Harrison Hugh Kaptur Laszlo Sandor Chairman called the meeting to order at 1 :30 p.m. Approval of Minutes: The Planning Commission Minutes of July 27, 1977, draft distributed, were unanimously approved. August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 2 PUBLIC HEARINGS CASE 5.998-CUP - Application by M. J. DRAGICEVICH for a Conditional Use Permit to allow a neighborhood shopping center use on an 8 acre parcel located on the south side of East Palm Canyon Drive between Matthew Drive and Dunn Road, R-3 Zone, Section 30. CASE 5.0005-CUP - Application by TOWNHOUSE BUILDERS CORPORATION for a Condi- tional Use Permit to allow a neighborhood shopping plaza use on an 8 acre parcel located on the north side of East Palm Canyon Drive between Cherokee Way and Seven Lakes Country Club, R-G-A (8) Zone, Section 30. CASE 5.0018-CUP - Application by R. W. CARVER and J. DUNAS for a Conditional Use Permit to allow a neighborhood shopping center use on property situated on the northeast corner of East Palm Canyon Drive and Bogie Road, Section 30. Commission response to written comments on draft Negative Declaration. No comments received in any of the above cases. Chairman advised that a staff report covering all three items had been prepared and that after its presentation public hearings would be opened on each individual case and, thereafter, the Commission would hold its discussion. Director of Community Development presented the staff report and explained the display board which showed the three sites in question. He advised that the General Plan indicated that only one shopping center could be approved in that general vicinity and, in addition, that if one were ap- proved the policy was to insure that it would become a reality. In that regard he suggested that the Commission might wish to reduce the three year time limit to perform to one year. He reported that no letters had been received either for or against Items 1 and 3, and presented the letters received both for and against item 2. He stated. that the staff recommendation was for denial of item 3 because the site was substandard in size and could not accommodate the use, and that items 1 and 2 be continued for two weeks so that the applicants could prepare material that would indicate their ability to proceed with development within one year. CASE 5.998-CUP - Chairman declared the hearing open and the following persons spoke from the audience: Matthew Dragicevich, the applicant of item 1 , discussed commercial enter- prises being used for buffering, noting that his site was completely buffered on all sides; the extension of Bogie Road and the fact that it would create a main intersection when it joined Highway 1.11 ; the services that must be provided for and the accessibility of a neighborhood shop.- ping center. He advised that from a planning point of view his site was August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 3 PUBLIC HEARINGS - Continued CASE 5.998-CUP - Continued "made to order" for such a center because of the easy ingress and egress as it would not conflict with vehicular traffic. He referred to the plot plan, observing that all of the undesirable elements normally con- nected with a shopping center would be hidden from view because of the size, shape and location of the parcel . He voiced his disagreement with the recommendation that the applicants be required to indicate their ability to proceed with development within one year.. In reply to a question by Commissioner Ehrens he advised that he and Mrs.. Dragicevich were the sole owners of the property. There being no further appearances the hearing was closed. CASE 5.0005-CUP The following was received from the Tribal Council : "The Tribal Council has consistently approved a commercial zone on the subject property, in agreement with the former commercial zone applying prior to 1973. Most recently, the Tribal Council has approved (July 12, 1977) the filing of a negative impact re- port in the instant case. Further, said Tribal Council has, in accordance with recommendations of the Indian Planning Commission, approved the above request." Chairman declared the hearing open and the following persons spoke from the audience: D. Slaughter advised that his law firm represented Townhouse Builders, Inc. , and Mr. Butler, and that they had been requested to attend the meeting in Mr. Butler's absence. He stated that they had reviewed the one year provision with Mr. Butler and that he was in agreement with it. Peter Kline, 2483 S. Camino Real , speaking in favor of the project, noted that a portion of the parcel was zoned for commercial use; ad- vised that Mr. Butler was the owner of Townhouse. Builders, Inc. , and that he had financing and was ready to proceed with the project. He reviewed the types of uses being proposed and outlined the various commitments received from prospective tenants. He requested immediate approval of the project, indicating that they wished to proceed with advertising in the September issue of Palm Springs Life Magazine. Hal Lacy, 526 Warm Sands Drive, advised