negative impact report in the instant case. Further, said
Tribal Council has, in accordance with recommendations of the
Indian Planning Commission, approved the above request. '
,., 'On this date, September 13, the Tribal Council has reiterated
the latter position. Notwithstanding such advice, the City
Planning Commission is relying on wholly fanciful and unsup-
ported conclusions in disapproving the request, according to
a draft of Resolution No. 1963.
'There has been no fact or related information which even
remotely justifies a City Planning Commission conclusion of
unreasonable or excessive traffic problems if the application
is approved. Further, the latter Commission has not indicated
where "the sensitive uses" it purports to protect are located.
Such fantasizing disregards the fact that the request has been
supported by adjacent property owners as well .as the fact that
occupied commercial zones exist directly opposite on the south side
of E. Palm Canyon Drive; it ignores the former and historical com-
mercial zoning applicable to the property, and to the use thereof
for commercial purposes, both situations preceding the undisclosed
"sensitive uses". The use of adequate screening facilities can
be required, thus refuting any conclusion that one site should be
selected over another based on the ability to screen or "buffer".
"The proposed City Planning Commission Resolutions if adopted,
.would grossly discriminate against the Indian-trust land involved,
through reliance upon unsupported alleged traffic problems, when
in all cased the development of a new shopping center, as approved
in Case 5.998, must introduce new traffic problems, congestion,

and hazard, which would be avoidable by development as proposed
in Case 5.0005. '
On this date, October 25, the Tribal Council reiterated the above position
approving the change of zone as requested, and further recommends that the
change in the General Plan as indicated by City staff,. be processed and ap-
proved forthwith, instead of waiting until January 11 , 1978, per staff
report. "
Planning Director stated that staff recommendation was to continue this
item until January 11 also since this item, too, would have to have an amend-
ment to the General Plan.
Chairman declared the hearing open.
Paul Butler, 2488 Alhambra Drive, the applicant, stated that he wished to
create a buffer area to protect a future condominium project that is proposed
in the area. He stated that the development would consist of a coffee shop,
a health club with racket ball courts, and perhaps offices above the health
club.
Frank Barton, 87 Westlake Circle in Seven Lakes stated that the Board of
Directors and the Homeowners' Association of Seven Lakes had written the Plan-
ning Commission stating that.they were in accordance with this project.
There being no further appearances, the hearing was closed.
Commissioner Lapham asked if this change of zone application could also be
processed as a Planned Development. Planning Director stated that it could
be processed this way.
After further brief discussion motion was made by Lapham, seconded by Ehrens
and carried. (Allan absent) continuing this item until January 11 , 1978, and
staff was directed to prepare a General Plan amendment to bring before the
Planning Commission and City Council for consideration.
STUDY SESSION ARRANGEMENTS
Chairman stated that a study session is to be held for the Commissioners for
the Mowing purposes: (1 ) To review the purpose of various types of ap-
plications such as Planned Development Districts, Conditional Use Permits,
Variances, etc; and (2) To review Planning Commission responsibilities as
established by State law and local ordinances, rules, and procedures. The
date of this study session will be November 9 at 10:00 a.m. with luncheon
to follow. Commissioners will be notified by staff as to the place.

