September 28, 1977 PLANNING COMMISSION MEETING MINUTES Page 2 PUBLIC HEARINGS CASE 5.0013-CUP - Application by JAMES HOUSTON_for a Conditional Use Permit to allow night lighting for a tennis court located on the south side of Via Lola, between North Palm Canyon Drive and Cahuilla Road, R-1--C Zone, Section 10. Planning Director stated that this item had been continued from the July 13, meeting because no response had been received from adjacent property owners to the east' who had voiced concern when the item had been on the agenda in 1976, to allow shrubs and trees on- the site to grog, and to allow out of town property owners enough time to return to Palm Springs after notifica- tion by the City of a public hearing. Planning Director then read previous recommendations made on this project by the Development Committee and stated that one letter had been received in opposition to the proposed project, that of Joseph W. Lowell . Planning Director further stated that the condominium property owners had not been listed by the title company as property owners in the 400' area because taxes had been paid under one name instead of each owner. Planning Director then circulated a photograph showing how the shrubbery has grown since the time of the first application and then stated that the applicant could not attend the meeting and had requested that a conti- nuance be granted if there was a possibility of the conditional use permit being denied. Planning Director also stated that staff's opinion was that the lighting scheme proposed was inadequate, and that the applicant should provide line of sight studies of the lighting plan as it affects the condominium owners and that alternate types of lighting should be explored by the applicant, Commissioner Lapham asked if the 24 condominium owners had now been noticed, Planning Director stated that the list would be furnished by the homeowners' association after the meeting. Commissioner Ehrens asked if names are received and letters sent out, would the public hearing have to be held within a certain length of time. Planning Director stated that the City has met its legal responsibility inso- far as noticing and that the 24 property owners would be notified additionally, and that the hearing on this item should be continued to the October 26, 1977, meeting. Acting Chairman declared the hearing open, and the following person spoke from the audience in opposition: Joseph W. Lowell , 197 Via Lola, #12 stated that the condominium property owners had understood that the tennis court was to be used for giving tennis lesson-s which would add to the noise and confusion, and that he would like to see the application turned down finally if the court is to be used for lessons. He also stated that he wouldlike a continuance of 60 days so that the owners could be notified and have.-an opportunity to return. Commissioner Harris stated that he would like for the record to show that staff had met its legal responsibility for noticing, and that the 24 condominium owners would be notified as soon as the list was received. This item was continued to the October 26, 1977, meeting. PUBLIC COMMENTS None ENVIRONMENTAL ASSESSMENT ITEMS CONSENT AGENDA Environmental evaluation reports were received by the Commissioners for their review and study prior to the Planning Commission meeting. Further review may be dispensed with and all items approved by motion. CASE 5.0029-CZ - Application by ROSE AND SAM MINASH for a change of zone from W-0-5 to R-4, C-2, M-1 . Property located on Bogie Road between Vista Chino and Ramon Road, W-0-5, Section 7. CASE 5.0030-CZ - Application 4Y TOWNHOUSE BUILDERS for a change of zone from R-G-A (8) to C-1 . Property located on north side of East alm anyo` n-'Fi, ive and Cherokee Way, Section 30. The following was received from the Tribal Council re:. Case 5,0030-CZ: "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, has consistently supported the change of zone as now requested. For example, the Tribal Council last advised the City of Palm Springs on September 13, 1977, as follows: ' Item No. 2 - Case 5.005 - Conditional Use Permit, N/W corner East Palm Canyon Drive and Cherokee Way. Under dates of August 9, and August 23, 1977, the Tribal Council has advised the City of Palm Springs in the instant Case No, 5.005, as follows: 'The Tribal Council has consistently approved a commercial zone on the subject property, in agreement with the former commercial zone applying prior to 1973. Most recently, the Tribal Council has ap- proved (July 12, 1977) the filing of a negative impact report on the instant case. Further, said Tribal Council has, in accordance with recommendations of the Indian Planning Commission, approved the above request. ' �. September 28, 1977 PLANNING COMMISSION MEETING MINUTES Page 4 ENVIRONMENTAL ASSESSMENT ITEMS (Continued) CASE 5.0030-CZ (Continued) On this