Neel * * * * * * * * * * * * * * * * Vice Chairman called the meeting to order at 1 :35 p.m. * * * * * * * * * * * * * * * * Approval of Minutes: The Planning Commission Minuted of April 27, 1977, drafts distributed, were unanimously approved. * * * * * * * * * * * * * * * * May 11 , 1977 PLANNING COMMISSION MEETING MINUTES Page 2 CASE 6.295 - Application by SUN DIAL INVESTMENT, INC. , for a_Variance from the 200 ft. setback requirement for second story in R-3 developments when abutting R-1-C Zoned property. Commission response to written comments on draft Negative_Declaration. No comments received. City Planner reviewed the location of the property on the aerial photo- graph and its relationship to surrounding properties. He set forth the staff report in detail . With reference to notifying home owners within 400 feet of the proposed project, he stated that because Staff had been aware of the new condominium project to the 'south where the names of new owners and buyers who had made deposits would not appear on the assessment roles, staff had requested and received from the developer a list of names, and that notices of the public hearing had been sent. He noted that technically there was not a responsibility on the part of the developer or staff to notify those people. Three letters in opposition weree read into the record. Findings were pre- sented and the Commission was advised that staff was recommending approval of the variance request subject to conditions there were set forth. The following was received from the Tribal Council "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, 'approved the requested variance." A plot plan showing the relationship of the proposed project to the condominium development from which the protests had been received was explained. City Planner advised that the intent of the Zoning Ordinance with reference to the 200 foot requirement was to protect R-1 property that directly abuts multiple residential property, but that the provision would not apply when a street divided the two zones. In the case of the applicant's request for relief from the requirement, he noted that the applicant could insure the provisions that staff had requested as he controlled both the R-1 and R-3 properties. He re- ported that in addition to Twin Palms_nDrive dividing the proposed pro- ject from the condominiums there was a minimum of 155 ft. between the two story hotel building and nearest condominium with the distance widening to 325 ft. at the east end of the project. In reply to questions by the Commissioners he explained the location of La Paloma, reviewed the background of the realignment of TwinPPalms Drive, ad- vising that it had been done in 1971/72, the procedure should someone wish to develop the property to the east of the proposed development, and the approximatee distance of the two story units at the Ocotillo from the single family homes on the south side of Twin Palms Drive. May 11 , 1977 PLANNING COMMISSION MEETING MINUTES Page 3 PUBLIC HEARINGS - Continued CASE 6.295 - Continued Vice Chairman declared the hearing open and the following persons spoke from the audience: Richard McCarthy, owner and developer of Canyon South III, speaking in favor of the project, advised that he had studied the elevations of the buildings, had met with staff and reviewed the physical layout of the project and, in his opinion, the architectural work was of a superior nature. He observed that it was a well conceived project inasmuch as the R-1 -C portion of the property was going to remain as open space which would ablow a permanent landscape buffer between the proposed development and Canyon South III that would be aesthetically beneficial . He advised that he would like to request that a decorative wall be in- stalldd along the entire R-1 -C zoning line at a minimum height of 4'6" to a maximum of 5' thereby totalty screening any automobiles from the landscaped area. He referred to the amount of money that had been spent in developing Canyon South III and advised that he was so in favor of the proposed project that if there was anyone from the Canyon South III project opposed and had not as yet acquired title he would,b at this stage, be willing to meet them in escrow and refund their money. D. Strong, 5466 Fremontia La. , San Diego, the developer advised that they concurred with the City Planning Department on ia'S views of the project. He stated that it would be a very fine project and everyone would be very happy with it. Elliott Milliman-advised that he had purchased a condominium at the most southeasterly corner of Canyon South III, and that while he did not feel that he would be injured by the proposed project he expressed concern for the purchasers of the condominiums at the northwest corner of Canyonn South III. He asked how they would be protected by the buffer zone and Vice