that he was associated with Mr. Butler. He stated that because of the number of dwellings located on August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 4 PUBLIC HEARINGS - Continued CASE 5.0005-CUP - Continued the north side of Highway 111 , the site in question was the more desirable one as far as traffic was concerned. He requested that the Commission approve the application. R. W. Keeley, Chairman for the Seven Lakes Home Owners Association, speaking in favor of the application, advised that Mr. Butler and his staff had kept the Association advised of all plans and that they would like to see the application approved as it would enhance the property on Highway 111 and Cherokee. Marion Hanke_y, 435 Desert Lakes Drive, speaking in opposition, advised that she was concerned with the traffic that would be generated on Cherokee Way and outlined the problems existing on that street at the present time. With reference to the intersection of Cherokee Way and Highway 111 she stated that there were already many accidents occurring. She observed that the types of businesses being proposed would necessi- tate delivery trucks and that she did not believe that the use was compatible with the neighborhood. Matthew Dragicevich advised that he wished to clarify statements that had been made relative to most of the dwellings being located on the north side of Highway 111 and the fact that vehicles would, therefore, not have to cross a busy highway to get to a shopping center. He reviewed the various shopping centers in Palm Springs indicating that regardless of which side of a street they were on there would always be people that would have to cross over, and that the argument as to location was not valid. With reference to the traffic that would be generated at such time as Bogie Road intersected Highway 111 , he advised that he believed the Council had, at one point in time, budgeted for signalization of that intersection and he assumed that at such time as the Dunn projects got underway that intersection too would be signalized. There being no further appearances the hearing was closed. CASE 5.0018-CUP Director of Community Development reviewed the statistics for this pro- ject, advised that one piece of correspondence has been received in opposition, and read the findings in support of staff's recommendation for denial . Chairman declared the hearing open and the following person spoke from the audience: Bill Carver, one of the developers, set forth the various reasons that had caused them to pick this location as opposed to the 15 acre parcel located on the southwest corner of the same intersection. August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 5 PUBLIC HEARINGS - Continued CASE 5.0018-CUP - Continued that they had been totally unaware, however, of the 75 ft. setback re- quirement from right of way line. He agreed that this requirement immediately disqualified their plot plan. He requested that they be allowed to resubmit another plot plan for the southwest corner of Matthew Drive and Highway 111 , explaining that with 15 acres the would p 9 Y be able to adjust the setback requirements so that they would have an 8 acre parcel suitable for a shopping center in an appropriate location. There being no further appearances the hearing was closed. In reply to questions by Commissioner Ehrens, Director of Community Development advised that statistics relative to traffic accidents at the intersection of Cherokee Way and Highway 111 could be made avail- able, that the traffic engineer had studied all three sites and could find very little difference between them as far as traffic was concerned and, with reference to the restaurant proposed on site 2, stated that staff had been advised that it would be a coffee shop. The Commissioners discussed the pros and cons of sites 1 and 2 and Commissioner Chase suggested that perhaps it would be best to view tentative plans before making a decision. Motion was made by Chase, seconded by Lapham, and unanimously carried (Harris and Allan absentT denying the application in Case No. 5.0018-CUP. CASE 5.998-CUP CASE 5.0005-CUP Discussion followed on sites 1 and 2 regarding open space, traffic generation, possible R-3 development on site #1 , and the one year time limitation. Motion was made by Ehrens, recommending approval of site #1 . The motion died for lack of a second. Commissioner Chase advised that he would like to have a study session on items l and 2 as he was not prepared to make a decision at this time. Motion was made by Chase, seconded by Lapham, and unanimously carried, (Harris and Allan absenty ordering the filing of a Negative Declaration for items 1 and 2 and continuing items 1 and 2 for two weeks, based on the condition that the applicants submit plot plans in accordance with the setback requirements of the Zoning Ordinance, and that a date be set for a study session on both projects. BROWN, INC. , for a variance from set- back requirements for property situated on the west side of Soutfi--Fa-lm canyon Drive between Camino Encanto and Cantina