Neel Laszlo Sandor Jim Theiss Chairman called the meeting to order at 1 :30 p.m. Approval of Minutes: The Planning Commission Minutes of June 22, 1977, drafts distributed, were unanimously approved with the following correction: Case 5.0009-CUP - page 7 - The name "Holsman" should read "Holtzman." * * * * * * * * * * * * * * * * July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 2 PUBLIC HEARINGS CASE 5.0001-PD-72 - Application by JOHN WESSMAN for a Planned Development District to construct a medical office complex on the south side of Tachevah Drive between Via Miraleste and Avenida Palos Verdes, R-1 Zone, Section 11 . City Planner reviewed highlights of the staff report and presented the plot plan for the project. He advised that staff was requesting a further continuance so that details of what would happen with the Avenida Palos Verdes right of way in terms of what would be an acceptable scheme, with reference to the development of the vacated portions of the street, to the three parties involved. He noted that if there was not concurrence by the three parties at the time the vacation was scheduled for hearing by the City Council , it was possible that the Council would send the entire project back. He informed the Commissioners that another item he would like to bring to their attention was the treat- ment of the back parking lot area along the portion of Via Eytel which was not proposed to be vacated. The developer had indicated that it was somewhat the desire of the residents in the area that the sidewalk be eliminated and he was, therefore, proposing a 5ft. high wall with land- scaping from 5 ft. to 8 ft. outside the right of way. Because of the recommendation for a continuance, findings were not presented. In reply to questions by Commissioners Ehrens and Allan, City Planner ' advised that there was approximately 70 ft. between the Bochner project and the one being proposed and, with reference to who would maintain the street once it was vacated, he explained in detail the process of street vacations setting forth the various alternatives involved. Chairman declared the hearing open and the following persons spoke from the audience: John Wessman, the developer, stated that while he would have liked the Commission to hear the application on its merits as this time, he did understand the problems invol ed and would concur in a two week con- tinuance. With reference to the street vacations he advised that if it were necessary he would have no objection to maintaining the entire area as part of the Planned Development District. Addressing himself to the wall being proposed and the landscaping in lieu of a sidewalk, he informed the Commssion that the wall would screen the cars in the parking lot from view, and that one of the home owners in the area had stated that land- scaping would be preferable to a sidewalk. He informed the Commission he was willing to do whatever would be satisfactory to all concerned. With respect to the statements made at the previous meeting by the representative from the Katherine Finchy Parent Group, he stated that he was in complete accord with the request for proper landscaping for pedestrian traffic, as well as posting a stop sign at the exit In July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 3 PUBLIC HEARINGS - Continued CASE 5.0001-PD-72 - Continued reply to questions by Commissioner Ehrens, he stated he did not believe that a flagman for the children going to and from school would be necessary as he would be placing the construction gate at the west end across from the hospital and would be installing a construction fence around the entire project. Sally Sands, 567 Lujo Circle, speaking in favor of the application, re- viewed some of her statements made at the previous meeting and observed that such a project would definitely benefit patients at the hospital , the doctors and the hospital itself. She stated that she hoped any problems with the project could be taken care of so that it could be approved as it would be an asset to the City. Arthur Scherer, 996 Avenida Palos Verdes, advised that while he tended to agree with Mrs. Sands generally that such a facility next to a hospital was a typically normal use, particularly in a large City, it was not particularly necessary in a town were most doctors lived within a few minutes of the hospital . With reference to the traffic pattern and the vacation of streets, he presented and explained a plan showing a "T" use as opposed to closing the entire street. He reiterated arguments made at previous meetings involving not only this application but others that had been presented in the past for this property. Commission Lapham asked whether Doctor Scherer was opposed to any development on this parcel other than R-1 , and he replied in the affirmative. There being no further appearances the hearing was closed. This item was continued to the July 27, 1977, Planning Commission Meeting. July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 4 PUBLIC HEARINGS - Continued CASE 5.0009-CUP - Application by R. A. WALLIS for a Conditional Use Permit to allow a 120 unit condominium use on property located on the south side of Ramon Road between Cerritos and Farrell Drive, R-I-C and W-R-1-C Zones, Section 24. Commission