RESOLUTION NO. 8792
OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, DENYING AN APPEAL OF
PLANNING COMMISSION DENIAL OF A VARIANCE
CONCERNING WALL HEIGHT. (MRS. FRANCES
BENTON - CASE 6 .253)
WHEREAS an appeal has been filed by William E. Iddings for Mrs.
Frances Benton of the Planning Commission's denial of a Variance
to allow the construction of an entry gate with side walls, the
highest part of which is to be six (6) feet, for property located
at the southwest corner of Camino Mirasol and Via Las Palmas ; and
WHEREAS the Planning Commission, at their meeting of November 2, 1966,
denied said Variance for the following reasons :
1. There are no special circumstances applicable to the
subject property, including size, shape, topography,
location or surroundings, where strict application of
the Zoning Ordinance would deprive the subject property
of privileges enjoyed by other properties in the same
area and under identical zone classification.
2. The granting of such Variance would constitute the
granting of a special privilege inconsistent with the
limitations upon other properties in the vicinity and
zone in which the subject property is located; and
WHEREAS the City Council is in agreement with the action taken
by the Planning Commission, as shown in Planning Commission
Resolution No. 1317 .
NOW THEREFORE BE IT RESOLVED that the City Council hereby upholds
the decision of the Planning Commission, as shown in Planning
Commission Resolution No, 1317, and denies the appeal herein.
Adopted this 28th day of November 1966 .