Way, R-2 Zone, Section 27. Commission response to written comments on draft Negative Declaration. No comments received. Commissioner Chase abstained from discussion and voting on this item. Director of Community Development reviewed the staff report, presented two letters in opposition and read the findings and conditions in support of staff's recommendation for approval . Chairman declared the hearing open and the following persons spoke from the audience: Sam Archillian, 166 Camino Encanto, Jerry Korman, Cantina Way, both stated their concern with reference to adequate parking, street dedica- tions and whether or not there would be a traffic problem. Director of Community Development and Senior Planner reviewed dedications and number of parking spaces required for a development of this kind and -° also explained what would be permitted on this property by right of zone. John Holmberg, 2301 Cantina Way advised that his property was immediately above the proposed development and that he too was concerned with park- ing on the street. In addition he advised that the tennis court, as shown on the plan, would abut his land and be approximately 20 ft. from his front porch and for that reason he was very much opposed to granting the variance. There being no further appearances the hearing was closed. Following discussion, motion was made by Ehrens, seconded by La ham, (Chase abstaining, Harris and Allan absent ordering the filing of a Negative Declaration and approving the application based on the follow- ing findings and subject to the following conditions: FINDINGS 1 . Special circumstances are applicable to the subject property relative to topograph, the intent and nature of the development proposed that cause the strict application of the Zoning Ordinance to deprive the subject property of privileges enjoyed by others in the vicinity and the zone in which the subject property is situated. The variances, if granted, shall be conditioned to assure that the adjustments authorized will not constitute a grant of special privilege inconsistent with the limitations upon other properties in the neighborhood and in the same R-2 zone. 3. The granting of these variances -will not be materially detrimental to the public health, safety, convenience, or welfare of the community or injurious to properties and improvements in the im- mediate vicinity of the subject property. 4. The granting of these variances will not adversely affect the General Plan and its various goals and objectives. CONDITIONS: 1 . That an application for architectural approval be submitted for the entire property, including the existing structures and the rehabilitation program planned for these buildings. 2. That an elevation across the entire property be submitted showing the relationship between the proposed development, the background hillside, and the hillside houses and pads to the west. 3. That roof plans be submitted for all buildings showing treatment of vents, mechanical equipment and the like. 4. That no two story structures be proposed within 150 feet of the north property line. Co. , for a Planned Development District to complete the west portion of Sun Center located on the east side of Belardo Road between Sunny Dunes and Ramon Road, R-3, C-2 Zones, Section 22. Commission response to written comments on draft Negative Declaration. No comments received. Director of Community Development reviewed the staff report, noting that while the applicants could have requested a change of zone for the portion of the property fronting on Belardo Road from W-R-3 to a commercial use, staff had indicated a preference for the Planned Development District approach because of wanting to see the existing commercial use upgraded. Findings and conditions were presented and the Commission was advised that staff recommended approval . Chairman declared the hearing open and the following persons spoke from the audience: E.J. Grofer, Vice President and Publisher of The Desert Sun newspaper advised that if this application were approved it would permit the expansion of their facilities in a far more efficient manner than having to relocate. He read a letter from The Desert Sun setting forth. their intentions with reference to utilizing one-half of the space in the proposed new building, and requested that the application be approved.. Sam Pascal , 373 S. Palm Canyon Drive, advised that he represented the owners of the property. He reported that the property in question was in a "general use designation, central business district" and for that reason they requested that they be allowed to use the lower floor for businesses compatible with those existing at the Center and not to re- strict the use to storage only. He advised that there were tenants at the Center who were in need of additional space and they should be allowed to expand. With reference to the condition restricting the Belardo frontage to office use only, he stated that some types of retail busi- nesses should be allowed, particularly those that would not require the walk-in type of customer, and