HomeMy WebLinkAbout8804RESOLUTION NO. 8804 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, PROVIDING FOR EMERGENCY EXPENDITURES AS PROVIDED IN SECTION 37906 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA TO REPAIR RAIN DAMAGE WITHIN THE CITY LIMITS. WHEREAS considerable rain damage has been incurred within the City of Palm Springs as a result of heavy mountain runoff on December 3, 5 and 6, 1966, and WHEREAS normal purchasing procedures required by the Government Code in respect to public works projects would result in undue delay and prolong the emergency conditions, and WHEREAS Section 37906 provides that the City Council may by a four- fifths vote declare that public interest and necessity require the immediate expenditure of public money to safeguard life, health, or property. NOW TI4EREFORE BE IT RESOLVED by The City Council of the City of Palm Springs that Section 1. Public interest and necessity require the immediate expenditure of public funds to safeguard life, health, and property within the City Limits as provided in Section 37906 of the Government Code of the State of California. Section 2. The Public Works Director subject to approval of the City Manager is hereby authorized to negotiate and award contracts for repair of flood damage to public properties including streets, sewer facilities and the Municipal Golf Course without regard to Chapter 6, Division 3 , Title 4 of the Government Code of the State of California.
