CASE 5.0023-CUP - Application by MURRAY CONSTRUCTION COMPANY for a Conditional
Use Permit to allow a 40-unit single story condominium use on property
situated on the southwest corner of Camino Parocela and Cerritos Drive,
R-G-A (8) & R-l-C Zones, Section 24.
This item continued by Commission to October 12, 1977, Planning Commission
meeting for plan revision at applicant's request.
CASE 5.0027 - Initiation by the CITY OF PALM SPRINGS to amend the General Street
Plan by deleting Avenida Olivos south of Tachevah, Section 11 .
This item continued by Commission to October 12, 1977, Planning Commission
meeting at which time a staff report will be presented which includes input
from residents of the area and cost estimates for the project.

CASE 5.998-CUP - Approval of Planning Commission .Resolution No. 1962 granting
M. J. Dragicevich a Conditional Use Permit.
CASE 5.0005-CUP - Approval of Planning Commission Resolution No. 1963 denying
the application of Townhouse Builders Corp. , for a Conditional Use Permit.
CASE 5.9998-CUP
The following was received from the Tribal Council :
"The Tribal Council has not received a copy of proposed Resolution
No. 1962, and therefore is unable to comment thereon. However,
said Council has heretofore recommended requiring a full Environ-
mental Impact Report, which was not required by the City of Palm
Springs, and as noted below, it appears from the City Planning
Commission is violating its own Ordinance, is relying on wholly
subjective and fanciful conclusions, rather than findings, in
approving the above application for conditional use."
Planning Director read Resolution No. 1962 to Commission and audience.
M. J. Dragicevich stated that as a developer he questioned the requirement
that the developer participate in the funding of the signalizati;on of the
intersection of Bogie and East Palm Canyon since that intersection would
probably have been signalized eventually anyway.
Commissioner Ehrens stated that perhaps the state should be approached for
participation before the shopping center is built.
Chairman stated that this funding condition in the resolution could not be
deleted, and that the developer would have to pay part of the cost of the
signalization if it becomes necessary.
Commissioner Lapham stated that the City Council would make the decision
regarding the signalization in any case, not the Planning Commission,
Following this discussion motion was made by La ham, seconded by Ehrens
(Chase absent) and unanimously carried approving Planning Commission eso-
lution No. 1962 granting M. J. Dragicevich a Conditional Use Permit for a
neighborhood shopping center-on the south side of East Palm Canyon Drive
between Matthew Drive and Dunn Road, R-3 Zone, Section 30.

LEGISLATIVE ACTION
CASE 5.0005-CUP
The following was received from the Tribal Council :
"Under dates of August 9, and August 23, 1977, the Tribal Council
has advised the City of Palm Springs in the instant Case
No. 5.0005, as follows:
'The Tribal Council has consistently approved a commercial
zone on the subject property, in agreement with the former
commercial zone applying prior to 1973. Most recently, the
Tribal Council has approved (July 12, 1977) the filing of
a negative impact report in the instant case. Further, said
Tribal Council has, in accordance with recommendations of the

Indian Planning Commission, approved the above request. '
On this date, September 13, the Tribal Council has reiterated the
latter position.
Notwithstanding such advice, the City Planning Commission is rely-
ing on wholly fanciful and unsupported conclusions in disapproving
the request, according to a draft of Resolution No. 1963.
There has been no fact or related information which even remotely
justifies a City Planning Commission conclusion of unreasonable
or excessive traffic problems if the application is approved.
Further, the latter Commission has not indicated where "the sensi-
tive uses" it purports to protect are located. Such fantasizing
disregards the fact that the request has been supported by adjacent
property owners, as well as the fact that occupied commercial zones
exist directly opposite on the south side of E. Palm Canyon Drive;
it ignores the former and historical commercial zoning appliable
to the property, and to the use thereof for commercial purposes,
both situations preceding the undisclosed "sensitive uses". The use
of adequate screening facilities can be required, thus refuting any
conclusion_that one site should be selected over another based on
the ability to screen or "buffer".
The proposed City Planning Commission Resolution, if adopted, would
grossly discriminate against the Indian-Trust land involved, through
reliance upon. unsupported alleged traffic problems, when in all cases
the development of a new shopping center, as approved in Case 5.998,
must introduce new traffic problems, congestion, and. hazard, which
would be avoidable by development as proposed in Case 5.0005. "
Planning Director read Resolution No. 1963 to Commission and audience.
Motion was made by Ehrens, seconded by Allan (Chase absent) and unanimously
carried approving Resolution No. 1963 denying the application of Townhouse
Builders Corporation for a Conditional Use Permit, to allow construction of
an 8 acre neighborhood shopping center on the northwest corner of East Palm
Canyon Drive and Cherokee Tay.

