Approval of Minutes: The Planning Commission Minutes of February 23, 1977,
drafts distributed, were unanimously approved.

CASE 5.986-PD-71 - Application by AFFILIATED PROPERTIES for a Planned
Development District to construct an office complex and residential
apartments with recreational facilities on property situated on the
east side of Farrell Drive between Tahquitz-McCallum Way and Baristo
Road, P Zone, Section 13. Action on draft Negative Declaration.
City Planner reviewed the boundaries of the 37 acre parcel advising
that there were two major changes on the revised plans, namely that
the applicants had decreased the amount of square footage originally
proposed in the professional section and while increasing the amount
of area being devoted to residential use had decreased the unit count
from 264 to 209. The original .and revised plans were presented and
explained as was a map that had been prepared by the applicants
indicating, to the best of their knowledge, the phasing of the project.
It was noted that while the open space areas on the overall plan were
very well planned, the Architectural Advisory Committee was still
concerned with the amount of streets and driveways devoted to the
residential area, and that with the "circle" type of arrangement,
people entering and leaving would be driving on a semi-blind corner
at all times. He reported that since the Architectural meeting, the
applicants' had prepared another plan where they had taken out a
portion of the streets that bisected the central area, and that since
the new plan would have to be reviewed by both the Archictural Advisory
Committee and the Development Committee, Staff was recommending a
continuance. He noted, however, that input should be received from the
applicants and anyone else who wished to speak..
Chairman declared the hearing open and the following persons spoke from
the audience:
Richard R. Oliphant, 7790 Avenue of the States , associated with Affiliated
Properties, advised that they had attended the Architectural Advisory
Committee Meeting and that as a result had attempted to interpret and
incorporate the input received from the Committee on the plans that had
just been submitted. He noted that the original plan had shown a three-
quarter circle and that at no time had the Committee commented on or
criticized that particular element; that the circle was an excellent
concept as it would tend to slow traffic as opposed to long straight
streets, and that the line of sight from an automobile at any point would
be three hundred feet which represented almost a City block. He explained
the parking concept noting that two cars for every unit could be parked
under the structures with additional parking for guests available in the
driveways that appeared on the plans to be "Large white blank spaces" ,
he advised that in most cases there was ample space for planting trees,
etc. , and, in addition, the driveways were of concrete which would offer
a different composition from the asphaltshown on the streets. He
reviewed the changes made to the tennis court area, noting that a park
had been created. He asked that the Commissoners consider the plan that
was being presented and requested input from them.

Commissioner Chase observed that the revised plan was an improvement
basically because of the decrease in the number of units and the
addition of the garage areas. After being advised by the applicant
that this would be a closed community with a gate, he indicated that
the circle did not seem objectionable, it would slow the traffic and
did add interest to the project.
Commissioner Lapham asked whether the Traffic Engineer had had in
opportunity to review the revised plans, noting that there were many
openings onto the circle and that one of the problems might be dis-
orientation because of constantly turning to the right or to the left.
In addition, with reference to the phasing plan, he observed that only
about one-half of the circle would be in phase one and questioned
what might happen if the applicants decided not to proceed with the
project as proposed, as it would be a difficult situation to correct.
The Commissioners agreed that input should be received from the Traffic
Engineer.
This item was continued to the March 23, 1977 Planning Commission Meeting.