response to written comments on draft Negative Declaration. No comments received. Commissioners Harris and Lapham abstained from discussion and voting on this item. City Planner presented the staff report, explaining that the technique being employed in this project was the allowance of a density transfer from flood plain areas to buildable areas which would permit the appli- cant to build 120 dwellings on the buildable portion of the site in ex- change for leaving the bulk of the area within the flood plain in its natural state. He read a condition received from the Tribal Council into the record and advised that staff did not find any problem with it. A letter that had been received was also read into the record. He advised that staff was recommending approval and the findings and conditions were outlined. The Tribal Council -reiterated their comments of June 21 , 1977, as stated in the Planning Commission Minutues of June 22, 1977, and in addition stated as follows: "On this date, July 12, 1977, the Tribal Council , in accordance with recommendations of the Indian Planning Commission, has re- considered its previous action, and approves the proposed Condi- tional Use request subject to a new, and only one condition, as follows: 1 . The southerly approximate one-third of the Indian-trust land involved, which southerly portion is presently classified in a watercourse zone, be used exclusively for open space and private recreation serving the proposed 120 residential units to be constructed on that portion of said land which is not classified in a "W" or watercourse zone. " Chairman declared the hearing open and the following persons spoke from the audience: Ron Wallis, 1317 El Alameda, the developer, stated that they had given a lot of thought to the project and were introducing new innovations by way of solar energy and other energy saving devices. He noted that the project would be an asset to the City and requested speedy approval . Ramon Road, speaking in opposition advised that he was the treasurer of the Firebird Home Owners Association located directly west of the project, and that the Board of Directors were very concerned with a single entrance to the proposed project on Cerritos. He estimated that approximately 200 cars would be using the single access onto Cerritos and that it would seem more reasonable to continue the access road which presently existed in front of the Firebird, Villa Riviera, and the Sun Spa, and have an additional access road onto Ramon Road. He informed the Commission that the entire Association was strongly opposed to the one access onto Cerritos. There being no further appearances, the hearing was closed. At the request of Chairman, City Planner addressed himself to the question of traffic, setting forth some of the data obtained during a three month study on frontage roads. With reference to the item under discussion he observed that if, in fact, the frontage road were installed across the front of the project, as was the case with the Firebird, staff would recommend no break in the road at the easterly edge and that traffic would be channeled back to Cerritos giving exactly the same re- sult as what was being proposed. He informed the Commission that this had been discussed at greath length and the recommendation of the Traffic Department was the better solution because of the amount of traffic on Ramon Road and the multiple driveways across from this project at the High School . Commissioner Ehrens noted that traffic would not necessarily have to go to Ramon Road but that it was also possible to take Cerritos to Camino Parocela and then to Sunrise Way. Following discussion, motion was made by Allan, seconded by Chase, and unanimously carried (Harris and Lapham abstaining) ordering the filing of a Negative Declaration and approving the application based on the following findings and subject to the following conditions: FINDINGS: 1 . This application for a Conditional Use Permit is authorized under Section 9206.01 C5 of the Palm Springs Zoning Ordinance. 2. The development of residential units is both necessary and desirable for community development and this project is in harmony with the goals and objectives of the General Plan. The cluster concept of residential units is similar to existing cluster units to the west and would not be detrimental to existing or future uses in surrounding areas. i July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 6 PUBLIC HEARINGS - Continued CASE 5.0009-CUP - Continued 3. The property being 36.2 net acres with a total of 120 dwelling units can provide adequate setbacks for buffering purposes in order to insure compatability with existing and future uses per- mitted in the neighborhood. 4. The traffic for this project will be channeled through a single entrance/exit on Cerritos Road, a 60 ft. collector street, which can accommodate the type and quantity of traffic generated by this use. CONDITIONS: 1 . That all requirements of the Development Committee are to be met with the exception of item #5 under Engineering Division - General . 