HomeMy WebLinkAbout8609RESOLUTION NO. 8609 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING SUFFICIENCY OF PETITION ASSESSMENT DISTRICT NO. 85 ) IN THE MATTER OF INSTALLATION OF CURBS, GUTTERS, PAVING AND IRRIGATION SYSTEM IN CENTER ISLANDS AT GOLF CLUB DRIVE, BETWEEN EAST PALM CANYON DRIVE AND APPROX- IMATELY 450 FEET NORTH OF AVENUE 34. WHEREAS, the City Council of the City of Palm Springs did, on the 14th day of February 1966 , receive a petition from property owners for the installation of Portland Cement concrete curbs and gutters, asphalt concrete pavement, and an irrigation system for planting in the curbed center islands from Highway 111 to Avenue 34 and asphalt concrete paving to approximately 450 feet north of Avenue 34 to a connection with Crosley Road, together with a plat or map 'showing the exterior boundaries of the proposed assessment district for said improvement ; and WHEREAS, the City Engineer has reported to this City Council that he has checked and examined the petition with report of owners, as shown by the last equalized assessment roll of the County of River- side, California, and finds that the same represents60.272 percent of the owners in area of the property subject to assessment for the proposed improvement, as shown and delineated upon said plat or map attached to said petition; and WHEREAS, the said City Council has duly considered the said petition and report of the City Engineer with reference to the proposed improvement referred to in said petition, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows : SECTION 1. That the improvements referred to in said petition are to be done under the provisions of the "Improvement Act of 1911," Division 7, of the Streets and Highways Code of the State of Calif- ornia. SECTION 2. That this City Council does hereby find and deter- mine that the qualified signatures to the said petition, as shown by the last equalized assessment roll of the County of Riverside, California, represents more than sixty percent (60%) of the total assessable area of the proposed district , as shown and delineated Iupon the plat or map attached to said petition. 4A2 Suff. of Petition Page 2 SECTION 3. That this City Council does hereby further find and determine that the said petition for said improvement represents all the requirements prescribed by Section 2804 of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931," being Division 4 of the Streets and Highways Code of the State of California, and the City Council intends to meet each and every condition and make each and every finding necessary on its part in order to permit the proceedings for said improvement to go forward to completion, without further reference to or application of the provisions of said Division 4 of said Streets and Higheaays Code . 0- CITY OF PALM SPRINGS, CALIFORNIA Bys City Manager ATTEST: F.
