April 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 2 PUBLIC HEARINGS CASE 5.0001-PD-72 - Application by JOHN WESSMAN for a Planned Development District to construct a medical office complex on the south side of Tachevah Drive between Via Miraleste and Avenida Palos Verdes, R-1 Zone, Section 11 . Commissioner Harris abstained from discussion and voting on this item. Commission response to written comments on draft Negative Declaration. No domments received. City Planner reviewed the staff report containing information relative to the background, guidelines previously adopted at the time a dif- ferent application had been processed, statistical analysis and find- ings. The plot plan, site plan and preliminary elevations were pre- sented and explained and it was noted that the plans indicated a proposed vacation of a portion of Via Eytel . With reference to the proposed vacation the Commission was advised that in a preliminary review between planning staff and traffic engineering, aswtll as one of the residents in the area, it had become apparent that staff should review the types of vacation that could be recommended in conjunction with the project. It was explained that the possibilities appeared to be the total vacation of Via Eytel and a vacation of a portion of Avenida Palos Verdes from Tachevah back to where it intersected Via Eytel . City Planner reported that there was also a desire on the part of someeof the residents on Via Olivos to cut that street off from Tachevah, at least to the depth of the professional office buildings, and create a cul -de-sac. He ad- vised that because of the various alternatives time.: was required to study the situation and that staff was, therefore, recommending a continuance. In reply to questions by Commissioner Lapham and Chairman Ortner, City Planner advised that the propesdd street vacations would not be at the request of staff but would be initiated by the developer in conjunction with the residents in the neighborhood. The procedure would be that once the request had been submitted it would be brought before the Commission for its deterrhination of the effect the vacation of the streets would have on the General Plan Street Plan and, after recommendation by the Commission, it would be presented to the City Council . Chairman declared. the hearing open and the following persons spoke from the audience: Dr. Richard Roger, speaking in favor of the development, reported that he lived approximately 40 ft. from the proposed project at 953 Avenida Palmas. He stated that he had lived at that location for six years and had been a resident of Palm Springs since 1940 and was, therefore, thoroughly familar with the development that had taken place. He ad- vised that he would like to go on record as approving and endorsing April 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 3 PUBLIC HEARINGS - Continued CASE 5.0001-PD-72 - Continued this development. He presented letters in favor of the project from Morton L. Kurland, L. W. Baldwin and Alan Silverman, advising that they;,i,al,l owned, property next to the development. The letters were read into the record. John Wessman, the developer, 498 Burton Way, advised that they had been working on the plans for approxilmately six months, that numerous meetings had been held with City staff and property owners in the area to try andssolve the problems that had arisen at the time of the Montgomery application. He reviewed the problems and explained the proposed solutions to those problems, noting that they were trying to create�asirmuth 6f,.a. bufferwas possibl&.-between' the residential area and the hospital . In addition, he discussed the various possibilities regarding the street circulation patterns in_the :area,-Ithe- fact that they Mould like to be allowed to have facilities related to the medical profession such as a laboratory and small pharmacy for the use of the tenants in the building. In reply to a question by Commissioner Ehrens, Mr. Wessman advised that he was the sole owner of the property, and that the escrow had been closed for over four months. He observed that the project would be an asset not only to the City but to the neighboring properties as well . Dr. Arthur Scherer, 996 Avenida Palos Verdes, while speaking in,ppposition, presented slides of the area in question showing the location of his home as well as other properties in relation to the proposed project, the streets in the area, pictures of various walls throughout the City, and vacant properties to the west and north of the Desert Hospital that he observed were more suited to this type of project. With reference to Via Eytel he stated that he was not opposed to totally closing that street. He observed that the project, although better in design than what had been proposed at the time of the %ntgomery application, would not be as desirable a buffer as single family hones. In regard to allow- ing other uses in the project such as a laboratory, pharmacy or x-ray facility, he expressed surprise that the Desert Hospital had not opposed the application and stated that those uses were not necessary but that if a drug store use were permitted it should be very limited. While commenting that the design of the development seemed to be compatible with the residential homes he noted that:ithe:,amountTdesigna`ted for two story was more than he would like to see and, in addition, advised