CASE 6.294 - A lication b P. TYNBERG for a Variance on property line wall
at east side front Via Norte frontage on property situated on the
west side of Via Norte between Vista Chino and Via Sol , R-1-A Zone,
Section 10. Commissioner Allan abstained from discussion and voting
on this item. Commission response to written comments on draft
Negative Declaration: No comments received.
City Planner presented the Staff report which contained the background
leading to this application. He advised that he had made a field trip,
not only to the site, but the surrounding area as well and cited
addresses where similar types of walls existed primarily because of the
slope of the land. The requirements of the Zoning Ordinance were ex-
plained. A photograph of the wall in question was viewed by the Com-
missioners and City Planner read four letters in favor of the wall , and
one letter outlining a compromise solution into the record. The
recommendations of the Architecural Advisory Committee were reviewed
and findings presented, and the Commission was advised that Staff
recommended approval , subject to the Committee's recommendations.
Chairman declared the hearing open and the following persons spoke
from the audience:
Peter Tynberg, the applicant, reviewed the various discussions and meetings
that had taken place both prior to and after the installation of the wall .
He advised that during the past week some planting had been done against
the wall on the Via Norte side and that a ground cover had been planted
along the east side. He referred to and commented on the letter that had
been received outlining a compromise solution. He asked that the Com-
mission approve the variance on the property line wall .
Dr. Williams, 373 Via Sole, advised that he wanted to go on record as
having no objection to the Tynberg wall . He too noted that there were
other homes in the area with the same type of topography and walls that
ran seven to eight feet above the crown of the road. He stated that it
seemed to be unjustified to request someone to alter an expensive wall
that had received approval , and he asked that the Commission act favorably
on the application.
Del Reese, 1550 Via Norte, speaking in opposition, advised that he was
the gentleman who had written the letter outlining a compromise solution.
He explained that his house was lcoated directly across from the Tynberg
property. He noted that the adjustment he had suggested was slight and
would represent very modest financial outlay. He advised that whatever
decision was made by the Commission would be agreeable to him but that his
suggestion for a little contouring would make a better looking wall and
bring it closer to Code requirements.

J. Hollomon, 1577 Via Norte, speaking in opposition, presented photo-
graphs of the wall , noting that there was a pile of unsightly rocks
placed on the property line by Dr. Tynberg. He referred to corres-
pondence to and from the City Manager and Director of Community
Development and read excerpts from the Director's letter. He related
conversations that he had with the Chief Building Inspector and voiced
his dislike and opposition to the wall .
There being no further appearances, the hearing was closed.
Commissioner Wessman, after looking at the photographs, stated that
the place should be cleaned up and the rocks removed. He noted that
this was not the only lot in the area where the street sloped faster
than the property line and that he would not be opposed to granting
the variance providing the applicant was required to plant some type
of bush and present detailed landscape plans.
Chairman advised that she concurred that the pile of rocks should be
removed, and that if the variance were approved with a condition for
landscaping, it should also contain irrigation plans.
Commissioner Chase agreed that, if approved, there should be a require-
ment for more mature plants on the landscape plans because what had
already been planted would take too long to cover the wall .
Following discussion, .motion was made by Harris, seconded by Chase,
that a Negative Declaration.be_ filed and approving the application
for a variance based on the following findings and subject to the
following conditions:
FINDINGS:
1 . That because of the existing topography of the property in question,
a strict interpretation of the method of measurement for perimeter
walls as outlined in the Zoning Ordinance, would deprive this
property of the ability to provide reasonable privacy from the Via
Norte side of the lot.
2. The granting of this variance would not constitute a grant of special
privilege since other properties in the vicinity have walls greater
than the height limit as measured under ordinance provisions and
since this type of variance would be considered for other properties
in the vicinity under similar circumstances.
3. The granting of this variance would not be materially detrimental
to the public health, safety, welfare, or injurious to properties
or improvements in the neighborhood.
4. The granting of this variance would not adversely affect the General
`� Plan of the City.

CASE 5.999 - Application by SECURITY PACIFIC NATIONAL BANK (Agents for
aci is Southwest Rea I Ly Co. ) for Conditional use Permit to expand
existing parking facilities on property situated on the west side
of Calle Ajo, between Ramon Road and Camino Parocela, R-2 Zone,
Section 23.
Commission response to written comments on draft Negative Declaration:
No comments received.
City Planner presented the Staff report containing background and
history of the bank at its present location, a statistical breakdown,
site condition, findings and recommendation for approval of the use
subject to revisions to the layout that would maximize the amount of
landscape buffer between the parking and the street. He advised that
the Architectural Advisory Committee had reviewed the item and also
recommended approval subject to the condition that detailed landscape
and irrigation plans be submitted and that the specimen trees on the
site should be saved wherever possible.
Chairman declared the hearing open and the following person spoke from
the audience:
Mr. Frank Gilbert, a representative from Security Pacific National
Bank, advised that the proposed changes to the landscape plans had
..-a been reviewed and that they agreed to the changes. He stated that
their intention was to eventually eliminate certain parking along the
south side of the drive-up facility in order to get cars off of Indian
Avenue and, in reply to a question by Chairman, acknowledged that in
the future they did anticipate doing some expansion to the building
that would provide for another drive-up window and would add stack
up spaces for automobiles.
Mrs. Wilson, 568 Calle Ajo, informed the Commission that she had lived
in the neighborhood for 31 years and while she had no objection to the
additional parking, she was concerned about the drive that ran from
Indian Avenue through to Calle Ajo as there were many cars that cut
through that drive onto Calle Ajo. She objected to having both ingress
and egress out of that drive, stating that it would be a hazard for the
people in the area. She asked why they could not have the cars enter
on Ramon Road or go out on Ramon Road from Indian Avenue.
Ted Taylor, 575 Calle Ajo, suggested that if the bank were permitted
to have two-way traffic in and out on Calle Ajo, the areas from Ramon
Road to the new drive should be either controlled or patrolled by the
City so that the automobiles would not be in the way. He stated that
he did not know whether it should be red zoned but that there should
be some sort of control so that the cars would have to stop before
entering Calle Ajo so that the pedestrians would be able to see the
vehicles.