Chairman advised that the plan was very specific as to what was happening with the buffer. Mr. Milliman questioned whether any variance like the one being requested had ever been granted in Palm Springs and he was advised by City Planner that the setback pro- vision was approximately three years old and, to his knowledge, this was the first variance application of this nature that had been applied for. Mr. Rilliman stated that more thought should be given to the pro- ject, that he was of the opinion that there were still some people who had not been notified, and that the Commission should place the applica- tion off calendar. Sam Corson, speaking in opposition, advised that he had purchased one of the Canyon South III condominiums at the northwest corner of that project and that if the proposed project were permitted to be built he would be looking right ofit onto it, and that it would block his view. He objected to a 24 hour restaurant where the noise from cars would carry throughout the night and stated that he agreed with everything that had been stated in the three letters read into the record. May 11 , 1977 PLANNING COMMISSION MEETING MINUTES Page 4 PUBLIC HEARINGS - Continued CASE 6.295 - Continued John Allan, 1095 Twin Palms Drive, advised that he owned the last condominium on the northwest corner of Twin Palms and that while he realized the applicant was entitled to do what he wished because of the zoning, he would request protection with a buffer zone. He opposed a 24 hour restaurant, noting that vehicle noise from the Ocotillo and Dennyts could be heard from his condominium. He stated that if the normal setbacks were adhered to he would have no objection to the project, other than the 24 hour restaurant. Mel Graves, 1067 Twin PalmssDrive, advised that the rules and regula- tions governing development in Palm Springs had been made by responsible people and that he would, therefore, urge the Commission to thoroughly review the request for a variance before making a decision. He noted that while the Ocotillo was partially developed with two stories, that portion of the building probably had setbacks in excess of 200 feet and, in addition, fronted on Palm Canyon Drive. With reference to the common parking to be shared by the proposed project and the two restaurants, he questioned whether it would be adequate or whether, during holidays and the season, cars would be parking on the street as was being done around other hotels in the city. He referred to the size of Arquilla, Twin Palms Drive and Palm Canyon Drive near the subject site and expressed concern that heavy traffic would cause congestion and could possibly be a hazard. He urged th6 Commission to give serious thought to the application and to require a 200 ft. setback. There being no further appearances the hearing was closed. In reply to a question by Commissioner Ehrens regarding parking, City Planner advised that the restaurant parking was not under considera- tion at this time as it was a separate application, and that the pro- posed hotel had provided in excess of the 1 .1 parking spaces required for the size of the development. Commissioner Allan requested -clarification 66 two points that seemed to have been misunderstood by two of the parties that had spoke in opposition. One was whether she had understood correctly that a list of the potential home owners and those already occupying condiminiums at Canyon South III had been obtained and notices mailed to them; and, was not the 200 ft. setback requirement only applicable where R-1 and R-3 properties abutted one another-=and'notwWhen'-a street.:divided properties. She was advised by City Planner that she was correct. May 11 , 1977 PLANNING COMMISSION MEETING MINUTES Page 5 PUBLIC HEARINGS - Continued CASE 6.295 - Continued Commissioner Ehrens stated that he would like to make a motion to table the Item until there was a full compliment of Commissioners present and also for the purpose of making a field trip to the site, and rquested that the developer stake building locations and zone lines. Vice Chairman agreed and, in addition, stated that since this was the first variance application of this type the Commission should take a longer look at it. Motion was made by Ehrens, seconded by Allan, and unanimously carried (Ortner and Chase absent) that this item be continued to the May 25, 1977, Planning Commission Meeting. * * * * * * * * * * * * * * * * May 11 , 1977 PLANNING COMMISSION MEETING MINUTES Page 6 PUBLIC HEARINGS - Continued CASE 5.0006-CUP - Application by CARROWS RESTAURANTS, INC. , for a Conditional Use Permit to allow construction of a 24 hour family style restaurant and a steak house restaurant. onpproperty located on the south side of of East Palm Canyon Drive at Arquilla Road, R-3 Zone, Section 26. Commission response to written comments on draft Negatige Declaration. No comments received. City Planner reviewed the staff report in detail and noted that two of the letters, in opposition, that had been read into the record on the previous application also applied to this application. lThe findings contained in the staff report were reviewed as were the condi- tions of approval of the application. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, approved the requested Conditional Use applications, but did not approve City Staff's recommended'C.ondition No. 4. Therein, Staff would apparently require the lowering of the proposed floor grade of the affected structure some four feet, in order to affect compliance with City's height regulations in the R-3 zone. Such a requirement is picayunish and should be deleted, since the proposed building height is now in complete compliance with the spirit, intent, and provisions of the height regula- tions applying to Indian-trust land in the R-3 zone since March, 1967." City Planner presented and explained the plot plan and elevations for the proposed restaurants, but advised that since this project and the preceding appldcation were to proceed simultaneously this item should also be continued. In reply to questions by Commissioner Ehrens, he advised that the Carrows restaurant would be approximately BOO feet from the condominium development, and that Jeremiahs would be approxi- mately 500 feet, and that it would be possible under a Condit4ona'l Use Permit to condition the hours of use for a restaurant. Vice Chairman declared the hearing open and the following persons . from the audience: Morris Yasskin, advised that he represent0 n, Canyon Site Corporation as a sales agent for Canyon South III and that he was neither for nor against the application but only wished to comment that the people in the audience were unable to see the location of the restaurants on the ,, plot plan for the entire development. May 11 , 1977 PLANNING COMMISS40N MEETING MINUTES Page 7 PUBLIC HEARINGS - Continued CASE 5.0006-CUP - Continued The plot plan was raised on the board for viewing by the audience and the location of the restaurants explained. Robert Mooney, 800 Miramonte, Santa Barbara, the architect for the restaurants, stated that they were in complete accordance with the recommendations of staff and would make any necessary changes. With reference to the concern expressed by the home owners regarding parking for the restaurants, he informed the Commission that it was their intent that the restaurants be self-sufficient as far as the parking would go, but that it should be noted that five to ten per cent of the restaurant business would come from the hotel and would be walk in trade. In connection with the concerns expressed regard- ing the noise, he advised that noise, like light, traveled in a straight line, and that the restaurants would be effectively screened by the two story units surrounding them. There being no further appearances the hearing was closed. Motion was made by Ehrens, seconded by Harris, and unanimously carried, (Ortner and Chase absent), continuing this item to the May 25, 1977, Planning Commission Meeting. * * * * * * * * * * * * * * * * May 11 , 1977 PLANNING COMMISSION MEETING MINUTES Page 8 DETERMINATION by the Planning Commission of the effect of a request to vacate Via Eytel between Palos Verdes and Via Miraleste and that portion of Palos Verdes between Tachevah and Via Eytel . City Planner advised that this item was on the agenda for the purpose of deterfitining whether or not the consideration of the vacation of the streets would effect the GeneralPPlan Street Plan and General Plan of the City, and that no action on the merits of vacating would be taken at this time. The location of the streets was explained and the Commission was informed that the request had been presented in the form of a petition signed by home owners in the area and had been brought about because of an application for a medical complex. He noted that that application had been tabled pending the outcome of this item. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, request that a complete report on the effect of the proposed street vacations be made available for study and review prior to any action being taken thereon. " City Planner reported that staff was recommending that the Commission find that the consideration of the vacation of the streets in question would not adversely effect the General Plan of the City. The actual proceedings for vacation were outlined and the Commission was informed that in order for the City Council to state its intent, state law re- quired that a Planning Commission, in any vacation of public ways, make a finding as to the affect on the General Plan. Commissioner Harris noted that during previous discussions concerning the two streets he had been, and still was, in favor of their vacation and that by