BY: Department of Special Program Compliance SUMMARY Pablo Flores with Helios Vacation Rentals has requested an appeal of administrative citation A7900 issued in the amount of $500 and two (2) year suspension of the Vacation Rental Registration Certificate #4990 for the property located at 400 W. Camino Alturas, Palm Springs, California. RECOMMENDATION: 1)Open the Appeal Hearing and accept public testimony. 2)Adopt Resolution No. ______, A RESOLUTION OF THE ADMINISTRATIVE APPEALS BOARD OF THE CITY OF PALM SPRINGS, CALIFORNIA, ON THE APPEAL OF PABLO FLORES FOR THE PROPERTY LOCATED AT 400 W. CAMINO ALTURAS, PALM SPRINGS, CALIFORNIA REGARDING ADMINISTRATIVE CITATION A7900 ISSUED IN THE AMOUNT OF $500 AND THE TWO-YEAR SUSPENSION OF VACATION RENTAL REGISTRATION CERTIFCATE #4990. Background The property located at 400 W. Camino Alturas, Palm Springs, California is currently registered as a Vacation Rental with Vacation Rental Registration Certificate #4990. The start date was May 5, 2022. Vacation Rental Ordinance 1918 was in effect April 2017 and later amended and reinstated in November 2022 with Ordinance 2075. The previous and current Vacation Rental Ordinance details rules that guests renting a Vacation Rental for a period of 28 consecutive days or less must follow; Regulations that owners must follow relating to each stay that is 28 consecutive days or less and that upon the third violation in any twelve-month period, the City Manager shall suspend the Vacation Registration Certificate for two (2) years. Camino Alturas, Palm Springs, CA STAFF ANALYSIS First Citation – A6704 On March 31, 2023, the City of Palm Springs Code Compliance discovered a web-based advertisement for the property located at 400 W. Camino Alturas, on the rental booking platform airbnb.com via the following link: www.airbnb.com/rooms/670478363746977770. Upon review of the advertisement, it was found that a copy of the current registration certificate, via posting the property's City ID number in a conspicuous location, was not included as required. Code Compliance Officer Gonzalez issued citation A6704. The officer report is included as ATTACHMENT 4. Citation A6704 was not appealed and paid in full on May 11, 2023. Second Citation – A7659 On June 12, 2023, the City of Palm Springs Code Compliance discovered a web-based advertisement for the property located at 400 W. Camino Alturas, on the rental booking platform airbnb.com via the following link: www.airbnb.com/rooms/670478363746977770. Upon review of the advertisement, it was found that a copy of the current registration certificate, via posting the property's City ID number in a conspicuous location, was not included as required. Code Compliance Officer Gonzalez issued citation A7659. The officer report is included as ATTACHMENT 5. Citation A7659 was not appealed and paid in full on June 27, 2023. Third Citation – A7900 On March 17, 2024, a City of Palm Springs Code Compliance Officers responded to a complaint for the property located at 400 W. Camino Alturas, Palm Springs regarding music at or beyond the property line. Code Officer Gonzalez and Code Officer Whittaker arrived at the property at 5:57 pm and observed a violation of Palm Springs Municipal Code “PSMC” 5.25.070(g) Music audible at the property line at the Vacation Rental located at 400 W. Camino Alturas. Code Officer Gonzalez and Code Officer Whittaker contacted the local contact to assist with making contact with the guests as there was no direct access to make contact. Once the local contact arrived, the Code Compliance Officers contacted the occupants, discussed the findings and violation, and issued citation A7900 for a violation of PSMC 5.25.070 (g). The officer report is included as ATTACHMENT 6. Citation A7900 is currently on hold pending the outcome of the appeal. Pursuant to PSMC 5.25.090(b), “Upon the third violation in any twelve-month period, the City Manager shall suspend the Vacation Registration Certificate for two (2) years”. Pursuant to Administrative Regulation dated 8/2017, appeals of the third administrative citation and the suspension of the Vacation Rental Registration Certificate will be heard by the Administrative Appeals Board according to PSMC Chapter 2.50. The Palm Springs Municipal Code, Vacation Rentals §5.25.070 - Operational Requirements and Standard Conditions: (g) “Notwithstanding the provisions of Section 11.74.043, any radio receiver, musical instrument, phonograph, loudspeaker, sound amplifier, or any machine or device for