January 26, 1977 PLANNING COMMISSION MEETING MINUTES Page 2 PUBLIC HEARINGS CASE 5.982-PD-70 - Application by CLINIC SERVICE CORPORATION (Palm Springs Dental Group) for a Planned Development District to expand existing medical facilities for dentalppurposes on wroperty situated on the west side of Sunrise Way between Vista Chino and Chia Road, GR-5 Zone, Section 11 . CityPlanner� reported that the environmental assessment had previously, been made in ease 5.950-PD-67. He advised that this matter had been continued for severalme�ztftro so that the plot plan could be revised to incorporate previously imposed conditions. The background and conditions were reviewed and the revised plot plan was presented and explained. The Commission was advised that the applicant had complied with the recommendations of the Architectural Advisory Committee and staff. He reviewed the findings in support of staff's recommenda- tion for approval , the recommendations of the Architectural Advisory Committee and stated that the approval should be based on a condition of the Ordinance that final detailed plans of all aspects of the project be submitted for approval within a period of one year. Chairman declared the hearing open There being no appearances the hearing ww as closed. Following discussion, motionwwas made by Ehrens, seconded by Allan, recommending approval based on the following inf dings and sub,7ect to the following conditions: FINDINGS: 1 . The subject project is one for which a Planned Development District is authorized under Section 9406.00 B.5.d. 2. This planned expansion of the Medical Clinic to include a dental facility to provide a total health care program to residents of the area is considered necessary and desirable for development of the community, is in harmony with the Geneval Plan and will not be detrimental to surrounding properties or uses in the area. 3. Total building area of approximately 12,000 sq. ft. on a site of 2+ acres can adequately accommodate the use and provide necessary setbacks and IaD seApe' buffers to adjacent properties. 4. Sunrise Way, a ma$or thoroughfare, is adequate insji=Ze ar.rd design to handle traffic generated by this use. CONDITIONS: 1 . That final detailed plans of all aspects of the project be sub- mitted for approval within a period of one year. 2. That all conditions of the Development Committee be met. AYES: Ortner, Allan, Chase, Ehrens, Harris, Lapham, Wessman NOES: January 26, 1977 PLANNING COMMISSION MEETING MINUTES Page 3 ENVIRONMENTAL ASSESSMENT ITEMS: Chairman reported that`Agenda items 2, 4 and 11 would be handled at one time since she had been advised by CityrPl,anner that staff was recommending a continuance of all three items, and that he would explain the reason for the requested continuance. CASE 5.917 - Environmental Assessment on application. by WESTVIEW DEVELOPMENT ORPORATION for&Conditional Use Permit to allbwra'shopping center and related facilities use of property located on the north side of Highway 111 betweeh.,Golf Club Drive and Broadmoor Drive, R-3 Zone, Section 29. CASE 5.998 - Environmental. Assessment on application by MATTHEW DRAGICEVICH or a Conditional Use Permit to construct a neighborhood sopping center on an 8 acre parcel located on the south side of East Palm Canyon Drive, between MatthbwwDrive and Dunn Road, R-3 Zone, Section 30. CASE 2.911 - Application b . HOWARD LAPHAM for Architectural Approval of apart- ment complex to be located at the corner of Highway 111 , Broadmoor Drive and extension of Waverly Drive, Section 29. City Planner advised that the reason for grouping the three items together was because they were all concerned with a single problem in- volving the frontage roads, as reflected in the City's General Plan, along East Palm Canyon Drive. He reviewed the three projects and noted that in all three cases the developers were not proposing to install the roads and were requesting that they be allowed to reduce setbacks or encroach into the designated right of way with parking and driveways. The staff report was presented and the Commission was advised that staff was recommending a 60 day continu_#nce as it would take that length of tmme to study and prepare a specific plan for frontage roads, have it reviewed by the Traffic and Parking Commission as well as Cal Trans. He advised that since the Westview application had been continued from meet- ing to meeting as a public hearing, the Commission should receive input on that item only. Chairman declared the hearing open in Case Number 5.917 and the following persons spoke from the audience: Gene Glick, 38175 Andreas Hills, the developer, explained that approxi- mately a year ago an application involving this property had been tbbled, that they had been asked to resubmit if the Conditional Use Permit had not been acted upon by.the then developer, and that they had done so. He advised that, at this time, they .wo t uld like to perfect on the plans submitted whatever the City's requirements would be so that the Conditional Use Permit could be approved and, in addition, thAt they be given a year to complete negotiations. He noted that they did have tenants and were ready to go forward with the project. With reference to the change in the frontage road, he observed that while it would be January 26,1977 PLANNING COMMISSION MEETING MINUTES Page 4 ENVIRONMENTAL ASSESSMENT ITEMS - Continued CASES 5.917, 5.998, 2.911 - Continued helpful to them it was not mandatory on their present plan. He stated that as a result of all the hearings, during which many requirements had been resolved, they should