that to restrict both levels and not allow compatible uses would create a hardship. Z. Pitts , 115 S. Indian Avenue, one of the owners of the property re- iterated the arguments set forth by Mr. Pascal and requested approval of the application. There being no further appearances the hearing was closed. August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 9 PUBLIC HEARINGS - Continued CASE 5.0016-PD-77 - Continued Following discussion, motion was made by La ham, seconded by Ehrens, and unanimously carried (Harris and Allan absent) ordering the filing of a Negative Declaration and recommending approval of the Planned Development District based on the following findings and subject to the following conditions: FINDINGS: 1 . The commercial use applied for in the R-3 Zone is properly one for which a Planned Development District is authorized by the Zoning Ordinance. 2. The use is necessary and desirable in the development of the com- munity, is consistent with the goals and objectives of the General Plan and would not be detrimental to the existing or possible future uses in the area. 3. The site is adequate in size to accommodate said use, including the necessary parking, setbacks, open space, etc. , required to adjust this use to the site and neighborhood in question. 4. The site is serviced primarily by Belardo Road an 80 ft. secondary thoroughfare, and by Palm Canyon Drive a 100 ft. major thoroughfare which are adequately designed to handle the type and quantity of traffic expected to be generated by this use. 5. The existing development falls short of current lot design and land- scape development, perimeter landscape development, building design, and signing. CONDITIONS: 1 . That the new buildings facing Belardo Road are to be developed as office use only with no retail type businesses allowed. 2. That spaces under the parking deck are to be used for the expansion of The Desert Sun newspaper in accordance with their letter dated August 10, 1977, and for parking and storage uses only with no re- tail type uses allowed. 3. That improvements be made in the existing main parking area to bring it up to present Ordinance requirements as to planters, landscaping and lighting, and that the entire area is to be resurfaced. i August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 10 PUBLIC HEARINGS - Continued CASE 5.0016-PD-77 - Continued 4. That a repaint or remodel program be submitted for the existing building complex as part of the detailed final plans, including plans showing the screening of equipment. 5. That an appropriate sign scheme be submitted for the existing development as well as the proposed new construction with implementa- tion to take place as businesses change 6. That all recommendations of the Development Committee are to be met. 7. That an overall landscape plan be submitted to cover the existing complex as well as the proposed addition and that a maintenance agreement be submitted as a portion of the detailed development plans specifying the minimum level of maintenance to be expected at this complex. * * * * * * * * * * * * * * * * August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 11 PUBLIC HEARINGS - Continued CASE 5.0017-CUP - Application by CANYON SITE CORPORATION for a Conditional Use Permit to allow construction of 32 condominium units Canyon South V) on property situated on the east side of Via Aguila between La Verne Way and Twin Palms Drive, R-1-C Zone, Section 26. Commission response to written comments on draft Negative Declaration. No comments received. Director of Community Development reviewed the staff report noting that there was a change in the statistical breakdown in that the net site area was 8.11 acres instead of 7.96 as reported. The site plan was explained and the Commission was advised that one letter in opposition had been received. Findings in favor of staff's recommendation for approval and conditions were read into the record. Chairman declared the hearing open and the following person spoke from the audience: Richard McCarthy, the developer, presented letters in favor of the pro- ject from potential buyers and advised that all of the units in the pro- ject had been reserved. In that regard he set forth arguments in opposition to staff's recommendation for the deletion of one unit and requested that the Commission grant the 3.94 units per acre and approve the application. The Commissioners agreed that the design of this project was excellent and that they could not see the necessity of deleting one unit. Following discussion, motion was made by Chase, seconded by Ehrens, and unanimously carried (Harris and Allan absent ordering the filing of a Negative Declaration and approving this application based on the follow- ing findings and subject to the following conditions: FINDINGS: 1 . The application for a cluster condominium development is properly one for which a Conditional Use Permit is authorized by the Zoning Ordinance. 