2. That the portion of the site located within the 100 year flood plain, for which a density credit has been approved, remain un- developed as long as the credit is being used. 3. That the southerly 14.5 acres as indicated on the plot plan be retained in its existing natural state. * * * * * * * * * * * * * * * * July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 7 PUBLIC HEARINGS - Continued CASE 5.0012-PD-75 - Application by ROY & ROBERT FEY for a Planned Development District to allow construction of 40 condominium units for property located on the north side of Mesquite Avenue between Cerritos and Farrell Drives, R-1-C Zone, Section 24. Commission response to written comments on draft Negative Declaration. No comments received. City Planner presented the staff report containing adjacent zoning, existing land use, background, a statistical breakdown, and advised that while findings and conditions were outlined in the report the Architectural Advisory Committee, after review, had recommended a restudy of the project for the purpose of breaking up the monotony of the layout of the units along the street. He noted that revised plans had been received that morning, that they were on the board along with the original plans, but that staff would recommend a continuance so that the Architectural Advisory Committee could have an opportunity to review the new plans. Chairman declared the hearing open and the following persons spoke from the audience: Robert Fey, 2029 Madrona, one of the developers, advised that the original plan represented some three to four months work and from the standpoint of energy conservation, straight design, and a quality of living it was close to an ideal plan. He noted that the alternate plan that had just been presented was for the easterly portion of the project only as the Architectural Advisory Commttee had approved the rest of the development. He reviewed the two plans noting that the original layout provided for patios with a southern exposure, more private pool area, recessed shaded entryways, minimizing concrete and streets, and no unshaded west windows; while the alternate design would expose windows and patios to the westerly sun, as well as heat and noise from the streets and would mean that an additional pool would have to be installed which would also consume more energy. He observed that with four elevations and three different type of roofs none of the condominiums would look alike even though they were in a straight line. He stated that any redesign would greatly increase the energy, decrease the aesthetic qualities for the owners and would result, in his opinion, in an insignificant site improvement when built. He advised the Commission that while they were willing to accept either plan he would strongly urge approval of the original plan as submitted. Philip Short, 1500 South Palm Canyon Drive, speaking in favor of the appli- cation and as a realtor, advised that the demand for well located condo- minium units from 1500 to 2500 sq. ft. was unprecedented and that if quality developments of this type were not on the market soon a "Hawaiian like" situation would be created with condominiums and resales selling for $100. a sq. ft. July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 8 PUBLIC HEARINGS - Continued CASE 5.0012-PD-75 - Continued Ralph Lovett, 2399 Oak Crest Drive, advised that he hived at Sunrise East, the project that would be directly across the street from the proposed development, and that they had reviewed both plans and liked the original layout better than the revision. He noted that even though the homes in the original layout would be in somewhat of a straight line that would, in turn, provide a much larger green area between Mesquite and the rear of the homes. He requested that the Commission approve the original plans. There being no further appearances the hearing was closed. Commissioner Lapham, after clarifying that the preliminary plot plans and the district could be approved at this time subject to conditions, stated that since the only concern seemed to be with the east half of the project, and since the Commission would be seeing final development plans with the Council being presented with preliminary as well as final plans, he would be in favor of granting the application with the understanding that the east half of the site plan be reworked and re- submitted to the Architectural Advisory Committee for review. Commissioner Ehrens advised that it was his understanding that the original plan had to be reworked because of a recommendation of staff to move the entrance to the project. City Planner replied in the affirmative and ex- plained the reason for the request. Commissioner Harris questioned whether Commission Lapham's suggestion was mechanically manageable and he was advised by City Planner that, while the Architectural Advisory Committee would like to have the feel that the elevations and plot plan were working together and while ideally it would be better to have plans tied down a little better, it was mechanically possible to proceed with the suggestion. Findings were presented. Following discussion, motion was made by La ham, seconded by Ehrens, and unanimously carried, ordering the filing of a Negative Declaration and recommending approval of the Planned Development District based on the following findings and subject to the following conditions: FINDINGS: 1 . The cluster condominium application, with a minor density exchange, is properly one for which a Planned Development District is author- ized by the Zoning Ordinance. i July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 9 PUBLIC HEARINGS, - Continued CASE 5.0012-PD-75 - Continued 2. The proposed condominium project is acceptable in the develop- ment of the community is in harmony with the various elements of the General Plan and is not detrimental to uses existing or possible in the vicinity of the subject property. 