Dear Sirs/Madames of the Palm Springs Planning Commission:
It is my understanding that the Planning Commission have been asked to render a decision
today on the request by Oswit Land Trust (“Oswit”) for a “minor amendment” to PDD 153 to
convert the former Mesquite Golf Course to a nature preserve. I fail to see how this change of
use which directly affects all homeowners (“Mesquite owners”) who bought into the Mesquite
Country Club condominiums can be deemed a “minor amendment”. I strongly object to this
change as it has been requested without prior approval of the Mesquite owners and in breach
of a long-standing lease of the subject property that is currently in dispute.
If the Planning Commission approves of Oswit’s requested amendment without prior approval
of the Mesquite Country Club HOA members, it will essentially be complicit in the breach of
the aforesaid lease and even potentially “inducing breach of contract”. Unless and until the
outstanding dispute between Oswit and the Mesquite HOA has been fully resolved, it is highly
improper and ill-advised for such approval to be granted.
