Re: Palm Partners / OLT preserve and development project I write to you as a taxpayer and property owner in Palm Springs. I am opposed to the apparent favorable treatment by the City of Palm Springs of the preserve and associated development proposals. There is a definitive non-arm’s length relationship between the two. This is just one of several legal issues related to the application by OLT to proceed with their landscaping modification. There is a portion of the Mesquite Golf Course property that is not subdivided from the proposed preserve. That property could be subdivided from the proposed preserve property by OLT but they choose not to. Further, that property is the subject of a development application that relies on the preserve property to attempt to satisfy your GCCO ordinance requirements with respect to permissible development. That application is being advanced without objection from OLT and so, it follows, the OLT property is not separate and distinct, from the development property. It cannot be considered part and parcel of a development proposal for one purpose, and then separate and distinct for any other purpose at their sole discretion and for their unilateral benefit. This landscaping application by OLT cannot rightfully be considered in isolation. The right for OLT to advance its project in any fashion, is one of several subjects of the well known lawsuit by MCC HOA. I, and many others are being financially and otherwise prejudiced by this preferential treatment by the city. It is your fiduciary duty to ensure any applicant, any citizen, or entity is in full compliance with your bylaws and ordinances. This application should be deferred until, at the very least, an arm’s length relationship is established between OLT and Palm Partners.
