Neel Laszlo Sandor * * * * * * * * * * * * * * * * Chairman called the meeting to order at 1 :40 pmm. * * * * * * * * * * * * * * * * Approval of Minutes: The Planning Commission Minutes of February 23, 1977, drafts distributed, were unanimously approved. * * * * * * * * * * * * * * * * March 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 2 PUBLIC HEARINGS CASE 5.986-PD-71 - Application by AFFILIATED PROPERTIES for a Planned Develop- ment District to construct an office complex and residential apartments with recreational facilities on property situated on the east side of Farrell Drive between Tahquitz-McCallum Way and Baristo Road, P. Zone, Section 13. Action on Negative Declaration. City Planner set forth the reasons for the several continuances and ad- vised that a revised preliminary development plan had been reviewed and approved as to concept by the Architectural Advisory Committee. The changes that had been made in the plans were explained, including the decrease in density, and it was noted that the circular drive had been redesigned to a half circle thereby changing the street system previously objected to by the Commission. The plan for the different phases was reviewed and, in response to concern expressed by Commis- sioner Ehrens relevant to the phases, City Planner ad#ised that each phase would function independently from the others. He reported that the revised plans before the Commission had not been reviewed by the Development Committee but that staff would recommend approval of the preliminary plot plan subject to any conditions that might be levied by that Committee. Chairman declaredtthe hearing open and the following persons spoke from the audience: �-- Richard R. Oliphant, 77900 Avenue of the States, associated with Affiliated Properties, stated that after the many lengthy discussions with the Architectural Advisory Committee they were please to have arrived at a harmonious agreement. He asked whether he could answer any questions that the Commissioners might have. R. Crawford, President of Los Compadres Association, owners of the 12 lots bordering the project, indicated they would want to keep a close watch on the final development plans. He inquired whether they would be notified as the plans were presented. He was advised that the City Council would hold a public hearing on the application, but that once the application had been approved, detailed plans would not be a matter for public hearing but that anyone interested could go to the Planning Department and review all the plans. He was also informed that any correspondence received could be entered into the record. There being no further appearances, the hearing was closed. The Commissioners agreed that the revised plans before them were far superior to those originally received. However, Commissioner Lapham and Chairman Ortner both expressed concern over the long, unbroken wall along the north side of Baristo and requested that particular attention be paid to its design and treatment on the final development plans. Motion was made by La ham, seconded by Ehrens, and unanimously carried, recommending approval of the Planned Development District based on the preliminary plot plan and subject to the following conditions: 1 . That all conditions of the Development CoM ttee shall be met. 2. That particular attention shall be paid to the design and treatment of the area along the north side of Baristo Road. March 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 4 �...� ENVIRONMENTAL ASSESSMENT ITEMS: CASE 5.0001 -PD-72 - Environmental Assessment on Application by J. WESSMAN for a Planned Development District to Construct a medical office complex on the south side of Tachevah Drive, between Via Miraleste and Avenida Palos Verdes, R-1 Zone, Section 11 . City Planner presebted the staff report containing adjacent zoning, existing land use, statistical analysis, site condition and the back- ground, noting that anaapplication for a 60,000 sq. ft. professional complex had previously been considered and denied by the Planning Commission. He advised that preliminary plot plans had been submitted for the purpose of acquainting the Commission with the site layout and architectural design. With reference to the design it was noted that it was Spanish in character so that the complex would match the many older residential homes in the area. He explained that the elevations showed both one and two story buildings located basically toward the Tachevah side of the project. The