date, September 13, the Tribal Council has reiterated the latter position. Notwithstanding such advice, the City Planning Commission is relying on wholly fanciful and unsupported conclusions in disapproving the request, according to a draft of Resolution No. 1963. There has been no fact or related information which even remotely justifies a City Planning Commission conclusion of unreasonable or excessive traffic problems if the application is approved. Further, the latter Commission has not indicated where "the sensi- tive uses" it purports to protect are located. Such fantasizing disregards the fact that the request has been supported by adja- cent property owners, as well as the fact that occupied commercial zones exist directly opposite on the south side of E. Palm Canyon Drive; it ignores the former and historical commercial zoning appliable to the property, and to the use thereof. for commercial purposes, both situations preceding the undisclosed- "sensitive uses". The use of adequate screening facilities can be required, thus refu- ting any conclusion that one site should be selected over another based on the ability to screen or "buffer". The proposed City Planning Commission resolution, if adopted, would grossly discriminate against the Indian-trust land involved, through reliance upon unsupported alleged traffic problems, when in all cases the development of a new shopping center, as approved in Case 5.998, must introduce new traffic problems, congestion, and hazard, which would be avoidable by development as proposed in Case 5.005. 1 On this date, and in reference to the present Environmental Assessment proceeding, the Tribal Council recommends acceptance of a Negative Impact Report." Planning Director stated that staff wanted to defer environmental assessment on Cases Nos. 5.0029-CZ and 5.0030-CZ until it is determined whether or not a General Plan amendment should be initiated. These items were continued to the October 26, 1977, meeting. Foster, for approval of Tentative Parcel Map 11147 (area between Santa Rosa Drive and Ramon Road) R-1-A Zone, Section 15. �.., September 28, 1977 PLANNING COMMISSION MEETING MINUTES Page 6 TENTATIVE TRACT AND PARCEL MAPS Senior Planner reviewed and explained the maps and the Planning Commission discussed and took action on the following Tentative Tract and Tentative Parcel Maps, based on the finding that the proposed subdivisions, together with the provisions for design and improvement are consistent with the General Plan of the City of Palm Springs and will not have a significant adverse effect on the environment, 'and subject to conditions as outlined TENTATIVE PARCEL MAP 11004 - Re uest b HALLMARK ENGINEERING; INC, for Harr Licker Sunrise Center for approval of Tentative Parcel Map 11004 divi- ding 5.801 acres into 4 parcels (southeast corner of Tahquitz-McCallum and Sunrise Way) C-D-N & P Zone, Section 13. Commission response to written comments on draft Negative Declaration and action for filing. The following was received from the Tribal Council : "The Tribal Council , in substantial accordance with recommenda- tions of the Indian Planning Commission, approved the above Tentative Map without the qualification of insulation of the units, and also in accordance the following conditions: 1 . That the area involved in proposed lots 1 , 2, 3, 4, 7, and 8 be redesigned to eliminate lots fronting on Farrell Drive, a heavy traffic street, which are de- pendent on vehicular access to said Farrell Drive, and 2. That the newly designed area referred to in No. 1 , above, be enclosed with a solid masonry wall , approxi- mately 6 feet in height, along the Farrell Drive frontage of said area." Planning Director stated that the City has been discouraging double frontage lots because of the maintenance problem and staff would recom- mend that double frontage not be allowed on this project. Motion was made by Ehrens, seconded by Allan, and unanimously carried (Chase and Ortner absent) ordering the filing of a Negative Declaration and recommending approval of Tentative Tract Map 10736 subject to Develop- ment Committee recommendations, notwithstanding the recommendations of the Tribal Council . TENTATIVE TRACT MAP 10856 - Request by JOHN G. GOETTEN representing Esther Voorhees, for approval of Tentative Tract Map 10856,for a one-lot sub- division of 4.058 acres (Ramon Road and Hermosa, northeast corner) R-2 Zone, Section 14. MISCELLANEOUS CASE 5.931 (TIME EXTENSION) - Application by the CHURCH OF THE NAZARENE for a one-year extension, of an approved Conditional Use Permit to allow construction of a church on South Avenida Caballeros, north of Ramon Road, R-G-A (8) Zone, Section 14. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, offers no objection to the exten- sion of time requested. " Motion was made by Allan, seconded by Ehrens, and unanimously carried (Chase and Ortner absent) approving a one-year time extension of this Conditional Use Permit. LEGISLATIVE ACTION CONSIDERATION by the Planning Commission for approval of Annexed Area No, 1 to the Preliminary Plan for the Palm Springs Central Business District Redevelopment Project. The following was received from the Tribal Council : "The Tribal Council , under date of September 13, 1977, advised the City of Palm Springs as follows: 'The Tribal Council , in general accordance with recommendations of the Indian Planning Commission, is of the strong opinion that additional and extensive written information should be available to the public and prior to further formal consideration September 28, 1977 PLANNING COMMISSION MEETING MINUTES Page 10 LEGISLATIVE ACTION (Continued) CONSIDERATION by the Planning Commission for approval of Annexed Area No. 1 Continued of the proposed annexation, in the following areas of interest: 1 . An objective estimate of the total cost to the public, with explanation of reasons therefore. 2. The generation and distribution of tax monies, and the pro- posed use and distribution of tax increments, if any, from the proposed hotel expansion. 3. The type and application of proposed bonding procedures. 4. The diversion, if any, of general tax funds from normal ave- nues of expenditure, i.e, public works, administration, recreation, etc. " Planning Director stated that this item has been requested for continuance by the Redevelopment Director because the DDAC has requested an open forum be held on this controversial item to allow interested persons to speak. After discussion Commission agreed to continue this item to the October 12, 1977 meeting of the Planning Commission and to set a date of October 10 at 7:30 p.m. in the Council Chamber for a joint meeting (open forum) with the DDAC to discuss the item. September 28, 1977 PLANNING COMMISSION MEETING MINUTES Page 11 ARCHITECTURAL APPROVAL ITEMS The Planning Commission reviewed plans, discussed and took action on the following items involving architectural-"approval, subject to the conditions as outlined: CASE 2.998 Application 'by H. LAPHAM (H & L. Company) for architectural approval of plans for construction of commercial/shop building at 605 East Sunny Dunes Road, M-1 Zone, Section 23, Motion was made by Ehrens, seconded by Allan and carried (Chase and Ortner absent, Laphamam abstaining) approving the plot plan and building elevations as submitted and subject to the following conditions. 1 . That detailed color, materials, landscape, irrigation, and exterior lighting plans be submitted, 2. That garage doors be left off the buildings, 3. That the parking provided has been based on industrial uses only, . and that retail , commercial , or office use will not be allowed unless additional parking is provided; CASE 2.999 Application by H. LAPHAM (Financial Structures) for architectural approval of plans for construction of a financial/medical complex at 1151 North Indian Avenue, C-1 Zone, Section 10. Motion was made by Allan, seconded by Harris, and carried (Chase and Ortner absent, Lapham abstaining) approving revised plans as submitted, and sub- ject to the following conditions: 1 . That detailed plans for colors, materials, landscaping, irrigation, and exterior lighting be submitted. 2. That a sign plan for the entire complex be submitted. 3. Motion was made by Allan, seconded by Harris (Ortner and Chase absent) and unanimously carried approving this application to the following conditions: 1 . That the tennis court .fence be left the natural metal color. NOTE: Tennis court is not proposed to be lighted. CASE 2.824 - Application b JAMES E. -BROWN-for architecrural "approval of colors, materials, landscape, and irrigation plans for a 36-unit apartment complex on property located on Vista Chino, R--3 Zone, Sec- tion 3. Motion was made by Ehrens, seconded by Harris and unanimously carried (Chase and Ortner absent] approving this p ication as submitted. SIGN APPLICATION*- Application by"SMITH'S FOOD KING"for architectural approval of sign at 1751 North Sunrise Way. Motion was made by Ehrens, seconded by Allan, and unanimously carried (Chase and Ortner absent) approving this application subject to the following conditions: 1 . That the letters be either reverse channel or regular channel with rust color faces. 2. That the maximum size of the largest letter is not to exceed 4 112 ' in height. 