Tentative Tract Map 8789 and Tentative Parcel Map 8912, reported on page 9, should show Commissioners Harris and Lapham as absent instead of abstaining. Commissioner Ehrens advised that he would like to have it reported in Case 2.874, appearing on page 13 of the Minutes, that he had asked the question whether the Desert Water Agency was going to use reclaimed water in connection with their landscape and irrigation plans, and that he had been advised by them that it was too expensive. * * * * * * * * * * * * * * * * i February 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 2 PUBLIC HEARINGS: CASE 5.986-PD-71 - Application by AFFILIATED PROPERTIES for a Planned Develop- ment District to construct an office complex and residential apartments with recreational facilities on property situated on the east side of Farrell Drive between Tahquitz-McCallum Way and Baristo Road, P Zone, Section 13. City Planner advised that a request to continue this matter had been received from the applicant. Chairman declared the hearing open, there being no appearances this item was continued to the March 9, 1977, Planning Commissionmmeeting. 04VIROMENTAL AS SET STEMS: CASE 6.294 - Environmental Assessment on application by P. TNYBERG for a Variance on property line wall at east side front Via Norte frontage) ondproperty situated on the west side of Via Norte between Vista Chino and Via Sol , R-1-A Zone, Section 13. Commissioner Allan abstained from consideration of this item. City Planner reviewed the staff report and advised that the proposal would not present any significant adverse impacts on the physical environment, and that staff was recommending the preparation of a Negative Declaration. Motion was made by La ham, seconded by Ehrens, and unanimously carried, (Allan abstaining, Wessman absent), that a Negative Declaration be prepared. TENTATIVE TRACT MAP 9317 - Environmental Assessment on application by KWL ASSOCIATES, representing P.S. Country Club, for approval of Tentative Tract Map 9317, being a subdivision of a portion of the northeast 1/4 of Section 1 . City Planner advised that the map represented a portion of a previously approved total developMentt plan for the island area surrounded by the Whitewater Golf Course, and that the map proposed to implement the third phase of the development. The environmental evaluation was read into the record and the Commission was advised that staff was recommending that a Negative Declaration be prepared for this item. Following discussion, motion was made by Ehrens, seconded by Allan, and unanimously carried (Wessman absent) that a Negative Declaration be prepared. February 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 3 TENTATIVE PARCEL AND TRACT MAPS: TENTATIVE PARCEL MAP 8912 - Request b WEBB ENGINEERING INC. representing q Y p � Hal Wallis, for approval of Tentative Parcel Map 8912, dividing 20+ acres into two lots, R-1 and R-3 Zones, Section 24. Commission response to written comments on draft Negative Declaration. No comments received. City Planner located the property in question on the aerial photograph, reviewed the parcel map and advised that staff was recommending approval subject to the conditions outlined by the Development Committee, with the exception of Engineering Division condition number 3. With reference to that condition he explained that the developer was pro- posing to bring Avery Drive through to another street and for that reason Staff would recommend that the words ". . . or show extension of Avery Drive to an existing street" be added to condition number 3. The following was received from the Tribal Council : It is recommended that no action be taken on tentative tract map 8912 until such time as the Tribal Council has the opportunity to review the tentative map in question. At this date, copy of said map has not been available for the Tribal Council . With reference to the Tribal Council request, City Planner explained that the map had been available, that in the past theprpcedure had been for the Tribal Council consultant to come to City Hall where he would be given a copy of the map or loaned a copy of the map. He advised that the map represented a parcel of fee land, rather than Indian land, and explained that by law the Commission had a period of 50 days within which to approve, deny, or conditionally approve any map, and that if action had not been taken within that period of time it would be tantamount to approval . He advised that this would be the last meeting to comply with the 50 day period and noted that if the Commission recommended approval the map would then have to be presented to the City Council at its meeting of March 16 which would give the Tribal Council time to comment on the map. Commissioner Ehrens requested clarification of the comment contained in the Development Committee recommendations under "Traffic." City Planner explained that the comment was not a condition but since there had been some question whether or not the property, once divided, would have access to Highway 111 , a letter had been directed to CAL- TRANS. He advised thAt CALTRANs had responded and had indicated that the property did have legal access onto the highway, and that when a development was