Commissioner Chase stated that he thought the best solution to the
problem would be to red curb the area from Ramon Road down to the
drive as that would enable pedestrians to see any cars, whereas they
would not be able to if cars were permitted to park along the street
and, in addition, that would insure that the bank's employees would
use the parking facility being provided for them. With reference to
ingress or egress onto Ramon Road, he observed that the drive would
be too close to an intersection and would create an even more
critical problem, particularly for cars trying to make a left turn.
Commissioner Lapham commended the bank for acquiring the property to
increase their parking, as the number of vehicles parking on Calle
Ajo created a dangerous situation.
City Planner advised that the Commission could, if they desired to
do so, indicate- restricted parking along the curb side and that
Staff sould have the Traffic Engineer check to make sure that it would
not cause any problems. In addition, he advised that the Commission
could indicate to the bank that they change their policy of not
permitting their employees to park in the bank's parking lot and that
the bank should instruct the employees to use the lot being provided.
Mr. Frank Gilbert advised that the bank had always had a policy of not
allowing employees to park on the bank's parking lot and, in fact,
instructed them not to park there or on the street adjacent to the
building.
Lengthy discussion ensued regarding the banks policy and the Commissioners
agreed that they had been under the impression that the additional parking
was being provided for bank personnel so that the parking on Calle Ajo
would be alleviated, and that if this were not so, they would not be in
favor of permitting an outlet onto that street. They were advised by
City Planner that the bank had never indicated that the parking would
be for employees but that Staff had so indicated in the report. The
Commissioners indicated that they were not in favor of the expansion
of the parking facilities and possibly the loss of mature trees on this
project, or any project, that would not relieve the situation on Calle
Ajo.
Commissioner Lapham advised that he would like to make a motion to
grant the Conditional Use Permit for parking, on the condition that
the City line the curb from the ingress, egress of the bank, north to
Ramon Road and that the bank's employees be discouraged from parking
on such a small residential street.
Motion died for lack of a second.

The Commissioners discussed in detail red lining curbs in front of
single family homes, restricted parking, using the drive onto Ramon
Road for ingress and egress, and whether or not a condition could
be imposed instructing the bank to change its policy regarding
employee parking. They were advised by the Director of Community
Development, relative to the Commission's reluctance to impose a
condition regarding the bank's parking policy, that if they wanted
that condition they should impose it as a condition on the permit,
and that at a later date should it be evident that the condition
had been violated it would be grounds for revocation or reconsider-
ation of the Conditional Use Permit.
Following discussion, motion was made by La ham, seconded by Chase,
and unani ly carried ( Ehrens absent ), that a Negative Declara-
tion be 4iled, and granting the Conditional Use Permit, based on the
following findings and subject to the following conditions:
FINDINGS:
1 . That the proposed parking use is property one for which a
Conditional Use Permit is authorized by Section 9209.01-C 4a
of the Zoning Ordinance.
2. Such a use is desirable in the development of the community,
is in harmony with the various elements and objectives of
the General Plan and is not detrimental to neighboring
residential and commercial uses.
3. The site is adequate in size and shape to insure that a park-
ing facility can be developed and still be adequately
buffered from adjoining residential properties.
4. The major effect that this project would have on streets would
be to relocate certain curbside parking to an on-site parking
lot and as such improve the circulation on CaHe Ajo.
CONDITIONS:
1 . That all requirements of the Development Committee be met.
2. That revisions to the layout that maximize the amount of
landscape buffer between the parking and the street be followed.
3. That detailed landscape and irrigation plans are to be submitted.
4. That the specimen trees existing on the site are to be saved
wherever possible.
5. That the bank shall not direct their employees to park any-
where other than on bank property, and that the curb on the
Vrgst side of Calle Ajo, from the driveway to Ramon Road is to
be painted red.