be granted the Conditional Use Permit at this time. Howard Lapham, 577 Eatt, Sunny Dunes Road, advised that he was neither for or against the Westview project but that he was opposed. to having his architectural application for apartment units merged with two Conditional Use Permit applications for shopping centers for the pur- pose of a 60 day continuance. City Planner advised that Mr. Lapham's project was the smallest of the three and that if he were willing to meet the required setbacks and dedications there would be no need to continue his application for the 60 day period. The Commissioners discussed whether or not this item should be heard in connection with the two applications for Conditional Use Permits and decided that the matter should be heard under the architectural review items. Doris Klabacha, 1997 Brentwood Drive, speaking in opposition, restated the arguments setforth at the last .Planning Commission meeting and contained in a petition submitted prior to the last meeting. The petition had been distributed to the Commissioners. Mr. John Levit,advised that he represented the owners of the property across from the proposed project, that they were not opposed to it nor did they feel that it would be detrmmental to their condominium project. In reply to a question by Commissioner Ehrens he stated that they owned all of the "pie" shaped property between Golf Club Drive and Broadmoor and the property was outlined on the aerial photograph for the ,Commission. He reported that their only concern was for the aesthetids involved for the side of the shopping center that would be facing their project. There being no further appearances the hearing was closed. Commissioner La ham advised that while he was not at -thfsf6i:me :sppakJng eit�pfov.-or.na,gain.st a shopping center, he did wish to point out to` the people in opposition that there was.a .designation' for a neighbor- hood shopping center on the General Plan for the area in question. He referred to.the amount of traffic on Highway 111 and noted that there was a great deal of travel from Broadmoor, in either direction, to other hhopping centers. January 26, 1977 PLANNING COMMISSION MEETING MINUTES Page 5 ENVIRONMENTAL ASSESSMENT ITEMS - Continued CASES 5.917, 5.998 —Continued Commissioner Ehrens stated that it was his recollection that at one time the area in question had been zoned C-1 . He was advised by City Planner that he was correct and that the change to the General Plan and Zoning Ordinance had taken place in 1973. He observed that the public should be made aware of the fact that this type of use had been on the General Plan for many years. Chairman stated her concurrence and, in addition, noted that there was a vast difference between a convenience neighborhood shopping center and a major shopping center. She observed that the designation of the area in question for a convenience shopping center was good Planning. Case 5.917 and case 5.998 were continued to the Planning Commission Meeting of March 23, 1977. TENTATIVE TRACT MAP 8789 - Environmental Assessment on request by WEBB ENGINEERING, INC., representing Farrell Canyon Estates, for approval of Tentative Tract Map 8789 dividing 11 .4+ acres into 35 lots, R-1-C Zone, Section 24. City Planner reported that this item had been continued from the last meeting as it was not possible to make an assessment until a letter had been received from the Riverside County Flood Control . He ad- vised that the letter had not as yet been received and it was recom- mended that this item be removed from the agenda. Tentative Tract Map 8789 was removed frmm the Planning Commission Agenda . CASE 6.293 - Environmental Assessment on application by ROSE ROSE for a variance from setbacks on property situated on the southwest corner of Vereda Norte and Camino Centro, R-1 -A Zone, Section 10. City Planner presented and ex0lained a plot plan thathad been pre- pared showing the required setbacks and those r quested. The staff report containing adjacent zoning, existing land use, background, statistical breakdown and findings,was reviewed.. In reply to a question by Commissioner Allan, he .ddvised that if the Commission recom- mended the filing of a Negative Declaration this item would be noticed for public hearing and all property owners within four hundred feet of the property would bennotified. The environmental impacts were re- viewed and the Commission was advised that staff was recommending that a Negative Delcaration be filed. January 26, 1977 PLANNING COMMISSION MEETING MINUTES Page 6 ENVIRONMENTAL ASSESSMENT ITEMS —Continued CASE 6.293 - Continued Commissioner Wessman asked how large a house was being proposed and he was advised that it was in the neighborhood of 4200 sq. ft. Chairman inquired whether staff knew how many vacant lots there were in the area where, at the time of development, the developer could request similar variances. She was advised by City Planner that the request for such a variance would not necessarily be limited to vacant lots but that owners of existing homes could request the same variances for purposes of additions. In reply to anquestion by Commissioner Allan, City Planner reviewed the number of square feet contained in various R-1 designations. Commissioner Lapham noted that it was obvious what size the lot was since it was vacant, that the City's policy with regard to setback violations had been not to grant special privileges except under extremely difficult situations, and that he could not see that this was that type of a situa- tion and would not be in favor of granting a