HomeMy WebLinkAbout87153e7 RESOLUTION NO. 8715 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, CALLING A SPECIAL ELECTION ON THE 20th DAY OF SEPTEMBER, 1966,I IN A CERTAIN TERRITORY IN THE COUNTY OF 1 RIVERSIDE CONTIGUOUS TO THE CITY OF PALM SPRINGS; PROVIDING FOR THE HOLDING OF SUCH ELECTION AND SUBMITTING TO THE ELECTORS RE-SIDING IN SUCH TERRITORY THE QUESTION OF WHETHER SUCH TERRITORY SHALL BE ANNEXED TO,INCORPORATED IN, AND MADE A PART OF SAID CITY OF PALM SPRINGS ; DESCRIBING SAID TERRITORY AN DESIGNATING IT BY .THE NAME OF "TRAMVIEW ANNEXATION" ; ESTABLISHING AN ELECTION PRE-CINCT AND POLLING PLACE IN THE SAID TERRI-TORY; APPOINTING THE OFFICERS OF ELECTION FOR SAID SPECIAL ELECTION, AND PROVIDING FOR THE PUBLICATION OF NOTICE OF SUCH _ELECTION.WHEREAS , the City Council of the City of Palm Springs ,California has heretofore received a written petition signed by residents , registered and qualified electors ,asking that certain new territory described in said petition be annexed to the City of Palm Springs , and WHEREAS, said territory so proposed to be annexed to the said City is situated in the County of Riverside , State of California, and is contiguous to the said City, and WHEREAS, the said petition submitted to the City Council is signed by not less than one-fourth of the qualified electors residing within the territory hereinafter de-scribed as shown by the County registration of voters , and WHEREAS, on the 31st day of May, 1966, the City Council of the City of Palm Springs did adopt its Resolution No.8665 declaring its intention to call a special election to be held not sooner than fifty-four (54) days or later than seventy-five (75) days after the termination of the hearing of protests and of its intention to submit the question of annexation to the electors residing in the territory described in said resolution, which said resolu-tion did specifically describe the boundaries of the territory proposed to be annexed, and did designate the territory by the name of "Tramview Annexation, by which name it shall be referred to upon the ballots used at the election; said resolution of intention also contained a notice of the day, hour and place where any person owning real property within said territory could appear before the City Council and protest against subject annexation,and I WHEREAS, thereafter and on the 27th day of June, 1966, the City Council did hold a hearing to consider all written protests heretofore filed objecting to the calling of said election or the annexation of said territory hereafter described to the City of Palm Springs ; thereupon, the City Council did adjourn the hearing to July 11, 1966, for the purpose of hearing supplementary protests , and the July 11,1966 hearing having been terminated, and WHEREAS, the said petition contains a request that the City Council of said City call a special election to be 8- B Res . 8715 Page 2 held in said territory thereby proposed to , be annexed to said City, and giving notice thereof as required by law for the submission to the electors residing within said territory of the question whether said new territory shall be annexed to, incorporated in, and made a part of the ICityofPalm 'Springs , NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs , California, does hereby find that written protests were not made by the owners of one-half of the value of the territory proposed to be annexed, ex- clusive of improvements as shown by the last equalized assessment roll, and BE IT FURTHER -RESOLVED that a special election be and the same is hereby called to he held on Tuesday, the 20th day of September, 1966 , in said new territory described here- after, for the purpose of submitting to the electors re- siding in the said new territory the question whether the said new territory shall be annexed to, incorporated in, and made a part of the City of Palm Springs . The new territory in which such special election is hereby called, as shown on the attached map marked Exhibit "A" which is incorporated herein by reference, is situated in the County of Riverside, State of California, said terri- tory being legally described as follows . Those portions of Sections 34 and 35, Township 3 South, , Range 4' East, ' d,escribed as follows: Beginning at the southeast corner of said Section thirty-four (34) , being a point on the p esent. boundary of the City of Palms Springs ; Nence North 89a45 ' 00" West along the southerly' line of said Section thirty-four (34) being also said present. boundary, a distance of 1647 .2.1 feet; thence North 00°08 ' 15" 'East along said present boundary a distance of 659 .86 feet; thence North 89' 41' 40"West along said present boundary a dis- tance of 494.20 feet; thence South 00°08 ' 07"West along said present boundary a distance of 660. 34 feet to a point on the southerly line of said Section thirty-four(34) ; thence North 89045 '00" West along said southerly section line, being also said present boundary, a distance of 494. 00 feet to the South Quarter corner of sAid Section thirty- four (34) ; thence North 00°08 ' 00'* East along the westerly line of the SPutheast Quarter of said Section thirty-four (34) , being also said present - boundary, a distance of 2643. 72 feet to the North- west corner of said ,Southeast quarter, which point is also the center of said Section thirty-four (34) ; thence South 89°31 '40" East along the northerly line of said Southeast Quarter, being also saidi present boundary a distance of 2636 . 98 feet to the West Quarter corner of said Section thirty-five (35) ; thence northerly along the westerly line of said Section thirty-five (35) , being also said present boundary, to the- Northwest corner of said Section thirty-five (35) ; thence easterly along the northerly line of said Section thirty-five (35) to a -point on an intersecting line parallel with, easterly of and 200 feet perpendicular—distance from said westerly line of Section thirty-five (35) ; thence southerly along said parallel line within said Section thirty- five (35) , being also said present boundary, to a 2- 8-B Res. 8715 Page 3 point on an intersecting line parallel with, southerly of and 200 feet perpendicular distance from the East-West center line of said Section thirty-five (35) ; thence westerly along said last I mentioned parallel line, being also said present boundary to a point on the easterly line of said Section thirty-four (34) ; thence South 00008 '40" West along said easterly line of Section thirty- four (34) , being also said present boundary, a distance of 2433 . 