3. The 11 .5 acre site is adequate in size and shape to accommodate the proposed residential project including the setbacks, access, walls, parking and the like necessary to adjust the use to the subject property. 4. The site proposes taking access from Mesquite Avenue, an 88 ft. secondary thoroughfare, which feeds to major thoroughfares both east and west and also is bordered by Cerritos which serves as a 60 ft. collector street for traffic headed south. Cerritos is not proposed to be extended (via bridging) across the Tahquitz Flood Plain. This street system should handle the amount and type of traffic expected to be generated by this use. CONDITIONS: 1 . That prior to subrdssion the preliminary plot plan to the City Council , the east half of the plot plan is to be submitted to the Architectural Advisory Committee for review and approval . 2. That detailed landscape and irrigation plans are to be submitted. 3. That detailed colors and materials and exterior lighting plans are to be submitted. 4. That all requirements of the Development Committee are to be met, with the exception that Planning Staff. is recommending that the Cerritos Street improvements be forestalled until such time as Cerritos might be put through. 5. A meandering sidewalk/bikepath system is to be installed along Farrell Drive and along Mesquite Avenue. 6. The detailed final plans are to be submitted to the Planning Commission and City Council for approval prior to the issuance of building permits. July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 10 PUBLIC HEARINGS - Continued CASE 5.0013-CUP - Application by JAMES HOUSTON for a Conditional Use Permit to allow night lighting for a tennis court located on the south side of Via Lola, between North Palm Canyon Drive and Cahuilla Road, R-1-C Zone, Section 10. Commission response to written comments on draft Negative Declaration. No comments received. City Planner presented the staff report and photographs of the tennis court that had been taken from the second story of the condominium pro- ject to the east. The photographs showed that while much of the land- scaping covered the fence and had grownsince the original application for lightin had been withdrawn, there were still two areas that were exposed to the second story of the condominium project. He noted that a field trip had been made to the site by staff, that it appeared many of the residents of the condominium project were out of town and for that reason, as well as those stated above, staff was recommending denial of this application. Chairman declared the hearing open and the following person spoke from the audience: Hugh Kaptur, representing the applicant, advised that he had originally done the landscape layout for the tennis court, and since the time the original application for lighting had been withdrawn the shrubs had grown sufficiently to screen the court with the exception of the two areas that could be seen from two separate second story condominiums to the east. He noted, however, that by the time the lights could be installed the Oleanders and Eucalyptus planted in the two areas would be filled out sufficiently to screen the court from the two apartments. In addition, he advised that the lights being requested would shine down and not up and, therefore, would not be directing light into the two apartments in question. He stated that should the Commission decide not to approve the application at this time, he would like to reserve the right to request another field trip to the site at a future date and that the matter be continued and not denied. There being no further appearances the hearing was closed. The Commissioners discussed the type of lighting proposed and the fact that the vegetation had grown sufficiently in the year since the first , application, with the exception of the two areas shown in the photographs. It was noted that the court itself met all of the criteria of the tennis court ordinance and that if lighting were not permitted for this court it should not be permitted on any court in an R-1 Zone. Commissioner Ehrens suggested that rather than deny the application, the applicant be given additional time to permit the vegetation in the two exposed areas to grow and fill out. The Commissioners agreed that the matter should be continued. This item was continued to the September 14, 1977, Planning Commission Meeting. * * * * * * * * * * * * * * * * July 13,1977 PLANNING COMMISSION MEETING MINUTES Page 11 PUBLIC HEARINGS - Continued CASE 5.0014-CUP - Application by THOMPSON ARCHITECTURAL GROUP for a Conditional Use Permit to allow a 249 room hotel complex, restaurant/coffee shop, banquet and recreational facilities, underground parking on property situated on the North side of Tahquitz-McCallum Way, between Calle En- cilia