3. That the words "open 24 hours" under the letters be allowed since it conforms to the spirit of the sign ordinance. Motion was made by Allan, seconded by Harris, and unanimously carried (Chase and Ortner absent) approving this sign application as submitted. CASE 5.0002-PD-73 - Application by ROBERT GRUNDT (Saddlerock Condominiums) for architectural approval of patio trellis plans and pool equipment structure on Highway 111 , R-3 Zone, Section 24. Motion was made by Allan, seconded by Harris, and unanimously carried (Chase and Ortner absent) approving unit alteration, patio trellis plan, and pool equipment structure plans as submitted. CASE 2.892 - Application by JOHN WESSMAN (Carls' Jr. Restaurant) for archi- tectural approval of exterior trellis plans, landscape and irrigation plans and signing. Motion was made by Allan, seconded by Ehrens, and carried (Chase and Ortner absent, Harris abstaining) approving this application subject to the following conditions: 1 . That the stone base of the sign be built into the ground. 2. That the maximum size of the sign be 2 1/2 ' by 8' . 3. That the wood borders be stained dark and interior wood be stained light to match stain colors used on the building. 4. That the red border around the inside of the frame be eliminated. 5. That pl:eki'gJass color #2325 be used and that staff make final determination on the color if this color proves to be inadequate. 6. That the landscape and irrigation plans be restudied. { September 28, 1977 PLANNING COMMISSION MEETING MINUTES Page 14 ADDED STARTERS DETERMINATION by Planning Commission to consider sale of certain properties at the municipal golf course as to conformance with the General Plan. Motion was made by Ehrens, seconded by Harris, and unanimously carried (Chase and Ortner a`bs_e__nt7 to approve sale of certain properties as noted above per recommendation of the Parks and Recreation Commission. COLORS AND SIGNS for the Big Yellow House at 150 E. Vista Chino. Motion was made by Ehrens, seconded by Allan, and unanimously carried (Ortner and Chase absent) approving logo sign and building color for the Big Yellow House subject to the following conditions: 1 . That staff review color (which is to be painted on a portion of the building for review) . 2. That the yellow plastic on the logo sign be changed to plexiglass color number 2325. 3. That the additional area being addedto the Vista Chino sign indica- ting family style dining be subject to staff approval . * * * * * * * * * * * * * * TENTATIVE TRACT MAP 9913 - Request by T. D. MARGRAVE, JR. for Ronson Invest- ment Inc. for approval of Tentative Tract Map 9913 for a one-lot sub- division of 84,000 square feet between Vista Chino and Cottonwood Road, R-2 Zone, Section 11 . This item is categorically exempt from environmental assessment. Motion was made by Allan, seconded by Ehrens, and unanimously carried (Chase and Ortner absent) recommending approval of Tentative Tract Map 9913. CONTINUED ITEMS The following item was continued to the Planning Commission meeting of October 12, ,1977: CASE 5.997-PD-76 - Application by MITCHELL LAUFORD & ASSOCIATES for architectu- ral approval of FINAL detailed development plans -for completion of an existing shopping center located at the southeast corner of Tahquitz- McCallum Way and Sunrise Way, C-D-N & P Zone, Section 13. Planning Director stated that the AAC approved building elevations ' September 28, 1977 PLANNING COMMISSION MEETING MINUTES Page 15 CONTINUED ITEMS (Continued) CASE 5.997--PD-76 (Continued) as submitted and final plot plan, subject to some minor alterations in trash location areas and parking, and subject to approval of a detailed landscape plan. Planning Director also stated that the traffic engineer had recom- mended that the north driveway of the complex be closed off because there had been a number of accidents there. Mitchell Lauford, the applicant, stated that he and his associates were very willing to concede to all other recommendations of the City staff, but would object strongly to closure of this driveway because of the inconvenience to the patrons of the stores in this complex. Commissioner Ehrens stated that as more traffic was generated in that area during the coming years, closure would be effected anyway, so that the City was just taking an opportune time to effect closure. After further discussion, Ehrens moved: to approve Case 5.997 subject to the Traffic and Parking Commission's recommendations on the closure of the driveway as specified in the traffic engineer's recommendation to the Planning Commission and also subject to the architectural ad- visory committee's recommendations. This motion died for lack,.of a second. After further discussion with staff and applicant, it was moved by Harris, seconded by Allan and carried (Chase and Ortner absent, Ehrens voting "No") that this item would be continued to October 12, 1977, meeting to receive recommendations from the Traffic and Parking Commis- sion. * * * * * * * * * * * * * * ITEMS FOR RESTUDY The following items were removed from the Planning Commission agenda pend- ing restudy. Applications will -be rescheduled for hearing only after re- vised submittals have been processed. CASE 2.993 Application by D & B BUILDERS CO. , INC for architectural approval of plans for a 33-unit apartment complex, 750 Murray Canyon Drive, R�2 Zone, Section 35.
