HomeMy WebLinkAbout8684RESOLUTION NO. 8684 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING SUFFICIENCY OF PETITION ASSESSMENT DISTRICT NO. 85) IN THE MATTER OF I INSTALLATION OF WATER SYSTEM 'IN GOLF CLUB DRIVE, BETWEEN EAST PALM CANYON DRIVE AND AVENUE 34 WHEREAS, the City Council of the City of Palm Springs did, on the 13th _ day of June 1 1966, receive a petition from property owners for the installation of a water distribu-, tion main consisting of 1,2" concrete lined steel with 8" and 6" stubs to property line, valves and appurtenances (exclusive of Fire Hydrants) as shown on the attached plan, in Golf Club Drive from Highway 111 to Avenue 34, together with a plat or map showing the exterior boundaries of the proposed assessment district for said improvement; and WHEREAS, the City Engineer has reported to this City Council that he has checked and examined the petition with report of owners for addition of water system for Assessment District No. 85, as shown by the last equalized assessment roll of the County of Riverside, California, and finds that the same represents 63.678% of the owners in area of the property subject to assessment for the proposed improvement, as shown and delineated upon said plat or map for Assessment District No. 85; and WHEREAS, the said City Council has duly considered the said petition I and report of the City Engineer with reference to the proposed improvement referred to in said petition, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows SECTION 1. That the improvements referred to in said petition are to be done under the provisions of the "Improvement Act of 1911," Division '7, of the Streets and Highways Code of the State of California, SECTION 2, That this City Council does hereby find and deter- mine that the qualified signatures to the said petition, as shown by the last equalized assessment roll of the County of Riverside, California, represents more than sixty percent (60%) of the total assessable area of the proposed district, as shown and delineated upon the plat or map attached to said petition. That this City Council does hereby further find Ianddeterminethatthesaidpetitionforsaidimprovementrepresents all the requirements prescribed by Section 2804 of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931," being Division 4 of the Streets and Highways Code of the State of California, and the City Council intends to meet each and every condition and make each and every finding necessary on its part in order to permit the proceedings for said improvement to go forward to completion, without further reference to or application of the provisions of said Division 4 of said Streets and Highways Code, Adopted this 13th day of —June 19660 AYES: Councilmen Dragicevich, Foster, Selig, Wiefles and Mayor McCoubrey NOES: None ABSENT: None ATTEST.