2. This type of residential project is acceptable in the development of the community, in harmony with the various goals and objectives of the General Plan, and is not detrimental to existing or possible future uses in the neighborhood. 3. The site is adequate in size and shape to accommodate the proposed use including the appropriate yards, setbacks, walls, parking, and the . like, necessary to adjust this use to the site. CONDITIONS: 1 . That all recommendations of the Development Committee are to be met. y� 2. That the driveway most easterly on La Verne respect a minimum 6 ft. setback from property line. BROWN, INC. , for a Conditional Use Permit to allow construction of a law office building on property situated on the south side of Ramon Road between Thornhill and Calle Amigos , R-2 Zone, Section 23. Commission response to written comments on draft Negative Declaration. No comments received. Senior Planner reviewed the staff report and presented the colored elevations, site plan and one letter in opposition. He advised that the Architectural Advisory Committee had discussed at length the merits of the architecture as there had been concern regarding its compatibility with the surrounding neighborhood but had agreed that some upgrading would be helpful to the area and had recommended approval . Chairman declared the hearing open and the following person spoke from the audience: Philip Palusso, a resident in the area, questioned the ingress and egress to the proposed building, noting that if there was an entrance on Thornhill it would be somewhat of a hazard for the children in the area as they were picked up by the school bus at that spot during the school season. He stated, however, that if the proposed building was going to be as well done as the Frederickson building he would be in favor of it. There being no further appearances, the hearing was closed. The Commissioners were in agreement that the architecture was interesting and that the use being requested was a good choice for the particular property in question. Following discussion, motion was made by Ehrens, seconded by Chase, and unanimously carried (Harris and Allan absent); ordering the filing of a Negative Declaration and approving this application based on the follow- ing findings and subject to the following conditions: FINDINGS: 1 . The professional office use is properly one for which a Conditional Use Permit is authorized by the Zoning Ordinance and meets the minimum standards required of this special use in this zone. 2. The office use is necessary and desirable in the development of the community, is in harmony with the various goals and objectives of the General Plan, and is not detrimental to existing or possible future uses in the vicinity. The site is adequate in size and shape to accommodate the proposed use with its required setbacks, parking, walls, etc. , necessary to adjust this use to the subject property. 4. The site is serviced by Ramon Road, a major thoroughfare, and Thornhill Road a local street, which are adequate in design to accommodate the amount and type of traffic expected to be generated by this use. CONDITIONS: 1 . That all conditions of the Development Committee are to be met. 2. That the employees of this complex be instructed to park in the spaces provided on the site. 3. That detailed colors and materials are to be submitted. 4. That detailed landscape, irrigation and exterior lighting plans are to be submitted. 5. That detailed signing plans are to be submitted. \tom August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 14 PUBLIC HEARINGS - Continued CASE 5.0021 CUP _- Application by R. N. & L. A. GEBHART for a Conditional Use Permit to allow the use of lights on a tennis court located at 561 Camino Norte between Camino Mirasol and Monte Vista, R-1-A Zone, Section 3. Commission response to written comments on draft Negative Declaration. No comments received. Senior Planner reviewed the staff report and presented photographs showing the location of the tennis court and the condition of the site relative to mature landscaping which screened the court from surrounding properties. He advised that two letters in opposition had been received and the letters were read into the record. A condition and findings in support of staff's recommendation for approval were presented. Chairman declared the hearing open and the following person spoke from the audience: Bob Gebhart, the applicant, advised that he and his wife had looked for a long time for property that would accommodate a tennis court with the least possible effect as far as neighbors were concerned. He noted that the court was well screened with Oleanders that were approximately 5 ft. higher than the fence and requested approval of the application. The Commissioners agreed that since all setbacks for the court had been met and in view of the fact that there was such dense landscaping around the tennis court site, lights should not pose a problem as far as neighbors were concerned. Following discussion,motion was made by Ehrens, seconded by Chase and unanimously carried (Harris and Allan absent , ordering the filing of a Negative Declaration and approving the application based on the follow- ing findings and subject to the following conditions: 1 . The proposed night lighting of this tennis court is a use for which a Conditional Use Permit is authorized by the Zoning Ordinance. 