doing so it would make the proposed medical development more receptive to the general area. Vice Chairman stated his agreement and also observed that it would provide an automatic open space between the proposed project and the single family homes. Following discussion, motion was made by Allan, seconded by Harris, and unanimously carried (Ortner and Chase absent), that the vacation of Via Eytel between Palos Verdes and Via Mirale.ste and that portion of Palos Verdes between Tachevah and``:Via`E>ytel ,�Nwoul,di=ncat .adversely effect the General Plan of the City or the General Plan Street Plan. May 11 , 1977 PLANNING COMMISSION MEETING MINUTES Page 9 CASE 5.959 - Request by SPRINGS AMBULANCE SERVICE (Allan Reichle) for an extension of time of one year on Conditional Use Permit application to allow a 24 hour ambulance service and medical supply facility on property situated on the east side of E1 Cielo Road between Tahquitz- McCallum Way and Ramon Road, R-2 Zone, Section 18. Vice Chairman abstained from discussion and voting on this item. City Planner presented and explained the plot plan showing the subject site and reviewed the background of the application. The letter from the applicant requesting an extension of time was read into the record. The Commission was advised that this was a normal procedure under a Conditional Use Permit and that staff was recommending the granting of the request. Following discussion, motion was made by Allan, seconded by Ehrens, and unanimously carried (Lapham abstaining, Ortner and Chase absent), recommending approval of the request for a one year extension of time. TENTATIVE PARCEL MAP 7967 - Request by HALLMARK ENGINEERING, INC., represent- ing Smoke Tree Plaza, for approval of Tentative Parcel Map 7967 dividing one 4.6 acre parcel into two lots, R-3 and R-G-A (6) Zones, Section 25. Following discussion, motion was made by Ehrens, seconded by Harris, and unanimously carried (Ortner and Chase absent recommending approval of Tentative Parcel Map 7967, . FINDING: Thetproposed subdivision, together with the provisions for its design and improvement is consistent with the General Plan of the City of Palm Springs and will not have a significant adverse effect on the environment. CONDITION: That the final map be submitted to the Engineering Division for a check of technical accuracy and conformance to local and state] laws. TENTATIVE TRACT MAP - 9619 - Request by WEBB ENGINEERING, INC., representing One Hundred Eleven, Inc. , for approval of Tentative Tract Map 9619 dividing 7.5+ acres into 44 lots, R-3 and R-I-C Zones, Section 24. Following discussion, motion was made by Ehrens, seconded by Allan, and unanimously carried (Ortner and Chase absent) that a Negative Declaration be filed, and recommending approval of Tentative Parcel Map 9762. FINDING: The proposed subdivision, together with the provisions for ME design and improvement is consistent with the General Plan of the City of Palm Springs and will not have a significant adverse effect on the environment. CONDITION: That all requirrements of the Development Committee are to be met. May 11 , 1977 PLANNING COMMISSION MEETING MINUTES Page 13 DISCUSSION ITEM TENTATIVE PARCEL MAP 9242 - Request by K. Hinsvark (Tentative Parcel Map 9242) to discuss possibility of an amendment to the General Plan Street Plan. City Planner reviewed the map, background relevant to the original re- quest for approval , discussion before the Commission at its meeting of April 27, 1977, and the conditions of approval including dedications and improvements of streets. He explained that the applicant had re- quested that this item be placed on the Agenda for discussion by the Commission relevant to the removal from the General Plan Street Plan of the proposed collector street that ran along the easterly boundary of the applicant9s property. He advised that staff would be willing to require dedication only, with the improvements being mdde at a future date, should the street be needed for the development of the area in question, but would not recommend its removal from the General Plan Street Plan at this time. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, and on being advised that n the matter involves the possible removal of a proposed 'collector street' from sddd 'plan, ' adjoining the easterly side of the Indian-trust land in question, requests that a complete report on the proposed amendment be made available for study and review prior to any action being taken thereon." Mr. Hinsvark, the applicant, advised that the placement of the street in question connecting Sunny Dunes with Camino Parocela, served no purpose. He observed that if the street were to be put in it would create further policing problems in the area that were already quite serious at this time, and that he would appreciate it if the Commis- sion would request that a study