HomeMy WebLinkAbout8619RESOLUTION NO. 8619 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, OVERRULING PROTESTS IN CONNECTION WITH ASSESSMENT DISTRICT NO. 76 AND CONFIRMING THE SPREAD OF ASSESSMENT. WHEREAS heretofore an Assessment Diagram has been filed with the City Clerk spreading an assessment upon the land comprising of improvements in Desert Way between Sunny Dunes Road and 495 feet south of Sunny Dunes Road; and WHEREAS the City Clerk duly posted and published notice of said filing of the Assessment Diagram and set the time and place for a hearing upon said Assessment Diagram; and WHEREAS four (4) appeals have been filed with the City Clerk pursuant to the provisions of Section 5366 of the Streets & Highways Code; and WHEREAS, in each of said appeals , the City Council finds that the work has been completed by the contractor in a substantial manner, the work has been extended to the limit of engineering feasibility so the respective cost of each said assessment is fair and reasonable and commensurate with the work done, NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs does hereby deny each of said appeals and does confirm the proceedings, Assessment, and Diagram in connection with the improvement of Desert Way between Sunny Dunes Road and 405 feet south of Sunny Dunes Road, Resolution of Intention No. 8472, and does further direct- that Warrant, Diagram and Assessment, be recorded in the office of the Superintendent of Streets, and that notice of assessment be recorded in the office of the County Recorder.