that concern had been expressed by some of the home owners in the area over what appeared to be the height of two towers at either end of the development. ..,; April 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 4 PUBLIC HEARINGS - Continued CASE 5.0001-PD-72 —Continued RonelddGonzalvez, 1001 Avenida Palos Verdes advised that he was the new owner of the old Rose Estate and a new resident of Palm Springs. He stated that he would not like to see any structure in the area built higher than the peak of his own roof. He advised that although he had been in the area only a short period of time he had observed a great many children and would, therefore, not like to see any further traffic generated. He referred to the architecture of the "Bochner" building, noting that the proposal before the Commission was far more Spanish in character and did lend itself to the site, but that he would like to know how high the second story peaks were going to be. With reference to a traffic study, he suggested that one should be done on the "Bochner" building before any further professional buildings were permitted in the avea. He stated that the home owners in the area should be considered not only because of being tax payers but also be- cause of the effect a further development might have on property values. He advised that he too would prefer to see single family residences on the site, as opposed to a commercial development, and requested that the Commission consider the various aspects of the proposal before taking any action. There being no further appearances the hearing was closed. The Commissioners discussed the traffic study that was to be done by staff and the length of time that it would take to complilte such a study. Comparison was made between the height of the walls shown to them on Dr. Scberer's slides and the wall proposed for the project. This item was continued to the June 22, 1977 Planning Commission Meeting. April 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 5 PUBLIC HEARINGS - Continued CASE 5.0002-PD-73 - Application by ROBERT GRUNDT for a Planned Development District to construct 42 single story condominium units and related recreational facilities on property situated on the west side of Highway 111 , between La Reina Way and South Cerritos Drive, R-3 Zone, Section 24. Commission response to written comments on Negative Declaration. No comments received. City Planner presented the staff report containing adjacent zoning and existing land use, background, statistical breakdown of the project, analysis,, street system and findings. He reported that the Architectural Advisory Committee had reviewed the project and had recommended approval of the preliminary and final development plans. The plans were presented and explained. He advised that staff was recommending approval of the application subject to certain conditions. The conditions were outlined. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, approved the proposed Planned Development District." Chairman declared the hearing open and the following person spoke from the au nce: Hugh Kaptur, 600 E. Tahquitz-McCallum Way, the architect, advised that a request by the Fire Department for 60 ft. cil-de-sacs at the end of the three driveways could not possibly be met, and that it should be noted that they were actually driveways with two of them servicing 6 units each, while the third serviced 14 units. He pointed out that three 60 ft. cut-de-sacs would take up a great deal of the property and that, in his opinion, the Fire Department should consider the use of smaller equipment because of the many residential developments similar to the one proposed that were being constructed in the City. He noted that while the giie equipment could get into the development. the Department could not turn it around and did not want to back the equipment out. He advised that the elevations before the Commission were not prelimin- ary but were actually the working drawings, and that they were request- ing approval of the final plans . There being no further appearances the hearing was closed. The Commissioners questioned and asked for clarification of the Fire Department requirement for three 60 ft. cul-de-sacs as that require- ment had not appeared in any of their reports. April 13, 1977 PLANNING COMMISSION MEETING MINWWES Page 6 PUBLIC HEARINGS - Continued CASE 5.0002-PD-73 - Continued City Ptanning Associate advised that the Plannd,,ng Department had not received any document from the Fire Department containing that re- quest, nor had they heard about it from anyone but Mr. Kaptur. He reviewed the requirements set forth by the Fire Department both before and after revised plans had been received and advised that during the discussion at the Development Committee meeting, the Department had indicated that either an additional hydrant on the site, or the con- nection of driveways with fire access lanes in turf block or concrete would suffice to eliminate the problem. The Commissioners and City Planner discussed the lining up of Cerritos and the closing off of La Reina and Comissioner Ehrens asked whether the developer had been asked to install a street light on the corner of La Reina and, if not, it should be recommended. Commissioner Lapham stated that since they had not been informed by the Fire Department regarding the cul-de-sacs and since there was adequate space to provide for emergency fire lanes across landscape areas, which provision could be inco rporated orated into the final landscap e plans, he d i d not see any reason to delay the project. Motion was made by Chase, seconded by Ehrens, and unanimously carried, that a Negative Declaration be filed in connection with this Item, and recommending approval of the application based on the following findings and subject to the following conditions: FINDINGS: 1 . This application for cluster condominiums, covering two different zones, is properly one for which a Planned Development District is authorized by the Zoning Ordinance. 