2. The use is acceptable in the development of the community, is in harmony with the goals and objectives of the General Plan, and is not detrimental to surrounding properties and residents. 3. The site is adequate in size to accommodate the previously approved court with adequate setbacks and will allow the mature screen land- scaping to remain. CONDITION: That additional plant materials such as vines or large shrubs are to be �-- planted around the southwest corner of the court, or the court shall be screened with dense windscreen material . August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 15 PUBLIC HEARINGS - Continued CASE 5.0022 - Initiation by the CITY OF PALM SPRINGS to delete a section of 8 inch sewer main now shown on the General Plan of Sewers between Sunrise Way and Arquilla Road along East Palm Canyon Drive. Commission response to written comments on draft Negative Declaration. No comments received. Director of Community Development reviewed the staff report which explained that the request for the deletion had been made by Smoke Tree Racquet Club and that the City Engineering staff, as well as its consultant, recom- mended approval . The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, approved the proposed'amend- ment. " Chairman declared the hearing open, there being no appearances the hearing was closed. Following discussion, motion was made by La ham, seconded by Chase, recommending approval of an amendment to the Master Plan of Sewers deleting a section of 8 inch sewer main between Sunrise (day and Arqui.11a Road along east Palm Canyon Drive. .. August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 16 PUBLIC HEARINGS - Continued CASE 5.0020 - Referred back by City Council : Initiation by the CITY OF PALM SPRINGS to consider an amendment to the General Plan Street Plan to eliminate the North Palm Canyon/Indian Avenue crossover. Director of Community Development reviewed the background of this item and advised that the City Council was of the opinion that there might be some merit in eliminating the crossover. He explained that State law required that when it appeared there might be an overriding by the City Council of a Planning Commission decision, the item had to be returned to the Planning Commission for a report. Two displays showing the use of the crossover were explained and the Commission was advised that since the City would be in the process of developing a circulation pattern during the coming year, and since it was the opinion of the Traffic Engineering Division that no matter what type of a scheme would be developed for the downtown area, whether it be one way or two, a crossover would be required, and since the North Palm Canyon/Indian Avenue was the best location for such a crossover, staff was recommending that the Commission reaffirm its decision. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, and in reiteration of its action of July 12, 1977, has approved the proposed amendment to the General Plan Street Plan. Commissioner Lapham advised that he agreed with staff's recommendation, and that even if there was a problem for the owners of this particular parcel , the City should not give it up until such time as an alternate plan had been adopted. Director of Community Development, in reply to questions by Commissioner Ehrens, advised that the record had been researched and the State had not been opposed to the crossover. In addition, the discussion had, at that time, centered around the fact that someone was going to buy the property and it had been recommended to the City Council by the Traffic and Parking Commission that the City purchase the property and that the State be notified. He acknowledged that if the decision was to retain the crossover on the General Plan the City would purchase the property and if it were found at some time in the future that it was not needed, it could be sold. He noted that over a period of time the options were becoming more and more limited which, in staff's opinion, would not be favorable for the City. Following discussion, motion was made by Chase, seconded by Lapham, and unanimously carried (Harris and Allan absent) that the South Palm Canyon/Indian Avenue crossover be retained. August 10, 1977 PLANNING COMMISSION MEETING MINUTES Page 17 TENTATIVE TRACT AND PARCEL MAPS Senior Planner reviewed and explained the maps and the Planning Commission discussed and took action on the following Tentative Tract and Tentative Parcel Maps, based on the finding that the proposed subdivisions, together with the provisions for design and improvement are consistent with the General Plan of the City of Palm Springs and will not have a significant adverse effect on the environment, and subject to conditions as outlined _TENTATIVE TRACT MAP 10510 - Request by WEBB ENGINEERING, INC.., representing Fey's