" June 8, 1977 PLANNING COMMISSION MEETING MINUTES Page 2 PUBLIC HEARINGS CASE 5.997-PD-76 - Application by MITCHELL LAUFORD & ASSOCIATES for a Planned Development District, in lieu of a Change of Zone, to allow completion of development of an existing shopping center located at the southeast corner of Tahquitz-McCallum Way and Sunrise Way, Section 13. City Planner explained the reasoning behind the rqquest that the applicant proceed by way of a Planned Development District instead of a Change of Zone. The staff report containing a detailed history of the property in question was reviewed as was a map showing the areas for which the Planned Development District was being requested. The statistics were set forth along with findings and conditions and the Commission was advised that staff was recommending approval . Chairman declared the hearingoopen and the following persons spoke from the audience: Mitchell Lauford, the applicant, stated that he did not know of any problems that could be associated with the development of the property that would have any detrimental effect as far as the property or community was concerned. He advised that he was in agreement with the conditions and guidelines set forth and, with reference to the condi- tion regarding landscaping and maintenance thereof, would be willing to provide a performance or completion bond if requested to do so. He observed that the proposal being made would resolve a difficult situa- tion that had been existing on the property for a period of approximately 10 years. He again expressed disbelief that anyone could object to a proposal that would not only benefit the shopping center but the com- munity as well . David Dahl , a representative from Vons Market, requested that the Com- mission approve the application. He explained that for years the market had been there without the full support of co-tenants and that they would be better able to serve the community if there were additional tenants at the proposed locations. Edward Kaplan, 1712 Grand Bahamd, speaking in opposition, advised that he owned the development across the street on Arenas. He advised that, in his opinion, the property should be developed as proposed on the original master plan as it provided better buffer zones for the surrounding area. He questioned the ingress and egress on Arenas Road and stated that he was opposed to any "change of zone." There being no further appearancesthe hearing was closed. June 8, 1977 PLANNING COMMISSION MEETING MINUTES Page 3 PUBLIC HEARINGS - Continued CASE 5.997-PD-76 - Continued The Commissioners were in agreement that the shopping center needed to be completed, that it was possible to build a two story profes- sional building on a portion of the property which would be lest desirable, and that the dense landscaping to be provided would be a sufficient buffer for adjacent properties. Following discussion, motion was made by Chase, seconded by Allan, and unanimously carried (Ehrens absent), approving this application based on the followin§gfindings and subject to the following conditions: FINDINGS: I . This application for a Planned Development District is authorized under Section 9407.00 of the Palm Springs Zoning Ordinance. 2. This commercial project is 85% constructed and the completion of development and upgrading of the existing portion of the project is necessary and desirable for the community, is in harmony with �. the General Plan and would be beneficial to the existing center. 3. The site is large enough for the proposed uses, providing adequate landscape setback areas and other features incorporated to insure compatability with other existing and future uses in the neighbor- hood. 4. The site is located at the intersection of two major thoroughfares and bordered on a third side by a local street, the combination of which is adequate to carry the quantity and type of traffic generated by this use. CONDITIONS: 1 . That a subdivision map be recorded to legally establish the boundary of the shopping center site. 2. That a new landscape plan be developed for the entire area as part of the final development plans. 3. That the owner of the center submit a landscape maintenance program to be approved as part of the final development plans. 4. That the architectural theme of the center be carried out for the two small additional retial buildings proposed to be added. 5. That all conditions of the Development Committee are to be met. * * * * * * * * * * * * * * * * June 8, 1977 PLANNING COMMISSION MEETING MINUTES Page 4 ENVIRONMENTAL ASSESSMENT ITEMS Chairman advised that when Environmental Evaluation Reports were re- ceived by the Commissioners for their review and study prior to a meeting, and if there were no problems and the Commissioners had no questions, all environmental assessment items would be handled on a consent agenda basis. Motion was made by Harris, seconded by Chase, and unanimously carried (Ehrens absent) that a draft negative declaration be prepared for public review and comment on the following items: CASE 5.0012-PD-75 - Environmental Assessment on application by ROY and ROBERT FEY for a Planned Development District to allow construction of 10-unit condominium project with recreational facilities on property situated on the north side of Mesquite Avenue between Cerritos Drive and Farrell Drive, R-l-C Zone, Section 24. CASE 5.0013-CUP - .Epvi-ronmental Assessment on application by JAMES HOUSTON for a Conditional Use Permit to allow night lighting for a tennis �. court located on the South side of Via Lola, between North Palm Canyon Drive and Cahuilla Road, R-1-C Zone, Section 10. * * * * * * * * * * * * * * * * CASE 5.0014-CUP - Environmental Assessment on application by THOMPSON ARCHI- TECTURAL GROUP for a Conditional Use Permit to allow a 249 room luxury hotel complex Ojith restaurant/coffee shop, banquet facilities, recreational facilities, and underground parking on property situated on the North side of Tahquitz-McCallum Way, between Calle Encilia and Calle El Segundo, C-I-AA and R-4-VP Zones, Section 14. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, approved the issuance of a Negative Impact Report in the above case." * * * * * * * * * * * * * * * * TENTATIVE PARCEL MAP 10028 - Environmental Assessment on appl1dation by L .G. Miller for approval of Tentative Parcel Map 10028 combining two lots into one 0.32 acre parcel , R-3 Zone, Section 15. i June 8, 1977 PLANNING COMMISSION MEETING MINUTES Page 5 TENTATIVE TRACT AND PARCEL MAPS City Planner reviewed and explained the maps and the Planning Commission discussed and took action on the following Tentative Tract and Tentative Parcel Maps, based on findings and subject to conditions as outlined Commissioner Harris abstained from discussion and voting on the following item. TENTATIVE TRACT MAP 9667 - Application by HALLMARK ENGINEERING, INC. , repre- senting John Wessman, for approval of Tentative Tract Map 9667 dividing 17.0 acres into 45 parcels, R-1-C Zone, Section 24. Commission response to written comments on draft Negative Declaration. No comments received. The following was received from the Tribal Council : "The Tribal Council , after consideration of the recommendations of the Indian Planning Commission, and in reiteration of the position of said Council in Case 5.0008, again concludes that the type of development represented by Tentative Map 9667 is an alternative forced upon Indian-trust land by reason of onerous and impractical conditions applying in R-3 zone formerly effective. Further, that such alternative has been selected rather than now use over a long term period. "With reiteration of all the points raised in the latter case on, May 10, 1977, the Tribal Council offers no objection to the approval of said Tentative Map 9667." Motion was made by La ham, seconded by Allan, and unanimously carried, (Harris abstaining, Ehrens absent), that a Negative Declaration be filed subject to mitigating measures, and recommending approval of Tentative Tract Map 9667 subject to all conditions of the Development Committee and the further condition that a maintenance district be established for the installation and maintenance of lots siding on El Cielo Road. Commission response to written comments on draft Negative Declaration. No comments received. Motion was made by La ham, seconded by Harris, and unanimously carried (Ehrens absent) that a Negative Declaration be filed and recommending approval of Tentative Parcel M{ip 9881 subject to all conditions of the Development Committee. * * * * * * * * * * * * * * * * TENTATIVE PARCEL MAP 10014 - Request by P. Motion was made by Chase, seconded by Allan, and unanimously carried, (Ehrens absent), that a Negative Declaration be filed subject to mitigating measures, and recommending approval of Tentative Parcel Map 10014 subject to all conditions of the Development Committee. TENTATIVE TRACT MAP 9780 - Request by WEBB ENGINEERING, INC. , representing Fairport Construction Company, dividing property into 15 M-1 -P lots, and 20 N-R-1-C and R-1-C lots, and 1 0-5 and N-0-5 parcel , Section 7. Commission response to written comments on draft Negative Declaration. No comments received. Motion was made by Allan, seconded by Harris, and unanimously carried, (Ehrens absent), that a Negative Declaration be filed subject to mitigating measures for sand and interior noise level control , and recommending approval of Tentative Tract Map 9780 subject to all condi- tions of the Development Committee. June 8, 1977 PLANNING COMMISSION MEETING MINUTES Page 7 TENTATIVE TRACT AND PARCEL MAPS - Continued TENTATIVE PARCEL MAP 9242 (revised) - Request by KEN HINSVARK for reconsider- ation of conditions imposed on Tentative Parcel Map 9242 revised or, in the alternative, consideration to permit posting of a bond in lieu of requiring the improvements at this time. City Planner reviewed the background of action taken by the Commission at its April 27, 1977 meeting, as well as the conditions of approval . He advised, relative to the conditions, staff would recommend that a performance bond be posted for the half street improvements of Sunny Dunes and Camino Parocela in lieu of installation of said improvements untilssuch time as surrounding development warrant their installation or, an amendment to the General Plan Street Plan is made changing or deleting the subject streets. In addition, that 30 ft. along the easterly portions of parcel 1 and 2 be dedicated. In reply to a question by Chairman he informed the Commission that he had discussed this recommendation with Mr. Hinsvark and that he had indicated that if the condition were established so that it depended on surrounding development taking place it was agreeable with him. The followding was received from the T*$bal Council : The Tribal Council reiterated comments as reported in the Planning Commission Minutes of May 11 , 1977, and added the following: "As of this date [June 7, 19771, the Tribal Council