ENVIRONMENTAL ASSESSMENT ITEMS
TENTATIVE TRACT MAP 9115 - Environmental Assessment on request by KWL
ASSOCIATES, representing Vanton Development Company,for approval
of Tentative Tract Map 9115 dividing 7.14+ acres into 21 lots,
R-1-C Zone, Section 24.
Commissioner Wessman abstained from discussion and voting on this item.
City Planner presented the map and explained the layout of the 21 lots
involved. He advised that the map showed there was a slight variance
in the standard of the lots as they were 89 feet in depth instead of
the 100 feet required in this particular zone, and explained that the
reason for this was because, in working with staff, the developer
could not work out an equitable circulation plan. It was noted, however,
that although all but two of the lots were 11% substandard in depth,
they had been increased in width so that they met the 10,000 sq. ft.
reggirement. The Environmental Evaluation was reviewed and the summary
comment from that evaluation was read intotthe record.
The following was received from the Tribal Council :
"The Tribal Council , in accordance with the recommendations
of the Indian Planning Commission, finds no impact on the
environment, other than proximity to the Tahquitz Flood Plan."
Following discussion, motion was made by Lapham seconded by Allan,
and unanimously carried (Wessman abstained, Ehrens absent), that a
draft Negative Declaration be prepared for this item.
CASE 5.0002-PD-73 - Environmental Assessment on application by R. GRUNDT (for
One Hundred Eleven, Inc. ) for a Planned Development District to con-
struct 42 single story condominium units and related recreational
facilities on property situated on the west side of Highway 111 , between
La Reina Way and So. Cerritos Drive, R-3 Zone, Section 24.
City Planner presented the staff report containing the background,
statistical breakdown, analysis, site condition and street system. The
environmental Evaluation was reviewed and the summary comment from that
evaluation was read into the record. The Commission was advised that
staff was recommending the preparation of a draft Negative Declaration.
The following was received from the Tribal Council :
I'The Tribal Council , in accordance with recommendations of the
Indian Planning Commission, finds no evident adverse environ-
mental impact from the proposed development. "
Following discussion, motion was made by Chase,seconded by Harris, and
unanimously carried (Ehrens absent), that a draft Negative Declaration
be prepared for this item.

TENTATIVE TRACT AND PARCEL MAPS:
City Planner reviewed and explained the maps and the Plannin Com-
mission discussed and took action on the following Tentative Tract
and Tentative Parcel Maps, based on findings and subject to conditions
as outlined.
Commissioner'Chase left the meeting at this time.
TENTATIVE TRACT MAP 9317 - Request by KWL ASSOCIATES, representing P.S.
Country Club, for approval of Tentative Tract Map 9317, being a sub-
division of a portion of the northeast 1/4 of Section 1 .
Commission response to written comments on draft Negatige Declaration.
No comments received.
Motion was made by Allan, seconded by La ham, and unanimously carried
(Ehrens and Chase absent) recommending approval of Tentative Tract
Map 9317,and the filing of a Negative Declaration.
FINDING:
That the proposed subdivision, together with the provisions ; ;
for its design and improvement is consistent with the General
Plan of the City of Palm Springs and will not have a signifi-
cant adverse affect on the environment.
CONDITOON:
That all requirements of the Development Committee be met.

