HomeMy WebLinkAbout8566RESOLUTION OF INTENTION N0. 8566 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS., CALIFORNIA, DECLARING ITS INTENTION TO ORDER CONSTRUCTION OF CERTAIN IMPROVEMENTS IN STEVENS RD, BETWEEN PALM CANYON & VIA MONTE VISTA: WAWONA RD & VIA MONTE VISTA, BETWEEN STEVENS & VISTA CHINO IN SAID CITY; DECLARINr, THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK ASSESSMENT DISTRICT NO. 77) 1 1 * * _" S * The City Council of the City of Palm Springs , pursuant to the provisions of the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California, does resolve as follows : SECTION ONEo That the public interest and convenience require, and it is the intention of the City Council of the City of Palm Springs, California, to order the following work to be done, to-wit : DESCRIPTION OF 'WORK Installation of sanitary sewers with house laterals to the property line in Stevens Road, between Wawona Road and Via Monte Vista; construction of concrete curbs, gutters, driveway aprons, and asphalt paving on Stevens Road, portions of Kaweah Road, Via Norte, Vine Avenue, adjacent to the property fronting on Stevens Road, between Via Monte Vista and North Palm Canyon Drive, and a portion of Via Monte Vista and Wawona Road, between Stevens Road and Vista Chino. City will participate in sum not to exceed 6,550.00, for additional paving on Stevens Road and Via Monte Vista. PLANS, PROFILES , DRAWINGS AND SPECIFICATIONS SECTION TWO: That all of the said work and improvement to be done shall be constructed upon the grades , along the lines, between the points, of the dimensions , at the places and in the manner shown on the plans, profiles and drawings for construction of said improvements in portions of Stevens Road, Wawona Road, and Via Monte Vista, and portions of Kaweah Road, Via Norte and Vine Avenue known as Assessment District No. 77 ) , being Drawing Nose 1073-1 to 1073-7 on file in the office of the City Engineer of said City, and except as otherwise provided on said plans, in further accordance with the specifica- tions being on file in the office of the City Clerk of said City and to which plans, profiles, drawings and specifications hereby approved by the City Council of said City, reference is hereby made for a further, full and more particular description of said work and by reference thereto the same are incorporated herein and made a part hereof DESCRIP'I t0N OF ASSESSMENT DISTRICT SECTION THREE: That ,the said contemplated work and improvement , in the opinion of said City Council, is of more than local or ordinary public benefit and the said City Council hereby makes the expenses of said 'work and improvement chargeable upon a district , which said district said City Council hereby declares to be the district benefited by said work and im- provement and to be assessed to pay the costs and expenses thereof, and which district is described as follows : Res. Inc. 8566 Pg. 2 All Char certain territory of the City of Palm Springs , California, exclusive of streets and alleys, included within the exterior boundary 7 line shown upon chat certain map or plat for Assessment District No. hereby and herein approved by the City Council of said City on this loth day of January 119 66 , indicating by said boundary line the exLeat of the territory included within the proposed assessment district and which map or plat is on file in the office of the City Cleric of said City. Reference is hereby made to said map or plat for a further, full and more particular description of said assessment district , and said map or plat so on file shall govern for all details as to the extent of said assessment district, DESCRIPTION OF BONDS SECTION FOUR: That serial bonds, 'bearing interest at the rate of six percent (6%) per annum, shall be issued to represent each assessment of fifty dollars (S50) or more remaining unpaid for thirty (30) days after the date of recording the warrant . Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September 1st following their date. Payments on the principal of unpaid assess- ments and interest thereon shall be made by property owners to the City Treasurer, and the same shall be disbursed by said City Treasurer all as provided in the "Improvement Act of 1911," hereinafter referred to. TIME AND PLACE OF HEARING SECTION FIVE : NOTICE -IS HEREBY GIVEN that on the 14t1I day of February 19_ 66 , at the hour of 7:30 o'clock p.m. , in the chambers of the City Council in the City Hall of said City, any and all parsons having any objections to the proposed work or improvement or to the extent of the assessment district, or to 'the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with this Resolution of Intention. Protests must be in writing and muse be delivered to the City Clerk prior to the time sec for the hearing. IMPROVEMENT ACT SECTION SI`K{ That all of the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California, designated the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California, and further that the City Clerk is the nominated officer to open all bids. PUBLICATION OF RESOLUTION OF INTENTION SECTION SEVEN: That the "Desert .Sun", a daily newspaper printed, published and of general circulation in the City of Palm Springs , California, is hereby designated as the newspaper in which the Resolution of intention shall be published by the City Clerk, in the manner and and for making all other publications in the pro-form provided by law ceedings under this Resolution of Intention. The City Clerk is directed to mail notices of the adoption of this Resolution of Intention to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized s:,essment roll for city- taxes, all in the manner and form provided for under Section 5070, 5194 and 5195 iDf the said "Improvement Act of 1911 ," of said Screets and Highways Code. Int. 8566 Pg. 3 POSTING OF NOTICE OF IMPROVEMENT SECTION EIGHT: That the Superintendent of Streets of the City of Palm Springs shall cause to be conspicuously posted along the line of said contemplated work or improvement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention, in the time, form and manner provided by said Code. 0- I, Judith Sumich, Deputy City Clerk of the City of Palm Springs , California, do hereby certify that the foregoing Resolution No. 8566 was duly adopted by the City Council of said City at a meeting thereof held on the 10th day of January, 1966.