the producing or reproducing of any sound shall be conducted within a fully enclosed Vacation Rental unit and shall not be audible at the property line of the Vacation Rental.” The Palm Springs Municipal Code, Vacation Rentals §5.25.040 - Operational Requirements and Standard Conditions: (f) “A copy of the current Registration Certificate as issued by the City and the maximum number of guests allowed on the premises shall be displayed in a clear and legible manner in a conspicuous and easily accessible location in the unit and on all advertising related to each Vacation Rental or Homesharing Interest, including without limitation, web based advertising, hosting platform, print media, and television. Palm Springs Municipal Code §5.25.090 (b) – Violations (b) “Upon the third violation in any twelve month period, the City Manager shall suspend the Vacation Registration Certificate for two (2) years”. ADMINISTRATIVE REGULATION “Violation Count for Purposes of Suspending a Vacation Rental Certificate”- Effective 8/2017 Procedure: A. Section 5.25.090(b) specifies, “Upon the third violation in any twelve (12) month period, the City Manager shall suspend the Vacation Rental Certificate for two (2) years.” Following is a clarification how violations are counted. There will be no suspension unless at least one (1) violation occurs under new Ordinance No. 1918. 3. Item 4 - Page 14 Subject: Appeal for Suspension of Helios Vacation Rentals' Management of 400 W Camino Alturas To Whom It May Concern, I am writing to appeal the suspension of Helios Vacation Rentals' management of 400 W Camino Alturas. As the owner of the management company overseeing this property, I feel compelled to address the citations issued against us, which I believe resulted from genuine misunderstandings rather than deliberate non-compliance. On 3/31/23, our property received a citation for the violation "Failure to post City ID." Our general manager spoke to the city and misunderstood the corrective action as needing to post a visible sign in front of the home with the City ID. Subsequently, on 06/12/23, we were surprised to receive another citation for the same infraction. It was after this second citation that we further clarified with the city authorities the specific nature of the violation, which pertained to the absence of the City ID on the online marketing listing. We promptly rectified this oversight by adding the required information to the listing description online. It is crucial to note that our actions were not indicative of intentional negligence or an attempt to circumvent regulatory requirements. Rather, they stemmed from a misinterpretation of the corrective measures needed. I understand that local authorities require the permit number to be visible online in order to verify homes are not being marketed without a valid rental certificate. Throughout this period, our City ID remained active, and we were committed to upholding all necessary regulations. Moreover, platforms such as Airbnb and VRBO enforce stringent measures to ensure compliance with local regulations. These platforms mandate the input of permit numbers before allowing listings to go live, thereby providing an additional layer of verification. The booking platforms in tum automatically make visible the permit number at the bottom of the listing in a specific section called "Registration Number". Therefore, it is perplexing that the City ID was not visibly displayed on our Airbnb listing despite our adherence to platform policies. Following the issuance of the second citation, I diligently pursued clarification from Airbnb regarding the absence of the permit number on our listing. Regrettably, due to the elapsed time since the initial citation, Airbnb was unable to provide a definitive response. Nonetheless, we have since implemented additional'safeguards, including the inclusion of the permit number in the listing description itself, to mitigate any recurrence of such issues. In summary, ~ appeal the suspension on the grounds that the initial citation was unwarranted given the stringent requirements imposed by platforms like Airbnb and VRBO. Furthermore, the subsequent citation resulted from a miscommunication regarding the nature of the violation. It is pertinent to acknowledge our consistent compliance with city regulations, exemplified by our active permit status, timely payment of transient occupancy taxes, and stringent noise control measures. Decibel readings were taken and read from 40db to 48-db.