ENVIRONMENTAL ASSESSMENT ITEMS - CONSENT AGENDA
Environmental Evaluation Reports were received by the Commissioners
for their review and study prior to the Planning Commission meeting;
further review may be dispensed with and all items approved by motion
Motion was made by Ehrens, seconded by Harris (Chase absent) with Lapham
abstaining on Tentative Tract Map 10731 and Ortner abstaining on Tentative
Tract Map 10856, and unanimously carried that a draft Negative Declaration
be prepared for public review and comment on the following items.

ING, INC. representing Stuart W. Cramer, for approval of Tentative Tract
Map 10830 dividing 13.7+ acres into 42 lots, R-1-C Zone, Section 11 .
TENTATIVE TRACT MAP 10856 - Environmental Assessment on request by JOHN G. GOETTEN
representing Easter Voorhees, for approval of Tentative Tract Map 18056 for a

TENTATIVE TRACT AND PARCEL MAPS
Senior Planner reviewed and explained the maps and the Planning Commission
discussed and took action on the following Tentative Tract and Tentative
Parcel Maps, based on the finding that the proposed subdivisions, together
with the provisions for design and improvement are consistent with the
General Plan of the City of Palm Springs and will not have a significant
adverse effect on the environment, and subject to conditions as outlined.
TENTATIVE TRACT MAP 10754 - Request by WEBB ENGINEERING, INC representinq Caravan
International for approval of Tentative Tract Map 10754 dividing 19.4 acres
into 21 lots, R-3 Zone, Section 2.
Environmental assessment previously done under Parcel Map 9475.
Motion was made by Allan, seconded by Harris, and unanimously carried (Chase
absent) ordering the filing of a Negative Declaration and recommending
approval of Tentative Tract Map 10754 subject to all conditions of the Devel-
opment Committee.
TENTATIVE TRACT MAP 9742 - Request by WEBB ENGINEERING, INC representing Canyon
Site Corporation or Nominee for 'approval of Tentative Tract Map 9742 for a
single lot subdivision of 5.92 acres, R-2 Zone, Section 35.
Commission response to written comments on draft Negative Declaration and
action for filing.
No comments received.
Motion was made by Ehrens, seconded by Allen, and unanimously carried (Chase
absent) ordering the filing of a Negative Declaration and recommending
approval of Tentative Tract Map 9742 subject to all conditions of the Develop-
ment Committee.

Mildred L. Patencio for approval of Tentative Tract Map 10594 to subdivide

The following was received from the Tribal Council :
"The Tribal Council , in accordance with recommendations of the Indian
Planning Commission, approved the above tentative map.
Said Tribal Council further directed that the City Planning Commis-
sion agenda should be corrected to indicate the name of the Indian
owner as Mildred L. Patencio, instead of "Mildred L. Pete". Further,
that the Tentative Map should be revised to delete any reference to
`"Agua Caliente Indians" as owners or developers. "
Motion was made by Allen, seconded by Harris, and unanimously carried (Chase

the filing of a Negative Declaration and recommending
approval of Tentative Tract Map 10594 subject to all conditions of the
Development Committee.

"The Tribal Council , in accordance with recommendations of the Indian
Planning Commission, approved the above Tentative Map. "

11.5+ acres into 40 lots for leasehold interest only, R-1-C Zone, Section 14.
Environmental Assessment previously done.
Motion was made by Allan, seconded by Harris, and unanimously carried, (Chase
absent) recommending approval of Tentative Tract Map 10508.
LEGISLATIVE ACTION
CONSIDERATION by the Planning Commission for approval of Annexed Area No. 1
to the re iminary Ian or t e a m Springs Central Business District
Redevelopment Project.
The following was received from the Tribal Council :
The Tribal Council , in general accordance with recommendations of
the Indian Planning Commission, is of the strong opinion that ad-
ditional and extensive written information should be available to
the public and prior to further formal consideration of the proposed
annexation, in the following areas of interest:
1. An objective estimate of the total cost to the public,
with explanation of reasons therefore.
2. The generation and distribution of tax monies, and the
proposed use and distribution. of tax increments, if any,
from the proposed hotel expansion.
3. The type and application of proposed bonding procedures.
4. The diversion, if any, of general tax funds from normal
avenues of expenditure, i. e. , public works, administra-
tion, recreation, etc. "
Redevelopment Director stated that the DDAC had recommended approval of the
preliminary plan for Annexed Area No. 1 to the existing redevelopment area
for purposes of assembling land for expansion of the Sheraton-Oasis Hotel .
He also stated that the Tribal Council requested that additional information
be available to the public prior to the proposed annexation as indicated in
its recommendations. Director stated that some of these Tribal Council re-
quests were part of the redevelopment plan consideration which is yet to be
drafted and which will be the subject of a public hearing to be held in Janu-
ary of 1978.
Commissioner Lapham asked the Director what the Planning Commission was being
asked to approve.

