Neel Laszlo Sandor Chairman called the meeting to order at 1 :30 p.m. Approval of Minutes: The Planning Commission Minutes of August 10, 1977, draft distributed, were approved unanimously as corrected. Correction: Page 18, Tribal Council recommendation regarding Tentative Tract Map No. 10573 should have referred to Tentative Tract Map No. 10631 . * * * * * * * * * * * August 24, 1977 PLANNING COMMISSION MEETING MINUTES Page 2 PUBLIC HEARINGS CASE 5 998-CUP -___Application by M. J. DRAGICEVICH for a Conditional Use Permit to allow a neighborhood shopping center use on an 8 acre parcel located on the south side of East Palm Canyon Drive between Matthew Drive and Dunn Road, R-3 Zone, Section 30. CASE 5 0005-CUP - Application by TOWNHOUSE BUILDERS CORPORATION for a Condi- tional Use Permit to allow a neighborhood shopping Plaza use on an 8 acre parcel located on the north side of East Palm Canyon Drive between Cherokee Way and Seven Lakes Country Club, R-G-A (8) Z one, Section 30. Planning Director presented and explained a large display map showing the sites in question and the number of residential units within a one mile radius of the proposed shopping centers. With reference to the Dragicevich application, he advised that revised plans had not been re- ceived but the applicant had indicated that if his application were approved he would proceed with the revision of the plot plan. He ad- vised that Townhouse Builders Corporation had presented revised plans observing all setback requirements of the Zoning Ordinance. Chairman reported that the Commissioners had held a study session on the two items, that because of his absence during discussion at previous meetings, Commissioner Harris had listened to the tapes and was familiar with the items, and were now ready to proceed. In reply to inquiries made by individuals in the audience she stated that the public hearings on both items had been closed at the Planning. Commission meeting of August 10, and that the Commission was not going to hear further testi- mony. Because of a disturbance in the audience, Chairman called a five minute recess. Upon reopening the meeting Chairman explained what had transpired before this meeting and announced that the Commission was ready to take action.. Commissioner Lapham stated that after carefully considering both sites and finding that they were virtually equal in every way it had been difficult to make a decision, but that because of the buffering that the Dragicevich 'site provided, he would be in favor of approving that application. Commissioner Chase advised that he agreed with Commissioner Lapham and, in addition, noted that since the Conditional Use Permit might eventually require a Change of Zone to C-D-N (Designed Neighborhood Shopping Center) , which zone would create a highly intense use with a great deal of 'activity, the Dragicevich site with the mountains and Highway 111 acting as buffers was the more desirable of the two sites. August 24, 1977 PLANNING COMMISSION MEETING MINUTES Page 3 PUBLIC HEARINGS - Continued CASE 5.998-CUP - Continued CASE 5.0005-CUP Commissioner Harris noted that any approval should include a condition that the applicant must obtain a building permit within one year from final approval . Following discussion, motion was made by Lapham, seconded by Chase, Harris casting a "yes" vote and Ortner casting a "no" vote, (Allan and Ehrens absent) recommending approval of the M. Dragicevich Appli- cation (Case No. 5-998 CUP) subject to the condition that the appli- cant obtain a building permit within one year from final approval . Staff was instructed to prepare a formal resolution containing findings and conditions, said resolution to be presented at the September 14, 1977 Planning Commission meeting for approval . CASE 5.0005-CUP The following was received from the Tribal Council : "Under date of Aug. 9, 1977, the Tribal Council advised the City of Palm Springs in the above matter as follows: 'The Tribal Council has consistently approved a commercial zone on the subject property, in agreement with the former commercial zone applying prior to 1973. Most recently, the Tribal Council has approved (July 12, 1977) the filing of a negative impact report in the instant case. Further, said Tribal Council has, in accordance with recommendations of the Indian Planning Com- mission, approved the above request. ' "On this date, August 23, the Tribal Council reiterated the latter comment." Motion was made by Lapham, seconded by Chase, Harris casting a "yes" vote, Ortner casting a "no" vote (Allan and Ehrens absent) denying this application. Staff was instructed to prepare a formal resolution containing findings and conditions. Said resolution to be presented at .the September 14, 1977, Planning Commission