and Calle E1 Segundo, C-1-AA, R-4-VP Zones, Section 14. Commission response to written comments on draft Negative Declaration and action for filing. No comments received. City Planner presented the Staff report, explaining that the reason this item was under a Conditional Use Permit Application was because the height of a portion of the buildings proposed in the project exceeded the 35 ft. maximum height limit and, therefore, was under the highrise ordinance pro- visions which required a public hearing. The property in question was out- lined on the aerial photograph and a model of the proposed development was presented. Findings and conditions were read and the Commission was advised that the Architectural Advisory Committee and Staff were recommending app- roval subject to those conditions. The following was received from the Tribal Council : "The Tribal Council , in .accordance with recommendations of the Indian Planning Commission, approved the proposed development, as referred to above". Senior Planner reviewed the comments of the Architectural Advisory Committee, noting that they had no problem with the height but were concerned and wanted to see a detailed roof plan as there was a possibility of looking down on mechanical equipment from the Spa Hotel . Chairman declared the hearing open, and the following persons spoke from the audience: Warren Thompson, the developer, advised that they appreciated the type of control and review that took place before the actual hearing on the application, noting that it had been of benefit. He stated that they did not have any problems with the conditions and that he would be happy to answer any questions that the Commissioners might have. Burton L. Spivack, 1155 Mesquite, advised that he was one of the. directors of the Spa Hotel and was not speak.ing in opposition but did wish to question whether the Traffic Engineer had done a study on Calle. Encilia as he was concerned with traffic movements. He also requested clarification of the parking for the complex, as well as what the fourth and fifth floors of the Spa Hotel would looking down on. i July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 12 PUBLIC HEARINGS - Continued CASE 5.0014-CUP - Continued Senior Planner explained that the entire parking lot was available to the entire complex, and that the concept at this time was to use valet parking as much as possible thereby making use of the auxiliary lots north of Andreas. He advised, with reference to the roof of the new complex, that detailed plans were being requested and that the guests of the Spa Hotel would not be looking down on any mechanical devices. There being no further appearances the hearing was closed. Commissioner Ehrens advised that as a member of the Architectural Advisory Committee he would like to say that the architects and develelopers had been most cooperative throughout the Architectural Advisory Committee meetings and had acted on all requests made by the Committee. Following discussion, motion was made by Ehrens, seconded by Chase, and unanimously carried, ordering the filing of a Negative Declaration and approving the application based on the following findings and subject to the following conditions: FINDINGS 1 . The application to allow the proposed 42 ft. high bui-lding is properly one for which a Conditional Use Permit is authorized by the Zoning Ordinance. 2. The three story luxury resort hotel use is necessary and desirable for the development of the community, is in harmony with the various goals and objectives of the General Plan and will not be detrimental to existing or possible future uses allowed in the vicinity. 3. The total 8 plus acre site is adequate in size to accommodate the hotel use, including the requisite open spaces, parking, setbacks and other features required to adjust this use to the site. 4. The site is bounded by one major and three secondary thorough- fares which are adequate in design to carry the type and quantity of traffic expected to be generated by the proposed hotel . That additional study be given the residential wing exterior elevations. 2. That construction documents (working drawings) for the project are to be reviewed. 3. That detailed landscape and irrigation plans are to be submitted. 4. That all requirements of the Development Committee are to be met. 5. That detailed roof materials are to be submitted. 6. That proof of a lease is to be provided for site B which con- tains parking, recreation facilities and open space to the main site A for as long as the hotel remains. July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 14 PUBLIC HEARINGS - Continued CASE 5.0020 - Initiation by the CITY OF PALM SPRINGS to consider an amendment to the General Plan Street Plan to eliminate the North Palm Canyon Drive Indian Avenue crossover, deleting Seven Lakes Drive between Cherokee Way and East Palm Canyon Drive, and extending Waverly Drive as a 60 ft. collector street from Birdie Way westerly to Bogie Road, and to consider frontage requirements along East Palm Canyon Drive from Sunrise Way to Golf Club Drive. City Planner reviewed the staff report for each of the above items and advised that staff was recommending that the Palm Canyon/Indian Avenue crossover be retained on the General Plan