OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS ,
CALIFORNIA, AUTHORIZING THE PURCHASE OF TILE WESTVIEW
DEVELOPMENT CORPORATION PROPERTY, AUTHORIZING THE
CITY MANAGER TO ENTER INTO THE NECESSARY ESCROW
AGREEMENT FOR THE CITY AND AUTHORIZING PARTIAL PAY-
MENT BY THE RELEASE OF A PRIOR OBLIGATION TO PAVE
AND UNDERGROUND CERTAIN UTILITIES.
WHEREAS the City of Palm Springs, desiring to acquire a particular
parcel of realty totaling 4.5 acres for further development of its
Municipal Golf Course and Clubhouse complex from Westview Development
Corporation, has had the property independently appraised at approx-
imately $15 ,000 per acre or a total of $68,000.00 by Robert J. Hill,
MAI, 263 North Indian Avenue, Palm Springs; and
WHEREAS pursuant to Resolution No. 7495 resolved on July 8, 1963,
the City and Morton B. Ulman, President of Westview Development
Corporation entered into a contract whereby Westview Development
Corporation agreed to place certain wires underground and to complete
certain paving as more specifically provided in said Resolution; and
WHEREAS, the City and Westview Development Corporation now mutually
desire to modify said agreement and incorporate it into the terms of
the subject sale;
NOW THEREFORE BE IT RESOLVED as follows :
1. The City Manager is hereby authorized and directed to purchase
the following described 4.5 acres of realty for the City of Palm Springs
for a total purchase price of $68,000.00, to be paid for out of the
Golf Course Bond Monies :
That portion of Lots 4 and 5 in Section 29, Township 4 South
Range 5 East, San Bernardino Base and Meridian, as shown on
map of Palm Valley Colony Lands, on file in Book 14, Page 652
of Maps, Records of San Diego County, California, described
as follows :
Beginning at the Southwesterly corner of Parcel 9 of that
certain real property described in deed recorded 4 May, 1961
as Instrument No. 37966 in Book 2899, Page 569 of Official
Records of Riverside County, California; thence along the
westerly and northerly boundary of said Parcel 9, North
03025 '35" West , 422.57 feet and North 60°32 '25" East, 38.00
feet to a point on the westerly line of Golf Club Drive (60
feet wide) , said westerly line being a curve concave easterly
and having a radius of 255.00 feet (a radial to said point
bears South 60°32'25" West) ; thence along said westerly line
northerly along said curve through a central angle of 29°30100"
a distance of 131.29 feet; thence tangent to said curve North
00°02 '25" East, 47.78 feet to the northerly line of said Sec-
tion 29; thence along said northerly line , North 89057 '35"
West, 405.06 feet to the northeasterly corner of Parcel 10
of said deed recorded in Book 2899, Page 569 of Official
Records; thence along the easterly line of said Parcel 10,
South 01041 '00" West , 341.24 feet to a point on the north-
easterly boundary of that certain right of way granted to the
Coachella Valley County Water District by deed recorded 5 June
1958 in Book 2281, Page 234 of Official Records of Riverside
County, California, said boundary being a curve concave
southwesterly and having a radius of 5,000.00 feet (a radial
to said point bears North 29°22 ' 14" East) ; thence along said
northeasterly boundary, southeasterly along said curve
through a central angle of 03°26' 16" a distance of 300.00
feet; thence tangent to' said curve South 57°1.1' 30" East, 218. 11

Containing 4.558 acres .
2. The City Manager is further authorized and directed to enter
into an escrow agreement for the City with Westview Development Corp-
oration forthwith. Said agreement shall include , along with all
other necessary and proper terms „the following provisions for payment
of the purchase price:
a) The City shall pay $50,000. 00 into escrow as agreed
upon.
b) The remaining $18,000.00 of the purchase price shall
be met by delivery to the escrow officer of a nego-
tiated release executed by the City Manager for the
City of Palm Springs . Said release shall totally
relieve the Westview Development Corporation of any
and all legal obligations set forth in said
Resolution No. 74915.