environmental evaluation was reviewed and the summary comment relative thereto was read into the record. With reference to the amoudt of traffic projected, the Commission was advised that the traffic study that had been prepared in connection with the previous]ggpphmcation would be reviewed in detail by the City's Traffic Engineer and that oomments relative thereto would be forthcoming. He advised that staff was recommending the preparation of a draft negative declaration. Commissioner Allan asked wh ther the applicant's proposal was to eliminate Via Eytel altogther and she was advised by City Planner that she was correct. He reported that after preliminary review the Development Committee had indicated that Via Eytel 's total elimination would create a problem for the Fire Department as it would create a 1000 ft. cul-de-sac street. He stated that at the time the actual application was considered there would be some modification of the request, possibly by eliminating half of Via Eytel and creating a loop street. Following discussion, motion was made by Ehrens, seconded by Chase, and unanimously carried, that a draft Negative Declaration be prepared for this item. March 23, 1977 PLANNING. COMMISSION MEETING MINUTES Page 5 ENVIRONMENTAL ASSESSMENT ITEMS - Continued CASE 5.0003-- Environmental Assessment on Application by R. A. HARRISON Irwin L. Trust, Trustee for a Conditional Use Permit to allow construction of a night club- cabaret on the east side of North Palm Canyon Drive, between Via Escuela and Vista Chino, C-1 and R-3 Zones, Section 3. City Planner reviewed the preliminary staff report, plot plan and preliminary elevations for the proposed project, advising that the General Plan Circulation Element indicated a cross over street con- necting North Palm Canyon Drive and Indian Avenue that would transect the site making it unusable, and that the General Plan Street Plan would have to be amended prior to consideration of this Conditional Use Permit. The Commission was advised that if they desired a hearing on the amendment it could be held at the next regularly scheduled hear- ing on General Plan amendments. The Commission was advised that staff was recommending that both the environmental assessment evaluation and the application be continued. Following discussion, motion was made by Harris, seconded by Ehrens, and unanimously carried, continuing the environmental assessment and the application until after hearings on an amendment to the General Plan Street Plan had been held. CASE 5.0004-PD-74 - Environmental Assessment on Application by PACIFIC SOUTH- WEST REALTY COMPANY for a Planned Development District to construct a bank building with parking facilities for Security Pacific National Bank on the south side of Andreas between Sunrise Way and Luring Drive, C-lAA and P Zones, Section 13. City Planner presented the preliminary staff report and explained the preliminary plot plan. The environmental evaluation containing mitiga- tion measures relative to transportation and circulation was revised. The Commission was advised that staff was recommending that _a.'draft Negative Declaration be prepared subject to compliance with mitigation measures as outlined in the evaluation. Following discussion, motion was made by Ehrens, seconded by Chase, and unanimously carried that a draft Negative Declaration be prepared. March 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 6 ENVIRONMENTAL ASSESSMENT ITEMS - Continued TENTATIVE PARCEL MAP 9076 (revised) - Environmental Assessment on request by KWL ASSOCIATES, representing Carver Companies, for approval of Tentative Parcel Map 9076 (revised) dividing 9.4+ acres into 4 lots for leasehold interest only, R-1-C Zone, Section 2. City Planner reported that an environmental evaluation involving this property had previously been done in Case 5.938, and that a Negative Declaration had been prepared and filed. He advised that the map could, therefore, be acted upon. The map was reviewed and the Commission was advised that staff was recommending approval subject to the final parcel map being submitted to the Engineering Division for check of techn4 W,' accuracy and conformance with local and state laws. The following was received from the T#$bal Council : "The Tribal Council , in accordance with recommendations of representative members of the Indian Planning Commission and the Tribal Planning Consultant, approved the proposed Parcel Map." Following discussion, motion was made by La ham, seconded by Allan, and unanimously