Street Plan; deletion of Seven Lakes Drive from Cherokee to East Palm Canyon Drive, and that Waverly Drive be extended as a 60 ft. collector street from Birdie Way to Bogie Road. He noted that the Traffic and Parking Commission had also recommended the amendments. With reference to the frontage road require- ments which were a result of a staff initiated study, no General Plan amend- ment was being proposed, rather staff was recommending that in addition to the existing standard drawing for construction of East Palm Canyon Drive with frontage road, an additional standard drawing be developed showing construction standards without the development of a frontage road. The standards were outlined and the Commission was advised that this would not be considered for amendment to the General Plan but merely a follow- up with the design and adoption of a new cross-sectional plan and possibly a minor amendment to the Zoning Ordinance. Commissioner Allan left the meeting at this time. Chairman declared the hearing open and the following persons spoke from the audience: Phil Short, 1570 South Palm Canyon Drive, speaking in opposition to the recommendation to retain the Palm Canyon/Indian Avenue crossover, ad- vised that in 1970 and 1973 the Traffic and Parking Commission, after public hearings, voted to abandon the crossover, that staff had been directed to take the necessary measures to remove it from the General Plan but that staff, on both occasions, had ignored the recommendations. He reviewed the background of the property involved advising that in 1976, he had obtained an exclusive right to sell . He had offered the property to the City but had been advised that the City had no interest and would not have any interest in the future, and that it was not concerned with the crossover. He reported that he had found a buyer for the property, that the buyer had had an opportunity to buy other property in the City but had chosen this parcel because it was across the street from the Riviera Hotel which was a logical spot for a nightclub which the buyer was proposing to construct. He noted that money had been spent on drawings and plans and an application had been submitted. He stated that it was at the time the application was filed that the City "woke up to the July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 15 PUBLIC HEARINGS - Continued CASE 5.0020 - Continued realization, that the City woke up to some of its old tricks, by saying we don't want the property b.ut we don't want you to have it either. He advised that he did not think the City was right and, in addition, if the City wanted a piece of ground it should buy it at the fair market price and reimburse his buyer for .having gone to so much trouble. He referred to the City's decision, because of an already existing street, to eliminate the crossover at Palm Canyon Drive and Belardo and advised that the situation was the same in the instant case. Commissioner Allan returned to the meeting at this time. M. Dragicevich, 4101 Matthew Drive, advised that he had not been present to address himself to this case but that after hearing the argument just presented,would like to clarify some of the facts. He reported that the crossover was a direct result of the one-way street system which had been fought some twelve years ago. He stated he and Mr. Essen had been directly involved with a gentleman from the State Highway District who had, at that time, committed better than one-half million dollars in State funds for the building of the crossover and the acquisition of the property itself, with the only requirement being that the one-way street system be extended all the way to the crossover. Because of the many objections the City Council had decided not to go that far at that time. He observed that to say the crossover would not be needed at some future time would not be a true statement, and that it was of importance to the Master Plan Street Plan. Stanley Haberman advised that he represented the testamentary trust of the previous owner of the property and that at this point the trust owed in Federal taxes an amount equal to the fair market value of the property and unless it were sold it would create a financial disaster for the family. He stated that they had not known that this property was still on the General Plan of the City and that if the City really wanted the property it should purchase it. He observed that no one had considered alternatives to the crossover and named several streets which, in his opinion, could be used as a source of removing the traffic from Indian Avenue if and when it should become necessary. He respectfully requested, in the interest of fairness to the landowner, that the crossover be deleted from the General Plan Street Plan so that the problems of the trust could be resolved at this time with the City resolving "its actual problems when they actually occur at some later date. July 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 16 PUBLIC HEARINGS - Continued CASE 5.0020 - Continued Commissioner Ehrens advised that he had been involved many years ago with the hearings regarding one-way streets and the crossover and, at that time, it had been decided to proceed in two phases with phase two being one-way traffic past