CONSIDERATION (Continued)
Chairman asked what the purpose was of taking the toe of the mountain. Direc-
tor stated that it would be preserved for open space.
Commissioner Ehrens stated that he was not ready to approve or disapprove
this project, and that a study should be made and public hearings scheduled
regarding this project.
Director stated that public hearings were not required by state law at the
Planning Commission level , and that the Planning Commission would only be
asked to approve that proposed use of the area was in conformance with the
General Plan of the City.
Chairman then read the proposed resolution regarding adoption of the Prelimi-
nary Plan.
Planning Director stated that the Planning Commission is charged only with the
responsibility of reviewing land use projects being compatible with the City
General Plan, and that.the Commission need only state that the proposed land
use is' compatible.
Commissioner Harris stated that he would like to see the resolution stated
along the lines which the Planning Director had stated. He also asked if this
would be the last input the Commission would have.
Redevelopment Director stated that the Planning Commission would have input
on the EIR scheduled for a November agenda.
After further discussion, the Commission set a date of,September 19, 19772
in the Crest Room of the Spa Hotel at 9;00 a.m. for a study. sess on at which
the redevelopment director could present the project in greater detail ,

ARCHITECTURAL APPROVAL ITEMS
The Planning Commission reviewed plans, discussed and took action on
the following items involving Architectural Approval , subject to the
conditions as outlined:
CASE 2.980 - Application by HARLAN & ASSOCIATES (Sunrise Harlando Estates)
for Architectural Approval of revised site plan, elevations, colors,
and materials for construction of a 61-unit project with recreational
facilities, 220 South Sunrise Way, R-2 Zone, Section 13.
Motion was made by Harris, seconded by Allan (.Chase absent) and unanimously
carried, approving this application subject to the fallowing conditions:
1 . That an additional 5 feet of landscaping be provided between the interior
private street and Baristo Road.
2. That the U-shaped staircase detail be used throughout the project.
3. That the wood balcony detail wrap around and include the soffit areas.
4. That detailed carport elevations be submitted.
5. That the AAC review the final working drawings.
6. That detailed landscape, irrigation, and exterior lighting plans be submitted.
7. That the two entrance scheme be used.
8. That all recommendations of the Development Committee be met.
CASE 2.986 - Application by RODARTE BROS for Architectural Approval of revised
exterior elevations, site plans, colors, and materials for an ice storage
building on Williams Road, M-1 Zone, Section 19.
Motion was made by Ehrens, seconded by Allan, (Chase absent) and unanimously
carried, approving cri s a plication sub-Jec o the following conditions:
1 . That an integral color slump block be used throughout the building.
2. That the windows be set on the inside of the block.
3. That detailed colors and materials be resubmitted for approval.
4. That detailed landscaping, irrigation, and exterior lighting plans be
submitted.
5. That all recommendations of the Development Committee be met.

CASE 2.985 — Application by P. H. FREEMAN for Architectural Approval of plans for
construction of a 94-um t condominium project on the north side of E. Palm
Canyon Drive between Deepwell Road and Sagebrush, R-2, R-3, and "0" Zones,
Section 23.
Motion was made by Ehrens, seconded by Allan (Chase absent) and unanimously
carried approving this application subject to the following conditions:
1 . That the overhang shown for the carports along East Palm Canyon Drive
provide openings for light and plant material ,
2. That a detailed plan of the front wall be submitted,
3. That detailed landscaping, irrigation, and exterior lighting plans be
submitted.
4. That detailed plans for tennis court lighting be submitted.
5. That all recommendations of the Development Committee be met.
CASE 2.659 - Application by DR. ROBERT FRANKS (Old World Restaurant) for Architec-
tural Approval of installation of canvas awning extending from building to edge
of patio, property located at 262 S. Palm Canyon Drive.
Motion was made by La ham, seconded by Harris (Chase absent) and unanimously
carried approving this application subject to the following conditions:
1 . That detailed plans showing the specific action of the mechanical system
of the awning be submitted for staff review.
2. That if the awning deteriorates, it must be replaced or removed,
CASE 2.997 - Application by GEORGE SIGAND for Architectural Approval of plans,
colors, and materials for construction of a hillside residence, 2355 Vista
Drive, R-1-B Zone, Section 3.
Motion was made by Ehrens, seconded by Harris (Chase absent), and unanimously
carried approving this application subject to the following conditions:
1 . That the mass color be resubmitted and suggesting a Navajo White color
with that being subject to staff approval .
2. That the large boulders be placed against the wall surrounding the pool
on the street side of the walla
3. That detailed landscape and irrigation plans be submitted.