carried, appvoving Tentative Parcel Map 9076 (revised , based on the following findings and subject to the following condi- tions: FINDING: That the proposed subdivision, together with the provisions for its design and improvement is consistent with the General Plan of the City of Palm Springs and will not have a signifi- cant adverse affect on the environment. CONDITION: That the final parcel map shall be submitted to the Engineering Division for check of technical accuracy and conformance with local and state laws. TENTATIVE PARCEL MAP 9361 - Environmental Assessment on request by HALLMARK ENGINEERING, INC., representing Heller Enterprises for approval of Tentative Parcel Map 9361 consolidating Lots 9 and 10 of Twin Palms Estates, R-2 Zone, Section 26. City Planner presented and explained the map, .outlined the conditions of the Development Committee and advised that staff was recommending that a draft Negative Declaration be prepared. Following discussion, motion was made by La ham, seconded by Ehrens, and unanimously carried, that a draft Negative Declaration be pre- pared for Tentative Parcel Map 9361 . TENTATIVE PARCEL MAP 9486 - Environmental Assessment on request by HALLMARK NGINEERING, INC., representing Wm. A. Foster, for approval of Tenta- tive Parcel Map 9486, dividing 1 .2 acre parcel into two lots, R-1-A Zone, Section 22. City Planner presented and explained the map, noted that the only re- quirement of the Development Committee was that the final parcel map be submitted for a check of technical accuracy, and advised that staff was recommending that a draft Negative Declaratj'on � be prepared. Following discussion, motion was made by Chase, seconded by Allan, and unanimously carried, that a draft Negative Declaration be prepared for Tentative Parcel Map 9486. March 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 8 �.- TENTATIVE TRACT MAPS: City Planner reviewed and explained the maps and the Planning Commission discussed and took action on the following Tentative Tract Maps, based on findings and subject to conditions as outlined. TENTATIVE TRACT MAP 9115 - Request by KW- ASSOCIATES, representing Vanton Development Company, for approval of Tentative Tract Map 9115, dividing 7.14+ acres into 21 dots, R-1-C Zone, Section 24. Commission response to written comments on draft Negative Declaration. No comments received. The following was received from the TtSbal Council : "The Tribal Council , in accordance with recommendation of representative members of the Indian Planning Commission, and the Tribal Planning Consultant, approved the proposed Tentative Tract Map." Motion was made by Lapham, seconded by Ehrens, and unanimously carried, recommending approval of Tentative Tract Map 9115, and the filing of a Negative Declaration. FINDING: That the proposed subdivision, together with the provisions for its design and improvement is consistent with the Geneval Plan of the City of Palm Springs and will not have a signifi- cant adverse affect on the environment. CONDITION: That all conditions of the Development Committee be met. TENTATIVE TRACT MAP 6884 - Request by L. G. RANKING & ENGINEERING CONSULTANTS, INC., representing P.S. Golf & Tennis Club, for an adjustment of lot line between Lots 3 and 4, Tract 6884, R-3 Zone, Section 29. Motion was made by Chase, seconded by Allan, and unanimously carried, recommending approval of a lot line adjustment between Lots 3 and 4.of Tract 6884. PUBLIC COMMENTS: None. March 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 9 �-' ARCHITECTURAL APPROVAL ITEMS The Planning Commission reviewed plans, discussed and took action on the following items involving Architectural Approval , subject to the conditions as outlined. CASE 2.932 - Application by LAUREL OIL COMPANY for Architectural Approval of remodel of exterior of existing building with slumpblock, and landscape and irrigation plans for building located at 670 South Palm Canyon Drive. Sign Application. Motion was made by Ehrens, seconded by Harris, and unanimously carried, approving the remodel of the exterior of the building and the sign application subject to the following condition: That the masonry block veneer be extended 4 ft. around to the north elevation. Landscape and irrigation plans were removed from the agenda pending re- study and resubmission. * * * * * * * * * * * * * * * * CASE 2.849 - Application by DIPLOMAT HOME OWNERS ASSOCIATION for Architectural Approval of plans for wrought iron fencing, and landscape and irrigation plans. Motion was made by Ehrens, seconded by Harris, and unanimously carried, approving the plans as submitted. CASE 2.859 - Application by JAMES E. BROWN, INC., for Architectural Approval of landscape/irrigation plans, colors and materials for 12 unit apartment complex to be located on the southeast corner of Sunrise Way and Arenas Road, Section 13. Motion was made by Chase, seconded by Allan, and unanimously carried, approving this application subject to the following conditions: 1 . That all of the walls are to be plastered and painted out a beige color. 