be made and a hearing held on the issue so that the Police Department could become involved in the decision. Vice Chairman inquired whether it was often that dedications were re- quired without improvements and City Planner replied in the affirmative, setting forth the typical cases and process. Vice Chairman asked whether any=member of the Commission wished to hold a hearing to amend the General Plan Street Plan. There being no response the request died for lack of a motion. Public Comments: None. * * * * * * * * * * * * * * * * May 11 , 1977 PLANNING COMMISSION MEETING MINUTES Page 14 ARCHITECTURAL APPROVAL ITEMS The Planning Commission reviewed plans, discussed and took action on the following items involving Architectural Approval , subject to the conditions as outlined. CASE 2.938 - Application by JAMB. FRENCH for Architectural Approval of revised plans for construction of hillside residence to be located at 800 West Sunny Dunes Road, R-1 -A Zone, Section 22. Following discussion, motion was made by Ehrens, seconded by Allan, and unanimously carried (Ortner add Chase absent) approving the application subject to the following conditions: I 1 . That a revised site plan showing the proposed minor revisions discussed at the time of the Architectural Meeting shall be submitted. (This can be done on the landscape plans. ) 2. That the tr6llis on the east elevation be increased to 8 ft. 3. That detailed colors and materials, landscape and irrigation plans are to be submitted. 4. That the building plans are to be reviewed by the Architectural Advisory Committee prior to the issuance of building permits. SIGN APPLICATION - Application by K._ M. PATEL for Architectural Approval of change of face for a sign at the Kingsway/Inn/President Hotel , 1450 North Indian Avenue. City Planning Associate advised that the applicant had not submitted a new face for the sign in question but was requesting that the pre- sent sign be permitted to remain as the economics of a new sign would present a hardship. He reviewed the comments of the Architectural Advisory Committee and reported that they recommended a restudy and re- design. The Commissioners agreed that while it was unfortunate that the appli- cant and the sign company had been unaware of the City's Sign Ordinance, the sign should not be permitted. Following discussion, motion was made by Allan, seconded by Ehrens, and unanimously carried (Ortner and Chase absent denying the application. That Arizona Ash trees be substituted for the proposed Carob. 2. That a multiple trunk Rhus Lancea be used in place of the single trunk proposed. 3. CASE 2.874 - Application by the DESERT WATER AGENCY for Architectural Approval of detailed colors and materials,for new building located on Bogie Road,south of Mesquite, M-1 Zone, Section 19. Motion was made by Allan, seconded by Ehrens, and unahimously carried, (©rtner and Chase absent), approving the application as submitted. Following discussion, motion was made by Harris, seconded by Allan, and unanimously carried (Ortner and Chase absent) approving the application subject to the following conditions: 1 . That two 15 gal . Eucalyptus trees are to be substituted for the proposed Palm tree in the parking lot double planter. 2. That trees and shrubs are to be added to the front raised planter along the front wall (subject to staff review). 3. That the Sterculiz Diversifalia are to be increased to 15 gal . in size. 4. That all shrubs are to be increased to a minimum 5 gal . size. 5. That five 15 gal . City Planner explained that .this item was before the Commission as a result of staff denial of a sign permit. He presented a video tape of the existing signs, reviewed what was being proposed and advised that the Architectural Advisory Committee had recommended denial of the sign proposed to be placed on top of the main sign on Palm Canyon Drive. With reference to the directional signs he stated that the Committee recommended approval subject to a condition. The condition was outlined. Mr. E. Briesemeister of Health and Company manufacturers of signs, and Mr. R. Caffrey, President of Coachella Valley Savings set forth their views and arguments in opposition to the recommendations of the Committee. Following discussion, motion,,was made by Allan, seconded by Harris, and unanimously carried, (Ortner and Chase absent)denying the sign proposed to be placed on top of the main sign on Palm Canyon Drive, and approving the directional signs on Ramon Road and Belardo sub- ject to the following condition: That the sign proposed on Belardo keep within the 5 square foot per face limit. Commissioner Harris abstained from discussion and voting on this item. That detailed colors and materials be submitted. 2. That carport details be submitted. 3. That detailed landscape and irrigation plans, as well as exterior {lighting plans are to be submitted.