TENTATIVE TRACT MAP 9205 - Request by WEBB ENGINEERING, INC'., representing
U.S.A. and Desert Dorados, Inc., for approval of Tentative Tract Map
9205, dividing 37.0+ acres into 108 lots, R-2 and R-I-C Zones,
Section 2.
Commissioners'Harris and La ham abstained from discussion and voting
on this item.
Commission response to written comments on draft Negative Declaration...
No comments received.
The following was received from the Tribal Council :
"The Tribal Council in accordance with recommendations of
the Indian Planning Commission, finds no evident adverse
environmental impact from the proposed Tract."
Motion was made by Wessman, seconded by Allan, and unanimously carried,
(Ehrens absent, Harris and Lapham abstaining , R6 0mmending approval of
Tentative Tract Map 9205 and the filing of a Negative Declaration.
FINDING:
That the proposed subdivision, together with the provisions
for its design and improvement is consistent with the General
Plan of the City of Palm Springs and will not have a signifi-
cant adverse effect on the environment.
CONDITION:
That all requirements of the Development Committee are to be met.

..� TENTATIVE TRACT AND PARCEL MAPS - Extensions of Time
TENTATIVE PARCEL MAP 7581 - Request by HALLMARK ENGINEERING, INC., repre-
senting MAX E. HAYWARD, for a six month extension of time on
Tentative Parcel Map 7587, for property located on the north side of
Ridge Road west of Mesa Drive, R-1-C Zone, Section 27.
Chairman left the meeting at this time and Vice Chairman Lapham
chaired the following item.
City Planner advised that this map represented a subdivision of an
existing six parcels of property on the north side of Ridge Road
into four lots, and that the map had been approved March 24, 1976.
He noted that the request was being made as the final map had not
as yet been recorded. In reply to questions by Commissioner Allan
he explained the ordinance requirements relative to extensions of
time and advised that this was the first extension requested for
this map.
Following discussion, motion was made by Chase, seconded by Allan,
and unanimously carried (Ehrens and Ortneer absent) recommending
approval of a six month extension of time on Tentative Parcel Map 7587.

TENTATIVE TRACT MAP 6069 - Request by HALLMARK ENGINEERING, INC. , represent-
ing JOHN WESSMAN, for a six month extension of time on Tentative Tract
Map 6069 (revised) for property situated on the north side of Escoba
Drive (extended), R-1-C Zone, Section 19.
Commissioners Harris and Wessman abstained from discussion and voting
on this item.
City Planner explained that this map represented 32 single family sub-
division lots a portion of which, although within the tract boundaries,
had been eliminated because of being within the flood plane area. He
advised that the request was being made as the final map had not as
yet been recorded, and that this map also had been approved in 1976.
The Commission was advised that staff recommended that the extension
be granted subject to all previous conditions.
Following discussion, motion was made by Chase, seconded by La ham,
and unanimously carried ( Ehrens absent, Harris and Wessman abstain-
ing) recommending a six month extension of time for Tentative Tract
Map 6069,sub3ecttto all previous conditions.

Public Comments: None.
Discussion Items:
City Planner explained that the Planning Commission considered amend-
ments to the General Plan three times a year and that the first meet-
ing in March would be the first time that new items could be brought
to the Commission's attention for the purpose of setting a date for
public hearings. He reported that one of the items of concern was the
Belardo crossover at the north end of the downtown area which the DDAC
was recommending be eliminated from the General Plan, while the other
item was the elimination of Jacaranda Road as a collector street from
the General Plan because of right of way problems and the low volume of
traffic carried by the street.
The Commission was advised that if they wished to proceed with the
amendments to the General Plan the date of April 27 could be set for
the public hearings.
Following discussion, staff-was instructed tonnotice both items for
the Planning Commission meeting of April 27, 1977.

The Planning Commission reviewed plans, discussed and took a tion
on the following items involving Architectural Approval , subject
to the conditions as outlined.