has received no study of report on the subject matter although it appears that a 'proposed collector street' may not be opened on the ground and with development proceeding notwithstanding. The Tribal Council again requests an adequate report on the elimina- tion of a proposed collector street." Following discussion, notion was made by Chase, seconded by Win, and unanimously carried (Ehrens absent) recommend ng approval of tFie re quest to post a bond in lieu of requiring improvements at this time subject to the dedication of 30 ft. along the easterly portions of parcel 1 and 2, and subject to all conditions of the Development Committee being met at such time as surrounding development warrants their installation.or, an amendment to the General Plan Street Plan is made changing or deleting the subject streets. June 8, 1977 PLANNING COMMISSION MEETING MINUTES Page 8 LOT LINE ADJUSTMENT - Section 10 Request by HALLMARK ENGINEERING, INC., re- presenting Mr. Paul Swidler, for approval of lot line adjustment for Lots 7 and 8 of Tract No. 4463. City.'Planner explained that this type of request was categorically exempt under the State Guidelines for environmental assessment. He reviewed the adjustment being requested and advised that staff was recommending approval . Motion was made by Allan, seconded by Chase, and unanimously carried, (Ehrens absent) recommending approval of the lot line adjustment, as submitted. Public Comments: None. DETERMINATION by the Planning Commission that the exchange of certain City property for a parcel of private property is in accordance with the goals and objectives of the General Plan. C W Planner advised that the City had been negotiating for some time with the owner of approximately 400 acres of property to the west of the Cahuilla Hills. He reported that the property in question was in a fairly rugged hillside area with very little of the total site being adaptable for any type of development, and that if it were acquired by the City it would be designated as permanent open space. With reference to the property that the City would be exchanging, he informed the Commission that it was located at the intersection of Ramon Road and Bogie Road and was designated and would remain an 110" (open space) Zone, that if the land exchange took place the gentleman acquiring the City property was contemplating a nine hole golf course which would be in conformance with the Zoning Ordinance. He advised that staff found that the exchange of the properties would further promote the City's General Plan objectives of discouraging development on hillsides and maintaining open space and would not be contrary to the elements and objectives of the General Plan. Following discussion, motion was made by Harris, seconded by Chase, and unanimously carried, (Ehrens absent) recommending approval of the land exchange based on the finding that it is accordance with the §oAls and objectives of the General Plan. June 8, 1977 PLANNING COMMISSION MEETING MINUTES Page 9 The Planning Commission reviewed plans, discussed and took action on the following items involving Architectural Approval , subject to the conditions as outlined. CASE 2.953 - Application by J. L. DeLAMARRE for Architectural Approval of revised plans for construction of hillside residence, 950 Via Olivera, R-1-B Zone, Section 3. Motion was made by La ham, seconded by Harris, and unanimously carried, (Ehrens absent), approving this application subject to the following conditions: 1 . That the mass color is to be a light beige. i 2. That the roof material shall be submitted for approval . CASE 5. - -0004 PD 74 - Application by PACIFIC SOUTHWEST REALTY COMPANY for Architectural Approval of detailed site plans, elevations, landscape and irrigation Plans for Security Pacific Nat'l . Bank to be located on the south side of Andreas Road between Sunrise Way and Luring Drive, C-1-AA and P Zones, Section 13. In addition to the conditions contained in the Architectural Advisory Committee Meeting Minutes, the Commission discussed the trash enclosure, elimination of a parking space and the elimination of the driveway to Luring Drive. The applicant did not agree with the elimination of that driveway indicating that it was needed for a better flow of traffic. The Commission, however, agreed with the comments made by the City Council and requested that the Luring Drive driveway be eliminated. Motion was made by Lapham, seconded by Chase, and unanimously carried (Ehrens absent), recommending approval of final development plans subject totthe follo*dtng conditions: 1 . That the Star Jasmine be eliminated and Shore Juniper substituted. 2. That the Carolina Jessamine be eliminated and Lavender Star Flower substituted. 3. That Wheeler's Dwarf be eliminated and Stokes Holly substituted. 4. That the Nerium Oleander Mrs. Roeding ;be eliminated and Salmon Dwarf Oleander be substituted. 5. That the 20 ft. light standards are to be eliminated and all exterior lighting shall be by landscape uplighting and low level walk lights. L w..,.' That the trash enclosure is to be redesigned to accommodate a user entry and an 8 ft. minimum opening. 7. That one parking space (#9 on working drating site plan) is to be eliminated and shall become a landscape area. 8. That the end of all parking areas shall end in a landscape island, 6 ft. in width minimum. 