2. That Carolina Cherry trees are to be substituted for the Serculia Diver- sifola with half of the trees to be 24" box size. 3. That the Olives are to be upgraded to 30" box size. 4. ARCHITECTURAL APPROVAL ITEMS - Continued CASE 2.904 - Application by C. COX, representing Slettedahl/Parker, for Architectural Approval of revised site plan and remodeling of front building to office building for the Home Building Center to be located at Indian Avenue and Oasis, C-M7Zone, Section 34. Motion was made by Ehrens, seconded by Chase, apo unanimously carried, approving this application as submitted. CASE 2.921 - Application by MR. and MRS. LARRY ADAMS for Architectural Approval of plans for construction of hillside residence, Cahuilla Hills, Section 27. Commissioners Allan and Chase abstained from discussion and voting on this item. Motion was made by Lapham, seconded by Ehrens, and unanimously carried (Allan and Chase abstaining), approving t— h application subject to the following conditions: 1 . That detailed colors and materials are to be submitted. 2. That landscape and irrigation plans are to be submitted. 3. That final grading plans are to be submitted. 4. That the approach to the property is to be reviewed and studied by the Engineering Division when that portion of the development plans are submitted. CASE 2.705 - Application by CANYON COUNTRY CLUB ESTADOS for Architectural Approval of landscape and irrigation plans for Phase II, property located on the north side of San Jose Road between S. Palm Canyon Drive and Calle Palo Fierro, Section 26. Motion was made by La ham, seconded by Ehrens, and unanimously carried, approving this application subject to the following conditions: 1 . That 50% of the trees are to be 24" box size. 2. That all of the Ceratonia Siliqua (Carob trees) are to be increased to 24" box size. 3. That the Allepo Pine be changed to Italian Stone Pine. 4. That the Hypencium ground cover is to be ddltted and some other type of ground cover is to be substituted. 5. Motion was made by Chase, seconded by Ehrens, and unanimously carried, approving this application subject to the following conditions: 1 . That carport details be submitted for approval . 2. That landscape and irrigation plans be submitted for approval . 3. That vccess between the phases toward inaccessible unitsd be designed into the landscape plans. (This condition is at the rust of the Fire Department). 4. That all conditions of the Development Committee are to be met. CASE 2.939 - Application by L. A. LAPHAM for Architectural Approval of plans for construction of hillside residence for T. J. Tracy, 800 Via Las Palmas. Commissioner La ham abstained from discussion and voting on this item. CASE 5.917 - Environmental Assessment on application by WESTVIEW DEVELOPMENT CORPORATION for a conditional Use Permit to allow a shopping center and related facilities use of property located on the north side of Highway 111 , between Golf Club Drive and Broadmoor Drive, R-3 Zone, Section 29. The following was received from the Tribal Cound1l : "The Tribal Council , in accordance with recommendations of representativesmembers of the Indian Planning Commission and the Tribal Planning Consultant, concurs in the City Planning Staff recommendations of continuance to May 25, 1977." CASE 5.998 - Environmental Assessment on Application by MATTHEW DRAGICEVICH for a Conditional Use Permit to construct a neighborhood shopping center on an 8 acre parcel located on the south side of East Palm Canyon Drive, between Matthew Drive and Dunn Road, R-3 Zone, Section 30. CASE 2.920 - Application by C. BRECHLIN, representing B. R. Preckwinkle for Architectural Approval of grading and street plan for Bogie Road south of Mesquite, M-1-P Zone, Section 20. The following was received from the Tribal Counddl : "The Tribal Council finds that owners of abutting lands, in- cluding that involved in the proposed grading project, hove mmet for the purpose of restudying the