CASE 2.919 - Application by C.C.C. DEVELOPMENT for Architectural Approval
of plans for construction of a 20 unit condominium project to be
located on the west side of Avenida Caballeros between Alejo Road
and Amado Road, R-G-A (8) Zone, Section 14.
Motion was made by Chase, seconded by Allan and unanimously carried
(Ehrens and Lapham absent) approving this application subject to the
following conditions:
1 . That detailed colors and materials are to be submitted for
approval .
2. That detailed landscape, irrigation, exterior lighting and tennis
court lighting plans are to be submitted for approval .
Commissioner Lapham returned to the meeting at this time
CASE 5.955 - Application by J. D. WRATHER, JR., for Architectural Approval
of roof material , detailed colors and materials, landscape and irriga-
tion plans for Elmer's Colonial Pancake House, northeast corner of
Deepwell Road and East Palm Canyon Drive, R-3 Zone, Section 23.
Motion was made Lapham, seconded by Chase, and unanimously carried
(Ehrens absent) approving this application subject to the following
conditions:
1 . That Washingtonia Filifera be substituted for Washington Robusta
where used near the building.
2. That the deciduous trees in the rear parking area are to be deleted
and evergreen type of trees, e.g. , Olive Carob, etc., are to be
used.

CASE 2.892 - Roquest by J. WESSMAN (Carl 's Jr. Restaurant) for clarification
of Planning Commission decision of February 23, 1977, denying architectural
details of proposed restaurant.
Commissioners Harris and Wessman abstained from discussion and voting obi
this item.
City Planning Associate advised that since the applicant had not been
present at the last meeting when the Commission had denied the appli-
cation as it related to the particular site in question, he wished to
be heard to discuss the Commission's intentions and reasoning behind
its action.
Chairman reviewed the background leading to the Planning Commission
decision.
Reese Moneyhun, 1200 E. Harbor Boulevard, Anaheim, advised that he was
the real estate director for Carl 's Jr. Restaurants. He stated that it
was unfortunate that they had not been made aware of the Commission's
dissatisfaction with the project. He stated that he would like to
hear the views and objections that had been expressed relative to the
building.
Commissioner Chase noted that the building was on a predominant corner
and although the building being presented was an improvement over the
Carl 's Jr. standard type of building it still was not acceptable at that
particular location. He stated that some relatively minor improvements
could be made to the building which would not require redrawing and sug-
gested that perhaps it could be approved separately from the existing
building.
The Commissioners and Reese Moneyhun discussed the possibility of an
outside eating area, or patio area, and they were advised by City
Planner that they did have the ability for an additional 225-feet of
eating area, based on the parking for the entire development, but that
a patior would exceed that figure.

Mr. Moneyhun pointed out that it would be impossible to attach
anything to the building because of the stress and strain and
asked whether it wouldpbanpbtsibl,e Ito.?incorporate some type of
patio cover in the landscape plans and, if so, what would be
acceptable. After discussing with City Planner the possibility
of incorporating the patio area into the landscape deheme, the
Commissioners advised Mr. Moneyhun that they would like to see
rough sawn heavy beams and posts coming out of the lower facia
that would give the building more of a "carriage" look.
Followihig discussion, motion was made by Chase, seconded by Allen,
and unanimously carried (Ehrens absen't, :Wessman�and Harris abstain-
' ing) approving this application subject to the following conditions:
1 . That all conditions of the previous approval of this application
are to be followed.
2. Teat landscape and irrigation plane inoorporating a patio area,,
are to be submitted for approval .
Commissioner Wessman returned to the meeting at this time.
CASE 2.885 - Application by H. FRANK for Architectural Approval of colors
and materials of wall and security gate details for property located
at 238 North Palm Canyon Drive, Section 15.
City Planning Associateaddvised that before the remodeling of this
building had beenccompleted there had been two modifications which
had not appeared on the plans or been approved. He presented the
materialsused for the top of the will and a photograph showing the
security gates, explaining that the gates were only closed at night.
He advised that the Architecural Advisory Committee had reviewed the
two items and had recommended approval subject to the security gates
being painted a Medium brown to match the stain.
The Commissioners discussed the fact that both of the items under
consideration had been done without submission or approval , that the
security gates looked very much like the type used for thatppnppose
at First and Main Streets and really did not belong on North Palm
Canyon Drive. T1by inquired whether the DDAC had reviewed these items
and were advised that it had not. They discussed the possible reasons
for wanting anyfitype of security gate at all and were advised by City
Planning Associate that the applicant wished to avoid people loitering
or groups making use of the area after hours. Different types of
enclosures were reviewed and the Commission agreed that some type of
wood, folding, sliding or collapsible shutters should be used. They
agreed that the cap on the wall should be changed to something more
conventional and that the security gates should be eliminated.