Motion was made by Harris, seconded by La ham (Chase absent) and unanimously
carried approving this application subject to the following conditions:
1 . That further study be made of the raised tennis court detail .
2. That detailed plans for colors and materials be submitted.
3. That detailed landscape, irrigation, and exterior lighting plans be
submitted.
4. That all recommendations of the Development Committee be met.
CASE 2.992 - Application by WORLD WIDE LEASING ENTERPRISES for Architectural
Approval of plans for remodel of Dollar Rent A Car Office., 351 North
Indian Avenue, C-B-D Zone, Section 15.
Motion was made by Allan, seconded by Ehrens (Chase absent, Harris abstain-
ing) and carried approving this application subject to the following condi-
tions:
1 . That an elevation for the south side be submitted for staff review.
2. That detailed landscape and irrigation plans are to be submitted. The
plans are to include the relocation of the palm trees from the south
side of the building to the front of the building.
3. That all recommendations of the Development Committee be met.

Approval of sign for Burger King Restaurant, 432 S. Indian Avenue.

Motion was made by Ehrens, seconded by Allan (Chase absent) and unanimously
carried approving this application subject to the following condition:
1. That the sign be no larger than 4 feet.by 5 1/2 feet and othertJse as• sub-
mitted.
NOTE: This case was reopened and reconsidered and there will. be a requirement
that a minimum of 6". of wood must be showing around the edge.

Racquet Club Road between Indian Avenue and Palm Canyon Drive, R-2 Zone,
Section 3.
Motion was made by Ehrens, seconded by Allan (Chase absent) and unanimously
carried approving this application subject to the following conditions:
1. That a redwood facia for the balcony is to wrap under and cover the
soffit as well .
2. That the use of redwood panels for the doors be required.
3. That detailed landscaping, irrigation, and exterior lighting plans be
submitted.
4. That all recommendations of the Development Committee be met,

Motion was made by Allan, seconded by Harris (Chase absent, Lapham abstaining)
and unanimously carried approving this application subject to the following
conditions:
1 . That detailed plans for colors and materials be submitted.
2. That detailed landscaping, irrigation, and exterior lighting plans be
submitted.

The following was received from the Tribal Council :
"The Tribal Council , in accordance with recommendations of the
Indian Planning Commission, recommends the filing of a complete
Environmental Impact Report, in order to secure necessary informa-
tion in respect to the area involved. It is regrettable that the
City of Palm Springs did not require a complete E. I.R. in the fore-
going Case No. 5.998, as previously recommended by the Tribal Council,
and thus define to some degree, the facts respecting said area. "
CASE 2.998 - Application by H. LAPHAM (H. & L. Company) for Architectural Approval
of plans for construction of commercial/shop building at 605 East Sunny Dunes
Road, M-1 Zone, Section 23.
After being advised of the recommendations of the Architectural Advisory
Committee, after motion by Ehrens to require removal of carport doors died
for lack of a second, and a'1teer discussion with Howard Lapham, the applicant,
Commissioners agreed that the item should be continued to the meeting of
September 28, 1977.

VACATION OF RIGHT OF WAY - In conjunction with the Wessman Professional Building
on Tachevah and Via Miraleste, R-1-B Zone, Section 11 .
Planning Director stated that the specific question was whether or not a
pedestrian path should be retained through that portion of Via Eytel which
is proposed to be vacated.
Planning Commission recommended that at the time of final development plans
for the project and recognizing that in vacating that portion of Via Eytel
the City proposed to retain easements for sidewalk purposes, the inclusion
of a sidewalk through this area at the time that final development plans
are reviewed by the Commission be considered.