2. The residential development is necessary and desirable for the development of the community, is in harmony with the various goals and objectives of the General Plan and is not detrimental to existing or possible future uses in the neighborhood. 3. The 7.77 acre site is adequate in size and shape to accommodate the condominiums proposed, as well as the necessary walls, fences, setbacks, and open spacennecessary to adjust this use to the subject site. 4. The subject site relates to East Palm Canyon Drive, a State . highway, Cerritos Road, a collector street, and La Reina, a .. local street, which are properly designed to carry the type of traffic generated by this use. i April 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 7 PUBLIC HEARINGS - Continued CASE 5.0002-PD-73 - Continued CONDITIONS: 1 . That all recommendations of the Development Committee are to be met. 2. That detailed colors and materials are to be submitted for approval . 3. That direct access to East Palm Canyon Drive from La Retina Way be eliminated by construction of an island across the existing opening, and that some type of lighting be provided at that intersection. 4. That detailed landscape and irrigation plans are to be re- studied. The plans are to include the use of turf block and show a redesign of the exterior wall . April 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 8 PUBLIC HEARINGS - Continued CASE 5.0004-PD-74 - Application by PACIFIC SOUTHWEST REALTY CO., for a Planned Development District to allow construction of a bank and parking facilities for Security Pacific National Bank on the south side of Andreas Road between Sunrise Way and Luring Drive, C-lAA and P Zones, Section 13. Commission response to written comments on draft Negative Declaration. No comments received. City Planner read the staff report containing the background, analysis, adjacent zoning and existing land use and findings. He advised that two letters in favor of the project had been received and the letters were read into the record. The letter from Mr. and Mrs. Derry did question how the development would affect the traffic at the curve of Andreas Road and Saturmino Drive. He reported that the Architectural Advisory Committee had reviewed the plans and had recommended a complete restudy and continuance of the item and, in addition, the plans before the Commission had been received too late to be presented to the Development Committee and for that reason staff was also recommending a continuance. Chairman declared the hearing open and the following person spoke from the audience: Frank Gilbert, a representative from Security Pacific National Bank, reported that the plan before the Commission was the result of a great deal of discussion and cooperation with planning staff. In answer to the question raised in the letter from Mr. and Mrs. Derry regarding the flow of traffic on Luring Drive,he advised that the access was for egress only and was designed to force a right turn into Luring, as opposed to a two way turn so close to the intersection, and that the other access would line up with the offset alignment of Luring Drive. With reference to the structure on the plot plan he noted that it was conceptudl only and that the final plan would show an irregular line along Sunrise Fund would also have some irregularity on the Andreas elevation. He reviewed the amount of wood being used in the project, the landscaping, drive up lanes and, in reply to qugsti:ons-°,byJry- Commissioner Allan, advised that there was adequat6 parking for employees,aand that the building would probably accommodate approxi- mately 10 people. April 13, 1977 PLANNING COMMISSION MEETING MINUTES Page 9 ENVIRONMENTAL ASSESSMENT ITEMS Staff Reports and Environmental Evaluations containing impact areas, comments and mitigating measures were presented and explained to the Commissioners and the Planning Commission took action on the following items involving environmental assessment. CASE 6.295 - Environmental Assessment on application by SUN DIALINVEST- MENT, INC., for a Variance from the 200 ft. setback requirement for second story in R-3 developments when abutting R-l-C zoned property. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, approved the requested variance." It was found=.that,!the subject request was a Class 5 categorical exemption and no action was necessary. CASE 5.0005-CUP - Environmental Assessment on Application by TOWNHOUSE BUILDERS CORPORATION for a Conditional Use Permit to construct a neighborhood shopping plaza, private tennis and health club, and condominiums on the north side of East Palm Canyon Drive, between Cherokee Way and Seven Lakes Country Club, R-G-A (8) Zone, Section 30. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, recommends a 'Negative Declaration of Impact report in the above case, particularly since the Indian-trust land involved formerly included a sub- stantial area classified in the C-1 zone (now sites of proposed shopping and coffee shop facilities), and purportedly changed to an R-3 zone by the City Council and contrary to the recom- mendations of the Tribal Council . Further, the property in- volved is located across Highway 111 from an occupied commercial area, and across Cherokee Way from a quasi-commercial hotel facility. " City Planner advised that staff was recommending a continuance of this item pending receipt of special reports regarding noise mitiga- tion measures and traffic studies. He noted that if the reports were received in time this item could;.possi'bly come up for public hearing at the same time two other shopping centers would be considered on the May 25, 1977 Planning Commission Agenda. �`'' This item was continued to May 25, 1977. The following was received from the Tribal Cound l : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, recommends a 'Negative Declaration of Impact' report in the above case." The following was received from the Tribal Council : "The Tribal: Council , in accordance with recommendations of the Indian Planning Commission, recommends a 'Negative Declara- tion of Impact' report." Motion was made by Ehrens, seconded by Chase, acid unanimously carried, that a draft Negative Declaration be prepared for Tentative Tract Map 9351 . * * * * * * * * * * * * * * * * TENTATIVE PARCEL MAP 9242 (revised) - Environmental Assessment on request by HALLMARK ENGINEERING, INC., representing Ken Hinsvark, Leasee, for approval of Tentative Parcel Map 9242 (revised) dividing 3.4 acres into 2 lots, R-1-A and W-R-1-A Zones, Section 22. Motion was made by Chase, seconded by Ehrens, and unanimausly carried, that a draft Negative Declaration be prepared for Tentative Parcel Map 9666. CASE 5.0007 - Environmental Assessment on amendments to the General Plan Street Plan which would pnovide for the elimination of Jacaranda Road as a collector street, and the elimination of the Belardo Road cross- over between Palm Canyon Drive and Belardo Road. The following was received from the Tribal Council : "The Tribal Council , in accordance with recommendations of the Indian Planning Commission, will await City Staff re- ports, maps, etc. , prior to commenting on the proposed amend- ments. TENTATIVE PARCEL MAP 9361 - Request by HALLMARK ENGINEERING, INC. , representing Heller Enterprises for approval of Tentative Parcel Map 9361 consolidating Lots 9 and 10 of Twin Palms Estates, R-2 Zone, Section 26. Commission response to written comments on draft Negative De Raration. No comments received. Motion was made by Ehrens, seconded by Allan, and unanimously carried, that a -Negativp, Decharati6n be .filed an&recommending approval of Tenta- tive Parcel Map 9361 subject to the following conditions: That all conditions oftbhe Development Committee be met. Commissioner Harr!"s abstained from discussion and voting on this item. Motion was made by La ham, seconded by Chase, and unanimously carried, (Harris abstaining), recommending approval of Tentative Tract Map 6069 (revised) subject to the following conditions: s 1 . That all recommendations contained in the minutes of the Development Committee,dated April 5, 1977, be met. 2. That all recommendations contained in a letter from the River- side County Flood Control and Water Conservation District, dated March 14, 1977, be met. SECTION 26 - LOT LINE ADJUSTMENT - Request by WEBB ENGINEERING, INC. , for approval of lot line adjustment for Lots 123 and 135 of Tract No. 3137, Section 26. Motion was made by La ham, seconded by Chase, and unanimously carried, recommending approval of the lot line adjustment. L. ELKINS for Architectural Approval of re- vised site plan, landscape and irrigation plans for development at 1268 Ramon Road, Section 14. Motion was made by Lapham, seconded by Ehrens, and unanimously carried, approving the revised site plan and landscape and irrigation plans subject to the following conditions: 1 . That larger shrub forms are to be used to screen the trash enclosures. 2. That tree and shrub form are to be added to the bare carport walls. SIGN APPLICATION - Application b JJOHN WHITING (Palm Valle OOil Company) for rchitectural Approval of change of face for sign located at 144 North Sunrise Way. Motion was a made by Chase, seconded by Ehrens, and unanimously carried, approving the sign application with-tfte`.use :oftthe word "ECONO" sub- ject to the following condition: That the colors to be used for the sign shall be beige, brown and ivory, said combination and lettering to be submitted to staff for approval . CASE 2.929 - Application by MARK A. BANTLE for Architectural Approval of plans for construction of hillside residence on La Mirada Road, R-1-A Zone, Section 22. Motion was made by Chase, seconded by Allan, apd',unanjsmously carried, approving this application subject to the following conditions: 1 . That detailed landscape and irrigation plans are to be submitted for approval . 2. The following was received from the Tribal Council : "The Tribal Council is advised that owners of abutting Indian-trust lands, either involved or affected by the project, are continuing to study and confer regarding common problems, and recommends that the item be continued until said problems are resolved to the maximumppossible extent.