proposed on the frontage property they would then re- view improvement on the street and would have the ability to make recommendations relative to the location of any access onto the highway. Motions€wastmdde by Lapham, seconded by Chase, and unanimously carried (Wessman absent) recommending approval of tentative parcel map 8912, and the filing of the Negative Declaration. February 23, 1977 PLANNING COMMISSION MEETING MINTUES Page 4 TENTATIVE PARCEL AND TRACT MAPS - Continued TENTATIVE TRACT MAP 8789 - Request by WEBB ENGINEERING, INC., representing Farrell Canyon Estates, for approval of Tentative Tract Map 8789 dividing 11 .4+ acres into 35 lots, R-1-C Zone, Section 24. Commission response to written comments on draft Negative Declaration. No comments received. City Planner reviewed and explained the map in question, as well as the conditions of the Development Committee. He noted that traffic conditions 1 a, b, and c, should be changed. The changes recommended were outlined and the reasons for them explained. He advised that in addition to the conditions just outlined, staff was recommending a further condition thatpphevwAll tequired by flood control along the south and east sides of the tract be constructed of decorative masonry at a minimum height of five feet, and that this was to include an extension across lots 34 and 35. The following was received from the Tribal Council : It is recommended that no action be taken on tentative tract map 8789 until such time as the Tribal Council has the opportunity to review the tentative map in question. At this date, copy of said map has not been available for the Tribal Council . City Planner advised that this was the same situation as .the ,previous item and, in addition, that the parcel was fee land and was surrounded on all sides by fee land. Following discussion, motion was made by Ehrens, seconded by Chase, and unanimously carried (Wessman absent) recommending approval of tentative tract map 8789 and the filing of a Negative Declaration. February 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 5 TENTATIVE PARCEL AND TRACT MAPS - Continued TENTATIVE TRACT MAP 9205 - Request by WEBB ENGINEERING, INC., representing U.S.A. and Desert Dorados, Inc. , for approval of Tentative Tract Map 9205, dividing 37.0+ acres into 108 lots, R-2 and R-1-C Zones, Section 2. Commission response to written comments on draft Negative Declaration. Commissioners Harris and Lapham abstained from consideration of this item. The following was received from the Tribal Council : It is recommended that no action be taken on tentative tract map 8789 until such time as the Tribal Council has the opportunity to review the tentative map in question. At this date, copy of said map has not been available for the Tribal Council . City Planner advised that this parcel was located on Indian land, and that the developer concurred in the Tribal Council request for a continuance. This item was continued to the Planning Commission Meeting of March 9, 1977. PUBLIC COMMENTS: Edith Spitzer, 314 Monterey Road, speaking on behalf of the League of Women Voters, advised that she had attended the study session between the Council and the Commission and was pleased with the Commission 's interest in the development of open space and, more particularly, that the Tahquitz Flood Control plain be purchased and left in its natural state. With reference to a comment made at the study session by Commissioner Wessman, relative to the water problem as it related to large areas of grass, she advised that the League had been dismayed that the Desert Water Agency not only suggested a large area of grass in their landscape scheme, but had received support and had been allowed to proceed with such a plan. She requested that careful attention be paid to such problems in the future. Lyle Clarkston requested clarification of a condition imposed at the last Planning Commission Meeting in Case 5.925 relative to additional landscaping for purposes of screening the driving range lighting. Commissioner Allan advised that her motion approving the driving range lights subject to the condition that landscape plans showing quantity and location of plant materials to screen the lighting be submitted had been intended for Farrell Drive only. Chairman stated her con- currence. February 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 6 NOT ON AGENDA CASE 5.688 - Request by FRANK CORTESSE representing Fairway Condominiums to delete 5 ft. sidewalk along Rush Street, the easterly border of the Fairway Condominium project. City Planner located the property on the aerial photograph, He explained that at the time of the development of the project there had been a proposal for the area in question which had called for the in- stallation of a half street. The Commission was advised that the developers had installed their half of the total street but that now the proposal for that area had been abandoned and they were requesting that they not be required to install the 5 ft. sidewalk but, in lieu thereof, that they be permitted to irrigate and landscape the area with trees at their own expense. He informed the Commission that since the street served no useful purpose"-itwas doubtful that the