variance. �— Commissioner Chase advised that he agreed with statements made :in the environmental impact report and that the cumulative effect of granting the variance might very well affect the aesthetics of the area and he would not be in favor of it. Commissioner Wessman indicated he would not be adverse to the lesser setbacks suggested in the staff report peovided they were not objection- able to the neighbors, but that he was opposed to those proposed by the applicant. He read the condition contained in the environmental impact report. Following discussion, motion was made by Ehrens, seconded by. Harris that a Negative Dedlaration of Environmental Impact be filed in Case 6.293, subject to the condition contained in the -.environmental impact report. TENTATIVE PARCEL MAP NO. 8779 —Request by WEBB ENGINEERING INC. , representing Jerry Cain for approval of Tentative Parcel Map 8779, dividing 25.1+ acres into 15 parcels,M-1 -P .Zone, Section 12. Environmental Assessment has been made. Motion was made by Wessman, seconded by Ehrens, and unanimously carried, recommending approval— subject to the fol o ng conditions: 1 . That all requirements of the Development Committee be met. 2. That the southerly cul de sac be pulled back in order to provide adequate landscape buffering between it and Tamarisk Road. 3. That the building height restrictions in conjunction with the portion of the property indicated within the "clear3- zone" of the airport be incorporated. TENTATIVE PARCEL MAP 9033 - Requett .by HALLMARK ENGINEERING, INC. , re ieesentin og a Esta lishment, for approval of Tentative Parcel Map 0033 combining three lots into one 1 .3 acre parcel, R-1-A Zone, Section 15. Motion was made by La ham, seconded byChase, and unanimously carried, recommending approval based on the finding that the vacation of a 10 ft. strip along the northerly edge of lot 20 is in accordance with the City's Master Plan Street Plan, and subject to the condition that the final map be submitted to theEffngineering Division for a check of technical accuracy and conformance with local and state laws. TENTATIVE TRACT MAP 7532 - Request by TITLE INSURANCE & TRUST COMPANY, Agent or The Racquet lub of Palm Springs, for a one year extension of time to complete and record map 7532. Motion was made by LLapham, seconded by_Ehrens, and unanimously carried, recommending approval�f a one year extension of time. Public Comments: None. CASE 5.332 - Application by SHELL OIL COMPANY for Architectural Approval of revised landscape plans for service station located at 27.90 North Palm Canyon Drive. Motion was made by Chase, seconded by Allan, and unanimously carried, approving this application subject to the following conditions: 1 . That CerUssCactus is to be used in place of Ecuador Pipe Organ. 2. That Yucca Pendula and Yucca Glorioso are to be used in place of Century Plant and Aloe Striata. CASE 2.897 - Application by GREAT WESTERN SAVINGS & LOAN ASSOCIATE for Architectural Approvalof landscape and irrigation plans for office building on Palm Canyon Drive between Baristo Road and Ramon Road. Motion was made by Chase, seconded by Ehrens, and unanimously carried, ., approving this applicat n subject to the following conditions: 1 . That 12 Melaleuca Leucadendra trees (50% 15 gal , 50% 24 inch box size) are to be added to the south property line planter. 2. That the existing planting along the east line is to be co- ordinated and 15 gal . Callistemon Viminalis are to be added near the trash enclosure. 3. That the minimum height of the Chamaerops Humilis Palms are to be five feet. 4. That detailed landscape material plans are to be submitted for the roof level planter boxes. Motion was made by Ehrens, seconded by Allan, and unanimously carried, approving this application subject to the following conditions: 1 . That detailed colors and materials are to be submitted. 2. Motion was made by Ehrens, seconded by Allan (Chase, Lapham, Ortner opposed) approving this application as submitted. January 26, 1977 PLANNING COMMISSION MEETING MINUTES Page 10 The Planning Commission continued the following items to its meeting of February 9, 1977 CASE 2.911 - Application by HOWARD LAPHAM for Architectural Approvalof- �l.ans for�:construction of apartment cmmplex to be located at the corner of Highway 111 , Broadmoor Drive and extension of Waverly Drive, Section 29. CothMissioner Lapham abstained from consideration of this item. City Planning Associate explained that this item had been continued from a previous meeting because the applicant had not met the setback requirements. He ddvised that the Architectural Advisory Committee had reviewed the plans and had recommended approval of the architectural scheme subject to the usual conditions of submission of detailed colors, materials, landscape and irrigation plans. The required and requested setbacks were reviewed and explained, as were the elevations. In reply to questions, City Planner explained that the lot was not sub- standard in overall lot size although it was substandard in depth (the east west measurement) but that the variance in setbacks was being re- quested for the north south dimensionswhic`h was not substandard. lie re- ported that the applicant would have to 'apply for a variance and that certain findings would have to be made which ibfta_ff's opinion could not be justified. He stated that either the total setback should be maintained or that the applicant should wait for the study that would be done on frontage roads in the area as it was possible that they would be eliminated from the General Plan and the 101 foot half street