There were no public comments.
ENVIRONMENTAL ASSESSMENT ITEMS CONSENT AGENDA
Environmental evaluation reports were received by the Commissioners for
their review and. study prior to the Planning Commission meeting, Further
review may be dispensed with and all items approved by motion.
Motion was made by Chase, seconded by Ehrens (Allan absent). and carried
that a draft Negative Declaration be prepared for review and comment on
the following items;
TENTATIVE PARCEL MAP 11302 - Environmental assessment on rege.ust by HALLMARK
ENGINEERING, INC. for Joseph R. Barbera for approval of Tentative Parcel
Map 11302 on property bounded by Camino del Norte and Camino del Mirasol ,
R-1-A Zone, Section 10.
CASE 5 0034-CUP - Environmental assessment on request by HALLMARK ENGINEERING,
INC. for Joseph R. Barbera for a Conditional Use Permit to allow construc-
tion of a tennis court which would extend into the required front yard set-
back area for property located on the west side of Camino del Mirasol and south
of Camino del Norte, R-1-A Zone, Section 10.
MISCELLANEOUS
DETERMINATION by the Planning Commission concerning the classification of "Mopeds"
wit relationship to zoning restrictions.
The following was received from the Tribal Council ;
"Under date of October 11 , 1977, the Indian Planning Commission advised
the City of Palm Springs as follows;
'The Indian Planning Commission requests that further information
be provided as to definition of the problem purportedly confronting
the City. As stated in the agenda of October 12, the relationship
between a newly distributed private vehicle, and a "zoning restric
tion," is somewhat obscure. '
On this date, October 25, the Tribal Council reiterated the above
position of the Indian Planning Commission."
Planning Director read the description of "Mopeds" as provided by Philip M.
Gilbert, an attorney whose client is applying for a determination
for rental and sales of these vehicles in the C-1 and C-2 Zones.
Planning Director stated that in the C-2 Zone sales and display are allowed
under a Conditional Use Permit but that in the C-1 Zone neither of these is
allowed. He stated that the history of Palm Springs regarding motorized
bicycles is to deny sale or rental since their small size and slow speed

make them hazardous, and although they are not extremely noisy, they are
not "noiseless".
Commissioner Chase stated that it was impossible to have any control of a
motorized scooter, and that the vehicle is a good idea in areas where it
is used in place of automobiles, but it is not a good vehicle for Palm
Springs because of the traffic problems in the downtown area, among other
factors.
Further discussion followed regarding areas where these vehicles could
be sold and/or repaired.
Chairman interjected at this point stating that the Planning Commission
has worked long and hard to create and maintain an image of what .the
Commissioners feel that Palm Springs should be for tourists and residents
alike, and that bike paths now built throughout the City are a part of
this image. Motorized vehicles would not be prohibited from using these
paths and would make riding bicycles difficult. Chairman stated further
that if these motorized vehicles are allowed to gain a foothold in Palm
Springs, it would establish a precedent which would be difficult to over-
come.
f Commissioner Lapham stated that since bicycles can go faster than "Mopeds",
there is no reason to allow these vehicles into Palm Springs and that he
believed that persons can use rd_gular .bicycles on bike paths to reach
their destinations rather than "Mopeds"..
Further discussion followed regarding the applicant's request including
the hazards involved at the rental location if on a busy street.
Planning Commission took no action on this application, thus reaffirming
the validity of the present ordinance.

TENTATIVE TRACT AND PARCEL MAPS
Planning Director reviewed and explained the maps and the Planning Commission
discussed and took action on the following Tentative Parcel Map based on the
finding that the proposed subdivision to with the provisions for design
and improvement are consistent with the General Plan of the City of Palm
Springs and will not have a significant adverse effect on the environment,
and subject to conditions as outlined.
TENTATIVE TRACT MAP 10633 - KWL ASSOCIATES for Effingham Homes for approval of
Tentative Tract Map 10633 property located between Bogie Road and Birdie
Way, north of Waverly Drive, extended) R-G-A (8) Zone, Section 30.
The following was received from the Tribal Council :
"Owing to the holiday of October 24, 1977, the Tribal Planning
Consultant was unable to contact City staff, .and receive the
latest copy of the above map. The Tribal Council , therefore,
and in accordance with recommendations of the Indian Planning
Commission, recommends a two-week continuance to permit receiv-
ing and study of said map.
Commission response to draft Negative Declaration and action for filing.
No response received.
Motion was made by La ham, seconded by Chase (Allan absent) and carried unani-
mously recommending approval of Tentative Tract Map 10633 subject to all con-
ditions of the Development Committee.