Canyon Estates, for approval of Tentative Tract Map 10510 con- verting an existing garden hotel apartment into condominium units, R-G-A (6) Zone, Section 25. Motion was made by Ehrens, seconded by Chase, and unanimously carried (Harris and Allan absent ordering the filing of a Negative Declaration and recommending approval of Tentative Tract Map 10510 subject to all conditions of the Development Committee. Public Comments: Robert Fey discussed the notification of people within four hundred feet of a project and inquired whether or not something could be done so that new owners or tenants would be notified. The Director of Community Development explained the process for notifying the people falling within the four hundred foot radius. Don Slaughter, with reference to item number 15 on the Agenda, inquired whether or not it had actually been continued to the next Planning Commission Meeting. He was advised that it had been continued at the applicant's request. Motion was made by Chase, seconded by Ehrens, and unanimously carried (Harris and Allan absent), that a draft Negative Declaration be prepared for public review and comment on the following items. TENTATIVE TRACT MAP 10573 - Environmental Assessment on request by T. W. ESSEN, representing Alan Petty, for approval of Tentative Tract Map 10573 combining a portion of lots 42 and 67 and all of lots 43 and 44 into one .44 acre parcel , R-2 Zone, Section 15. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, approved the filing of a negative impact report in the instant case. In connection therewith the Tribal Council requested information as to authority and reasons for the proposed application of standards for dwellings in 'the 60 db CNEL noise contour in the instant case, all as out- lined in the City staff report. Further, information is desired as to the locations throughout the City, where such standards have been previously required. " TENTATIVE TRACT MAP 10631 - Environmental Assessment on request by KWL ASSOCIATES, representing Friedman-Dunphy Associates, for approval of Tentative Tract Map 10631 , subdividing 9.9 acres into 69 parcels for leasehold interest only. TENTATIVE PARCEL MAP 9475 - Environmental Assessment on request by WEBB ENGINEERING, INC. , representing Larry Kay, for approval of Tentative Parcel Map 9475 dividing 35+ acres into 3 parcels, R-3 Zone, Section 2. CASE 5.0023-CUP - Environmental Assessment on application by MURRAY CON- STRUCTION COMPANY for a Conditional Use Permit to allow a sing e story condominium use on property located at the southwest corner of Camino Parocela and Cerritos Drive, R-G-A (8) Zone, Section 24. CASE 2.937 - Application by D. STRONG (Sun Dial Investment, Inc. ,) for Architectural Approval of working drawings for construction of 154 unit motel and manager's apartment at 1269 East Palm Canyon Drive, Section 26. Motion was made by Ehrens, seconded by Chase, and unanimously carried, (Harris and Allan absent) , approving this application subject to the following conditions: 1 . That the changes as marked on the plans at the time of the Architectural Advisory Committee Meeting be adhered to. 2. That a 6 X 10 beam be used along the top fascia. 3. That paneling be used to match the door panel detail above the door. 4. That redwood channel siding be used in place of the T-111 plywood paneling on the balcony. 5. That additional design study be given the immediate street frontage area, showing more annual color, shrubs, boulders, etc. 6. That vines be added to the porte couchere columns. CASE 2.978 - Application by WESSMAN DEVELOPMENT for Architectural Approval of revised elevations for commercial building to be located on Tahquitz- McCallum Way between Sunrise and Luring Drive, C-1-AA Zone, Section 13. Motion was made by La ham, seconded by Chase, and unaimously carried, (Harris and Allan absent) , approving this application subject to detailed colors and materials being coordinated with those approved for the Carl 's Jr. Restaurant. CASE 2.968 - Application by FRANCIS MARKLEY for Architectural Approval of landscape and irrigation plans for a 5 unit apartment building located at 525 Thornhill Road, Section 23. F. P. DEVELOPMENT for Architectural Approval of revised plans for remodel of building (Chi Chi ) into three stores, property located at 237 North Palm Canyon Drive, C-B-D Zone, Section 10. The Commissioners reviewed the original plan and the two revised plans for the remodel of this building and it was the consensus of opinion that the second revised plan was superior to the others. Motion was made by La ham, seconded by Chase, and unanimously carried, (Harris and Allan absent) approving drawing number 2 subject to the following conditions: 1 . That the drawing be revised to show one large canopy in place of the two. 2. That planter materials are to be added between the store fronts. Said plans and materials are to be reviewed by staff. CASE 2.987 - Application by D. L. CHRISTIAN for Architectural Approval of plans for construction of B. Blinn hillside residence on Janis Drive, R-1-B Zone, Section 3.