Vista Chino which would require the cross- over. He stated that it was at that time that the crossover was put on the General Plan but, after many hearings, a decision was made to forget phase two and he had., therefore, been surprised to find the crossover still existed on the General Plan. He noted that the Down- town Development Advisory Commission was talking about going back to two-way streets and that if that were so then the crossover would not be needed. Commissioner Lapham inquired whether a traffic study had been done years ago when the crossover had been adopted. City Planner advised that he was not sure of all of the background surrounding the crossover but that he did know it had been on the General Plan since it was adopted in 1966. In answer to another question by Commissioner. Lapham, City Planner ad- vised that the traffic engineer was recommending that the crossover be retained, that the decision had been based on many discussions and what might ultimately happen since the increase of traffic on Palm Canyon �.. continued each year, and that alternate solutions had to be considered. With reference to whether or not the City had money to purchase the land, he advised that should not be a concern of the Planning Commission, nor should the Commission be pressured with regard to the land cost or what the feasibility of purchase might be, as that was a decision of the City Council . Commissioner Lapham stated his agreement. Following discussion, motion was made by Ehrens that the crossover be eliminated from the General Plan Street Plan. Motion died for lack of a second. Motion was made by Lapham, seconded by Allan, and unanimously carried, (Ehrens casting a NO vote) recommending that the crossover be retained on the General Plan Street Plan; that Seven Lakes Drive be eliminated as a collector street between Cherokee Way and East Palm Canyon Drive; that Waverly Drive be extended as a 60 ft. collector street from Birdie Way to Bogie Road. They also recommended that staff proceed with an additional standard drawing showing construction standards without the development of a frontage road for East Palm Canyon Drive. FILE 119 - Request by VINCENT J. PIROZZI to amend a previously established ` condition for curb installation for properties located on the southwest corner of Via Monte Vista and Via Escuela, Section 3. City Planner presented a drawing showing the location of the property and a proposed resolution. He advised that the purpose of the resolution was to alter a condition that was levied in conjunction with a tract map that was filed in 1959, explaining that the requirement levied was the deposit of a cash bond in the amount of $1100.00. He stated that the curbs were never installed, that there were still no curbs in the area at all and that the new owner of the property had asked that, since there was an assessment district underway, he be allowed to use the monies held by the City since 1959 for the purpose of black-topping as opposed to installing curbs. He noted that he had discussed this with the City Attorney, and that since curbs would be installed through an assessment district at some future date, Staff was recommending that the Planning Commission amend Resolution 696. Commissioner Lapham advised that he agreed with the recommendation of the Architectural Advisory Committee that the City consider providing direct access from Sunrise Way to the parking lot and/or modifying the interior of the library to provide the main entry from Baristo. Motion was made by Ehrens, seconded by Chase, and unanimously carried, (Allan and Harris absent) approving this application subject to the changes as shown on the plans. CASE 2.850 - Application by HOWARD LAPHAM (Tahquitz Village) for Architectural Approval of revised elevations for a commercial complex on Tahquitz- McCallum Way, C-1-AA Zone, Section 14. Chairman Ortner and Commissioner Lapham abstained from discussion and voting on this item. Commissioner Ehrens chaired the item. l` Senior Planner noted that there were three plans on the board, two of which had been presented at previous meetings and one that was being considered at this time. He advised that the Architectural Advisory Committee had once again reqqested a restudy of the project, noting that the request for restudy was primarily based on the flatness of the perimeter wall as well as its design, the elevations and site plan seemed inadequate for the Tahquitz-McCallum location and, in general , the project did not appear inviting. He observed that this was approxi- mately the sixth study. Howard Lapham, the applicant, reviewed the background of the project noting that originally it had been designed for small novelty type shops but that now, after the many sessions with the Architectural Advisory Committee, it represented a high-fashion type shopping center. Commissioner Allan returned to the meeting at this time. By way of comparison he presented photographs of other buildings in the City. He requested approval of the concept advising that financing had been arranged, that the major tenants were waiting and he wished to begin working with them toward the final working drawings. He stated that he was not going to restudy the project again but would take it to the City Council .