meeting for approval . L August 24, 1977 PLANNING COMMISSION MEETING MINUTES Page 4 PUBLIC HEARINGS - Continued I CASE 5.0023-CUP - Application by MURRAY CONSTRUCTION COMPANY for a Conditional Use Permit to allow a 40-unit single story condominium use on property situated on the southwest corner of Camino Parocela and Cerritos Drive, R-G-A (8) Zone, Section 24. Planning Director reviewed portions of the staff report and advised that because 14 units contained in the project were within the 100-year flood plain, staff was recommending a continuance in order to give the developers an opportunity to redesign the plan so that the units could be removed from the flood plain area. Chairman declared the hearing open and the following person spoke from the audience: Virginia Shonaker advised that she lived adjacent to the proposed project, and that she was in favor of having it approved as it would enhance the area. She requested and received a copy of the flood plain map showing the property in question. �... There being no further appearances, the hearing was closed and this item was continued to the September 14, 1977, Planning Commission meeting. August 24, 1977 PLANNING COMMISSION MEETING MINUTES Page 5 ENVIRONMENTAL ASSESSMENT ITEMS- CONSENT AGENDA Environmental Evaluation Reports were received by the Commissioners for their review and study prior to the Planning Commission Meeting; further review may be dispensed with and all items approved by motion. Motion was made by Chase, seconded by Harris, and unanimously carried (Allan and .Ehrens absent) , that a draft Negative Declaration be pre- pared for public review and comment on the following items. TENTATIVE TRACT MAP 9742 - Environmental Assessment on request by WE BB ENGINEERING, INC. , representing Canyon Site Corporation or Nominee for approval of Tentative Tract Map 9742 for a single lot subdivision of 5.92 acres, R-2 Zone, Section 35. TENTATIVE TRACT MAP 10528 - Environmental Assessment on request by P. ABRAMS CONSULTING ENGINEERS T. W. Essen) , representing FCC Inc. , for approval of Tentative Tract Map 10528 for a single lot subdivision of 8.94 acres, W-G-R-5 Zone, Section 20. * * * * * * * * * * * * * * * * TENTATIVE TRACT MAP 10594 - Environmental Assessment on request by CHARLES HAVER & ASSOCIATES, representing Mildred L. Pete, for approval of Tentative Tract Map 10594 to subdivide a 20.19 acre parcel into 60 lots, R-1-C Zone, Section 2. The following was received from the Tribal Council : The Tribal Council , in accordance with recommendations of the Indian Planning Commission approved acceptance of a negative impact report in the above matter. " * * * * * * * * * * * * * * * * August 24, 1977 PLANNING COMMISSION MEETING MINUTES Page 6 TENTATIVE TRACT AND PARCEL MAPS Senior Planner reviewed and explained the maps and the Planning Commission discussed and took action on the following Tentative Tract and Tentative Parcel Maps, based on the finding that the proposed subdivisions, together with the provisions for design and improvement are consistent with the General Plan of the City of Palm Springs and will not have a significant adverse effect on the environment, and subject to conditions as outlined. TENTATIVE TRACT MAP 10573 - Request by P. ABRAMS CONSULTING ENGINEERS (T. Essen) representing Alan Petty, for approval of Tentative Tract Map 10573 combining a portion of lots 42 and 67 and all of lots 43 and 44 into one .44 acre parcel , R-2 Zone, Section 15. Commission response to written comments on draft Negative Declaration and action for filing. No comments received. Motion was made by Lapham, seconded by Harris, and unanimously carried (Allan and Ehrens absent) ordering the filing of a Negative Declaration and recommending approval of Tentative Tract Map 10573 subject to all conditions of the Development Committee. TENTATIVE TRACT MAP 10631 - Request by KWL ASSOCIATES, representing Friedman- Dunphy Associates, for approval of Tentative Tract Map 10631 , subdividing 9.9 acres into 69 parcels for leasehold interest only. Commission response to written comments on draft Negative Declaration and action for filing. No comments received. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, approved the above Tentative Map. " Motion was made by Chase, seconded by Harris, and unanimously carried (Allan and Ehrens absent) ordering the filing of a Negative Declaration and recommending approval of Tentative Tract Map 10631 subject to all conditions of the Development Committee. TENTATIVE PARCEL MAP 9475 - Request by KWL ASSOCIATES, representing Larry Kay, j or approval of lentative Parcel Map 9475 subdividing acres in o parcels, R-3 Zone, Section 2. Commission response to written comments on draft Negative Declaration and action for filing. No comments received. August 24, 1977 PLANNING COMMISSION MEETING MINUTES Page 7 PUBLIC COMMENTS: Mr. J. Dunas reported that he was the owner of a five acre parcel at the northwest corner of Bogie Road and Highway 111 on which an appli- cation had been made for a neighborhood shopping center but that, due to the encroachment of new streets and the change in policy by the City regarding the use of Highway 111 , the acreage had been found to be in- sufficient and the Commission had, therefore, denied that application. He advised that he was also the owner of a fifteen acre parcel on the southwest corner of Bogie Road and Highway 111 and that his associate, Mr. Carver, had made application for a neighborhood shopping center on that site which, in their opinion, was a more desirable location and would also be a more desirable type of development than the one just recommended for approval by the Commission. He stated that he wished to go on record that he was requesting that the Commission consider the new site and plans before making a final decision. lte�/. August 24, 1977 PLANNING COMMISSION MEETING MINUTES Page 8 ARCHITECTURAL APPROVAL ITEMS The Planning Commission reviewed plans, discussed and took action on the following items involving Architectural Approval , subject to the conditions as outlined: CASE 2.897 - Application by GREAT WESTERN SAVINGS AND LOAN ASSOCIATION for Architectural Approval of revised plot plans for building proposed at 420 South Palm Canyon Drive. Motion was made by Lapham, seconded by Chase (Allan and Ehrens absent) and unanimously carried, approving this application subject to the condition that applicant retain the originally approved site plan. * * * * * * * * * * * * CASE 2.984 - Application by CARAVAN INTERNATIONAL LTD. , for Architectural Approv- al of plans for 221 condominium units Riviera Project on the golf course surrounding the Riviera Hotel bounded by Indian Avenue, Vista Chino, Via Miraleste and Via Escuela, R-3 Zone, Section 2. Motion was made by Lapham, seconded by Chase (Allan and Ehrens absent) and unanimously carried, approving this application subject to the following conditions: 1 . That detailed carport plans and elevations be submitted, 2. That detailed colors and materials be submitted. 3. That detailed landscape and irrigation plans be submitted. * * * * * * * * * * * * CASE 2.988 - Application by D. McKINNEY representing Grayson A Dix for Archi- tectural Approval of plans for addition to existing storage building at 811 Williams Road, M-1 Zone, Section 19. Motion was made by Chase, seconded by Harris (Allan and Ehrens absent) and unanimously carried, approving this application subject to detailed colors and materials and detailed landscape and irrigation plans being submitted. August 24, 1977 PLANNING COMMISSION MEETING MINUTES Page 9 ARCHITECTURAL APPROVAL ITEMS (Continued) CASE 2.989 - Application by EFFINGHAM HOMES, INC. for Architectural Approval of plans for construction of 114 cluster homes to be located on Bogie Road north of Waverly, R-G-A (8) Zone, Section 30. Motion was made by Chase, seconded by Harris (Allan and Ehrens absent) and unanimously carried approving this application subject to the following conditions: 1 . That all exposed beams are to be glue-laminated type. 2. That final detailed landscape, irrigation, and exterior lighting plans be submitted. CASE 2.945 - Application by L. N. BLAKE (Affiliated American Corp.) for Archi- tectural Approval of landscape and irrigation plans for condominium project (Casitas Arenas) located on Arenas Road west of Avenida Caballeros, Section 14. Motion was made by Chase, seconded by Harris (Allan. and Ehrens absent) , and unanimously carried approving this application subject to the following condi- tions: 1 . That all tree sizes are to be upgraded so that 80% of the street trees and 50% of the interior trees are to be 24" box size or larger. 2. That Carolina Cherry (Prunus Caroliniana) shall be substitu- ted for the Silk Oak trees proposed around the perimeter of the project. SIGN APPLICATION Application by B. HOWLETT for Architectural Approval of sign for the Burger King Restaurant, 432 S. Indian Avenue. Motion was made by Chase, seconded by Harris (Allan and Ehrens absent, Lam- ham abstaining) approving this application subject to the conditions that back of the sign be rough-sawn wood, and that it is to remain the same size as the existing sign. CASE 2.979 - Application by R. M. SERVICE, JR. for Architectural Approval of revised elevations for major remodel and additions for restaurant purposes (Las Casuelas Terraza) property located at 222 South Palm Canyon Drive, C-B-D Zone, Section 10. Motion was made by Chase, seconded by Lapham (Allan and Ehrens absent) and unanimously carried approving this application as submitted. August 24, 1977 PLANNING COMMISSION MEETING MINUTES Page 10 CONTINUED ITEMS The following items were continued to the Planning Commission Meeting of September 14, 1977: TENTATIVE TRACT MAP 10754 - Request by KWL ASSOCIATES, representing Caravan International for approval of Tentative Tract Map 10754 dividing 19.4 acres into 21 lots, R-3 Zone, Section 2. CONSIDERATION BY THE PLANNING COMMISSION for approval of Annexed Area No. 1 to the Preliminary Plan for the Palm Springs Central Business District Redevelopment Project. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian IPlanning Commission, seriously questions the use of the 'Redevelopment' process in the instant case, and as further de- scribed in the lately available apparent staff report relating to the above subject. Further, said Council has extended a cordial invitation to Mr. Kenneth E. Feenstra, Downtown Redevelopment Direc- tor, to attend a joint meeting of said Tribal Council and Indian Planning Commission, at 10:00 a.m. , Tuesday, Sept. b, 1977, at 587 S. Palm Canyon Drive, Palm Springs. Mr. Feenstra has accepted at this writing. He will be invited to describe the various phases of the above project, and the justification therefore, as well as to answer questions from members of the Tribal Council and the Indian Planning Commission. It is therefore requested that the proposed 'Annexation' matter be continued, until such time as the Tribal Council is provided with more valid and specific information, with the opportunity to study and respond to the same. * * * * * * * * * * * * * * * * August 24, 1977 PLANNING COMMISSION MEETING MINUTES Page 11 CONTINUED ITEMS Continued i DISCUSSION BY THE PLANNING COMMISSION to consider a request by Robert Martin & Associates, Civil Engineers representing Cathedral Canyon Country Club, to consider the abandonment of a proposed street known as the Palm Springs By-Pass. i The following was received from the Tribal Council : "The Tribal Council has been advised of the pending Traffic Study involving all portions of the City and certain environs. It is therefore recommended, and in accordance with recommendations of the Indian Planning Commission, that any decision respecting the above amendment should await the completion and analysis of the proposed study material ." CASE 2.980 - Application by HARLAN & ASSOCIATES (Sunrise Harlando Estates) for Architectural Approval of revised site plan, elevations, colors, and materials for construction of a 61-unit project with recreational facilities, 220 South Sunrise Way, R-2 Zone, Section 13. CASE 2.986 - Application by RODARTE BROS. , for Architectural Approval of revised exterior elevations, site plan, colors, and materials for an ice storage building on Williams Road, M-1 Zone, Section 19. CASE 2.991 - Application by W. H. SMITH for Architectural Approval of revised plans, colors, and materials for construction of a hillside residence to be located at 2111 Leonard Street, R-I-B Zone, Section,13. * * * * * * * * * * * CASE 2.983 - Application by WENDELL W. VEITH for F. K. Chan for Architectural Approval of plans for construction of 32 condominium units to be located at 2777 S. Palm Canyon Drive, R-2 Zone, Section 35. FREEMAN for Architectural Approval of plans for construction of a 94-unit condominium project on the north side of East Palm Canyon Drive between Deepwell Road and Sagebrush, R-2, R-3, and 0 Zones, Section 23. After being advised of the recommendations of the Architectural Advisory Committee the Commissioners agreed that this item should be continued. Mr. Larry Paul , a representative for the applicant, asked to be heard and a lengthy discussion, confined primarily to all on-site streets, followed. The Commissioners agreed to act on the question of the width of the on- site streets only. Following discussion, motion was made by Harris, seconded by Lapham, and unanimously carried (Allan and Ehrens absent that the streets in this project are to be a minimum of 32 ft. in width. CASE 2.992 Application by WORLD WIDE LEASING ENTERPRISES for Architectur_aL Approval of plans for remodel of Dollar Rent-Car Office, 351 N. Indian Avenue, C-B-D Zone, Section 15. Senior Planner advised that this item was being continued at the request of the Redevelopment Director so that the matter could be presented to the Downtown Development Advisory Committee at its next meeting. ITEM FOR RESTUDY The following item was removed from the Planning Commission Agenda pend- ing restudy, Applications will be rescheduled for heari.ng on] after revised submittals have been processed. CASE 2.993 - Application by D & B BUILDERS CO. , INC. , for Architectural Approval of plans for a 33-unit apartment complex, 750 Murray Canyon Drive, R-2 Zone, Section 35.
