OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, DECLARING THE VACATION OF ALL RIGHT, .
TITLE AND INTEREST OF SAID CITY IN A PORTION OF
A 40-FOOT EASEMENT ALONG THE EAST SECTION LINE
OF SECTION 22 BETWEEN SOUTH PALM CANYON DRIVE
AND SUNNY DUNES ROAD- - -
WHEREAS the City Council of the City of Palm Springs , Cali-
fornia, is authorized by the Street Vacation Act of 1941,
Part 3, Division 9, of the Streets and Highways Code, to
vacate and close up to the public use, streets or parts of
streets , within the limits of the City; and
WHEREAS heretofore the City Council did adopt a resolution
declaring its intention to vacate a portion of the herein-
after referred to easement, and the City Council did post
notice as required by the statute, and did hold its public
hearing, as required by the statute; and
WHEREAS at said public hearing a showing was made that the
hereinafter described easement is no longer necessary for
public use ; and
WHEREAS the Department of Public Works has submitted a
recommendation against maintaining said easement as a
public right of way because of the danger involved at the
intersection of the Northerly portion of the property with
South Palm Canyon Drive,
NOW THEREFORE BE IT RESOLVED that the City Council of the
City of Palm Springs , California, does hereby vacate all
the City' s right, title and interest in a portion of a 40-
foot easement along the east section line of Section 22
between South Palm Canyon Drive and Sunny Dunes Road, an
easement within said City, County of Riverside, State of
California, described as follows.
The Easterly 40 .00 feet of a portion of the North-
east Quarter of the Northeast Quarter of Section
Twenty-Two (22) , Township Four (4) South, Range
Four (4) East, San Bernardino Base and Meridian,
extending from a line which is Northerly of,
parallel with, and 44.00 feet perpendicular distance
from the centerline of the Westerly extension of
Sunny Dunes Road to an arc line concave Northeasterly,
which is Southwesterly of, parallel with, and 50.00
feet radial distance from the centerline of South
Palm Canyon Drive,
Said easement is depicted on a map on file in the office of
the City Clerk of the City of Palm Springs , California, which
said office is hereby referred to for particulars on the pro-
posed easement vacation.