projected plan. Therefore, the Tribal Council , in accordance with recommenda- tions of representative members of the Indian Planning Com- mission and the Tribal Planning Consultant, requests further continuance until April 13, 1977." CASE 2,933 - Application by DUNCAN EMMONS for Architectural Approval of plans NN for a 3400 sq. ft. addition to an existing structure located at 340 San Rafael Place. City Planning Associate explained that while the Architectural Advisory Committee had recommended approval subject to certain conditions relative to updating the building, there were other problems with the site. He advised that no dedications had ever been made for any of the sites on the north side of San Raphael , that San Raphael was designated as a secondary thoroughfare, and that if the 44 ft. dedication along the en- tire frontage were imposed it would eliminate the front office from the building in question. He reported that it would take a General Plan amendment to delete the street as a secondary thoroughfare in order to circumvent the 44 ft. dedication. Mr. Duncan Emmons, the applicant,advised that although he had discussed this property with planning staff prior to its purchase, he had been ;totally unawhre-thatr thereswbul d--be;oat-Any t�'ymt�edove!6pment,�roqui,.i;re- ments such as the ones being requested by the Development Committee. He noted. that if the dedication were to be made along the street in question, it would mean that an entire building would have to be removed from an adjoining site. The Commissioners discussed with City Planning Associate alternatives that might be available to the applicant and agreed that they could not approve the application with the street dedications being exempted. It was recom- mended that the applicant review and discuss the situation with staff and that the item be continued for two weeks. FRENCH for Architectural Approval of plans for construction of hillside residence to be located at 800 W. Sunny Dunes Road, R-1-A Zone, Section 22. This item was continued to the April 13, 1977, Planning Commission Meeting so that the applicant would have an opportunity to be present at the Architectural Advisory Committee Meeting of April 11 for the purpose of clarification of details. The following items were removed from the Planning Commission Agenda pending resty4y. Following discussion, motion was made by La ham, seconded by Chase, and unanimously carried that the three elevations involving the classroom and chapel buildings be restudied. CASE 6.294 - Application by P. TYNBERG for Architectural Approval of landscape and irrigation plans for exterior of wall on property situated on the west side of Via Norte between Vista Chino and Via Sol , R-1-A Zone, Sec. 10. Commissioner Allan abstained from discussion and voting on this item. The Commissioners agreed that the landscape plans submitted, as well as the materials used for landscaping, were insufficient and that since they had granted a variance on theswftl�pprmfessional landscape plans should be submitted showing mounding, larger plantings, and trees. This item was removed from the Agenda for restudy. CASE 2.856 - Application by J. L. ELKINS for Architectural Approval of land- scape and irrigation plans for development at 1268 Ramon Road, Secion 14. The question arose whether Brazilian Pepper trees should be used near play areas since there were many children who suffered from allergies. This item was removed from the Agenda pending restudy. Restudy was recommended by the Architectural Advisory Committee for the purpose of unifying the scheme. CASE 2.927 - Applica6ion by J. B. BARRINGER re resentin Bob's Biq Bo Restaurants for Architectural Approval of plans to construct a Bob's Bd§ Boy Restaurant on the northwest corner of North Palm Canyon Drive and West Stevens Road, C-1 and R-3 Zones, Section 10. The Commissioners agreed that there be a redesign of the bu;iHtng,�tb integrate the entire structure. CASE 2.929 - Application by MARK A BANTLE for Architectural Approval of plans for construction of hillside residence on La Mirada Road, R-1-A Zone, Section 22. CASE 2.935 Application by A TUNIC & SON for Architectural Approval of plans, colors and materials for construction of a 7 unit, 2 story apartment build- ing to be located at 760 S. Calle Palo Fierro, Section 23. CASE 2.937 - Application by D. STRONG (Sun Dial Invest., Inc.,) for r hitectural Approval of plans for construction of 154 unit motel and manager's apartment at 1269 E. Palm Canyon Drive, Section 26.