sidewalk would either, and that staff recommended that the requirement for a 5 ft. sidewalk be deleted. In reply to a question by Chairman he stated that he did not know what kind of trees were being proposed but that they would be clustered and would not be planted in a straight row. Following discussion, motion was made by Ehrens, seconded by Harris, and unanimously carried (Wessman absent) granting the request for the deletion of a 5 ft. sidewalk along Rush Street. * * * * * * * * * * * * * * * * February 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 7 The Planning Commission reviewed plans, discussed and took action on the following items involving Architectural Approval , subject to the conditions as outlined. CASE 2.914 - Application by MARK BLAICH for Architectural Approval of revised plans for construction of hillside residence, R-1-B Zone, Section 3. Motion was made by Lapham, seconded by Allan, and unanimously carried Wessman absent), approving this application subject to the following con itions: 1 . That the front elevation be revised to incorporate a change in planes. 2. That minor revisions to the elevAtions are to be reviewed by staff. 3. That the distance from the arches to the wall is to be increased from fourtfeet to six feet. 4. That detailed colors and materials are to be submitted for approval . * * * * * * * * * * * * * * * * SIGN APPLICATION - Application by D. A. JAEGER for Architectural Approval of sign for Le Cafe, 394 North Palm Canyon Drive. Motion was made by Chase, seconded by Ehrens, and unanimously carried (Wessman absent) approving the sign and the graphics surrounding the sign, subject to the following conditions: 1 . That the sign and graphics shall be subject to final review and approval by staff. 2. That all other signs are to be removed. SIGN APPLICATION - Application by L. LAPHAM for Architectural Approval of sign for the Burger King Restaurant, 400 South Indian Avenue. Commissioner Lapham abstained from consideration of this item. Miotion was made by Chase, seconded by Allan, and unanimously carried (Wessman absent), approving a sign for the Burger King Restaurant at 4 (ITS.Indian Avenue, subject to the following conditions: 1 . That the size of the sign shall be 4 ft. by 4 ft. 2. That the sign is to be a sandblasted wood sign with uplighting in the landscaping. 3. CASE 2.836 - Application by A. FALLOWS for Architectural Approval of revised plans for construction of commercial/industrial office complex on pro- perty situated at the northwest corner of Sunny Dunes and Calle Pa18 Fierro, C-M Zone, Section 23. Motion was made by Ehrens, seconded by Harris, and unanimously carried j (Wessman absent), approving this application subject to the followIng conditions: I 1 . That the sign scheme be restudied. 2. Commissioner Harris abstained from consideration of this item. City Planning Associate noted that the Commission had approved plans for the construction of a Carl 's Jr. Restaurant on October 13, 1976, subject to the condition that the Architectural Advisory Committee re- view detailed plans. He advised that the Committee had reviewed not only the plans but a sign scheme as well , and that while they recommended approval of the architectural plans they had requested a restudy of the proposed sign scheme. The type of signing proposed by the applicant was explained, as well as the sign scheme recommended by the Committee. Commissioner Chase noted that even though the Commission had approved Tans the building was marginal at best articular) on the corner in- volved, and that the sign scheme should be carefully monitored. Commissioner Ehrens asked if the parapet on top of the building was to hfik a it c oning, noting that it looked top heavy, and he was ad- visod by City Planning Associate that it hid mechanical equipment. The Commissioners, after further discussion, agreed that the buildin was unimaginative and lacked style which was often the case with chain food restaurants. Chairman advised that if the Commissioners did not approve of the plans they still had the opportunity to send them back to the Architectural Advisory Committee for restudy. It was the con- census of the majority of Commissioners that the building configuration and elevations needed to be restudied. Motion was made by Chase, seconded by Ehrens, denying the application for approval of detailed architectural plans, recommending a restudy of the building. COX (Representing Slettedahl/Parker) for Architectural Approval of revised plans for construction of Home Building Center at Indian Avenue and Oasis, C-M Zone, Section 34. Motion was made by Lapham, seconded by Chase, and unanimously carried (Wessman absent), approving the application for revised plans subject to the following conditions: I . That the planter islands be enlarged to a minimum as shown on the plans by staff. 2. That plans for the treatment of the existing building showing how it is to be tied into the complex are to be submitted. 