would not be required. He observed that the project could be built as proposed without any encroachment on setbacks but that there would probably be at least a six month period involved before the matter of reducing that requirement would be finalized. Discussion followed regarding streets in thearea that were designated as through streets on the General Plan, who would receive the property if abandoned and the philosphy behind frontage roads. Howard Lapham, 577 East Sunny Dunes Road, the applicant, reported when the project was first designed it was on the basis that the City would abandon the service road and that it would be landscaped by the developer in return for a variance on the setbacks. He advised that since the service road was already dedicated he would like to request a two week continuance for the purpose of redesigning the project, meeting all setback requirements and incorporating a wall along the service road, as well as adding additional two story buildings. Following discussion, motion was made by Wessman, seconded by Allan, continuing this item to the February 9, 1977, Planning Commission Meeting. January 26, 1977 PLANNING COMMISSION MEETING MINUTES Page 11 CASE 2.913 - Application by JAMES E. BROWN for Architectural Approval of plans for construction of $8 single story units to be located on Ramon Road west of El Cielo, R-2 Zone, Section 24. City Planning Associate presented the plans explaining that the itectural Advisory Committee had reviewed them and had recommended a continuance for the purpose of obtaining additional information re- garding elements with the roof plan on lots 1 and 2 that did not appear on the site plan, in addition to questions relevant to the overhang. The location of the propet= y was reviewed by the Commission and they were advised that at the time the frontage road was put on the General Plan, a portion of the property had been zoned R-1 and a portion zoned R-2, and that in rezoning the entire parcel to R-2 a one foot barrier strip had been installed blocking access to Teresa Drive for a multiple project. He noted that in order to remove this condition a. public hear- ing would be necessary and a finding would have to be made to the effect that it would not be detrimental to have cars entering onto Teresa Drive. He advised thattthe applicant was looking for direction from the Commis- sion. Commissioner Wessman stated that it was difficult to stay within the perimeters of the zoning the way it was established on the property, and that the plan being presented was not a good plan as all of the cars and parking would be on a major highway. Commissioner Allan noted that almott everyone would have to enter on one driveway. City Planner reported that the frontage road in question was doing exactly what it had been intended to do, collecting traffic from drive- ways. In addition, that the condition under which the R-2 zoning had been approved and the buffer strip installed were commitments to the home owners in the single family tract to the south, and that to remove them would more than likely bring vigorous opposition. Commissioner Wessman agreed that the home owners might object but, in his opinion, the Commission should be looking at what was best environ- mentally, as well as for the City, and that while the plan being pre- sented might be best for the home owners it was not for the City or the people using Ramon Road. There was discussion regarding whowwould maintain the "island" and it was pointed out that under architectural procedures a condition could not be imposed upon the developer for perpetual maintenance. The Commission discussed various alternatives,including reversing the drive- ways and Commissioner Ehrens noted that if this were done there would be approximately 107 cars that would be going into a residential area. January 26, 1977 PLANNING COMMISSION MEETING MINUTES Page 12 CASE 2.913 - Continued Commissioner Lapham stated that while the proposal might be in accordance with the General Plan it represented a very poor circulation plan, and that there had to be another way of handling the project. Commissioner Harris suggested that,since this item involved the General Plan as well as an unusual parcel of property that was subject to conditions,} a study session should be held. Commissioner Ehrens and Lapham agreed and Commissioner Lapham stated that the Commission should be looking at a number of alternatives . Chairman, addressing her statements to the architect for the applicant, assured him that the Commission was aware of the many problems involved but that she would like to request that he work with staff along the lines discussed by the Commissioners. This item was continued to the February 9, 1977, Planning Commission Meeting. Chairman announced that there would be a joint meeting between the Planning Commission and the Architectural Advisory Committee Monday, February 7, 1977 at 1 :00 p.m. in the large conference room. City Planner requested that the Commissioners plan on adjourning to t e Community Development conference room after their meeting with the Committee for ,the purpose of reviewing goals and policies. City Planner informed the Commissioners that the night lighting had been installed on the driving range at the Clarkston Recreation Center and requested that they inspect the system at their convenience. The Commissioners, with reference to the new environmental assessment procedure, requested that applicants be advised that the filing of a Negative Declaration would not necessarily reflect either approval or disapproval of a project.