9. That the driveway to Luring Drive is to be eliminated and is to be landscaped (per City Council comments). CASE 2.950 - Application by ANDY JESSUP for Architectural Approval of revised plans for construction of hillside residence, 599 Fern Canyon, R-1-A Zone, Section 22. Motion was made by Allan, deconded by Harris, and unanimously carried ., ^ (Ehrens absent), approving this application subject to the following conditions: 1 . That detailed colors and materials, including anodized bronze frames be submitted. 2. Motion was made by Lapham, seconded by Chase, and unanimously carried, (Ehrens absent), approving this application subject to the following conditions: 1 . That the proposed aluminum in the garden walls is to be deleted. 2. That detailed colors and materials are to be submitted. 3. That detailed landscape and irrigation plans are to be submitted. 4. That decorative paving is to be used in the parking entry to make up open space deficiency. 5. That all conditions of the Development Committee shall be met. CASE 2.958 - Application by JAMES E. That decorative concrete be used in the parking areas and sidewalks. 2. That detailed paving materials plan be submitted. 3. That detailed colors and materials be submitted. 4. That detailed landscape and irrigation plans be submitted. 5. That a sign program be submitted. 6. That all working drawings are to be reviewed by the Architectural Advisory Committee. 7. That all conditions of the Development Committee are to be met. CASE 2.961 Application by D. L. McKINNEY for Architectural Approval of plans for construction of an industrial complex on property located at Eugene and Sunny Dunes Road, M-1 Zone, Section 19. Motion was made by Allan, seconded by Harris, and unanimously carried (Ehrens absent) approving this application subject to the following conditions: 1 . That the indicated portions ofthe fascia element be changed from plaster to redwood on the face and soffit. 2. That the tile band be eliminated on the -Fascia. 3. That the color of the plaster fascia be submitted. 4. That detailed landscape and irrigation plans are to be submitted. 5. That a sign scheme be submitted. 6. Motion was made by Chase, seconded by La ham, and unanimously carried (Ehrens absent), approving this application subject to the following conditions: 1 . That the end elements of the roof be changed to a hip style roof. 2. That the parking is to be brought up to standard. CASE 2.966 - Application by DR. & MRS. R. GEBHART for Architectural Approval of plans for construction of a tennis court on property located at 561 Camino Norte, R-1 -A Zone, Section 10. Motion was made by Chase, seconded by Allan, and unanimously carried (Ehrens absent), approving this applicat on as submitted. i j CASE 2.967 - Application by HUGH KAPTUR for Arthur and David Lyons for Architectural Approval of plans, colors and materials for exterior remodel of Lindy Lou's Restaurant located at 211 E. Palm Canyon Drive, C-1 Zone, Section 23. Motion was made by Chase, seconded by Harris, and unanimously carried (Ehrens absent), approving this application subject to the fol$owing conditions: 1 . That detailed landscape plans are to be submitted. 2. CASE 2.962 - Application by JAMES E. BROWN', _INC., for Architectural Approval of plans for construction of an industrial complex on property located at Eugene and Sunny Dunes Road, M-1 Zone, Section 19. * * * * * * * * * * * * * * * * The Planning Commission removed the following_ items from its Agenda pending restudy®and resubmission. CASE 2.836 4 Application by A. FALLOWS for Architectural Approval of land- scape and irrigation plans for commercial/industrial complex at the northwest corner of Sunny Dunes and Calle Palo Fierro, C-M Zone, Section 23. * * * * * * * * * * * * * * * CASE 2.850 - Application by HOWARD LAPHAM (Tahquitz-Village) for Architectural Approval of revised. elevations for a commercial complex on Tahquitz- McCallum Way, C-lAA Zone, Section 14. Chairman Ortneir and Commissioner Lapham abstained from discussion and voting on this item. City Planning Associated advised that while this item had previously been sent back for restudy the plans that were before the Commission were basically the same as those denied at the last meeting. He noted that the applicant was present and wished to address the Commission. Howard Lapham, 577 E. Sunny Dunes Road, the applicant, by way of explana- tion for resubmitting basically the same plans,reviewed in detail the background leading to the present application. He explained the plans anddnoted that they had been based on study and review of various success- ful shopping centers and requested approval . The Commissioners basically agreed with the comments made by the Architectural Advisory Committee that cited monotony of building eleva- tions, lack of quality environments, and repetitious building masses, and that while perhaps a total restudy might not be necessary something more would have to be done. Motion was made by Allan, seconded by Chase and carried (Chairman Ortner and Commissioner Lapham abstaining, Commissioner Ehrens absent, denying this application and recommending restudy. * * * * * * * * * * * * * * * * II t June 8, 1977 PLANNING COMMISSION MEETING MINUTES Pagel 5 Reports and Requests. The Commissioners acknowledged receipt of a memorandum regarding hill- side development. The possibility of snow fences for control of blow sand was again dis- cussed and it was still the consensus of opinion that there should be a moratorium on grading during the windy season on all areas affected by the wind where single family dwellings were downwind.