3. That detailed landscape and irrigation plans are to be submitted. CASE 2.922 - Application by ROBT. C. RAMSEY for Architectural Approval of plans for construction of a warehouse to be located at the northwest corner of Indian Avenue and Radio Road, C-M Zone, Section 34. Motion was made by Ehrens, seconded by Allan, and unanimously carried (}Wes?sman-absent), approving this application subject to the following cond ti ions: 1 . That all conditions of the Development Committee be met. 2. That detailed landscape and irrigation plans be submitted for approval . CASE 2.923 - Application by JAMES E. BROWN, INC., for Architectural Approval of plans for construction of an eight unit apartment project to be located on Warm Sands, R-2 Zone, Section 23. City Planning Associate reviewed the plans and the location of the site and advised that the ArchitecturilAAdvisory Committee had recommended a continuance for restudy. He reported that the Committee had expressed concern over the angular elements over the windows, as well as the severity of the elevations and had suggested a softer solution. He stated that the architect was present and wished to address the Commission. Chris Mills advised that he had been present at the Architectural Advisory Committee Meeting and thA.t the objection seemed to be that the whole scheme was too harsh or severe. He stated that he did not agree, that there were different types of architectural stylesand that, in his opinion, the City was aiming toward one particular style which this plan did not fit into. He observed that the design was handsome, simple and would be easy to build and would be an asset to the area and to the February 23, 1977 PLANNING COMMISSION MEETING MINUTES Page ll Architectural Items - Continued CASE 2.923 - Continued City. He observed that because of the orientation of the building on the siteeonly one unit could be seen from the street. Questions were answered regarding the angular elements, stucco parapet on the roof and the recessed areas on the front elevations. Commissioner Lapham advised that, in this particular case, he would have to disagree with the Committee. He noted that the architect had taken a very small site and had handled it simply and by doing so had pre- sented something that was different. He stated that, in his opinion, it had be6h tastofully and well done. Commissioner Chase advised that he concurred, that he would like to see it attempted because it was different, and that his only suggestion would be a deeper color on the parapet. Chairman advised that she had heard what was stated at the Architectural Advisory Committee meeting and that she did not see anything offensive in the design and had no objection to it at all . REUTZEL for Architectural Approval of plans for construction of hillside residence to be located at 700 Camino Norte, R-1-A Zone, Section 10. Motion was made by Chase, seconded by Ehrens, and unanimously carried (Wessman absent), approving this application subject to the following cond�i ns: 1 . That detailed landscape and irrigation plans are to be submitted. 2. CASE 2.919 - Application by CYC.C. DEVELOPMENT for Architectural Approval of plans for construction of a 20 unit condominiumpproject to be located on the west side of Avenida Caballeros between Alejo Road and Amado Road, R-G-A (8) Zone, Section 14. CASE 2.920 - Application by G. BRECHLIN, representing B.R. Preckwinkle, for Architectural Approval of grading and street plan for Bogie Road south of Mesquite, M-1 Zone, Section 20. The following was received from the Tribal Counddl : "The Tribal Planning Consultant, in accordance with consensus developed by the Indian Planning Commission on February 21 , 1977, recommends no action until the Tribal Council has an opportunity to review additional data to be made available by the allottee's representative, consisting of additional topographical data referring to adjacent land to the south; proposed grades and alignment of Bogie Road from Mesquire Avenue to Palm Canyon wash; and proposed sewer grades ad- jacent to the property in question. "Attention is further called to errors in the agenda descrip- tion of the property. Said property should be property described as in Section 20 (not 19), and in the M-1 -P Zone (not M-1 ). CASE 2.865 - Application by HELLER ENTERPRISES for Architectural Approval of landscape and irrigation plans for apartment complex, northeast corenr of Camino Real and La Jolla Road, Section 26. * * * * * * * * * * * * * * * * February 23, 1977 PLANNING COMMISSION MEETING MINUTES Page 13 REPORTS AND REQUESTS: The Commissioners discussed various pieces of property where construction of homes had been started but never completed.. These included the Montgomery house in Cahuilla Hills, the Bob Hope house on Southrddge Drive, a house on Marion Way and Yucca Place, and the remodeling of a home on Via Lola. They questioned why this was permitted and discussed what could be done to require all types of construction to be completed within a certain period of time. They agreed that some type of ordinance requiring a completion date should be adopted.and instructed staff to prepare such an ordinance. With reference to the Hope house, the Commission requested that staff obtain a letter from the City Attorney,addressed to the Commission, explaining what was being done, why the frame of the house could not be removed as a public nuisance, and how an individual could keep an entire governmental agency from taking action.