ARCHITECTURAL APPROVAL ITEMS
The Planning Commission reviewed plans, discussed and took action on the
following items .involving architectural approval , subject to the conditions
as outlined.
CASE 3.002 - Application by ALLWEST DEVELOPMENT CORPORATION for.Amado Associates,
Inc. for Architectural Approval of 88 condominium units area bounded by
Amado Road, Hermosa Drive, and Andreas Road) R-G-A (8) Zone, Section 14.
Motion was made by Chase, seconded by Ehrens (Allan absent) and unanimously
carried approving the revised elevations and site plan subject to the fol-
lowing conditions:
1 . That the AAC review the. working drawings.
2. That landscape, irrigation, and exterior lighting plans be submitted.
3. That in regard to the plantings a planter be incorporated against the
garden wall at the end .of the open parking.
CASE 3.006 - Application by COBLE, BRAMLETT, SNEDAKER CONSTRUCTION AND DEVELOPMENT
CO. for Architectural Approval of single-phase condominium project on pro-
perty one block east of Caballeros on the north side of Ramon Road, R-2
�... Zone, Section 14.
Commission response to draft Negative Declaration and action for filing.
No response received.
Motion was made by Ehrens, seconded by Lapham (Allan absent) and unanimously
carried approving this application subject to the following condition:
1 . That detailed landscape, irrigation, and exterior lighting plans be
submitted.
CASE 3.007 Application b JAMES E. BROWN for Architectural Approval of 84-unit
apartment project single and two-story at 3400 East Ramon Road, R-2 Zone,
Section 18.
Motion was made by Ehrens, seconded by Harris (Allan absent) and unanimously
carried approving this application subject to the following condition:
1 . That detailed landscape, irrigation, and exterior lighting plans be
submitted.

CASE 3.009 - Application by PALM SPRINGS MORTUARY (International Funeral Services)
for Architectural Approval of alterations and additions to commercial buil-
ding (the Palm Springs Mortuary) at 4107 Sunny Dunes Road, M-1 Zone, Sec-
tion 19.
Motion was made by Lapham, seconded by Chase (Allan absent) and unanimously
carried approving this application subject to the following conditions:
1 . That the roof material be changed to either redwood or plaster with that
to be reviewed by staff.
2. That detailed .landscape, irrigation, and exterior lighting plans be
submitted.
CASE 3.013 - Application by GARY W. KNUTSON for A & P Associates for Architectural
Approval of landscape and irrigation plans for retail/office complex located
on Calle Encilia, C-1-A-A Zone, Section 14.
Motion was made by Lapham, seconded by Ehrens (Allan absent) and unanimously
carried approving this application subject to staff's working out some details
of the landscaping plans with the applicant.
CASE 3.012 - Application by KENT REALTY for Architectural Approval of remodel
of facia and sign program at 1063 N. Palm Canyon Drive, C-1 Zone, Section 10.
Motion was made by Ehrens, seconded by Chase (Allan absent) and unanimously
carried approving this application subject to the following conditions:
1 . That the proposed wood siding runs in a single direction on the facia
and a single direction on the base.
2. That the sign program be individual letters on the wood.
CASE 3.016 - Application by ROBERT AND BEVERLY DEAN for Architectural Approval of
ornamental iron gate and fence closing private property at entrance at end
of deadend road (Via Monte Vista), 2170 Via Monte Vista, R-1-C Zone, Section 3.
Motion was made by Lapham, seconded by Harris (Allan absent) and carried
unanimously approving this application subject to the following conditions:
1 . That staff review the installation.
2. The addition of any necessary landscaping deemed necessary by staff.

CASE 5 0014-CUP -Application by THOMPSON ARCHITECTURAL GROUP for revised
site plan and recreation building elevations on 249 room hotel complex
site on north side of Tahquitz-McCallum Way, between Calle Encilia and
Calle El Segundo, C-1-AA and R-4-VP Zones, Section 14.
Motion was made by Chase, seconded by Ehrens (Allan absent) and unanimously
carried approving this application of a revised site plan for the "B" site
and the proposed recreational building for this project.
CASE 2.964 -Application by ALFRED H. COOK for Architectural Approval of revised