07 feet to the point of beginning, BE IT FURTHER RESOLVED that the polls of said election shall be opened at 7 .00 o' clock A.M. of the day of said election and shall remain open continuously from said time until 7000 o' clock P.M. of the same day, when said polls shall be closed. BE IT FURTHER RESOLVED that at said special election the question whether said new territory shall be annexed to, incorporated in, and made a part of the City of Palm Springs shall be submitted to the electors re- siding in said new territory so proposed to be annexed to said City of Palm Springs , That said new territory hereinbefore and in said petition for annexation described is hereby designated as "Tramview Annexation, " and said territory shall be indicated and referred to by the name of "Tramview Annexation," upon the ballots to be used at said special I election at which the question of such annexation of said territory to the City of Palm Springs is submitted to the electors of said territory, and the name "Tram- view Annexation"whenever used in the notice of said special election hereby called in said territory, and any and all proceedings for the annexation of said territory to the City of Palm Springs shall mean and shall be construed to mean the territory hereinbefore and in said petition described, and so proposed by said petition to be annexed to said City of Palm Springs , That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following. MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL, ABSENTEE BALLOTS MAY BE MARKED WITH PEN ,AND INK OR PENCIL INSTRUCTIONS TO VOTERS To vote on any measure , stamp a cross (+) in the voting square after the word "YES" or after the word "NO" . All marks, except the cross (+) are forbidden, All distin- guishing marks or erasures are forbidden and make the ballot void, If you wrongly stamp, tear or deface this ballot, re- turn it to the inspector of election and obtain another, On absent voter' s ballots mark a cross (-h) with pen or pencil. 3- Res. 8715 Page 4 MEASURE SUBMITTED TO VOTE OF VOTERS Shall the "Tramview Annexation" YES be annexed to the City of IPalmSprings , California? NO A cross (+) placed in the voting square after the word "'YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition or measure . A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore pro- vided shall be counted against the adoption of the proposition. The qualified electors residing in said new territory so proposed to be annexed to said City of Palm'Springs are hereby directed to vote upon the question of the annexa- tion of said territory to the City of Palm Springs , by stamping a cross (+) in the voting square after the word YES" on the ballots to be used in said election, or by stamping a cross (+) in the voting square after the word NO" on such ballots . If an elector shall stamp,,a cross in the voting square after the printed word "YES" , the vote of such elector shall be counted in favor of said territory being ,annex:ed to, incorporated in, and made a part of the City of Palm Springs ; and if an elector Ishallstampacross (+) in the voting square after the printed word 1°NO" , the vote of such elector shall be counted against such annexation. BE IT FURTHER RESOLVED that for the purpose of holding said election there shall be, and here js established, one election precinct designated as hereinafter stated. The polling place for said precinct shall be the placehereinafterdesignatedandthepersonshereinafternamed, being competent and qualified electors and residents ofsaidterritoryandofsaidelectionprecinct, are herebyappointedofficersofelectionandtheyshallholdsaid election and make return thereof in the manner provided by law. TRAMVIEW ANNEXATION" voting precinct shall consist of portion of County Precinct. 42-002 which includes all ofsaidabovedescribedterritoryproposedtobeannexed to the City of Palm Springs for the purpose: of holding said election . Miss Paula Gonzalez 63-855 Avenida Cerca Except as otherwise provided in this resolution, said 4- 8 311 Res. 8715 Page 5 election hereby called shall be conducted as provided by law for municipal elections in the City of Palm Springs and the Annexation Act of 1913 (Statutes of 1913 , Chapter 312 , Title IV, Division ,2 , Part 2 , Chapter 1, Articles 1 to 4 inclusive, of the Government Code of the State of I California) and all acts amendatory thereof and supplementary thereto, BE IT FURTHER RESOLVED that the City, Clerk of the City of Palm Springs be, and he is hereby, , authorized and directed to give notice of said special election by causing a notice thereof to be published once ,a week for four (4) successive weeks prior to the 20th day of September, 1966, in THE RIVERSIDE ENTERPRISE, a newspaper of general cir- culation printed and published outside the City of Palm Springs . but in the County of Riverside in which the terri- tory so proposed to be annexed to the City of Palm Springs is situated. Such notice shall distinctly state the date of such special election, the measure or proposition to be submitted at such special election, to wit. That it is proposed to annex to, incorporate in., and make a part of said City of Palm Springs the aforesaid territory sought to be annexed and shall specifically describe the boundaries thereof, Such notice shall distinctly desig- nate said territory proposed to be annexed to said City of Palm Springs as "Tramview Annexation' as the name by which such territory shall be indicated upon the election. ballots ; , and that such notice shall instruct the electors how to vote at said special elections . Such notice shall designate the election precinct, the place at which the polls will be open, and the hours at which such polls ,will be open , for such election in said new territory as established by this resolution, In such notice, the qualified electors residing in said new terri- tory, so proposed to be annexed shall, be directed to vote upon the question of annexation as hereinabove provided. BE IT' FURTHER RESOLVED that immediately upon the closing of the polls , the election officers for said election pre- cinct hereinabove designated shall count the ballots , , make up, certify and seal the ballots and tally sheets of the ballots case, and deliver them, wi.th the returns to the City Clerk of the City of Palm Springs , At its next regular meeting, the• City Council shall canvass the re- turns . The canvass shall be completed at the meeting, if practicable, or as soon as possible, avoiding adjournments .
