HomeMy WebLinkAbout8708o')(Q RESOLUTION NO. 8708 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNZA, .DETERMINING SUFFICIENCY OF PETITION ASSESSMENT' DISTRICT NO, 91) IN THE MATTER OF INSTALLATION OF. SEWERS, CURBS, GUTTERS & PAVING IN PORTIONS OF AMADO ROAD AND SATURMINO DRIVE. WHEREAS, the City Council of the City of Palm Springs did, on the 11th day of .June 1966, receive a petition from property owners for the construction of Portland cement concrete curbs and gutters, driveway approaches and asphalt concrete pavement and the installation of sewer laterals to the existing sewer main ,in a ^pvvtion of Amado Road between Saturmino Drive and 100 feet east of Cerritos Drive and the portions of streets adjacent to the property fronting on Amado Road and the in- stallation of a sanitary sewer main with house laterals to the property line and the construction of Portland cement concrete curbs and gutters, driveway approaches and asphalt concrete pavement on Saturmino Drive between Amado Road and Andreas Road and the portions of streets adjacent to the property fronting on Saturmino Drive, together with a plat or map showing the exterior boundaries of the proposed assessment district for said improvement; and WHEREAS, the City Engineer has reported to this City, Council that he has checked and examined the petiti0tis,wifh report of owners, as shown by the last equalized assessment roll of the County of Riverside, I California, and finds that the same represents 63.461 and 72.45% of the owners in area of the property subject to assessment for the proposed improvement, as shown and delineated upon said plat or map attached to said petition; and WHEREAS, the said City Council has duly considered the said petition and report of the City Engineer with reference to the proposed improvement referred to in said petition, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows : SECTION 'l. That the improvements referred to in said petition are to be done under the provisions of the "IlmproVementL Act of 1911", Division 7, of the Streets and Highways Code of the State of California, SECTION 2. That this City Council does hereby find and determine that the qualified signatures to the said petition, as shown by the last equalized assessment roll of the County of Riverside, California, represents more than sixty percent (60%) of the total assessable area of the proposed district, as shown and delineated upon the plat or map attached to said petition. 6-B 8708 page 2 Suff. of Petition Page 2 SECTION 3. That this City Council does hereby further 'Lind and determine that the said petition- for said improvement represents all the requirements prescribed by Section 2804 of the "Special Assessment Investi.- gation, Limitation and Majority Protest Act of 1931," being Division 4 of the Streets and Highways Code of the State of California, and the City Counciland make each and everyintendstomeeteachandeverycondition finding necessary on its part in order to permit the proceedings for said improvement to go forward to completion, without further reference to or application of the provisions of said Division 4 of said Streets and Highways Code.
