OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, OVERRULING PROTESTS IN CONNECTION WITH
ASSESSMENT DISTRICT NO. 77, FOR CONSTRUCTION OF
CERTAIN IMPROVEMENTS IN STEVENS ROAD, WAWONA ROAD,
VIA MONTE VISTA, PORTIONS OF KAWEAH ROAD, VIA NORTE
VINE AVENUE.
WHEREAS, two written protests have been filed with the City Clerk
in accordance with the law in objection to the work and improvement
described in Resolution of Intention No. 8566 and against Assessment
District No. 77, the improvement described in said Resolution of
Intention; and
WHEREAS, the Superintendent of Streets has reported that the said
protests represent 3 percent of the Land area within the
assessment district , as set forth in the records now on file with
the City Clerk; and
WHEREAS, it is the desiere of the remaining property owners of the
district that the City Council shall proceed in the matter to ac-
complish the improvement , all as set forth in said Resolution of
Intention;
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of
Palm Springs does hereby find and determine that the written protests
heretofore filed with the City Clerk represent 3 percent of
the land area within said assessment district , and being less than
50 percent thereof , does hereby overrule all protests and directs
that the work or improvement proceed according to law;
BE IT FURTHER RESOLVED that the continuance of this work and improve-
ment as set forth in said Resolution of Intention is in the best
interest of the owners within said assessment district and the City
of Palm Springs as a whole.
